A top House Democrat has reintroduced a bill to federally legalize, tax and regulate marijuana, with provisions to expunge prior cannabis convictions.

Rep. Jerrold Nadler (D-NY), ranking member of the House Judiciary Committee, refiled the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act on Wednesday. There are 33 initial cosponsors—all Democrats.

The comprehensive legalization legislation has passed the House twice in recent sessions—but this marks the first time it’s being introduced with Republicans in control of the chamber, raising serious questions about whether it will move. The Judiciary Committee, which is the primary panel of jurisdiction, is chaired by anti-cannabis Rep. Jim Jordan (R-OH).

Even the prospects of a modest marijuana banking bill that’s set for committee action in the Senate next week are uncertain in the House under the GOP majority. That said, a GOP-led House panel did advance legislation on Wednesday to prevent the denial of federal employment or security clearances based on a candidate’s past cannabis use.

In any case, advocates have long touted the MORE Act as an example of the type of wide-ranging cannabis reform legislation that would not only end prohibition but take steps to right the wrongs of prohibition and promote social equity.

Here are details about the key provisions of the MORE Act:

“Nadler’s MORE Act would deschedule marijuana by removing it from the list of federally banned drugs under the Controlled Substances Act (CSA). However, it would not require states to legalize cannabis and would maintain a level of regulatory discretion up to states.

Marijuana products would be subject to a federal excise tax, starting at 5% for the first two years after enactment and rising to 8% by the fifth year of implementation.

Nobody could be denied federal public benefits based solely on the use or possession of marijuana or past juvenile conviction for a cannabis offense. Federal agencies couldn’t use 'past or present cannabis or marijuana use as criteria for granting, denying, or rescinding a security clearance.'

People could not be penalized under federal immigration laws for any cannabis related activity or conviction, whether it occurred before or after the enactment of the legalization legislation.

The bill creates a process for expungements of non-violent federal marijuana convictions.

Tax revenue from cannabis sales would be placed in a new 'Opportunity Trust Fund.' Half of those tax dollars would support a 'Community Reinvestment Grant Program' under the Justice Department, 10% would support substance misuse treatment programs, 40% would go to the federal Small Business Administration (SBA) to support implementation and a newly created equitable licensing grant program.

The Community Reinvestment Grant Program would 'fund eligible non-profit community organizations to provide a variety of services for individuals adversely impacted by the War on Drugs…to include job training, reentry services, legal aid for civil and criminal cases (including for expungement of cannabis convictions), among others.'

The program would further support funding for substance misuse treatment for people from communities disproportionately impacted by drug criminalization. Those funds would be available for programs offering services to people with substance misuse disorders for any drug, not just cannabis.

While the bill wouldn’t force states to adopt legalization, it would create incentives to promote equity. For example, SBA would facilitate a program to providing licensing grants to states and localities that have moved to expunge records for people with prior marijuana convictions or 'taken steps to eliminate violations or other penalties for persons still under State or local criminal supervision for a cannabis-related offense or violation for conduct now lawful under State or local law.'

The bill’s proposed Cannabis Restorative Opportunity Program would provide funds 'for loans to assist small business concerns that are owned and controlled by individuals adversely impacted by the War on Drugs in eligible States and localities.'

The comptroller general, in consultation with the head of the U.S. Department of Health and Human Services (HHS), would be required to carry out a study on the demographics of people who have faced federal marijuana convictions, 'including information about the age, race, ethnicity, sex, and gender identity.'

The Departments of Treasury, Justice and the SBA would need to 'issue or amend any rules, standard operating procedures, and other legal or policy guidance necessary to carry out implementation of the MORE Act' within one year of its enactment.

Marijuana producers and importers would also need to obtain a federal permit. And they would be subject to a $1,000 per year federal tax as well for each premise they operate.

The bill would impose certain packaging and labeling requirements.

It also prescribes penalties for unlawful conduct such as illegal, unlicensed production or importation of cannabis products.

The Treasury Secretary would be required to carry out a study 'on the characteristics of the cannabis industry, with recommendations to improve the regulation of the industry and related taxes.'

The Bureau of Labor Statistics (BLS) would be required to 'regularly compile, maintain, and make public data on the demographics' of marijuana business owners and workers.

Workers in 'safety sensitive' positions, such as those regulated by the Department of Transportation, could continue to be drug tested for THC and face penalties for unauthorized use. Federal workers would also continue to be subject to existing drug testing policies.

References to 'marijuana' or 'marihuana' under federal statute would be changed to 'cannabis.' It’s unclear if that would also apply to the title of the bill itself.”

Some advocates say that the MORE Act’s time has passed, however, and that it doesn’t realistically grapple with the need to enact truly justice-focused legalization through a fair and equitable market.

“The MORE Act was never meant to be a bill to address the real needs of federal regulations,” Shaleen Title, founder and director, Parabola Center for Law and Policy, told Marijuana Moment. “It was a historic bill when it was first introduced to address systemic racial disparities and demonstrate that social justice must be addressed in federal reform, but has never fully addressed the economic justice side of the equation.”

“We’re in a period of rapid corporate consolidation, with a real possibility that big pharmaceutical corporations will be entering the industry in the near future,” she said. “Outdated legalization bills like this would quickly allow for monopolization, putting small farmers and mom-and-pop shops out of business and undermining the public health and racial equity goals of most state cannabis programs. They should all be updated with an intentional regulatory structure and a thoughtful plan to transition to a national market.”

The Biden administration will renominate a board member at an anti-Israel group to help lead the Small Business Administration, one year after the nominee was blocked by Republicans, according to the Wall Street Journal.

Dilawar Syed served on the board of Emgage Action—a group that describes Israel as an "apartheid state" and defends the anti-Israel Boycott, Divestment, and Sanctions movement—until at least 2021, when President Joe Biden nominated him as deputy administrator at the SBA, according to federal disclosure records.

Syed is one of 85 failed nominees whom the Biden administration is resubmitting for confirmation by the new Senate, the Journal reported on Tuesday.

Syed’s affiliation with Emgage raised concerns among Republican legislators and pro-Israel leaders, who blocked his nomination in September 2021. Since last February, Syed has served as a special representative for trade at the State Department, a position that doesn’t require Senate approval.

Emgage has accused the Jewish state of instituting a "racist, undemocratic Israeli apartheid rule that steals [Palestinian] land and destroys their homes to make way for illegal Jewish settlements" and said it "support[s] the right to boycott, divest, and sanction, as well as the Right of Return of Palestinians."

The group also lobbied against legislation that would penalize boycotts of the Jewish state and called the BDS movement a "constitutionally protected nonviolent response that seeks to end the occupation."

Syed told legislators during his unsuccessful confirmation process that he doesn’t support the BDS movement. But Republicans questioned his affiliation with Emgage and his refusal to commit to recovering $100 million in federal COVID relief funding that they say was illegally distributed to abortion provider Planned Parenthood.

Tom Jones, the founder of the American Accountability Foundation watchdog group, told the Washington Free Beacon in September 2021 that Syed’s involvement with Emgage, "paired with his lack of a commitment to recover PPP funds illegally allocated to Planned Parenthood, should immediately disqualify him as deputy administrator of the Small Business Administration."

Other failed Biden administration picks who will be renominated include former Los Angeles mayor Eric Garcetti as ambassador to India and Danny Werfel as IRS commissioner, according to the Journal.

A federal judge on Thursday ordered the Small Business Administration to release details on coronavirus pandemic-related loans that would disclose information on businesses that benefited from $717 billion in federally backed borrowings.

The judge ordered the agency to disclose all the names, addresses and precise loan amounts issued through the Paycheck Protection Program and Emergency Injury Disaster Loan program. The decision comes after a lawsuit was filed by a dozen news organizations, charging that the agency was not fulfilling its obligations under the Freedom of Information Act.

The SBA had previously released only summarized and anonymized data for PPP loans under $150,000 — which account for about 4.5 million of the 5.2 million in total loans made — claiming they would violate borrowers’ privacy by revealing the size of their payroll.

When the SBA denied the FOIA requests by news agencies, it argued that releasing government loan information would reveal business and personal information that should be kept private.

Federal Judge James Boasberg rejected those claims, saying in his ruling that, “the significant public interest in shedding light on SBA’s administration of the PPP and EIDL program dramatically outweighs any limited private interest in nondisclosure.” The judge discounted the SBA’s claim that the size of a loan would reveal a company’s payroll, calling the assertion “fundamentally flawed.”

He noted “the PPP loan application expressly notified potential borrowers — admittedly in a form disclaimer — that their names and loan amounts would be ’automatically released’ upon a FOIA request,” and criticized the agency for offering “a series of arguments that essentially all reduce to the unavailing contention that the agency did not mean what the loan-application forms actually said.”

The SBA had no comment, agency spokesperson Jim Billimoria said in an email to NBC News. The Justice Department, representing the agency in the lawsuit, did not reply to requests for comment and whether the Trump administration plans to appeal the ruling.

“In response to the unprecedented challenges faced by small businesses this year, the Trump administration provided more than three-quarters of a trillion dollars in financial assistance to support impacted small businesses," SBA Administrator Jovita Carranza said in a recent release. "SBA lending data further reflects the extraordinary commitment this administration has made to supporting entrepreneurs in underserved communities.”

Nearly 30 percent of the PPP loans were made in low-and moderate-income communities and over 15 percent were approved for rural communities, according to the agency.

Government watchdog groups welcomed the release and pledged to begin scrutinizing the data once released.

“From the beginning, the Trump administration did everything in its power to hide the recipients of PPP loans,” Jeremey Funk, spokesman for Accountable.us, a progressive government watchdog group, told NBC News in an email. “As soon as the administration abides by the court order and releases all data, we will scour it to see whether more Trump administration officials and family members — and other well-connected folks — than previously known received the loans.”

The data was released following a FOIA request filed by 11 news organizations, including NBC News, The Washington Post and The New York Times, and was consolidated with a separate lawsuit filed by the Center for Public Integrity, a DC-based investigative journalism nonprofit.

News organizations had mined the limited data released in July to reveal loans given to those connected with the Trump administration and how Black-owned businesses appeared to have greater difficulty getting SBA aid.

Report: Live Nation Subsidiaries Received $19 Million from Save Our Stages Act

- “I did not want Live Nation getting a nickel,” Rep. Peter Welch (D-Vt.) tells Washington Post

Despite lawmakers’ express intent, venues partially owned by Live Nation received some $19 million from the Shuttered Venue Operators Grant program, The Washington Post reports.

Live Nation holds a minority stake in the venues in question that received a share of the $15 billion in the emergency-relief act known colloquially as Save Our Stages. No laws appear to have been broken. But sponsors, including Sen. Amy Klobuchar (D-Minn.), didn’t want Live Nation to benefit.

“It’s true it (the legislation) doesn’t include Live Nation venues, because they have such a vast empire with the ticketing and things,” she said in 2020.

That sentiment hasn’t changed since the legislation designed to help small, independent venues weather the pandemic and lack of performances it necessitated was passed.

“When we wrote this, we specifically didn’t want these publicly traded companies - Live Nation foremost among them - to get their hands on this money,” Rep. Peter Welch (D-Vt.), told the Post. “I did not want Live Nation getting a nickel.”

In a statement to the Post, Live Nation reiterated it does not have a majority stake in any of the benefiting venues and pointed out the Small Business Administration approved the funds.

“These entities control their own day-to-day operations, and the folks running these small businesses used every resource legally available to them to support their employees through this crisis, which was not only their right but also an entirely understandable and human thing to do,” it said.

A little more than two years ago, on July 9, 2021, President Biden signed an executive order to promote competition in the U.S. economy. Echoing the language of his predecessors, he said, “competition keeps the economy moving and keeps it growing. Fair competition is why capitalism has been the world’s greatest force for prosperity and growth…. But what we’ve seen over the past few decades is less competition and more concentration that holds our economy back.”

In that speech, Biden deliberately positioned himself in our country’s long history of opposing economic consolidation. Calling out both Roosevelt presidents—Republican Theodore Roosevelt, who oversaw part of the Progressive Era, and Democrat Franklin Delano Roosevelt, who oversaw the New Deal—Biden celebrated their attempt to rein in the power of big business, first by focusing on the abuses of those businesses, and then by championing competition.

Biden promised to enforce antitrust laws, interpreting them in the way they had been understood traditionally. Like his progressive predecessors, he believed antitrust laws should prevent large entities from swallowing up markets, consolidating their power so they could raise prices and undercut workers’ rights. Traditionally, those advocating antitrust legislation wanted to protect economic competition, believing that such competition would promote innovation, protect workers, and keep consumer prices down.

In the 1980s, government officials threw out that understanding and replaced it with a new line of thinking advanced by former solicitor general of the United States Robert Bork. He claimed that the traditional understanding of antitrust legislation was economically inefficient because it restricted the ways businesses could operate. Instead, he said, consolidation of industries was fine so long as it promoted economic efficiencies that, at least in the short term, cut costs for consumers. While antitrust legislation remained on the books, the understanding of what it meant changed dramatically.

Reagan and his people advanced Bork’s position, abandoning the idea that capitalism fundamentally depends on competition. Industries consolidated, and by the time Biden took office his people estimated the lack of competition was costing a median U.S. household as much as $5000 a year. Two years ago, Biden called the turn toward Bork’s ideas “the wrong path,” and vowed to restore competition in an increasingly consolidated marketplace. With his executive order in July 2021, he established a White House Competition Council to direct a whole-of-government approach to promoting competition in the economy.

This shift gained momentum in part because of what appeared to be price gouging as the shutdowns of the pandemic eased. The five largest ocean container shipping companies, for example, made $300 billion in profits in 2022, compared to $64 billion the year before, which itself was a higher number than in the past. Those higher prices helped to drive inflation.

The baby formula shortage that began in February 2022 also highlighted the problems of concentration in an industry. Just four companies controlled 90% of the baby formula market in the U.S., and when one of them shut down production at a plant that appeared to be contaminated, supplies fell dramatically across the country. The administration had to start flying millions of bottles of formula in from other countries under Operation Fly Formula, a solution that suggested something was badly out of whack.

The administration’s focus on restoring competition had some immediate effects. It worked to get a bipartisan reform to ocean shipping through Congress, permitting greater oversight of the shipping industry by the Federal Maritime Commission. That law was part of the solution that brought ocean-going shipping prices down 80% from their peak. It worked with the Food and Drug Administration to make hearing aids available over the counter, cutting costs for American families. It also has worked to get rid of the non-compete clauses which made it hard for about 30 million workers to change jobs. And it began cracking down on junk fees, add-ons to rental car contracts, ticket sales, banking services, and so on, getting those fees down an estimated $5 billion a year.

“Folks are tired of being played for suckers,” Biden said. “[I]t’s about basic fairness.”

Today, the administration announced new measures to promote competition in the economy. The Department of Agriculture will work with attorneys general in 31 states and Washington, D.C. to enforce antitrust and consumer protection laws in food and agriculture. They will make sure that large corporations can’t fix food prices or price gouge in stores in areas where they have a monopoly. They will work to expand the nation’s processing capacity for meat and poultry, and are also promoting better access to markets for all agricultural producers and keeping seeds open-source.

Having cracked down on junk fees in consumer products, the administration is now turning to junk fees in rental housing, fees like those required just to file a rental application or fees to be able to pay your rent online.

The Department of Justice and the Federal Trade Commission today released new merger guidelines to protect the country from mass layoffs, higher prices, and fewer options for consumers and workers. Biden used the example of hospital mergers, which have led to extraordinary price hikes, to explain why new guidelines are necessary.

The agencies reached out for public comment to construct 13 guidelines that seek to prevent mergers that threaten competition or tend to create monopolies. They declare that agencies must address the effect of proposed mergers on “all market participants and any dimension of competition, including for workers.”

Now that the guidelines are proposed, officials are asking the public to provide comments on them. The comment period will end on September 18.

One of the reporters on the press call about the new initiatives noted that the U.S. Chamber of Commerce has accused the Biden administration of regulatory overreach, exactly as Bork outlined in a famous 1978 book introducing his revision of U.S. antitrust policy. An answer by a senior administration official highlighted a key element of the struggle over business consolidation that is rarely discussed and has been key to demands to end such consolidation since the 1870s.

The official noted that small businesses, especially those in rural areas, are quite happy to see consolidation broken up, because it gives them an opportunity to get into fields that previously had been closed to them. In fact, small businesses have boomed under this administration; there were 10.5 million small business applications in its first two years and those numbers continue strong.

This is the same pattern the U.S. saw during the Progressive Era of the early twentieth century and during the New Deal of the 1930s. In both of those eras, established business leaders insisted that government regulation was bad for the economy and that any attempts to limit their power came from workers who were at least flirting with socialism. But in fact entrepreneurs and small businesses were always part of the coalition that wanted such regulation. They needed it to level the playing field enough to let them participate.

The effects of this turnaround in the government’s approach to economic consolidation is a big deal. It is already having real effects on our lives, and offers to do more: saving consumers money, protecting workers’ wages and safety, and promoting small businesses, especially in rural areas. It’s another part of this administration’s rejection of the top-down economy that has shaped the country since 1981.

The Biden administration announced a series of measures Thursday to track down and punish fraudsters who scammed billions of taxpayer dollars that were supposed to provide relief to Americans during the COVID-19 pandemic.

Biden is pledging $1.6 billion to bolster law enforcement manpower and new programs that will be used to prosecute scammers, prevent fraud, and provide assistance to victims of identity theft.

“We want to not only capture them and get their funds, we want to send a signal to them that you can run, but you cannot hide,” said Gene Sperling, a Biden senior adviser who is overseeing the implementation of the COVID-relief plan.

THE LATEST

• The administration’s plans call for creating 10 Department of Justice “strike forces” that will include U.S. attorneys and other law enforcement officials to investigate COVID-relief fraud and help recover stolen tax dollars. The teams will target criminal syndicates and other major fraudsters. Three strike forces already are in place and have recovered millions of dollars in stolen relief funds, officials said.

• The administration also will propose increasing the statute of limitations to 10 years for fraud involving the pandemic Unemployment Insurance program, which has been hit especially hard by scammers.

• Some $300 million will be distributed to inspectors general at the Small Business Administration, the Department of Labor and the staff of the Pandemic Response Accountability Committee, a government watchdog over pandemic spending. The money would be used to hire investigators and make sure they have the resources needed to pursue specialized cases of pandemic fraud.

• In his proposed budget to be released next week, Biden will offer a package of legislative reforms to prevent, detect and recover payments made improperly through the Unemployment Insurance program.

• Federal grants would be made to states to help modernize their information technology systems to enable them to respond more quickly to fraud, decrease erroneous payments and provide more efficient claims processing.

• New initiatives also would be put in place to identify victims of identity theft, including an early warning system to stop potentially fraudulent transactions before they occur and a one-stop shop to report identity crimes.

WHY IT MATTERS

The federal government distributed more than $5 trillion in pandemic relief under programs approved by Biden and former President Donald Trump. The money was distributed quickly, leading to an increase in fraud and other improper payments, such as those that shouldn’t have been made or were made in the wrong amount.

The Government Accountability Office reported last month that the extent of fraud in COVID-relief programs is not yet known but that the Unemployment Insurance program alone was believed to have made more than $60 billion in fraudulent payments.

From March 2020 to last January, at least 1,044 people pleaded guilty or were convicted of defrauding COVID relief programs, the GAO report said. Federal charges were pending against another 609 individuals or entities for attempting to defraud COVID-relief programs.

Also, the federal government gave $5.4 billion in COVID aid to small businesses with “questionable” Social Security numbers, the Pandemic Response Accountability Committee reported in January. The watchdog identified nearly 70,000 questionable Social Security numbers used to obtain pandemic aid from two programs run by the Small Business Administration.

WHAT'S NEXT?

The Republican-led House Oversight and Accountability Committee has opened an investigation into fraud in COVID-relief programs. The committee held its first hearing on the subject last month.

Sperling, however, said the administration’s anti-fraud package isn’t a direct response to the GOP investigations. Most of the proposals were being prepared before last November’s election, he said.
