At long last, a meaningful step to protect Americans' privacy

This Saturday (19 Aug), I'm appearing at the San Diego Union-Tribune Festival of Books. I'm on a 2:30PM panel called "Return From Retirement," followed by a signing:

Privacy raises some thorny, subtle and complex issues. It also raises some stupid-simple ones. The American surveillance industry's shell-game is founded on the deliberate confusion of the two, so that the most modest and sensible actions are posed as reductive, simplistic and unworkable.

Two pillars of the American surveillance industry are credit reporting bureaux and data brokers. Both are unbelievably sleazy, reckless and dangerous, and neither faces any real accountability, let alone regulation.

Remember Equifax, the company that doxed every adult in America and was given a mere wrist-slap, and now continues to assemble nonconsensual dossiers on every one of us, without any material oversight improvements?

It's hard to overstate how fucking scummy the credit reporting world is. Equifax invented the business in 1899, when, as the Retail Credit Company, it used private spies to track queers, political dissidents and "race mixers" so that banks and merchants could discriminate against them:

As awful as credit reporting is, the data broker industry makes it look like a paragon of virtue. If you want to target an ad to "Rural and Barely Making It" consumers, the brokers have you covered:

More than 650,000 of these categories exist, allowing advertisers to target substance abusers, depressed teens, and people on the brink of bankruptcy:

These companies follow you everywhere, including to abortion clinics, and sell the data to just about anyone:

There are zillions of these data brokers, operating in an unregulated wild west industry. Many of them have been rolled up into tech giants (Oracle owns more than 80 brokers), while others merely do business with ad-tech giants like Google and Meta, who are some of their best customers.

As bad as these two sectors are, they're even worse in combination – the harms data brokers (sloppy, invasive) inflict on us when they supply credit bureaux (consequential, secretive, intransigent) are far worse than the sum of the harms of each.

And now for some good news. The Consumer Finance Protection Bureau, under the leadership of Rohit Chopra, has declared war on this alliance:

They've proposed new rules limiting the trade between brokers and bureaux, under the Fair Credit Reporting Act, putting strict restrictions on the transfer of information between the two:

As Karl Bode writes for Techdirt, this is long overdue and meaningful. Remember all the handwringing and chest-thumping about Tiktok stealing Americans' data to the Chinese military? China doesn't need Tiktok to get that data – it can buy it from data-brokers. For peanuts.

The CFPB action is part of a muscular style of governance that is characteristic of the best Biden appointees, who are some of the most principled and competent in living memory. These regulators have scoured the legislation that gives them the power to act on behalf of the American people and discovered an arsenal of action they can take:

And it's true that privacy regulation faces stiff headwinds. Surveillance is a public-private partnership from hell. Cops and spies love to raid the surveillance industries' dossiers, treating them as an off-the-books, warrantless source of unconstitutional personal data on their targets:

These powerful state actors reliably intervene to hamstring attempts at privacy law, defending the massive profits raked in by data brokers and credit bureaux. These profits, meanwhile, can be mobilized as lobbying dollars that work lawmakers and regulators from the private sector side. Caught in the squeeze between powerful government actors (the true "Deep State") and a cartel of filthy rich private spies, lawmakers and regulators are frozen in place.

Or, at least, they were. The CFPB's discovery that it had the power all along to curb commercial surveillance follows on from the FTC's similar realization last summer:

I don't want to pretend that all privacy questions can be resolved with simple, bright-line rules. It's not clear who "owns" many classes of private data – does your mother own the fact that she gave birth to you, or do you? What if you disagree about such a disclosure – say, if you want to identify your mother as an abusive parent and she objects?

But there are so many stupid-simple privacy questions. Credit bureaux and data-brokers don't inhabit any kind of grey area. They simply should not exist. Getting rid of them is a project of years, but it starts with hacking away at their sources of profits, stripping them of defenses so we can finally annihilate them.

Continuing thoughts on how Ghost and Soap's relationship has changed over the course of mw(19), mwii(22) and mwiii(23)

BEWARE SPOILERS TO MWIII(23) !

I've had time to settle my thoughts on Ghostsoap in mwiii (23) and this will go more into depth of the re-contextualising of Ghost and Soap's relationship in mwii (22) from the verdansk mission: "Flashpoint".

Flashpoint is set 4 years to mwiii(23). The game places it as April 6, 2019. This is important to us because it sets a different potential first mission (meet cute lmao) between the two and thus changes the tone of their interactions in mwii (22)

So let's set up a timeline with the available dates. Thankfully, the game sets some very concrete dates for us. Not all missions are included.*

Flashpoint - April 06, 2019

First canonical appearance of SAS Ghost and Soap

So now that's done. I've mostly ignored Farah and Alex and focused on Price, Ghost, Gaz, Soap and Nikolai as it pertains to relationships within the core group of Price/Ghost/Gaz/Soap.

What can we make of this ?

Well, a couple things.

We can now say that from 2019 to the events of "Kill or Capture" in 2022, Ghost and Soap have most likely worked together on missions before. The timeline shows that they at least had to have met in Dec 2020 in Verdansk as Soap had called for backup to Price and group.

That makes it actually at least 3 years of knowledge of each other prior to mwii(22). So a total of 4 years + potentially at the start of mwiii(23).

It also shows us how quickly their relationship changed from the Alone mission in '22 despite the 3 years of prior knowledge they had since '19.

Let it be said that it took 1 week, ONLY 7 DAYS!! to change Ghost and Soap's relationship. 7 days out of a total at least 3 years total.

Ghost started at not even bothering to name Soap in 2019, to presumably basic Soap/Mactavish/sergeant for the next 3 years.

Cut to the events in mwii(22). Lets say beginning at "Kill or Capture" and finishing at "Alone" and suddenly Ghost ends up having made up his own personal nickname that no one else can use for Soap in just those 7 days.

I posit that this was in part due to "Kill or Capture" in '22 being the first mission that Soap has directly worked under Ghost's command.

This is all hypotheticals and guesswork so take it as you may.

Assuming Ghost was mainly a solo mission sort of guy, let's also assume he mostly helped as sniper overwatch if he ever had team missions (like in Flashpoint). Most 141 missions have him taking that position as well, so it's safe to say he is support most of the time.

Given that assumption, it's also likely that Soap and Ghost had to have interacted mainly on comms and any physical meeting would be restricted to transport via heli or otherwise.

It's possible Soap and Ghost have worked together on a more physical basis (aka Ghost leading Soap on a squad), but given how much Ghost seemed to be testing Soap in "Kill or Capture" I find that somewhat unlikely.

In 2019 we see how brusque Ghost is with Soap. It's very likely that Ghost was largely monosyllabic with Soap pre or post missions to Flashpoint.

Considering Soap's propensity to chatter in 2022 and 2023, it's also very likely Soap annoyed the hell out of Ghost on comms. Lol.

This could explain why Ghost was so dismissive of having Soap as his sergeant in "Kill or Capture", despite working together 3 years ago.

I, and arguably most of fandom had theorised that "Kill or Capture" was the first mission that Soap and Ghost ever had together. And we weren't quite right, but we weren't completely wrong either.

With Flashpoint, it's obvious now that was not quite true. It even suggests in it that Ghost and Soap had worked together prior to even that, as there was no formal introduction between the two.

This dramatically changes how Ghost's dialogue and Soap's to a lesser degree can be read in mwii(22) and implies much much more if you consider how they interact with each other in '23.

So why does it matter when Ghost and Soap's relationship started?

With mwiii(23) we can now definitively tell when Ghost and Soap's relationship changed. We now have a rough basis of a timeline and we can track down the differences between '19 -'22 and then '22- '23. Its important because we can see how their relationship deepens and how it changed within a span of 3 years, 7 compelling days and 1 heartwrenching year later.

For all that mwiii(23) was lax with explicit Ghostsoap moments, it's rich in how much context we gain to their relationship. We see how Ghost changes and how his relationships differ between 141. It's an interesting and compelling look at both Ghost and Soap's characters.

In this discussion I separate this analysis into 3 parts. Part 2 will cover the implications of "Flashpoint" on mwii (22), with discussion line by line. Part 3 will most likely go over comparisons a year makes from the events in '22 to '23. (This might be subject to change as I get further into the analysis)

This is my attempt at taking the best of the past years and bringing something for everyone. What I've come up with are three levels of abstraction that (hopefully) serve as different levels of difficulty. The first week-ish draws more from 2019's style, and the last couple weeks are the more recent style, with the middle being a segue between them. (i kinda struggled to make questions, but you're welcome to use the prompts as keywords for your own!)

A reminder that you don’t have to commit to every day. Take care of yourself. You can make it more manageable by skipping days. Black Farmers

In the fall of 1864 at the height of the Civil War, one of the most famous Union generals, William Tecumseh Sherman, begins his march out of the city of Atlanta to the sea.

And as Sherman and his men make their way through Georgia, black Southerners are seeing an opportunity.

And so by the thousands, they start to leave the plantations where they’ve been enslaved and are falling behind Sherman’s troops as they make their way to the coast.

But these newly liberated people were not exactly welcomed. Sherman didn’t actually oppose slavery, and so he’s really not that sympathetic to those who are fleeing these plantations, and he also sees them as a drain on his resources. They are families. They are people of all ages, young and old, who need food and care, and they are slowing the troops down.

By December of that year, some of Sherman’s troops are about to approach Savannah, and they come upon a creek that is both too wide and too deep to cross without a bridge. So the troops start building one, and they instruct the black people who are following them to just wait, that the troops need to cross first, but then they’ll be able to come after. But the Confederate Army is on their heels, and once the Union troops cross, they break up the bridge, leaving all those people who had just escaped slavery behind to face either the icy waters or the rebel army that was in pursuit.

It is a massacre. Some of them drown trying to swim across. Others are trampled or shot to death, and those who remain are captured and re-enslaved. When word gets back to Lincoln’s secretary of war, Edwin Stanton, he is outraged. He has Sherman pull together a meeting with 20 black church leaders. There’s a transcript of this meeting, and it shows that these two men, Stanton and Sherman, actually turned to this group of black leaders and asked them, what do you want for your own people?

Speaking for the group, one of the men tells them, “The way we can best take care of ourselves is to have land, and turn it and till it by our own labor — that is, by the labor of the women and children and old men, and we can soon maintain ourselves and have something to spare.”

And what’s remarkable is that Sherman turns that request of those men for land to work for themselves into a government order, Special Order No. 15. It said that the government would take 400,000 acres that it had seized from the Confederacy and split it up among those thousands of newly emancipated people. This becomes what is perhaps the most famous provision of the Reconstruction period, which we all know as 40 acres and a mule. President Lincoln approves the order, but soon after, he’s assassinated. And Andrew Johnson, a Southerner who had once enslaved people himself, takes over the presidency and quickly overturns it. And within a few short months, the small amount of land that had been distributed to black people was returned to white Southerners.

I started this challenge with the intention of finishing it within 30 days, which is evident with the initial posting habits. I'm quite happy with some of the earlier drawings, as they were fresh and snappy, definitely leaning more towards comedy than romance. But Life Happens and of course the consistency was all over the place. And the longer it took to complete the challenge, the less relevant the prompts became to me... But through stubbornness and stupidity, I finally finished it a few months over the 10 year mark!

This challenge developed some of my favorite concepts like the IRL middle school AU, Veilstone Academy, and mirror world versions. And even if the themes are outdated, looking back at it reminds me of a simpler and fun time in fandom.

From the month of March 2019, the lads appears in 13 episodes (15 produced) on 10 dates - together in 14, Robert in 14 and Aaron in 15. This was the month the show added an additional episode (on Tuesdays) for a total of 7 showing per week! Briefly:
