The Supreme Court on Friday dismissed the Federal Government’s appeal to overturn the Court of Appeal’s decision which cleared former Minister of Niger Delta Affairs, Godsday Orubebe, of false asset declaration. In 2015, Orubebe was arraigned for not disclosing his properties in the asset declaration forms submitted to the Code of Conduct Bureau during his tenure as a minister from 2007 to 2011. The offence was said to be contrary to Section 15 of the Code of Conduct Bureau and Tribunal Act Cap 15 Laws of the Federation of Nigeria, 2004, and punishable under Section 23(2) of the same Act. He, however, pleaded not guilty to the charge preferred against him. Orubebe said he did not declare the plot of land as his asset in 2011 because he had sold it to his landlord before he made the last asset declaration while leaving office. But the Code of Conduct Tribunal ordered that the property which the former minister failed to declare be forfeited to the Federal Government. Orubebe subsequently challenged the tribunal’s judgment at the Court of Appeal. The appellate court in its judgment upturned the decision of the tribunal which had earlier convicted the former minister and confiscated the undeclared asset. The Federal Government, not satisfied with the appellate court’s decision, filed an appeal at the apex court. Reading the lead judgment, Justice Emmanuel Agim, said the appeal was incompetent. By • Olalekan Fagbade You can’t scrap Niger Delta ministry, Group warns President Tinubu   The Board of Trustees (BoT) of the Pan Niger Delta Forum (PANDEF) has warned President Bola Ahmed Tinubu against scrapping the ministry of Niger Delta Affairs. The forum said this in a communiqué signed by its National Leader, Chief Edwin Clark and National Chairman, Senator Emmanuel Ibok Essien. It was issued at the end of their meeting in Abuja on Friday. The forum said the Ministry was created by late President Umaru Musa Yar’Adua and sustained by the successive administrations of President Goodluck Jonathan and Muhammadu Buhari and must continue to function. The forum asked Tinubu to nominate a minister for Niger Delta Affairs, threatening that scrapping the ministry would be met with “adverse consequences.”   The communiqué reads in part, “The meeting discussed issues pertaining to the ongoing appointment and assignment of ministers, as it affects the states of the Niger Delta region and South South geo-political zone, particularly, the omission of the ministry of Niger Delta Affairs. The meeting resolves as follows: “Expresses great surprise that in the published assignment of ministers to their various cabinet portfolios, there is none designated for the existing ministry of Niger Delta Affairs. “Reminds Mr. President that the Ministry of Niger Delta was created, specifically, to focus on infrastructural development, environmental protection and empowerment of youths in the oil-rich Niger Delta region, which continues to be greatly impacted by the oil and gas industry, and remains the live-wire of the national economy. “That the ministry which was created by President Umaru Musa Yar’Adua in 2008, and was sustained under his two immediate predecessors (Goodluck Jonathan and Muhammadu Buhari) to help advance the course of the peace in the Niger Delta region. ad “Cautions that any misguided step towards scrapping or submerging the ministry, will create an unfavorable environment with adverse consequences. “Further cautions the federal government to desist from tampering with any institution(s), which along with the Ministry of Niger Delta Affairs, have been flagship institution(s), to ensure peace and development in the Niger Delta region. “We are hopeful that the federal government will be properly advised on this matter, even as we reiterate the commitment of the leadership of PANDEF and the people of the region to enduring the reign of peace and stability in the overall interest of country.” Shortly after President Tinubu was sworn in, former Senate Chief Whip, Orji Uzor Kalu, urged him to scrap the Ministry of Niger Delta Affairs, saying it was a duplication of the Niger Delta Development Commission (NDDC). “Some of the ministries and parastatals that are no longer viable like the Ministry of Niger Delta Affairs and some other ministries that are not viable should be scrapped. “We have the Niger Delta Development Commission like we have the North East Development Commission. So the Ministry of Niger Delta should be scrapped,” he had said. [caption id="attachment_37540" align="alignnone" width="1000"] N/Delta minister, Umana[/caption] The group futher cautioned the minister not to cause unnecessary confusion with the appointment as his choice is not the most senior director. The minister subsequently announced Mr. Emmanuel Audu-Ohwavborua, to perform the duties of the managing director in acting capacity pending the appointment of a substantive Managing Director and members of the Governing Board. But in a statement signed Thursday in Abuja by its coordinator, Barr. Preye Johnson, the group said the director appointed by the Minister to succeed the sacked administrator "is not the most senior director as directed by the President. In fact, there are two most senior directors ahead of him." The forum named the said most qualified senior directors to include Seigha Glasgow and Prince Alazigha. The South-south forum, however threatened to drag the minister to Court if the right thing is not done based on the directive of President Muhammadu Buhari. According to forum, if the injustice melted against the most senior directors are not corrected there will be no proper growth in the the Commission and the most senior directors will be disrespected. The statement also urged the Central Bank of Nigeria (CBN) not to recognise and allow for the change of signature Mr. by Emmanuel Audu-Ohwavborua. The statement said: "As a frontline forum of professionals in the Niger Delta, we are using this medium to call on the Minister of Niger Delta Affairs, Mr. Umana Okon Umana, to do the right thing and avoid unnecessary confusion at the NDDC by appoint the most senior director as directed by Mr. President. "We are making this call because the appointment of Mr. Emmanuel Audu-Ohwavborua is in contrary to the directive of the President and it is in the public knowledge that there are two most senior directors ahead of Mr. Mr. Emmanuel Audu-Ohwavborua. "We hereby call on the Governor of Central Bank of Nigeria (CBN) not to recognise or allow for the change of signature by Emmanuel Audu-Ohwavborua as the acting Managing Diractor of NDDC because he is not the most senior Director in the Commission as stated in the letter signed by the Ministry of Niger Delta and dated 20th October 2022. "Apart from the CBN, we call on the National Assembly not to have anything to do with the leadership of Mr. Emmanuel Audu-Ohwavborua as NDDC's acting helmsman. "We also warn that if the right thing is not done we shall have no option than to approach the Court of Law to correct the injustice," the statement said.
