Heavy footsteps and whimpers filled the hallway. Keitaro paused amidst his sketching in the study; he swore he caught a blur of Natsuno past his reading glasses. A door slammed shut seconds later, no doubt the one for the bathroom.

“That’s the third time this week,” BJ murmured beside him.

Keitaro’s eyes lingered in the hall, where echoes of Natsuno’s utmost discomfort permeated the area. “We should check on her.”

“And get chewed out again? It’s best to give her space. She knows to come to us if she requires support.”

“I know, but—” He sighed and returned his head to center. “I’m worried.”

BJ rubbed his back. “So am I.”

But why sketch new building designs for the colony’s farm when their wife was locked up in the bathroom, utterly miserable? Was it something we ate? Keitaro wondered, tapping his pencil against the drafting desk. I could cook different dishes if she’s unhappy with our meals lately. Or it was stress from the... well, everything. Even years after they won against the Deimos and woke up to the real world, there was always work to be done. For humanity’s future, of course, but that didn’t make the reality of their situation any easier to digest.

Seconds crawled on like years. Keitaro and BJ said nothing to one another, though glanced into the hallway more often than not. By the time Keitaro finished a page of sketches, the distinct click of a door unlocking pierced the silence.

Keitaro and BJ abandoned their work to rush out of the study.

Ist das Fitnessstudio aufgrund hoheitlicher Anordnung wegen der CORONA-19-Pandemie zu schließen, liegt darin ein Fall der Unmöglichkeit der Zurverfügungstellung der Räume zum Training durch dessen Betreiber, § 275 Abs. 1 BGB. Dies hat zur Folge, dass der Nutzer während er Schließungszeit leistungsfrei wird, § 326 Abs. 1 BGB.

Eine Vertragsanpassung nach § 313 BGB nach den Reglungen über die Geschäftsgrundlage findet nicht statt.

Eine Vertragsanpassung ist ausgeschlossen, soweit eine spezialgesetzliche Vorschrift besteht, die die Leistungsstörung regelt. Die ist § 275 Abs. 1 BGB.

Zudem hat der Gesetzgeber zur Abmilderung der coronabedingten Folgen (hier in Form der Schließung der Einrichtungen) in Art. 240 § 5 Abs. 2 EGBGB bestimmt, dass der Betreiber Gutscheine ausgeben kann, die dem Wert der vertraglich nicht erbrachten Leistung (Schließungszeit) entsprechen. Damit hat der Gesetzgeber

Anmerkung: Nach Art. 240 § 5 Abs. 5 EGBGB hat der Betreiber der Veranstaltung (hier Fitnessstudio) auf Verlangen des Nutzers den Gutschein ab dem 01.01.2022, wird er nicht vorher eingelöst, im Wert auszuzahlen. Der BGH verweist darauf, dass der Gesetzgeber mit der Regelung die gesetzliche Regelung der Unmöglichkeit modifizieren und damit die Anwendbarkeit des § 313 BGB in ihrem Bereich ausschließen wollte. Da aber der Gesetzgeber ersichtlich nicht daran gedacht hat, dass es zu einem weiteren Lockdown kommt, ergäbe sich aus der Begründung des BGH, dass mithin der Gesetzgeber doch die Anwendbarkeit des § 313 BGB annahm und hier Abhilfe schaffen wollte, weshalb dieser Intention zufolge eine Regelung auch nach § 313 Abs. 1 BGB für das zweite und weitere Lockdowns wegen COVID-19-Pandemien möglich sein muss.
