WES: In the three Tomes it’s only mentioned in the second–

So, in Brazilian healthcare and politics news, the Superior Court Of Justice (STJ) a couple weeks ago has determined that health plans must offer users only the procedures listed by the National Supplementary Health Agency (ANS), the so-called 'rol taxativo' (exhaustive list).

In practice, most services will continue to be covered by the healthcare plans. However, there is a limitation of novelties and innovative solutions, which may harm some treatments, especially for people who have uncommon diseases or disabilities (1 in 10,000 people or rarer). Treatments like newly approved drugs, some types of oral chemotherapy and radiotherapy, and surgeries with robotics, prostheses, and even some therapies for Autism Spectrum Disorders might also be affected.

[This week, however, the ANS determined that the coverage of any technique or method indicated by the attending physician for the treatment of any of the disorders classified in ICD F84 (International Classification of Diseases) – which are the Autism Spectrum ones – will become mandatory, including unlimited sessions with a speech therapist, psychologist, occupational therapist, and physical therapist.]

The ANS list, predicted by the Law 9.656/98, features more than 3,700 procedures that, so far, had been considered exemplary, not exhaustive or all-reaching, by most judicial decisions on the subject. This means that patients who had procedures that were not on the list could appeal to Justice to expand care. Thus, procedures or medications that were similar to those that were already planned were added to the health plan account.

With the new understanding of the STJ, the healthcare plans have obligation to meet only the agency's list, which already contains all mandatory coverage. That is, what isn't listed does not need to be paid by the operator. They can offer it, they're just no longer obliged to.

If a patient needs expanded coverage, in addition to the ANS list, they will have to show that the desired treatment has no substitute, in addition to proving the effectiveness of the requested treatment, including the recommendation of renowned technical bodies to obtain coverage by the health plan. The ANS list is notably slow to be updated.

According to the Brazilian Medical Association (AMB), more than eight million beneficiaries of health plans may be directly affected by the change in legislation. The entity also highlights that the determination may make several beneficiaries need to interrupt or change the treatments currently carried out. In Brazil, about 50 million people use health plans.

“The operators will start to profit much more with the additional ones.", commented the lawyer and specialist in medical and health law Georgia Racce". Faced with a refusal and without hiring an addition to the plan, I believe that the trend is a great increase in judicialization so that the Courts analyze the exception factor of each user of the plan, as well as there will be even more demands for the Universal Health System (SUS) overloading it.”

According to the ANS, however, the STJ's decision will improve the rite of updating the list of mandatory procedures, improving the lives of beneficiaries. The measure “will make procedures more accessible and faster, as well as guaranteeing extensive social participation and prioritizing the safety of incorporated health procedures and events”.
