// Lucky for you I actually wrote my thesis about copyrights and fanworks. From what I learned, you can be at ease and rest assured, this legal talk of Tumblr's is all that it is, legal talk to cover their own ass. As a huge company, copyright holders have a much greater interest to sue them rather than individual creators, so they rather be safe than sorry.
Cases of copyright holders going after fanwork creators are few and far between and more often so the whole thing ended up biting them in the ass rather than help bring any type of positive outcome. Main reason why they usually won't even try though is if there is little or no money to be made from the lawsuit, there's really not much point to. Hence, individual creators can rest at ease.
Fair use means you can basically do p much anything as long as you don't earn professionally off of them or so. Even then, if somehow you're told not to by the copyright holder, the very most they usually do, as was already mentioned, is a simple a cease and desist. Basically, if you're unlucky enough to get one, which is rare as is, you're good if you just stop what they ask you to do. They usually have little interest to go to court, it's not good press for them and honestly, why should they risk unnecessarily angering the literal source of their income: their biggest (and loudest and most influential) fans, the online fanwork creators.
Cases that might theoretically take you to court are such as, competing in the same medium or higher as the source material, aka if the source material are novels, you might get in trouble if you write and publish your own novels or equivalent based off the same material, or make a comicbook out of it and publish it and actively make money off of it or write it into a movie and publish it. Without permission and royalty fees and whatever else was agreed upon, this is illegal. However, writing fanfics or drawing fan-art as paid commissions hardly compares, as long as you're not doing it professionally or earning massive amounts off of it on a regular basis.
You might also get into trouble if you create and publish professional level material and print them/sell physical products such as toys and distribute them in high emounts via retail or equivalent, but don't pay royalties etc for the copyright holders, or so. Even then, the offense should usually be large scale or gain a massive followship for the copyright holders to actually care.
TLDR, if the copyright holders feel what you're doing is actively losing them big money, they might care. Otherwise, you can be pretty chill. Again, the legal jargon is for Tumblr to cover their own ass, not threaten us users. You should be fine to sell fanworks, but it might be a good idea to keep it small scale and hobby-based rather than professional to avoid getting into trouble.
some very important info re: paid accounts~
I am not a lawyer, but I can decently interpret legalese and, being as I also suffer from tl;dr syndrome and assume others may as well, I took one for the team and went through the updated TOS for the post+ accounts and highlighted (what I understand to be) the most pertinent information, which ultimately comes down to this:
You cannot monetize copyrighted works (aka charge and earn money from fanfic, fanworks, etc) and if you do decide to put your fanworks behind a paywall via Tumblr, when you are inevitably sued, Tumblr will not protect you and will not defend you and you alone, personally, will be responsible for whatever monetary damages said lawsuit results in.
If anyone is a lawyer and knows I've gotten any of this wrong, please do not hesitate to correct me/this post.

1. Your paid account will not be hosted by tumblr; it is routed through a 3rd party.

2. By signing up for a paid account, you're entering into an agreement with Stripe, so in addition to Tumblr's TOS, you are also bound to Stripe's TOS.

5. Tumblr's TOS specifically states that you can't put any content on your post+ account that violates any laws, including laws that protect intellectual property rights of others. This is super important, because Tumblr's post+ FAQ also states that you can post anything that you would regularly post on tumblr, which I'm sure many will take to mean that gifsets, fanworks, etc are fair game, since all of that stuff can be posted on tumblr now. However, the difference is, you're not making money from the fanworks you're posting or reblogging now. Once money enters the equation, the game changes.

Tumblr is making it seem like any and all content goes for post+ accounts, knowing 90% of this site is fanworks. This is not true and you'll be opening yourself up for lawsuits if you charge for fanworks.
6. Tumblr further disclaims any and all liability in any legal issues.

tl;dr: Please do not make a post+ account, bc you will be opening yourself to lawsuits and if that happens, Tumblr's response will be not our problem, you agreed to all the terms which said you couldn't do that, sorry not sorry. Please protect yourself.
