Did you know that a cup of coffee could spark a major lawsuit? Let me tell you about the famous Liebeck v. McDonald's case!” In 1992, Stella Liebeck, a 79-year old woman sued McDonalds after she was severely burned by its coffee. She sued McDonald’s for $20,000 after she was hospitalised for eight days for her third-degree burns. Experts testified that McDonald's served scalding hot coffee that can cause third-degree burns in seconds. In fact, knew its coffee was causing serious burns, but it decided that, with billions of cups served annually, this number of burns was not significant. Yikes!
Guess what? In the end, the jury decided to give Liebeck a whopping $160,000 in compensatory damages for her pain, suffering, and medical costs. The Liebeck v. McDonald's case had left several significant impact, such as the importance for manufacturers to provide clear warnings about potential dangers associated with their products, and prompted businesses to reevaluate their practices and consider customer safety as a priority.

i don't see myself pursuing law as my career, i don't go back to this area whenever i have nothing to do but i go back to the areas that i'm interested in (creative works). no matter how busy i am, i always find myself coming back to these things and relate it to life.
so here's where the problem starts.
i always think that in a way, i'm better. "i'm actually smart but a wasted potential but it's okay, i can get As one day" which validates myself who actually don't want to purse law as a career thinking that i don't have to work hard.
as an ENTJ, who grows up believing she's somewhat smart, 'gifted' kid, she thought that she doesn't have to work hard. however, what she didn't realize is the fact that she's an ENTJ.
Ni aux: irrelevant information to my Te dom won't be remembered or connected.
this is where it went wrong and why i feel so left behind.
i could not connect the dots because they are irrelevant to my goals. probably why despite not being able to focus in my copyright class, i scored better than what i expected because that was the only relevant topic in law to my goals in the future. i could relate the topics in my creative works in order not to get sued, which brings me back to 2020; the reason why i agreed with my dad to take this course.
if it's relevant to my Te, my Ni aux would always connect the dots and see things in different perspectives. i won't say Ni doms or Ne users have it easier but for Ni aux, this is not a tool for me to score the exams naturally, unconsciously.
the only solution that i could think of is to use my Ni-- to see the bigger picture. realising i see the information as separated things is the reason why i cannot score.
i get it now, why they said ENTJs that used Ni, is healthy. i finally understand now.
it's not about visioning my future but how i use my Ni to connect the dots, to see things in a bigger picture, to see how everything is connected.
Ni was about information and how you understand it in details, like i did with the things that i am interested in.
the answer was in me after all this time.
it's not too late, i can still catch up. i just need to use my Ni properly.
just in case there are ENTJs who see this post, what do you guys think?

Exciting news! I’m getting ready to go to Miami this summer for an amazing summer associate position I got at a big time law firm! My imposter syndrome is affecting me pretty heavily but I’m trying to put that aside so I can maintain my excitement for my new adventure.
While I was looking into some summer clothes to buy (because I have ZERO living in the North), I realized how boring lawyers fashion can be. I mean no offense to anyone who enjoys the classic buttoned-up lawyer style, but it’s just not for me. I abhor plainness and typical law fashion is just so plain. “Why can’t I just dress how I want!?” I thought. “There’s no reason why, as long as I remain professional, that I can’t put on some interesting belts, asymmetrical lines, interesting patterns and layers. Cause why not?! Why should I have to sacrifice creativity for the sake of looking “professional”? The answer is, I’m not! I have chosen to dress how I like and express my individuality exactly how I like. It’s hard enough studying law. I shouldn’t have to give up part of who I am too... So in 2023, I’m just not.
Stay tuned for some of my outfit inspiration!

Overcoming "Imposter Syndrome"
I am no stranger to "Imposter syndrome". It is something that has plagued my academic career since studying for GCSEs. It is something that already exemplifies perfectionism within me, all whilst adding a delightful feeling that no matter how hard you work it will never make you worthy of being in the setting you are in.
For those of you who do not know what "Imposter Syndrome" is, allow me to explain. "Imposter Syndrome" is a constant feeling that you do not deserve to be in the place you are, whether that is a workplace or at University. It can also apply to countless other settings.
Currently, I am attending a Russel Group University here in the UK that has one of the highest percentage of private school students in the country, It must also be mentioned that my law school is one that also contains a large proportion of international students who have attended either private international schools in the UK or top schools in their home countries.
Imposter Syndrome is a horrible feeling, but I have found some little ways to help me feel more confident in my classes and I want to share them with you.
Find a piece of clothing that makes you feel confident or important. For me, I find that a blazer or smart shirt does the trick. They don't have to be designer or expensive. Some of my favourite workwear items include items from supermarket brands and high street shops. (Remember, being comfy can be just as empowering so if you want to rock a hoodie and jeans... GO FOR IT!)
2. Music! Hyping yourself up with some energetic tunes is a great way to start your day. Taylor Swift is a personal favourite, but I also love musical soundtracks. Equally, something slower and more mellow like jazz or classical can make you feel like a movie character.
3. Share your feelings. Talking to family and friends about how you feel really can help. I recognise that not everyone has this, so looking online is also a great place. If you are at a Russel Group University, The 93% Club is also a a fab resource.
Remember, you are where you need to be and you absolutely deserve to be there. You would not have been given this opportunity if you did not deserve it.
I am already so proud of you!

What Does 25 to life Mean?
Tumblr media
In legal terminology, a prisoner condemned to life imprisonment but entitled to parole after spending 25 years is said to be serving a “25 to life” sentence. It provides a means of establishing a certain minimum sentence without eliminating the possibility of parole release.
Although the sentence may formally call for 25 years of incarceration before granting parole, this may occasionally depend on the conditions of the prison population, a prisoner’s behavior, or other considerations. However, if parole is refused, the sentence can go on until the inmate dies.
The punishment may simply be stated as a “life sentence” in cases where the crime was especially atrocious, and parole is not an option.

People vs. Webb, G.R. No. 176864, 14 December 2010.
A criminal trial is not about personal redress for the victims, but about determining the guilt and the just punishment of the accused.
The concept of “fair trial” is that the rights of the accused are protected, to the extent necessary to ensure fairness for him. Rights of the victims are not ignored, but they are respected only to the extent that they are consistent with the fairness of the trial for the accused.

Related case to Art 1194
Related Case:
Josefa vs. San Buenaventura; G.R. No. 163429; Mar 3, 2006
Ponente; CALLEJO, SR., J
Facts:  Lourdes San Buenaventura owns a parcel of land in Pasig City. On July 15, 1990, Johnny Josefa entered into a lease contract with San Buenaventura for the said property. The lease contract stated that the period covered by the agreement is from August 1, 1990, to July 31, 1995, renewable upon agreement of the parties.
After the expiration of the lease contract, San Buenaventura informed Josefa that the lease would no longer be extended but that he may continue with the lease at a rental rate of P30,000.00 a month. Josefa refused to vacate the premises and continued to occupy the property, paying a monthly rental of P15,400.00. San Buenaventura made demands for Josefa to vacate the property, but he still refused to leave.
San Buenaventura filed a complaint for unlawful detainer against Josefa, which was initially dismissed due to a procedural issue. The complaint was refiled and eventually heard by the Metropolitan Trial Court (MeTC) of Pasig City. The MeTC ordered Josefa to vacate the premises and pay reasonable compensation for his continued use and occupation of the property at the old rate of P15,000.00 a month. Josefa appealed the decision to the Regional Trial Court (RTC), which reversed the ruling of the MeTC and dismissed San Buenaventura's complaint. The RTC held that the inclusion of the renewal clause in the lease contract showed the intent of both parties to extend the lease without any condition or requirement of mutual agreement. San Buenaventura appealed to the Court of Appeals (CA), which granted the petition and reinstated the decision of the MeTC. The CA held that after the expiration of the lease contract, the owner of the property had the right not only to terminate the lease but to demand a new rental rate. The CA also ruled that Josefa could not claim to be a builder in good faith since he knew that he was only a lessee.  Josefa filed a petition for review with the Supreme Court.
Issue: Whether Josefa is entitled to reimbursement for his improvements on the property.
Ruling: Josefa is not entitled to reimbursement for his improvements on the property. Josefa, as a lessee, cannot claim to be a builder in good faith because he knew that he was only a lessee and not the owner of the property. Josefa is not entitled to reimbursement for his improvements on the property because he made the improvements knowing that he was only a lessee.
