Important Updates in the Rust Film Shooting
Here is a previous post from right after the shooting
Actor Alec Baldwin, the principal actor and a producer on the film, claims that he didn't pull the trigger, but did release the hammer, when the gun went off as they rehearsed.
Gun experts say that this is possible but extremely unlikely. FBI states the gun could not be fired without pulling the trigger.
Baldwin also stated he was a purely creative producer who was not involved in hiring staff.
Gaffer Serge Svetnoy, who stood shoulder to shoulder with Halyna Hutchins during the scene and held her as she died, filed lawsuits against the producers, claiming they cut corners by hiring armorer Hannah Gutierrez-Reed, a young armorer with only one other film as experience and who was forced to do a second job on set.
Armorer Hannah Gutierrez-Reed filed a lawsuits against the ammunition supplier for providing a mix of dummy and live ammunition, "including a live .45 caliber round."
Gutierrez-Reed also stated that she was attending to other props, and was unaware that rehearsal for this weapon scene was underway, or she would be have been present to advise on safety protocols.
Assistant Director David Halls, who handed the gun to Alec Baldwin, claims when inspecting the gun with the armorer before the scene, it had "at least four dummy casings with the holes on the side, and one without the hole." Dummy rounds are sometimes identified by a pierced hole on the side.
Halls was fired as AD from a previous film when an accidental discharge went off in a boom operator's face. The AD's main responsibility on set is safety.
Today, October 5th, 2022
Matt Hutchins, widower of Halyna Hutchins, the cinematographer who was killed during the Rust film shooting, settled in a wrongful death lawsuit against producers.
In a statement, he writes, "I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin). All of us believe Halyna's death was a terrible accident. I'm grateful that the producers and the entertainment community have come together to pay tribute to Halyna's final work."
Filming will resume in January 2023 with cast and director returning and himself as executive producer. A portion of the film profits will go to Halyna Hutchins' family.

The trial for "Rust" armorer Hannah Gutierrez-Reed is set to begin with jury selection next week.
In January 2023, Hannah Gutierrez-Reed and actor Alec Baldwin were charged with two counts of involuntary manslaughter in connection with the death of cinematographer Halyna Hutchins. In April 2023, the charges against the "30 Rock" actor were dropped without prejudice pending further investigation. However, the charges were refiled in January 2024.
In the summer of 2023, Hannah Gutierrez-Reed was charged with tampering with evidence after prosecutors claimed that they found a witness who alleged that the armorer had transferred cocaine to another individual on the day that Hutchins was killed, thus impeding the police investigation into her death.
The rookie armorer has pleaded not guilty to all charges. Although her trial was initially scheduled for December 2023, it was postponed until February 2024. Alec Baldwin is not expected to be called as a witness in her trial, given his own legal troubles.
'Rust' Armorer Hannah Gutierrez-Reed's Legal Team Tries To Get Trial Thrown Out
On Wednesday, February 14, 2024, a judge in Santa Fe rejected a last-minute bid to throw out the case against "Rust" armorer Hannah Gutierrez-Reed, despite repeated attempts by her legal team to get the case tossed.
Gutierrez-Reed’s lawyer, Jason Bowles, had unsuccessfully argued that it was impossible for the armorer to receive a fair trial when the state turned over hundreds of attorney-client text messages to a key witness, as per Variety. However, Judge Mary Marlowe Sommer refused to dismiss the case and did not find the disclosure prejudicial to her case.
The trial is now scheduled to begin on Wednesday, February 21, 2024. She has submitted a plea of not guilty to charges of involuntary manslaughter and tampering with evidence due to allegations of her drug use. Hannah Gutierrez-Reed has been accused of being reckless on set in terms of firearm safety. Prosecutors have alleged that she not only brought live ammunition onto the movie set, but they have also claimed that she was the one who put the live bullet into a gun that Baldwin used for a scene inside a church.
It is worth noting that Hannah Gutierrez-Reed was not inside the church when the gun went off, striking Halyna Hutchins and director Joel Souza, who was standing directly behind the cinematographer. Souza was hospitalized as a result of his injuries, but Hutchins did not survive.
It was actually first assistant director Dave Halls who had told Alec Baldwin that the gun was a "cold gun," meaning that it did not contain live rounds. Halls reached a plea deal with prosecutors and pled guilty to the negligent use of a firearm. He was given six months of probation.
Judge Declines To Throw Out Additional Drug Charges
On Wednesday, February 14, 2024, Judge Sommer dealt with several different motions ahead of next week's trial. Declining to dismiss the trial, Judge Sommer noted that Hannah Gutierrez-Reed's attorney, Jason Bowles, had signed a consent form allowing law enforcement officials to search the armorer's phone. The consent form did not exclude attorney-client communications.
Judge Sommer also rejected a motion to sever the two counts to be heard at two separate trials. In the summer of 2023, special prosecutors alleged that Hannah Gutierrez-Reed gave someone on set a bag of cocaine after the shooting. Special prosecutor Kari Morrissey has claimed that the rookie armorer was attempting to conceal evidence that she was impaired during filming.
In court documents obtained by The Blast, Kari Morrissey quoted several text messages between Hannah Gutierrez-Reed and others that allegedly make references to cocaine and marijuana. However, the armorer's legal team has argued that the claims are speculative and felt that drug claims may raise the likelihood that potential jurors will convict her on the involuntary manslaughter charges she is also facing.
Although Judge Sommer declined to sever the two counts, she did ask prosecutors to limit the references to the armorer's drug and alcohol use at the trial, stating that some of the state’s proposed evidence would be “unfair to the defendant."
In addition to the drug charges, special prosecutor Kari Morrissey asked a judge to exclude a report from the Occupational Safety and Health Administration (OSHA), which blamed the production company for relaxed safety standards on set. Hannah Gutierrez-Reed's legal team is hoping to use the report during the trial in order to redirect blame from the armorer to the production company. In the end, Judge Summer decided that the OSHA report would be allowed into evidence during the trial.
However, Judge Sommer will not allow Jason Bowles to call an expert witness on safety standards in union productions, as this witness only came forward within the last ten days. When prosecutors argued that they had no time to prepare for this new witness, Jason Bowles proposed that the trial could be delayed.
However, Judge Sommer stayed firm that the trial, already delayed from December 2023, will begin on February 21, 2024, as planned.

A plethora of cast and crew from the “Rust” production are being summoned as witnesses for Alec Baldwin‘s trial, including its helmer Joel Souza who was present on set during filming.
On February 24th, Baldwin will be making his initial appearance in court electronically after being charged with two counts of involuntary manslaughter for the demise of cinematographer Halyna Hutchins.
Court documents acquired by Fox News Digital name camera assistant Lane Luper and gaffer Serge Svetnoy as witnesses of the incident on the set of “Rust” – both have previously voiced their concerns about its lack of safety.
Luper resigned from his job on the production of “Rust” prior to the fatal shooting incident.
“What I put in my resignation letter was lax COVID policies, the housing situation driving to and from Albuquerque, and specifically, gun safety, a lack of rehearsals, a lack of preparing the crew for what we were doing that day,” Luper previously said during an appearance on “Good Morning America” in Nov. 2021.
Svetnoy also verified the danger that exists on set.
During a press conference months after the shooting, Svetnoy’s attorney told reporters that the movie’s producers “were cutting too many corners to save money” and that negligence on set led to Hutchins’ death.
Rounding out the list are Jensen Ackles, actor; Mamie Mitchell, script supervisor; Seth Kenney, owner of prop store; Gabrielle Pickle, line producer and Sarah Zachry, prop master.
In addition, a group of investigators from Santa Fe County led by Sheriff Adan Mendoza are listed, alongside FBI analysts and experts.
Astoundingly, assistant director David Halls was absent from the witness list. The first assistant director agreed to accept culpability for his actions and plead guilty to negligent use of a deadly weapon; now awaiting confirmation by a judge.
Halls allegedly handed Baldwin the gun before the fatal shooting of Hutchins and confirmed it was “cold,” meaning no live ammunition.
On January 31st, according to court documents, the formal charges against Baldwin and Gutierrez-Reed were two counts of involuntary manslaughter.
In the same documents, prosecutors provided a comprehensive overview of their probable cause against Baldwin.
“Baldwin’s deviation from known standards, practice and protocol directly caused the fatal death of Hutchins,” the documents state.
“By not receiving the required training on firearms, not checking the firearm with the armorer, letting the armorer leave the firearms in the church without being present, deviating from the practice of only accepting the firearm from the armorer, not dealing with the safety complaints on set and/or making sure safety meetings were held, putting his finger on the trigger of a real firearm when a replica or rubber gun should have been used, pointing the firearms at Hutchins and Souza, and the overall handling of the firearms in a negligent manner, Baldwin acted with willful disregard for the safety of others and in a manner which endangered other people, specifically Hutchins and Souza.”
On October 21, 2021, tragedy struck when a gun held by Baldwin discharged on the set of a church at Bonanza Creek Ranch in New Mexico. The incident resulted in the death of Hutchins.
Over the past year, the Santa Fe County Sheriff’s Department has been diligently looking into how live ammunition wound up on set. Gutierrez-Reed and Halls were supposedly two of only a few individuals that managed the firearm.
Before Halls is said to have provided Baldwin with the gun, Gutierrez-Reed spun the cylinder so that Halls could see it contained bullets, her lawyer reported.
In a primetime interview and again in a podcast episode, Baldwin strongly declared that he had not pulled the trigger of the gun. Initially indicating that he had only cocked it back as far as possible then let go, his story remains unaltered ever since.

Uvalde school shooting hits home for Jensen Ackles: 'It's scary, and it doesn't need to happen'
Last October, Jensen Ackles was in New Mexico filming the Western "Rust" when cinematographer Halyna Hutchins was killed on set. And now another tragedy closer to home – the school shooting in Uvalde, Texas – has deeply affected the actor.
As a performer who loves action and adventure, Ackles, 44, has wielded firearms onscreen – most recently as demon-hunting Dean Winchester on CW’s long-running show “Supernatural” and  in his newest gig, as superhero Soldier Boy on Season 3 of “The Boys” (streaming Friday on Amazon Prime). And he understands that “tragedies happen constantly.”
But what occurred last week in Uvalde – where a gunman killed 19 children and two teachers at an elementary school – “shook me more as a dad than what happened right before my eyes, because that was premeditated. And what happened on ‘Rust’ was an accident,” says the Texas native, who lives in Austin with his family (wife Danneel, 9-year-old daughter Justice and 5-year-old twins Arrow and Zeppelin).
Last year, Ackles was working on “Rust” with actor/producer Alec Baldwin when, during a rehearsal, Baldwin discharged a replica Colt that killed 42-year-old Hutchins and injured director Joel Souza. The incident immediately shuttered production on the film and sparked a series of lawsuits. In April, New Mexico's Occupational Health and Safety Bureau issued a report blasting "Rust" producers for "plain indifference" and noted they "willfully violated" known industry safety protocols in imposing a nearly $137,000 fine for firearms safety failures.
“You can chalk it up to negligence or try to point a finger at anybody," Ackles tells USA TODAY. "At the end of the day, it was a horrible, horrible accident that ended with a life. Unfortunately, those do happen all the time around the world everywhere. You don't normally witness them like I did, and it's certainly shocking and jarring. It makes you value life even more than you had."
In a Hollywood Reporter interview last month, “Rust” producer Anjul Nigam said he expects to finish the film after an investigation into the shooting is completed, but “I'd be pretty shocked if that happened," Ackles says. "Time has passed now (and) everybody's kind of moved on, which is very unfortunate because I would've loved for the world to see what Halyna was doing.
“We were only about a week and a half away from being done with that film, so there was a lot of footage in the can and she was doing something really exceptional,” he says. “She was an incredible talent, and I wish there was some way to get it out there to the masses, but I don't know that that's possible.”
Weighing more heavily on his heart and mind these days are "the school shootings, the church shootings and the grocery store shootings,” Ackles says. “That's a whole conversation that is certainly being had and needs to be had in a wide variety of ways.
“My 5-year-old twins graduated from preschool (last Thursday). It was weird, because I was celebrating them and excited for them. But at the same time, in the back of my head, I was like, ‘I’m glad I don't have to put my kids back in school for the next however long.’ It's scary and it doesn't need to happen.”

how common is the armourer just saying cold gun and everybody trusting them vs them actually showing people where the bullet isn't?
Well, I can't say for sure because I can only speak from experience, but in my experience, no armorer I've worked with has said "cold gun" and then gone around to show every person that the gun is empty. I just trust the armorer has done their job.
But I think that is common for literally any workplace. When a boss hires a person to do a job, then it is expected that person knows what they're doing and does it correctly every time (or helps manage them if something isn't working). If a boss hasn't done that, or they hinder the job because they don't like the process of how the job gets done (too many regulations/too many parts/too slow), then its not fully the fault of the person they hired. Its also the fault of the person who put them in that position in the first place.
So yeah, if an armorer hasn't done their job, that sucks majorly, but that also means the producers who hired them and the directors who manage them also didn't do their jobs and should take responsibility

Some critic had some harsh words for the movie calling it subpar. It is a good movie. Very clever kind of western. Atypical in some ways. Ambiguous morality. It's a little like True Grit, but a curious character personality you don't see in westerns.
It's Nicolas Cage's first western. He should do another.
TRIVIA:
The armorer on the shoot was Hannah Gutierrez-Reed, who was blamed for a number of unsafe activities by the assistant director and Cage and was nearly thrown off the set. She was the armorer on Rust (which was shot after The Old Way in 2021) and is being investigated for the death of Halyna Hutchins and injury to Joel Souza on that set due to unsafe firearm handling.
After the second time in 3 days of Gutierrez-Reed testing a weapon near everyone else unexpectedly, Cage yelled -- "Make an announcement, you just blew my fucking eardrums out!" Then, he stormed off.
