Once again, as i said, i do not support him nor do i defend him, but let's stay objective and consider each and every possibility, even the worst ones.

As for his sentence, he has pleaded guilty and that is a non-negligeable factor in the case. He is guilty in the eyes of the law, and until it is not proven othetwise, he remains gulity. But we have the right to dismantle the case to see how all this happened and what has happened actually.

Seungri, the Burning Sun scandal and why some people should do a fact-check before speaking.

Disclaimer: i do not support Seungri and i won't defend him, i'm staying impartial on his case as i won't touch the JJY molka and SA case here, only what concerns Seungri, the charges against him, the evidence against him and what is true and what is not. Thank you for reading the disclaimer before coming to behead me. (All my sources will be cited at the end.)

What are the charges against him?

Prostitution (for self)

Prostitution Mediation (for others between Dec 2015 - Jan 2016)

Embezzlement (Hiring legal representative fee)

Embezzlement (528M ₩, involving Burning Sun revenues)

Violation of food sanitary act (Seungri's Monkey Museum Club registered as restaurant instead of Club)

Habitual Gambling (One Time Last Vegas Gambling)

Distribution of Obscene Material (a promotion photo of Singaporean Adult Entertainment Etablishment, not taken by Defendant, Seungri)

Violation of Foreign Exchange Transaction Act (Loan in dollars paid back in won, illegal money exchange)

Co-principle in Violence (Co-Defendant in aggravated assault, in which Seungri escorted the people who were being disrespectful out of a bar.)

Now these are all the charges against him. He denied for years all the charges besides 1. , the 8th one, Violation of Foreign Money Transaction Act, then on 27th January 2022, Seungri has admitted to all of the charges, seeing his 3 year sentence being halved into 1 year and 6 months (18 months in total)

Let's make this clear before we head further, there are some definitions you have to have before saying things such as "He committed SA" or such.

Sex Work is performing sexual acitvities and getting paid after it. Both parties are consenting.

Prostitution is the act of performing sexual acts in exchange of money and you share the revenue with your pimp/madam. Prostitution is a service that is illegal in many countries.

A prostitute is a person who performs sexual acts in exchange of money then shares the revenue with their pimp/madam.

A pimp/madam is someone who is "running" a brothel, who is "employing" the prostitutes.

Was it illegal for Seungri to solicit prostitues and mediate prostitues for others? YES.

Did he commit Sexual Assault? There is no proof for that, nor a charge, therefore, NO.

Fact Check:

Seungri held 8% of the shares of Yuri Holdings, and Yuri Holdings held 20% of Burning Sun's shares. Seungri was never the CEO, manager, social media manager or anything else. The only engagement he had was to bring in more foreign DJ's to the club.

The Burning Sun Scandal (Rape, Drugs and Prostitution in the club) was based on a claim that has been debunked by the South Korean Police. Kim Sangkyo (the person who claimed all this) claimed that there was rape and usage of drugs going on inside the club while he was in arrest because assault over police in November 2018. This got to the media only in January 2019.

The police investigated this, it turned out Kim Sangkyo was harassing women (CCTV Footage and 4 victims came forward. He is currently on trial for Sexual Harassment and Misconduct.)

While investigating the club, an investigation initiated based on the claims of K.SK, the police also investigated if there was any possible bribery and police collusion.

Now as i said, Seungri's shares and frequent appearances in the club blew the case out of proportion, or more like, it put it into the spotlight. Everyone became interested, the media blew things out of proportion a lot of times, claiming that Seungri was the CEO, then that he was a Manager of the club, then dismissed these claims. Then came the sexual assault claims, the participation in the Molka Chatrooms which i won't develop here as i haven't been informed that much over it, i just know the perpetrators are behind bars.

The media portrayed Burning Sun as Seungri's Club even though he only had 1,6% of its shares (it is not much, considered how many other shareholders there were).

Here we are, in 2022 and there are some objective things we have to put forward.

The media claimed Seungri participated in the Molka chatrooms and the sexual assaults at some point. There were no proofs for that. It was objectively blown out of proportion. The only connection JJY and Seungri had here was in a restaurant business chat (this is objective info, sustained by Naver sources.) Seungri didn't participate in the Molka Chatrooms.

He was never blamed by any of the Molka victims and had no charges against him.

He willingly participated in all investigations, the "fact" exposed by the media that he destroyed evidence doesn't hold much weight.

The only argument that the judge had (about the Molka), was that "He must've known" while being biased. (For those who don't know, in a court, all jury and/or judges must stay impartial, which is a claim that for example, Amber Heard's team could appeal with as no one can stay impartial during 6 weeks, let alone a year.). The judgment is biased, which doesn't paint the judge in a good light.

So, is Seungri Guilty? Most probably, yes as he pleaded guilty on the 27th of January 2022, after almost 3 years of investigation (precisely 8088 hours in total), after being questioned by more than 100 officers, but this plead could also be just to halve his sentence. (It is a possibility, not a reality.)

However, we must take in count that the prosecutor asked to reclassify the case as Association, cause there was no real evidence (cfr.: 25th hearing) against Seungri in the end. The judge sentenced him by quoting a tabloid "He must've known", showing his biased stand on the situation. A judge should never be biased, we are all human so we will always get biased, it is normal, but you must try your best to not be biased during a trial and only take objective facts as facts, not tabloids and personal feelings.

People can say "Yes, there was no prood because he could have bribed the police." It is a possibility we must not rule out. Others will say "People judge him when there is no real evidence against him and all the charges." It is anothet possibility that there are really no tangible pieces of evidence and he got tangled up in a shady business. There are endless possibilities, in the end, he's the only one who know's the truth.

Some VIP's will claim it's a conspiracy against him, some others will say they are delusional and will continue standing besides what has been said by the Judge. One thing we should not forget is to see objective pieces of text that can help us see what really happened.

Once again. Seungri has pleaded guilty, therefore he is considered guilty at the eyes of the law, but no one knows if the court was really impartial.

My heart and support goes out to the victims of the Molka incident, i hope they can rebuild themselves and have a normal life after living those atrocities.
