A New York City directive allowing first responders to enforce a state law that allows them to potentially involuntarily commit people experiencing a mental health crisis can proceed after facing legal challenges by mental health advocates, a judge has ruled.
The ruling, issued Monday by U.S. District Judge Paul Crotty in the Southern District of New York, denied a motion brought by individuals and mental health organizations in December. The legal challenge asked a judge to issue a temporary restraining order and preliminary injunction against the city’s implementation of the policy.
The motion was filed on December 8 as part of an existing lawsuit that alleges New York City has consistently failed to provide safe and appropriate care to New Yorkers experiencing mental health crises. The plaintiffs argued the city’s plan is unconstitutional and violates an individual’s “freedom to live without unlawful seizures and excessive force by law enforcement.”
New York City Mayor Eric Adams first announced the directive in November as part of an attempt to address concerns about homelessness and crime.
Adams said it was a myth that first responders can only involuntarily commit those who displayed an “overt act” showing they may be suicidal, violent or a danger to others, CNN previously reported. Instead, he said the law allowed first responders to involuntarily commit those who cannot meet their own “basic human needs” – a lower bar.
New York Lawyers for Public Interest, a non-profit civil rights law firm, said in a statement to CNN it was disappointed by the court’s ruling.
“The rights of New Yorkers with mental disabilities, particularly those who are unhoused, remain imperiled by the city’s new involuntary removal policy. Our litigation challenging the city’s use of New York Police Department officers as first responders when someone is experiencing a mental health crisis continues,” reads the statement from the firm, which was one of the plaintiffs in the December lawsuit.
Nicholas Paolucci, the director of public affairs at the New York City Law Department, said in a statement to CNN that the defendants are “pleased the court agreed plaintiffs have no legal standing to halt the Mayor’s sound and compassionate plan.”
NEW YORK CITY’S PLAN DRAWS CRITICISM
As part of the city’s plan, New York Police Department officers and first responders will get additional training to help them make such evaluations and a team of mental health technicians will be available, either via a hotline or video chat, to help them determine whether a person needs to be taken to a hospital for further evaluation, CNN previously reported.
The city also plans to develop specialized intervention teams to work side by side with NYPD officers.
Adams said first responders weren’t consistently enforcing the law because they were unsure of its scope, reserving it only for cases that appeared the most serious.
New York state enacted a law in 2021 to allow first responders to involuntarily commit a person with mental illness who needs immediate care. The directive led to a mixed response from officials, who acknowledged the challenges of properly and humanely treating mentally ill people.
“This is a longstanding and very complex issue,” NYPD Commissioner Keechant Sewell said in a statement. “We will continue to work closely with our many partners to ensure that everyone has access to the services they require. This deserves the full support and attention of our collective efforts.”
Mental health advocates argued in their legal challenge that the city’s policy will authorize officers with “little to no expertise in dealing with individuals with mental disabilities…to determine whether an individual should be forcefully – often violently – detained against their will.”
“If the Involuntary Removal Policy is permitted to continue to be implemented, Plaintiffs and countless other New Yorkers will suffer irreparable harm, including a substantially increased likelihood that they will be subjected to unlawful detention and involuntary hospitalization just for exhibiting behavior perceived by a police officer to be unusual – whether the individual has a mental disability or not,” the advocates’ December motion stated.

"Research on a police diversion program implemented in 2014 shows a striking 91% reduction in in-school arrests over less than 10 years.
Across the United States, arrest rates for young people under age 18 have been declining for decades. However, the proportion of youth arrests associated with school incidents has increased.
According to the U.S. Department of Education, K–12 schools referred nearly 230,000 students to law enforcement during the school year that began in 2017. These referrals and the 54,321 reported school-based arrests that same year were mostly for minor misbehavior like marijuana possession, as opposed to more serious offenses like bringing a gun to school.
School-based arrests are one part of the school-to-prison pipeline, through which students—especially Black and Latine students and those with disabilities—are pushed out of their schools and into the legal system.
Getting caught up in the legal system has been linked to negative health, social, and academic outcomes, as well as increased risk for future arrest.
Given these negative consequences, public agencies in states like Connecticut, New York, and Pennsylvania have looked for ways to arrest fewer young people in schools. Philadelphia, in particular, has pioneered a successful effort to divert youth from the legal system.
Philadelphia Police School Diversion Program
In Philadelphia, police department leaders recognized that the city’s school district was its largest source of referrals for youth arrests. To address this issue, then–Deputy Police Commissioner Kevin Bethel developed and implemented a school-based, pre-arrest diversion initiative in partnership with the school district and the city’s department of human services. The program is called the Philadelphia Police School Diversion Program, and it officially launched in May 2014.
Mayor-elect Cherelle Parker named Bethel as her new police commissioner on Nov. 22, 2023.
Since the diversion program began, when police are called to schools in the city for offenses like marijuana possession or disorderly conduct, they cannot arrest the student involved if that student has no pending court case or history of adjudication. In juvenile court, an adjudication is similar to a conviction in criminal court.
Instead of being arrested, the diverted student remains in school, and school personnel decide how to respond to their behavior. For example, they might speak with the student, schedule a meeting with a parent, or suspend the student.
A social worker from the city also contacts the student’s family to arrange a home visit, where they assess youth and family needs. Then, the social worker makes referrals to no-cost community-based services. The student and their family choose whether to attend.
Our team—the Juvenile Justice Research and Reform Lab at Drexel University—evaluated the effectiveness of the diversion program as independent researchers not affiliated with the police department or school district. We published four research articles describing various ways the diversion program affected students, schools, and costs to the city.

Arrests Dropped
In our evaluation of the diversion program’s first five years, we reported that the annual number of school-based arrests in Philadelphia decreased by 84%: from nearly 1,600 in the school year beginning in 2013 to just 251 arrests in the school year beginning in 2018.
Since then, school district data indicates the annual number of school-based arrests in Philadelphia has continued to decline—dropping to just 147 arrests in the school year that began in 2022. That’s a 91% reduction from the year before the program started.
We also investigated the number of serious behavioral incidents recorded in the school district in the program’s first five years. Those fell as well, suggesting that the diversion program effectively reduced school-based arrests without compromising school safety.
Additionally, data showed that city social workers successfully contacted the families of 74% of students diverted through the program during its first five years. Nearly 90% of these families accepted at least one referral to community-based programming, which includes services like academic support, job skill development, and behavioral health counseling...
Long-Term Outcomes
To evaluate a longer follow-up period, we compared the 427 students diverted in the program’s first year to the group of 531 students arrested before the program began. Results showed arrested students were significantly more likely to be arrested again in the following five years...
Finally, a cost-benefit analysis revealed that the program saves taxpayers millions of dollars.
Based on its success in Philadelphia, several other cities and counties across Pennsylvania have begun replicating the Police School Diversion Program. These efforts could further contribute to a nationwide movement to safely keep kids in their communities and out of the legal system."

sally and paul were enjoying a peaceful night in. you should probably note the past tense. estella was over at a friends house and percy had taken you out on a date, something about an aquarium that they hadn't cared to grill him about. the pair were cuddled up on the couch, some movie playing in the background that they didn't care to listen to as they just talked to each other, enjoying the company of their lover more than anything. the house phone rang and they both looked over at it but ultimately shurgged. if percy or estella needed something, they wouldn't even think to call the house phone. sally wasn't even sure percy knew the number. so they let it go to voicemail, which was set to play on speaker, in case it was another call from one of percy or estella's schools or something important.
"Hello. This is a call from The New York City Police Department for inmate Percy Jackson. Say Yes if you would like to accept the call."
instantly, sally and paul were jumping for the phone, basically screaming 'yes' at the damn thing. there was a pause and then a clicking and they could hear the sound of breathing on the other end along with the faint sound of your voice. oh, they were going to kill him for getting their precious moonchild in trouble.
"mom? are you there?" percy asked through the phone and sally sighed out a breath, as he sounded pretty alright.
"percy, why in your father's name are you calling me from the new york city police department?" sally bit into the phone, paul comfortingly rubbing at her back but it was doing little to ease her anger. percy mutter something that sally didn't catch and she was about to rip him a new one when there was a shuffling on the other side of the phone, percy's whining voice growing faint
"shut up, you're just gonna get us in more trouble," your voice hissed, despite trying to muffle the phone sally and paul heard you loud and clear, "percy and i broke into sea world. we would have made it out had somebody not insisted we stop by the gift shop."
"if i ever go to an aquarium and not stop at the gift shop, that's not me, i've been replaced by aliens!" percy's voice spoke, clearly having yanked the phone back from you only for you to tug it back from him.
"we did not go to an aquarium, percy, we broke into an aquarium," you huffed at the boy, but sally could hear the smile in your voice. and she knew you weren't passive in this ordeal. just as troublesome as her son. paul had already grabbed their jackets and her purse, waiting by the door for the call to end.
"okay, listen up, you two, and listen good. this is your one 'get out of jail free card', okay? literally, getting out of jail free. paul and i are going to take the longest way we can, walking at the pace of snails, you hear? you're going to hang out in the jail for as long as i can make happen, got it?" sally stated, firmly and without argument.
"thanks, mom!" percy mused into the phone and she couldn't help but smile at the sound of her son's voice, forgetting for a moment that he was in jail.
"thanks, mrs. jackson!" you followed suit and sally could hear the beaming smile in your voice.
"of course," she sighed into the phone before hanging up, sharing a look with paul before the two burst into laughter.
"sea world?? they broke- they broke into sea world??" cackled paul, struggling to get the words out through his laughs. sally joined him, using their linked arms to keep her upright.
"i've raised an idiot! a complete idiot. goodness, i love that boy," sally hummed, smiling despite herself.
true to her word, it took her and paul nearly two and half hours to reach the police station, when if she had wanted to she could have made it in forty minutes. she and paul walked into the jail, paying the relatively small bail, before being lead back towards the jailcells. sally's heart melted at the sight and she urged paul to take a picture, her hand placed over her heart as she smiled at the sight.
you and percy were slumped against each other behind the bars, matching dusty sea world shirts on. your head was resting against percy's shoulder, your nose slightly scrunched, and percy's head was placed on top of your own, drool slowly dripping from his mouth into your hair. where your two bodies were pressed together, your interlocked hands rested, firmly wrapped and tangled together like seaweed in a torrential bay. or like comets dancing around each other, shooting past a bright moon and going deeper into space together.

Follow up to the situation
The New York situation brought together Ohio, Delaware, and Maryland.
I saw the entire situation in 2007 via losing control of my mind through anxiety, panic attacks, and mental health issues, and when I opened my first Citibank account.  I did not know how it was going to play out in reality.  In 2022, Social Security Administration little mini conscious voice stated send the money the Citibank.

Please note I read all the paperwork fast to see everything.  If convicted of the initial charge, the following additional charges are hidden, but logged New York City – Make Terroristic Threat (Felony) carries ten (10) years and New York State – Make Terroristic Threat (Felony) times two carrying twenty (20) years total.  This is all for a one-time event to an unknown person and well-known organization who created the problem.  This also brings in Maryland again for my first felony (this will be further discussed in Journal Entry #62 – I alluded to it in my mental health and hospital journal entries). Think back to the question Teachers, Managers, and Executives, ask the question, “What do you want to be in ten (10) years?”  For my life, if I started out as nothing and did not dream of becoming anything, then examine the families are nothing, and the United States of America system does work to ensure I become nothing in reality with all the barriers and keep doing me thinking something else to f*ck up my life comes out.  These ideals are being pushed onto neutral countries.
Like I said, “Give me my United States passport, the European visa, and plane ticket in year 2029 or 2030, there will be no real problems.” 
The academic and medical research was already done before I was born, the academic and medical research still proves the same thing today, and the academic and medical research proves the exact result in the future if United States of America does not let me go.  The books of George Washington did not say he killed anyone even though he is revered to lead other people to kill others.  The books of Martin Luther King, Jr. did not say he killed anyone. The books of Malcolm X did not say he killed anyone.  Without sitting in front of television, watching youtube, or watching a movie all day, show me the other way…hmmm...phff.  United States of America better do everybody from age 12 and above since law is first.
September 28, 2022 - Court date. Judge Decision and District Attorney Message - "Case dismissed and sealed", which means the record remain there forever, no expungement.  I said, "Thank you." and Judge stated, "Stay out of trouble."
I logged on the New York Courts eWeb systems to find the case and it is no longer there.  My attorney did advise that the Certificate of Disposition should be available the next day or thereafter.
Thanks to the staff of The Legal Aid Society of New York for serving as my pro bono attorney. Great job and excellent work.  I hope I did not share too much medical and health information.
This New York situation did take 90% of my current W2 and 1099 employment opportunities away due to background checks.
New York eliminated three of my major tasks in and for the United States - voting, blood donation (diamond platinum O+ blood), and physically seeing the city and state itself.
