Warning signs of the instability of the global financial system abounded in the months leading up to the 2008 Lehman Brothers crash. Among these early signs were the astounding revelations about UBS, the world’s largest private bank, by Stephanie Gibaud, who was employee at the bank’s French division. Gibaud refused instructions given to her and other employees to delete all their company files. In doing so, she helped reveal a vast web of corruption and fraud linking UBS to a shadowy tax evasion scheme. More than 15 years later, Gibaud has endured harassment, professional ostracization, lawsuits, and threats. She joins��The Chris Hedges Report to speak on her ordeal and the extent of corruption in the international banking system.

Chris Hedges:  Stephanie Gibaud in June, 2008, was ordered by one of her managers at the UBS Bank in Paris, to destroy all her computer files that related to customers with offshore accounts in Switzerland. The order came in the wake of the 2007 American banker, Bradley Birkenfeld’s disclosure of client information to the US Department of Justice, which suggested that UBS was facilitating massive tax evasion schemes for its American clients, which ultimately led to a penalty of $780 million. Swiss banks have long been havens for those seeking to avoid taxes. In 2014, for example, Credit Suisse, which would also plead guilty to sheltering money for its clients so they could avoid paying taxes, had to pay $2.6 billion in penalties.

Gibaud, however, was the only bank employee at UBS who refused to delete her files. She protested to UBS management and French regulators. Her documents would eventually help to identify 38,000 offshore bank accounts amounting to $12 billion. UBS responded by trying to fire her as part of a mass redundancy of 100 employees during the 2008 financial crisis. The French Ministry of Work intervened, but her life at UBS became excruciating. She suffered harassment and discrimination along with social and professional isolation. She endured constant anxiety and depression. UBS fired her finally in 2012. She was sued for defamation by the bank after writing her book, The Woman Who Knew Too Much, part of a series of lawsuits that plague her to this day.

She requested compensation totaling 3.5 million euros and the judge gave her 4,500 euros, which barely covered her legal fees. UBS was eventually forced to pay a record fine in 2019 of $4.9 billion, but Gibaud found herself financially ruined and blacklisted from the financial sector where she had spent her career. The French legal system does not compensate whistleblowers, unlike the US. The Commodities Future Trading Commission, for example, recently awarded an anonymous whistleblower around $200 million for providing information about Deutsche Bank’s manipulation of the LIBOR benchmark. Birkenfeld, who exposed UBS’s offshore accounts for American clients, was handed a check from the US Treasury for $104 million, minus taxes. Gibaud is currently battling in the French courts to become the first legally recognized whistleblower, which could pave the way for greater protection and compensation.

Self-immolation comes from the Latin stem immolāre, to sprinkle with salted flour when offering up a consecrated victim for sacrifice. Self-immolations, like Bushnell’s, link the sacred and the profane through the medium of sacrificial death. But to go to this extreme requires what the theologian Reinhold Niebuhr calls “a sublime madness in the soul.” He notes that “nothing but such madness will do battle with malignant power and spiritual wickedness in high places.” This madness is dangerous, but it is necessary when confronting radical evil because without it “truth is obscured.” Liberalism, Niebuhr warns, “lacks the spirit of enthusiasm, not to say fanaticism, which is so necessary to move the world out of its beaten tracks. It is too intellectual and too little emotional to be an efficient force in history.”

The case will not be determined by the documentation of specific crimes, even those defined as war crimes. It will be determined by genocidal intent — the intent to eradicate in whole or in part, a national, ethnic, racial or religious group — as defined in the Genocide Convention.

These acts collectively include the targeting of refugee camps and other densely packed civilian areas with 2,000-pound bombs, the blocking of humanitarian aid, the destruction of the health care system and its effects on children and pregnant women — the U.N. estimates there are around 50,000 pregnant women in Gaza, and that more than 160 babies are delivered every day — as well as repeated genocidal statements by leading Israeli politicians and generals. 

Prime Minister Benjamin Netanyahu equated Gaza with Amalek, a nation hostile to the Israelites in the Bible, and cited the Biblical injunction to kill every Amalek man, woman, child or animal. 

Defence Minister Yoav Gallant called Palestinians “human animals.” 

Israeli President Isaac Herzog stated, as the South African lawyers told the court, that everybody in Gaza is responsible for what happened on Oct. 7 because they voted for Hamas, although half the population in Gaza are children who are too young to vote. [Or were too young to vote in 2006 when the election took place.]

But even if the entire population of Gaza did vote for Hamas this does not make them a legitimate military target. They are still, under the rules of war, civilians, and entitled to protection. They are also entitled under international law to resist their occupation via armed struggle.  

The South African lawyers, who compared Israel’s crimes with those carried out by the apartheid regime in South Africa, showed the court a video of Israeli soldiers celebrating and calling for the death of Palestinians — they sang as they danced “There are no uninvolved civilians” — as evidence that genocidal intent descends from the top to the bottom of the Israeli war machine and political system.

They provided the court with photos of mass graves where bodies were buried “often unidentified.” No one – including newborns – was spared, the South African lawyer Adila Hassim, senior counsel, explained to the court.

UNRWA’s role in documenting the genocide, as well as providing food and aid to the Palestinians, infuriates the Israeli government. Prime Minister Benjamin Netanyahu accused UNRWA after the ruling of providing false information to the ICJ. Already an Israeli target for decades, Israel decided that UNRWA, which supports 5.9 million Palestinian refugees across the Middle East with clinics, schools and food, had to be eliminated. Israel’s destruction of UNRWA serves a political as well as material objective. 

The evidence-free Israeli accusations against UNRWA that a dozen of the 13,000 employees had links to those who carried out the attacks in Israel on Oct. 7 did the trick. It saw 16 major donors, including the United States, the U.K., Germany, Italy, the Netherlands, Austria, Switzerland, Finland, Australia, Canada, Sweden, Estonia and Japan, suspend financial support for the relief agency on which nearly every Palestinian in Gaza depends for food. Israel has killed 152 UNRWA workers and damaged 147 UNRWA installations since the attacks inside Israel by Hamas and other resistance groups on Oct. 7 that killed some 1,200 Israelis. Israel has also bombed UNRWA relief trucks. 

More than 27,708 Palestinians have been killed in Gaza, some 67,000 have been wounded and at least 7,000 are missing, most likely dead and buried under the rubble.

More than half a million Palestinians – one in four – are starving in Gaza, according to the U.N. Starvation will soon be ubiquitous. Palestinians in Gaza, 1.7 million of whom have been internally displaced, lack not only sufficient food, but clean water, shelter and medicine. There are few fruits or vegetables. There is little flour to make bread. Pasta, along with meat, cheese and eggs, have disappeared. Black market prices for dry goods such as lentils and beans have increased 25 times from pre-war prices. A bag of flour on the black market has risen from $8.00 to $200 dollars. The healthcare system in Gaza, with only three of Gaza’s 36 hospitals left partially functioning, has largely collapsed. Some 1.3 million displaced Palestinians live on the streets of the southern city of Rafah, which Israel designated a “safe zone,” but has begun to bomb. Families shiver in the winter rains under flimsy tarps amid pools of raw sewage. An estimated 90 percent of Gaza’s 2.3 million people have been driven from their homes.

“There is no instance since the Second World War in which an entire population has been reduced to extreme hunger and destitution with such speed,” writes Alex de Waal, executive director of the World Peace Foundation at Tufts University and the author of “Mass Starvation: The History and Future of Famine,” in the Guardian. “And there’s no case in which the international obligation to stop it has been so clear.”

The United States, formerly UNRWA’s largest contributor, provided $422 million to the agency in 2023. The severance of funds ensures that UNRWA food deliveries, already in very short supply because of blockages by Israel, will largely come to a halt by the end of February or the beginning of March.

The some 160 self-immolations in Tibet since 2009 to protest Chinese occupation are perceived as religious rites, acts that declare the independence of the victims from the control of the state. Self-immolation calls us to a different way of being. These sacrificial victims become martyrs. Communities of resistance, even if they are secular, are bound together by the sacrifices of martyrs. Only apostates betray their memory. The martyr, through his or her example of self-sacrifice, weakens and severs the bonds and the coercive power of the state. The martyr represents a total rejection of the status quo. This is why all states seek to discredit the martyr or turn the martyr into a nonperson. They know and fear the power of the martyr, even in death.
