Charter Change: Yes or No?

Over the years, the Constitution of the Philippines is constantly changing with different colonizers, presidents, and leaders leading the country, but what is a constitution? Constitution, in simple terms, serves as the limiting force that holds back the power of the president, thus, it is more powerful than the president itself. With the given circumstances, the argument of cha cha being implemented came into the frame after 34 years. The post-EDSA constitution was threatened to be changed when President Duterte reportedly instructed the allied congress to begin with the proceedings. Furthermore, I have gathered 7 perspectives from different Industries and professions using Google Forms. Results show that 4 of the interviewees disagreed and 3 agreed.

On the first account, he did not want to show his name but he is in the Recruitment industry. According to him, the idea of changing the constitution should not be the priority of the government at this point, instead improving the healthcare and passing laws that will benefit the poor because cha-cha would just "benefit the elites and oppress the poor".

Another primary source that disagrees with cha-cha is from Joseph Sydney Valdez who works in Business Process Outsourcing (BPO). According to Mr. Valdez, changing the current constitution will only lead to a more complex bureaucracy, corruption and inefficient public service.

The 2 anonymous remaining accounts in the disagreement side is from the same insurance industry, one is a manager and another is an advisor. The manager's perspective focuses on the lawmakers. According to him/her, the qualifications of the lawmakers nowadays is not capable of thinking a better constitution that will help our fellow countrymen. He/she adds that lawmakers in the government are mostly not a law graduate. In relation, the advisor's perspective does not go far from this. According to him/her, the solution to the country's problem is not the amendment of the constitution, instead it should be the amendment of the current government's leadership that will better address the problems.

On the other hand, 3 accounts are on the agree side of changing the constitution. One is Gerardo Cruz who works at a Life Insurance Company. According to Mr. Cruz, the implementation of cha-cha should only have one lawmaking body, and the senate and the house of representatives should be merged as one for efficiency purposes. In addition, the 2 accounts that were in the law industry both had to say in the argument. One law student agreed in the amendment because according to him/her, there is a lack in empowering the local government unit. The last account is from a lawyer, according to him/her, the necessity in changing the constitution goes along with the fact that some of the provisions in the current constitution are "obsolete" or no longer "applicable".

After a thorough analyzation with the different results from different industries, I realized that the amendment really is not necessary in today's time. A good development for our country is possible but not necessarily with the use of cha-cha. The priority should be the development of those who are in poverty, security in healthcare and better handling of the country's economy. I believe that Charter Change will not be as successful because of its factors that favor most of the high class and will limit resources from people, which makes it difficult for the oppressed community to develop. In conclusion, although President Duterte have just planned but did not made it through the change, Charter Change is still out there waiting for the time that it will become necessary. But today, our leaders must face even a harder challenge that is spreading around the world.

#PHnews: LTFRB to open 16 more jeepney routes in Metro Manila

MANILA – There will be more traditional public utility jeepneys (TPUJ) plying the roads of Metro Manila after the Land Transportation Franchising and Regulatory Board (LTFRB) announced that it is opening 16 more routes on Wednesday.

In an advisory on Tuesday, the LTFRB said a total of 816 TPUJs in 16 routes will return to the streets of Metro Manila as prescribed in its Memorandum Circular (MC) 2020-071.

These new routes are as follows: --T276 Edsa/Shaw Blvd – E. Rodriguez (Brgy. Ugong), Vargas Ave. --T277 Edsa/Shaw Blvd – E. Rodriguez /Ortigas Ave. --T278 Edsa/Shaw Blvd – E.R. Ort via Shaw Blvd --T279 Edsa/Shaw Central -- Pateros --T3180 Dapitan -- Libertad via Mabini --T3181 Dapitan -- Pasay Rotonda via L. Guinto --T3182 Del Pan -- Guadalupe --T3183 Divisoria -- Pasay Rotonda via L. Guinto --T3184 Divisoria -- Punta via Sta. Mesa --T3185 Libertad -- QI via L. Guinto --T3186 Malanday -- Pier South --T3187 Project 2 and 3 -- Remedios via E. Rodriguez --T440 Filinvest City Located at Alabang, Muntinlupa --T441 Kabihasnan – Sucat --T442 Nichols -- SM Mall of Asia via Macapagal Ave, and --T443 Sucat -- Market Market (Fort Bonifacio, Taguig)

Aside from these new routes, a total of 387 routes plied by 33,979 TPUJs are already active in Metro Manila.

Since June 1, the LTFRB has allowed the resumption of service of 865 modern jeepneys in 48 routes, 4,499 public utility buses in 35 routes, 387 point-to-point buses in 34 routes, 6,755 UV Express units in 118 routes, 21,436 taxis, 25,068 transport network vehicle services, 459 provincial buses in 20 routes, and 40 modern UV Express units in two routes.

The LTFRB also reminded passengers, drivers, conductors, and operators to always wear face masks and shields, refrain from talking, eating in public transport, maintain proper ventilation of the vehicle, regular disinfection, bar anyone with Covid-19 symptoms, and to always follow the “one-seat-apart” physical distancing rule. Ito ay hindi ukol sa Presidente lamang. Habang naka-tuon ang pansin ng lahat sa naglalabanang pwersa ng mga tumatakbong Pangulo kaalinsabay nito ang di matapos na pagpasok ng ‘messiah syndrome’ sa kaisipan ng mahigit 100 milyong mga Pilipinong naghihintay ng isang taong mag-aahon sa kanila sa lugmok na pagdurusa at burak ng ekonomikal na kumunoy ng ating lipunan. Ang bigat hano. Poverty porn ang tawag dyan. Paggamit sa konteksto at kapangyarihan ng kahirapan para mapasunod sa tugtugin ng media ang lipunan. Mahal ng mga pulitiko ang kahirapan. Puhunan nila ito sa kampanya. Sa kabilang banda, mula sa nasabing istatiska, mayroong higit kumulang na 54.36 milyong mga botante. Sa pag-iral ng demokrasiya, ang mga botanteng ito ang siyang pipili ng magiging pinuno ng pamahalaan. Ayon naman sa iba pang istatiska, 1% lamang dito ay tinatawag na MAYAMAN, 10% ang upper middle class, 13% ang lower middle class, at ang nalalabing 76% ay tinatawag nating mahirap. Basic statistics, na tulad ni Daniel Padilla na basic lang din ang utak, mayorya sa botante ay mga mahihirap. Kung paramihan ng boto ang labanan, kayang-kayang magpanalo ng mga mahihirap nating kababayan ng kandidatong tatawagin ang sariling ‘galing din po ako sa hirap’, ‘nauunawaan ko po ang inyong kahirapan, o di kaya’y ‘mahal ko ang mahihirap’. Nakalangoy ka na ba sa dagat ng basura?. Ano naman ang papel naming middle class? Sagana rin kami sa oras para manuod ng mga artista, mag-Facebook, Twitter at Instagram, makipag-party all night long habang manamis-namis naming sinasabi na ‘minor subjects’ ang Kasaysayan ng Pilipinas, Sosyolohiya, Lipunan at Kalinangan, Rizal at maraming iba pa. Samantalang marami sa aming middle class ang matatalino, wala kaming interes sa takbo ng lipunan at pulitika dahil ang mahalaga ay matupad namin ang sarili naming mga gusto at hangarin sa puñetang life na ito. Goals ang tawag namin dito. Mas pinipili din namin ang mangarap na magkaroon ng magarang bahay, mapormang kotse, maraming sapatos at damit samantalang lulong ang ibang kababaihan na magkaroon ng maputing balat at malapakwan na suso habang naghahanap ng fuckboy na malaki ang katawan ngunit walang karne ang bungo. Marami ang matatalino sa amin pero walang interes na maunawaan ang sistemang bumibilanggo sa lahat. Eh ang 1%? Maliban sa labanan ang ENDO, masaya silang puhunanan ang mga pulitikong magpoprotekta sa kanilang interes o di kaya’y puhunanan ang rebolusyon tulad ng EDSA para maisulong pilit ang kanilang interes. Anyway, 24.7 milyong botante naman ay may edad na 18 -34 at kasunod nito ang 15.5 milyong may edad na 35 – 50. Sabi ni Pepe, ‘Kabataan ang PAG-ASA ng Bayan’. Isipin mo ang pwersa ng sektor ng lipunang ito. 24.7 milyong kabataan na kayang magdala ng isang kritikong pagpili ng pinuno. Busy lang sila ngayon sa ibang mga bagay kung kaya’t pasensya na muna!! Kailangan din nating pumili ng mga Konsehal at Bokal na ang PANGUNAHING TRABAHO AY SUMULAT NG BATAS AT ORDINANSA para sa kanilang nasasakupan. Mga batas na may PERMANENTENG BENEPISYO sa mga kababayan at hindi ang PANSAMANTALANG gymnasium, waiting shed, pa-liga sa barangay, libreng tuli, libreng pustiso, libreng pads, at marami pang iba. Philippine President Rodrigo Duterte has confirmed that he killed three men during his time as mayor of Davao city, despite officials trying to downplay an earlier admission. Duterte’s comments might yet hurt his popularity but that seems unlikely.

Duterte’s national crusade has resulted in an alarming daily average of 34 drug war-related murders. Despite this death toll and international condemnation, public satisfaction with his anti-drug war is at a significantly high rate of 78%.

How can this be explained in a country that a mere 30 years ago brought down a dictator without resorting to violence? How could a nation that inspired the world with its peaceful “People Power” revolution now welcome a return to the state-sanctioned murders of the martial-law era of 1972-1981?

Duterte’s rise is an evolving lesson in the vulnerability of democracies in the face of a neglected public. The democratic institutions of the Philippines have little power when faced with a populist president determined to channel frustrations into immediate actions.

Unfulfilled promise

In 1986, millions of Filipinos ended Ferdinand Marcos’ dictatorship through sustained civil resistance against government violence and electoral fraud. This culminated in a massive peaceful protest in the capital along Epifanio Delos Santos Avenue (EDSA). The event is now popularly known as the 1986 EDSA People Power Revolution.

Marcos was ousted after 21 years in power. He had been democratically elected as president in 1965, but essentially ruled as a dictator from 1972 to 1986.

To the disappointment of many, an elite-dominated democracy replaced Marcos’ authoritarian rule. From 1987, a small number of families started to restore their control of the government and rotate the seats of power among themselves. They included the Marcos family, who returned from exile in 1991 and were welcomed by their allies.

In the public imagination, the promises of the People Power Revolution went beyond restoring democratic institutions. The narrative went like this: a return to democracy would secure prosperity and security for everyone. The overall framework and various social justice provisions of the 1987 Philippine Constitution clearly reflect this.

But three decades later, the post-EDSA pact is far from being fulfilled.

A neglected public

The post-EDSA leadership has failed to solve many of the problems that concern Filipinos. Despite promising national growth rates, the gains appear to have largely benefited the rich. More than 26 million Filipinos remain impoverished. And unemployment rates are said to be the worst in Asia.

This widening gap between rich and poor, recurrent domestic economic crises, epidemic levels of corruption and failed attempts to significantly reduce criminality, have left the public deeply frustrated. Surveys in recent decades have consistently shown that these are the most urgent national concerns for many Filipinos.

The 1986 revolution, once a symbol of the promise of democracy and prosperity, is now synonymous in the Filipino popular imagination with the dysfunctional transport system in Metro Manila.

National commemorations of the EDSA consensus have become officially important, but in the public imagination they tell the tale of how promises are meant to be broken.

Democracy’s discontent

Amid political and economic exclusion and malaise came Duterte. He offered empathy to the economic strugglers and protection from the violence of criminals and politicians. His was a twin campaign narrative of care and power. His supporters often highlighted how they felt that Duterte truly cared for them.

And he was not just all talk. Duterte is seen as a man of action: decisive and quick. His “authenticity” is manifest in his everyday language coupled with humour that comes from the streets.

Duterte articulated the public’s deep-seated feelings of precariousness and powerlessness using rhetoric they could relate to. His campaign rallies, which many proclaimed as a marvel to behold, showed the rapport between the candidate and his supporters.

Many felt that Duterte rose from the ranks of ordinary citizens despite coming from a traditional political family and holding various political offices for 30 years. This is especially evident in his overwhelming support in the southern Philippines, as the first president from a region long neglected by the capital.

How did it come to this?

When democracy doesn’t deliver, its legitimacy becomes difficult to defend. And when successive elite-dominated governments have used democracy for their own ends, the balance tilts towards authoritarianism.

Under post-EDSA democracy the richest families amassed more wealth than ever while poverty, hunger, homelessness, and crime continued to afflict ordinary Filipinos. It’s not difficult to imagine why some are nostalgic for the authoritarian past. Although national statistics show otherwise, people felt those were the country’s golden years.

Extrajudicial killings are a regular feature of post-EDSA governments as they were of the martial law years. Examples include the 1987 Mendiola massacre, 2004 Hacienda Luisita massacre and 2009 Maguindanao massacre, to name a few.

Perpetrators have not been brought to justice. Even before Duterte, the Philippines was known as the country with the worst state of impunity. Government critics were the usual victims until Duterte took aim at alleged drug dealers and users.

In my fieldwork in a massive poor urban community in Quezon City, residents have welcomed Duterte’s war on drugs. They now feel more secure in what they call their “drug-infested community” even though drug use has substantially declined compared to previous decades, according to one village official.

Residents argue that their perceptions of community security are just as important as the numbers in government records. For people to feel safe in a city where 92% of villages face drug-related crimes and in a nation where crimes against persons and property are rising is no easy thing.

When Duterte’s campaign translates to perceived everyday safety, it is no wonder that drug-war murders have not met considerable resistance.

Anyone with experience of the country’s institutions of justice knows how elusive criminal justice is. Around 80% of drug cases end up being dismissed and it may take a decade to achieve a conviction.

There are many reasons for this, but Duterte’s narrative that drug lords are so powerful that they can influence even the judiciary is not far-fetched. Most people do not trust the judiciary and many are convinced that power and money are needed to claim justice.

Previous administrations also made a mockery out of the national justice system; even convicted corrupt politicians enjoy their freedom while innocents languish in jail. A corruption whistleblower, Jun Lozada, was recently convicted, while ex-president Gloria Arroyo was acquitted and set free.

The legislature has been used to turn issues of justice into a public circus, such as in the impeachment of Supreme Court Chief Justice Reynato Corona and the hearings on allegations of graft and corruption against former vice president Jejomar Binay.

Is it surprising then that Dutarte’s supporters find calls to follow the rule of law and due process hypocritical? When institutions do not work, it becomes unreasonable to rely on them.

Duterte’s narrative plays on the temptations for a disgruntled public to claim swift justice. In the context of his rise to power, it’s no surprise that calls to respect human rights or the rule of law fall on deaf ears.

The election of Duterte may be seen as the nadir, but possibly also a turning point, in the long-standing democratic deficit in Asia’s oldest democracy. His rejection of the rule of law and liberal democracy represents a rupture in the post-EDSA consensus.

It’s not a stretch to say that the Philippines’ elite democracy had it coming. The failure to deliver on the promises of the People Power revolution made the rise of Duterte politically possible.
