Qualified Immunity needs legislative reform
The doctrine of Qualified Immunity is unfit for purpose. We ask the US Supreme Court to reconsider its scope and particularly its application to cases of excessive force and police brutality.

The Supreme Court established qualified immunity in 1967, creating it as an exception for public officials who had acted in “good faith” and believed that their conduct was authorized by law. Fifteen years later, in Harlow v. Fitzgerald, the Court expanded the defense. The protection afforded to public officials would no longer turn on whether the official acted in “good faith.” Instead, even officials who violate peoples’ rights maliciously will be immune unless the victim can show that his or her right was “clearly established.”
Qualified immunity means that victims of brutality or harassment by law enforcement generally get no relief in court and have no ability to hold offending officers accountable for their actions. That means the officers who commit the brutality and harassment—and the governments that employ them—have little incentive to improve their practices and follow the law.

Because of the Philippines’ poor governance in the midst of this pandemic, the number of people criticizing the Duterte administration has reached an exponential high. Because of this, they are fast-tracking a bill that allows our government to silence critics and activists, violating our human rights and strengthening state fascism.
As such, we would like to CALL FOR YOUR HELP.
Filipinos are holding an #EmailProtest at 8PM (GMT +8) every day, as a call to #JunkTerrorBill. Petitions mean nothing to the PH Government, so directly emailing them would be more effective.

SUBJECT: Junk Terror Bill, or Anti-Terror Bill, or Senate Bill No. 1083 (Please use variations for the subject lines to avoid getting emails marked as spam i.e. JUNK T3RR0R B1LL etc.)
BODY TEMPLATE: We urge the rejection of the ‘Anti-Terror Bill’ to protect the fundamental right of Filipinos to freedom of speech.

White people: if you want to help long term: get used to being told your opinion is wrong, irrelevant, or unwanted. Tell your friends to get used to it. Work on getting used to it and do this work with other white people. Because white supremacy has all of y’all very used  to being right and being an inherently valued voice and if we’re going to fight white supremacy you’re going to have to be comfortable surrendering that expectation and also white people will need to learn how to handle being rejected or disagreed with. It’s an extension of racism and racial trauma for black people to try and educate or speak up about our issues only to expose ourselves to your white fragility which  makes you defensive– this defensiveness can look like shutting down, silencing us, painting all corrections or disagreements as ‘fighs’ (extending the idea that black people are aggressive) etc.
White resilience is the opposite of white fragility and black people are VERY good at resilience, unfortunately. Listen to us we know how to combat this.
