Company that makes millions spying on students will get to sue a whistleblower

Yesterday, the Court of Appeal for British Columbia handed down a jaw-droppingly stupid and terrible decision, rejecting the whistleblower Ian Linkletter’s claim that he was engaged in legitimate criticism when he linked to freely available materials from the ed-tech surveillance company Proctorio:

It’s been a minute since Linkletter’s case arose, so I’ll give you a little recap here. Proctorio is a massive, wildly profitable ed-tech company that sells a surveillance tool to monitor students while they take high-stakes tests from home. The tool monitors the student’s computer and the student’s face, especially their eye-movements. It also allows instructors and other personnel to watch the students and even take control of their computer. This is called “remote invigilation.”

This is ghastly in just about every way. For starters, Proctorio’s facial monitoring software embeds the usual racist problems with machine-learning stuff, and struggles to recognize Black and brown faces. Black children sitting exams under Proctorio’s gimlet eye have reported that the only way to satisfy Proctorio’s digital phrenology system is to work with multiple high-powered lights shining directly in their faces.

A Proctorio session typically begins with a student being forced to pan a webcam around their test-taking room. During lockdown, this meant that students who shared a room — for example, with a parent who worked night-shifts — would have to invade their family’s privacy, and might be disqualified because they couldn’t afford a place large enough to have private room in which to take their tests.

Proctorio’s tools also punish students for engaging in normal test-taking activity. Do you stare off into space when you’re trying through a problem? Bzzzt. Do you read questions aloud to yourself under your breath when you’re trying to understand their meanings? Bzzzt. Do you have IBS and need to go to the toilet? Bzzzt. The canon of remote invigilation horror stories is filled with accounts of students being forced to defecate themselves, or vomit down their shirts without turning their heads (because looking away is an automatically flagged offense).

The tragedy is that all of this is in service to the pedagogically bankrupt practice of high-stakes testing. Few pedagogists believe that the kind of exam that Proctorio seeks to recreate in students’ homes has real assessment merit. As the old saying goes, “Tests measure your ability to take tests.” But Proctorio doesn’t even measure your ability to take a test — it measures your ability to take a test with three bright lights shining directly on your face. Or while you are covered in your own feces and vomit. While you stare rigidly at a screen. While your tired mother who just worked 16 hours in a covid ward stands outside the door to your apartment.

The lockdown could have been an opportunity to improve educational assessment. There is a rich panoply of techniques that educators can adopt that deliver a far better picture of students’ learning, and work well for remote as well as in-person education. Instead, companies like Proctorio made vast fortunes, most of it from publicly funded institutions, by encouraging a worse-than-useless, discriminatory practice:

Proctorio clearly knows that its racket is brittle. Like any disaster profiteer, Proctorio will struggle to survive after the crisis passes and we awaken from our collective nightmare and ask ourselves why we were stampeded into using its terrible products. The company went to war against its critics.

In 2021, the reviews for Proctorio’s Chrome plugin all mysteriously vanished. Needless to say, these reviews — from students forced to use Proctorio’s spyware — were brutal:

Proctorio claims that it protects “educational integrity,” but its actions suggest a company far more concerned about the integrity of its own profits:

One of the critics that Proctorio attacked is Ian Linkletter. In 2020, Linkletter was a Learning Technology Specialist at UBC’s Faculty of Education. His job was to assess and support ed-tech tools, including Proctorio. In the course of that work, Linkletter reviewed Proctorio’s training material for educators, which are a bonanza of mask-off materials that are palpably contemptuous of students, who are presumed to be cheaters.

At the time, a debate over remote invigilation tools was raging through Canadian education circles, with students, teachers and parents fiercely arguing the merits and downsides of making surveillance the linchpin of assessment. Linkletter waded into this debate, tweeting a series of sharp criticisms of Proctorio. In these tweets, Linkletter linked to Proctorio’s unlisted, but publicly available, Youtube videos.

A note of explanation: Youtube videos can be flagged as “unlisted,” which means they don’t show up in searches. They can also be flagged as “private,” which means you have to be on a list of authorized users to see them. Proctorio made its training videos unlisted, but they weren’t private — they were visible to anyone who had a link to them.

Proctorio sued Linkletter for this. They argued that he had breached a duty of confidentiality, and that linking to these videos was a copyright violation:

This is a classic SLAPP — a “strategic litigation against public participation.” That’s when a deep-pocketed, thin-skinned bully, like Proctorio, uses the threat of a long court battle to force their critics into silence. They know they can’t win their case, but that’s not the victory they’re seeking. They don’t want to win the case, they want to win the argument, by silencing a critic who would otherwise be bankrupted by legal fees.

Getting SLAPPed is no fun. I’ve been there. Just this year, a billionaire financier tried to force me into silence by threatening me with a lawsuit. Thankfully, Ken “Popehat” White was on the case, and he reminded this billionaire’s counsel that California has a strong anti-SLAPP law, and if Ken had to defend me in court, he could get a fortune in fees from the bully after he prevailed:

British Columbia also has an anti-SLAPP law, but unlike California’s anti-SLAPP, the law is relatively new and untested. Still, Proctorio’s suit against Linkletter was such an obvious SLAPP that for many of us, it seemed likely that Linkletter would be able to defend himself from this American bully and its attempt to use Canada’s courts to silence a Canadian educator.

For Linkletter to use BC’s anti-SLAPP law, he would have to prove that he was weighing in on a matter of public interest, and that Proctorio’s copyright and confidentiality claims were nonsense, unlikely to prevail on their merits. If he could do that, he’d be able to get the case thrown out, without having to go through a lengthy, brutally expensive trial.

Incredibly, though, the lower court found against Linkletter. Naturally, Linkletter appealed. His “factotum” is a crystal clear document that sets out the serious errors of law and fact the lower court made:

But yesterday, the Court of Appeal upheld the lower court, repeating all of these gross errors and finding for Proctorio:

This judgment is grotesque. It makes a mockery of BC’s anti-SLAPP statute, to say nothing of Canadian copyright and confidentiality law. For starters, it finds that publishing a link can be a “performance” of a copyrighted work, which meant that when Linkletter linked to the world-viewable Youtube files that Proctorio had posted, he infringed on copyright.

This is a perverse, even surreal take on copyright. The court rejects Linkletter’s argument that even Youtube’s terms of service warned Proctorio that publishing world-viewable material on its site constituted permission for people to link to and watch that material.

But what about “fair dealing” (similar to fair use)? Linkletter argued that linking to a video that shows that Proctorio’s assurances to parents and students about its products’ benign nature were contradicted by the way it talked to educators was fair dealing. Fair dealing is a broad suite of limitations and exceptions to copyright for the purposes of commentary, criticism, study, satire, etc.

So even if linking is a copyright infringement (ugh, seriously?!), surely it’s fair dealing in this case. Proctorio was selling millions of dollars in software to public institutions, inflicting it on kids whose parents weren’t getting the whole story. Linkletter used Proctorio’s own words to rebut its assurances. What could be more fair dealing than that?

Not so fast, the appeals panel says: they say that Linkletter could have made his case just as well without linking to Proctorio’s materials. This is…bad. I mean, it’s also wrong, but it’s very bad, too. It’s wrong because an argument about what a company intends necessarily has to draw upon the company’s own statements. It’s absurd to say that Linkletter’s point would have been made equally well if he said “I disbelieve Proctorio’s public assurances because I’ve seen seekrit documents” as it was when he was able to link to those documents so that people could see them for themselves.

But it’s bad because it rips the heart out of the fair dealing exception for criticism. Publishing a link to a copyrighted work is the most minimal way to quote from it in a debate — Linkletter literally didn’t reproduce a single word, not a single letter, from Proctorio’s copyrighted works. If the court says, “Sure, you can quote from a work to criticize it, but only so much as you need to make your argument,” and then says, “But also, simply referencing a work without quoting it at all is taking too much,” then what reasonable person would ever try to rely on a fair dealing exemption for criticism?

Then there’s the confidentiality claim: in his submissions to the lower court and the appeals court, Linkletter pointed out that the “confidential” materials he’d linked to were available in many places online, and could be easily located with a Google search. Proctorio had uploaded these “confidential” materials to many sites — without flagging them as “unlisted” or “private.”

What’s more, the videos that Linkletter linked to were in found a “Help Center” that didn’t even have a terms-of-service condition that required confidentiality. How on Earth can materials that are publicly available all over the web be “confidential?”

Here, the court takes yet another bizarre turn in logic. They find that because a member of the public would have to “gather” the videos from “many sources,” that the collection of links was confidential, even if none of the links in the collection were confidential. Again, this is both wrong and bad.

Every investigator, every journalist, every critic, starts by looking in different places for information that can be combined to paint a coherent picture of what’s going on. This is the heart of “open source intelligence,” combing different sources for data points that shed light on one another.

The idea that “gathering” public information can breach confidentiality strikes directly at all investigative activity. Every day, every newspaper and news broadcast in Canada engages in this conduct. The appeals court has put them all in jeopardy with this terrible finding.

Finally, there’s the question of Proctorio’s security. Proctorio argued that by publishing links to its educator materials, Linkletter weakened the security of its products. That is, they claim that if students know how the invigilation tool works, it stops working. This is the very definition of “security through obscurity,” and it’s a practice that every serious infosec professional rejects. If Proctorio is telling the truth when it says that describing how its products work makes them stop working, then they make bad products that no one should pay money for.

The court absolutely flubs this one, too, accepting the claim of security through obscurity at face value. That’s a finding that flies in the face of all security research.

So what happens now? Well, Linkletter has lost his SLAPP claim, so nominally the case can proceed. Linkletter could appeal his case to Canada’s Supreme Court (about 7% of Supreme Court appeals of BC appeals court judgments get heard). Or Proctorio could drop the case. Or it could go to a full trial, where these outlandish ideas about copyright, confidentiality and information security would get a thorough — and blisteringly expensive — examination.

In Linkletter’s statement, he remains defiant and unwilling to give in to bullying, but says he’ll have to “carefully consider” his next step. That’s fair enough: there’s a lot on the line here:

Linkletter answers his supporters’ questions about how they can help with some excellent advice: “What I ask is for you to do what you can to protect students. Academic surveillance technology companies would like nothing more but for us all to shut up. Don’t let them silence you. Don’t let anyone or anything take away your human right to freedom of expression.”

Penske Perfect and Details Matter are two phrases often used in conjunction with the Penske organization. And when they can be used to dunk on Ferrucci, all the better.

Josef is a perfectionist. This is a combo of his highly competitive nature - which has been said about him from a young age - and the Penske Perfect motto which he has taken to heart. He is highly critical of himself - getting very down on himself if he makes a mistake and taking the blame for things not wholly under his control. But he tried to maintain a genial if slightly arrogant image in public. He slips sometimes - there have been a few angry Twitter interactions that he later apologized for and on occasion after a race, his temper will get the better of him and he'll say things he probably shouldn't.

He can be goofy as hell as seen on Bus Bros. Scott McLaughlin has brought this out of him since becoming teammates. Josef has said that Scott makes him feel more comfortable being his real self.

⚠️⚠️TRIGGER WARNING: ED, body image, depression, mental illness ⚠️⚠️

I would never in a million years post something like this to any of my other social media accounts but I’m proud of myself and how far I’ve come and want to make a post. It’s likely that this will be taken down for the “inappropriate photos” and I sincerely doubt that many will take the time to read this, but oh well. I’m writing this for me.

The purpose of this post is to share my story and spread awareness as well as positivity.

My body image is something that I have struggled with for a very long time now. Since middle school, I was overly aware of how my body looked and I developed severe body dysmorphia. I refused to wear bathing suits, I cried in the dressing room whenever I went clothes shopping, and I constantly compared myself to those around me. I hated my body and the way that I looked. This obsession with my appearance and my weight continued to progress throughout high school and even college. I began working out frequently, I logged my weight and everything that I ate for years, I counted calories, I would use a tape measure to measure my waste. At 15 years old, I would sob quietly to myself while looking at my body in the mirror. I would force myself to throw up after meals or when I felt like I overindulged. I wholeheartedly hated myself.

It wasn’t until my adult years that things started to get really bad. From 2021 to late 2022, I was at my absolute worst. I was in a bad place mentally and I was feeling out of control. As unhealthy as it sounds, my eating disorder was one of the few things that helped me feel in control of my life. I began weighing myself 4-5 times every day, my hair started falling out in large clumps, I began passing out almost on a daily basis (at home, at work, in the shower, in public), I was freezing cold all the time, i was chronically fatigued, and my body hurt and ached at all times. I was refusing to eat more than one full meal a day, and that meal typically consisted of a bagel with butter. I would look up the calories in ibuprofen before taking it, I started drinking my coffee black to avoid the calories from cream, I was constantly lying to my friends and family about my eating, I wouldn’t even let myself drink carbonated water because it made me feel bloated. I was so so so sick. Within one year, I had lost a total of 50 pounds, gone down 2 bra sizes, and had no longer fit in any of my clothing. I am a 6’3” woman and was weighing in at 124lbs when I decided that I needed to make a change if I wanted to live.

In November of 2022, I decided to actively work on getting better. I threw away my scale and called my doctor to get a referral to an ED program. I was advised to go completely inpatient considering the severity of my problem.

It’s hard. Every single day of this healing process has been hard for me. I have not once weighed myself since November and have been eating normal meals again. I refuse to let myself see the calories of the things that I eat and I’m pushing myself to break all of the unhealthy “rules” that I had previously made for myself. It’s obvious that I have gained quite a bit of weight since starting this journey, and although I still struggle with that and frequently have negative thoughts… I’m recovering and I’m trying. And that is all the matters.

I’ve slowly been learning to love myself with this new and improved body and I’m proud of myself for making it this far. I promise myself that I will continue to grow and heal even on days where I want to relapse or when I feel worthless or uncomfortable in my own skin.

I just recently learned some information that caused me to really, truly think about this terrible illness and how deeply and negatively it has, and always will, affect my life. About 3 weeks ago I wound up in the emergency department with severe heart palpitations, tachycardia, and vertigo. After doing an EKG and further testing, I was diagnosed with a rare heart condition in which can cause sudden fainting, seizures, or even sudden death. Unfortunately, one of the few things that can cause this, are eating disorders, more specifically anorexia nervosa. I wanted to throw up when I heard this. I didn’t realize how badly my ED could have been affecting my health. All that ever ran through my head was that I wanted to be skinny. I wanted to be thin because I didn’t feel worthy if I wasn’t. Surely, nobody would love me or want to see me naked if I wasn’t thin. What absolutely bullshit that is. I’m heartbroken for myself and I am so sad that I ever let myself get that bad. It devastates me to think about how many other people (men, women, young, old, etc.) struggle with eating disorders every waking minute of their lives. It isn’t worth it.

Please, please, please reach out to somebody if you are struggling with an eating disorder. You are so worth it and you deserve a chance at a happy and healthy life. You are SO much more than a number on a scale.

I am sitting on my couch sipping a mango lassi as dessert. I have been at the Vancouver Museum [not its actual name] for 8 days. I ordered Indian delivery for a treat. It was very good.

Ianto and I seem to be settling in pretty well. He, of course, wins hearts very easily - he's been making my life easier too.

So far I haven't done too much, still very much learning about my new museum/job/board but it is already going more smoothly than Camel Town. My second in command has been here for over 8 years, loves the museum, does NOT want to be an ED. She has been doing basically 3 full time jobs since about 2021. She is so happy that I am here actively taking things off her plate. I have also been dragging her outside at least two times every 3 days so far - she has a bad work history of working through breaks and staying late.

She managed to put together a pretty good team of contract and summer employees. 3 out of 4 I would keep if I could, I can only maybe keep one of them.

The board is 6 people 2 are in the museum regularly as active volunteers, the president and I are in near constant contact, and one of the remaining 3 drops by semi-regularly [the other two live farther away]. By comparison I only EVER saw 2 board members at Camel Town - one very rarely because he lived in the US.

People here are actively showing me what has happened and also what they want me to do... instead of whatever happened in Camel Town where I was basically left to figure it out on my own.

I am so tired, but not weary.

I’m 18, turning 19 in March. I have a lot of mental illnesses: CPTSD, some sort of dissociative disorder, bpd, delusional parasitosis, schizoaffective, and a fuck ton of phobias lmao

I was diagnosed with an0rexia in 2019-2021, now I’m diagnosed with ednos or osfed or whatever it’s called now. I’ve been in “recovery” since 2022 so I was forced to leave this side of tumblr. But I don’t give a fuck anymore abt anything. So I’m backkkkk

I’m fat af now, birth control really fucked me up, but I’m off it now so this bitch is gonna be ✨skinni✨again.

Overview: Hermaphroditism & Aircraft Sex-Ed

(Slight pre-warning for mature content, though I don't think it's enough to warrant a maturity tag)

This is being dedicated to an entire - long - chapter. Yup. This is a thing! Hold onto your hats y’all!

This is an important tidbit to make, purely because it will help explain a lot of concepts and themes surrounding my (generally not safe for work) fics, as well as the headcanon of the world and its inhabitants. While this may not be everybody’s cup of tea, it’s still going to be relevant to my storytelling, and that’s why this is here! So let’s...talk about airplane and helicopter reproduction systems, oh joy. XD

First and most notably to this rather lengthy headcanon explanation (because it’s the most often used slash needed to explain), helicopters, as well as large aircraft, both have forms of what is called hermaphroditism [herm-aff-row-dite-is-um]. While they each display them in different ways, both have the same basic principles: males and females each have their own male and female reproductive organs, stacked one on top of the other, hidden beneath separate sets of releasable panelling.

Now for the main differences between the two species, large aircraft are simultaneous hermaphrodites, meaning they have both parts, and can use them, you guessed it, simultaneously. Both exist at the same time without overcrowding each other. The ways they do this are mostly because of the fact that large planes have much lower hormone levels, even as adolescents, so there’s never a problem that one set is simply outpowering another. Now this does mean that they have to deal with female cycles (though, aircraft do not bleed) but again, natural hormone levels are so low and so well evened out that there never seems to be a big difference in behavior. (Side note: you might still see Cabbie swiping extra caffeine from the kitchen, though.)

Large aircraft will still have one set that determines their gender from birth, however, and that is whichever set is positioned closer to their underbellies (this works the same way with helicopters which we’ll get to in a minute). Then as they reach adolescence, both reproductive organs will begin to properly function. As a special note to add, no, they can not self-impregnate. They do still have to have a partner in order to reproduce.

And now onto my personal (very biased) favorites, the helicopters. Though they share the main hermaphrodite aspects, helicopters are known alternatively as being ‘sequential’ hermaphrodites. From birth, there is always one set that will be more prevalent and have stronger hormones than another, making the secondary dormant by comparison. The stronger set (or the natural one, I should say - transgender helis do of course exist) will always be the one closest to the craft’s belly, the same as large craft in determining gender, and the dormant set will be resting behind it. To put it very bluntly, cisgendered male helis have a penis in the front and a vagina behind it, and cisgendered females are the reverse!

When helicopters reach their adolescence, only the main set will be active. The dormant parts will remain dormant...for the most part. There is however one aspect of these dormant parts that need to be dealt with into a helicopter’s adulthood, and that is precautionary cycling. About every ten years or so, or roughly 12 different times in their lifespans, a helicopter’s secondary panelling becomes highly active only to ensure that it is healthy and functioning, and ready to use if absolutely necessary. Cycling will last between one and two weeks when active, and then (granted it doesn’t become actually active during that time, ie they’re not dropping eggs or releasing sperm) it will naturally just go back to a dormant state. Generally speaking, male cycling will make them more moody, and females will be hornier and occasionally more aggressive or dominating. Oh the wonderful world of double hormones.

Now, you may be wondering, “But why have a second set of reproduction parts if they serve no purpose for most of their lives?”. Well you see, the only reason helicopters and large aircraft even evolved to having hermaphroditism in the first place is their need to not go extinct. It’s much more difficult for the both of them (large aircraft in particular) to find suitable mates to bear children with, especially when you need to find one male and one female to do so. In the case of planes such as Cabbie, as well, there’s historical evidence to prove that this hermaphroditism was purposefully bred into them in order to maintain high numbers of C-119s without having to decline females in war (sexism being what it was). The evolution definitely saved their afts in the long run, however, making it easier for them to reproduce effectively.

So why are helicopters different, why have their secondary sets completely dormant from birth as opposed to large aircraft's way of doing it? Long story short for their excuse: it's for emergency uses.

Helicopters are a species of aircraft that, historically, often bordered on the lines of 'difficult' in keeping good numbers of. Compared to the vast majority of aircraft, helicopters actually don't have as long a life expectancy, capping at 150 years, whereas prop planes in good condition will average 150, some even topping 200 or more. (Side note: Helos have also consistently had some of the highest numbers of same-sex couples in their species, seconding only to larger aircraft. Hermaphroditism is full of The Gays, apparently!) As a cherry on top to all of that, helos also have much stronger hormones than large aircraft, since they are much smaller and lighter. Because of these small issues in reproductivity, it's alleged that hermaphroditism evolved into the species as an emergency use for hard times. In the instance of, say, an apocalypse, so long as you have two helis, not necessarily two helis of differing genders, you could still conceivably continue their species. But that's only hypothetical scenarios, I'm not implying that Blade may be forced to carry pups for humanity in any kind of alternate universe…yet.

Though small aircraft don’t really need as much of an explanation for their way of doing things, I will add them to the pile as well just for clarification; small ‘craft, including all the prop-planes (and the sweet potato) are born with one of two biological sexes - but a male’s parts are tucked away in a cavity almost identical-looking to that of a female. Their balls are also further in the body so they’re protected from harm (though I’m sure a fist at the right angle over there would hit them effectively XD), and that’s just across the board, all males and male parts are that way across the aircraft spectrum. So, in essence, they’re basically like whales and dolphins! (I’m now thoroughly regretting adding “Do whales have balls?” to my Google search history…)

Now, some random things relative to all of this that I also wanted to point out, gestation periods! Aircraft differ by make and model quite a bit, but the general rule of thumb is that smaller bodies equal shorter terms, heavier bodies equal longer ones.

The shortest gestation periods are within the small single-engine prop planes, going from the world’s smallest (the Starr Bumble Bee model, respectively) into planes about Dusty’s size, though he is stunted in size for an Air Tractor, and their pregnancy times are around three to four months at a time.

Slightly larger aircraft, including most of your warplanes and bigger single-engine aircraft, have gestation periods of six to ten months.

Small double-engine planes, Bulldog as an example, are between eight and eleven months.

Bigger double-engines, starting at Dipper’s type and going all the way up to Cabbie, have a minimum period of twelve months, but often go up to fifteen.

Light helicopters, and most often skidded copters, have a period closest to a human term of nine to ten months.

Bigger helicopters, Blade’s size and up, capping a little under Windlifter’s size, are all twelve-month terms.

Windlifter and other big choppers, which also include models with double rotor assemblies, take around thirteen months.

Okay, you got all that? Alright, I got one more round of random things to add here, if you’ve made it this far, and these I didn’t really organize all that well so it’s just a mix of headcanon tidbits here!

One feature between aircraft coupling is reproductive magnetism. This is a bit of headcanon I’ve added to an upcoming Prop Calendar project that you’ll hopefully get to see, one day at least. There are natural magnets lining the rims of each panelled set of parts, and they grow more powerful with arousal, until the point of orgasm, when they quite literally snap full force with the set of a partner’s, like a lock-on system during mating. Between two of the same sets of panelling, there’s not much magnetic response, but between a male and female coupling, the opposite polarities get really damn strong.

Despite the obvious sequential hermaphroditism within helicopter species, their societies are still a widely homophobic and transphobic demographic (as shown by Blade’s relationship with his father and biological family). A lot of your helo purists will believe that your secondary set should be ignored at all costs, and that giving in to using it is equivalent to an unforgivable sin. Times did change for them in needing to have such a thing, but times are changing again to make that something that shouldn’t need to be shunned.

Though this isn’t confirmed headcanon, I’m really just thinking out loud on this, but I have considered toying around with the idea of airplane sex drives and how those may naturally alter between species. Larger aircraft may tend to have a much lower sexual appetite, whereas smaller or more flexible craft have a much higher one. There are, of course, plenty of exceptions to that (Oscar), but that’s an unconfirmed concept of differences in species.

And that concludes our random-ass tidbit (that took way too long to produce) on plane and heli sex-ed! Now, I am aware there’s a lot of aspects I haven’t covered here, so if anyone has any further questions, feel free to add them into a comment, I’m always open to getting questions to fill up Q and As, and I’ve got a few already that I’ll be rolling out in the next chapter. There have been more developments today surrounding yesterday’s indictment of former president Trump for conspiring to defraud the United States, conspiring to disenfranchise voters, and conspiring and attempting to obstruct an official proceeding as he tried to overturn the results of the 2020 election and install himself in office over the wishes of the American people. 

Observers today called out the part of the indictment that describes how Trump and Co-Conspirator 4, who appears to be Jeffrey Clark, the man Trump wanted to make attorney general, intended to use the military to quell any protests against Trump’s overturning of the election results. When warned that staying in power would lead to “riots in every major city in the United States,” Co-Conspirator 4 replied, “Well…that’s why there’s an Insurrection Act.”

The Insurrection Act of 1807 permits the president to use the military to enforce domestic laws, invoking martial law. Trump’s allies urged him to do just that to stay in power. Fears that Trump might do such a thing were strong enough that on January 3, 2021, all 10 living former defense secretaries signed a Washington Post op-ed warning that “[e]fforts to involve the U.S. armed forces in resolving election disputes would take us into dangerous, unlawful and unconstitutional territory.” 

They put their colleagues on notice: “Civilian and military officials who direct or carry out such measures would be accountable, including potentially facing criminal penalties, for the grave consequences of their actions on our republic.” Josh Marshall at Talking Points Memo recalled today that military leaders told Congress they were reluctant to respond to the violence at the Capitol out of concern about how Trump might use the military under the Insurrection Act. 

Political pollster Tom Bonier wrote: “I understand Trump fatigue, but it feels like the president and his advisors preparing to use the military to quash protests against his planned coup should be bigger news. Especially when that same guy is in the midst of a somewhat credible comeback effort.”

On The Beat tonight, Ari Melber connected Trump Co-Conspirator John Eastman to Senator Ted Cruz (R-TX). Just before midnight on January 6, 2021, after the attack on the U.S. Capitol, Eastman wrote to Pence’s lawyer to beg him to get Pence to adjourn Congress “for 10 days to allow the legislatures to finish their investigations, as well as to allow a full forensic audit of the massive amount of illegal activity that has occurred here.” On the floor of the Senate at about the same time, Cruz, who voted against certification, used very similar language when he called for “a ten-day emergency audit.” 

An email sent by Co-Conspirator 6, the political consultant, matches one sent from Boris Epshteyn to Trump lawyer Rudy Giuliani, suggesting that Epshteyn is Co-Conspirator 6. The Russian-born Epshteyn has been with Trump’s political organization since 2016 and was involved in organizing the slates of false electors in 2020. Along with political consultant Steve Bannon, Epshteyn created a cryptocurrency called “$FJB, which officially stands for “Freedom. Jobs. Business.” but which they marketed to Trump loyalists as “F*ck Joe Biden.” By February 2023, Nikki McCann Ramirez reported in Rolling Stone that the currency had lost 95% of its value.

Since the indictment became public, Trump loyalists have insisted that the Department of Justice is attacking Trump’s First Amendment rights to free speech. Indeed, if Giuliani’s unhinged appearance on Newsmax last night is any indication, it appears that has been their strategy all along. Aside from the obvious limit that the First Amendment does not cover criminal behavior, the grand jury sidestepped this issue by acknowledging that Trump had a right to lie about his election loss. It indicted him for unlawfully trying to obstruct an official proceeding and to disenfranchise voters. 

Today, Trump’s former attorney general William Barr dismissed the idea that the indictment is an attack on Trump’s First Amendment rights. Barr told CNN’s Kaitlan Collins: “As the indictment says, they're not attacking his First Amendment right. He can say whatever he wants. He can even lie. He can even tell people that the election was stolen when he knew better. But that does not protect you from entering into a conspiracy. All conspiracies involve speech. And all fraud involves speech. Free speech doesn't give you the right to engage in a fraudulent conspiracy.” 

Rudy Giuliani has his own troubles in the news today, unrelated to the attempt to overturn the results of the 2020 election. His former assistant Noelle Dunphy is suing him for sexual harassment and abuse, and new transcripts filed in the New York Supreme Court of Giuliani’s own words reveal disturbing fantasies of sexual domination that are unlikely to help his reputation. (Historian Kevin Kruse retweeted part of the transcript with the words, “Goodbye, lunch.”) 

The chaos in the country’s political leaders comes with a financial cost. According to Fitch Ratings Inc., a credit-rating agency, the national instability caused by “a steady deterioration in standards of governance over the last 20 years” has damaged confidence in the country’s fiscal management. Yesterday it downgraded the United States of America’s long-term credit rating for the second time in U.S. history. 

Fitch cited “repeated debt-limit political standoffs and last-minute resolutions,” “a complex budgeting process,” and “several economic shocks as well as tax cuts and new spending initiatives” for its downgrade. The New York Times warned that the downgrade is “another sign that Wall Street is worried about political chaos, including brinkmanship over the debt limit that is becoming entrenched in Washington.”

The timing of the downgrade made little sense economically, as U.S. economic growth is strong enough that the Bank of America today walked back earlier warnings of a recession. Treasury Secretary Janet Yellen noted that the key factors on which Fitch based its downgrade had started in 2018 and called the downgrade “arbitrary.” The editorial board of the Washington Post  called the timing “bizarre.” But the timing makes more sense in the context of the fact that House Republicans could not pass 11 of 12 necessary appropriations bills before leaving for their August recess.

The White House said it “strongly disagree[d]” with the decision to downgrade the U.S. credit rating, noting that the ratings model Fitch used declined under Trump before rebounding under Biden, and saying “it defies reality to downgrade the United States at a moment when President Biden has delivered the strongest recovery of any major economy in the world.” But it did agree that “extremism by Republican officials—from cheerleading default, to undermining governance and democracy, to seeking to extend deficit-busting tax giveaways for the wealthy and corporations—is a continued threat to our economy.”

What's the Point of This Blog?

When I relapsed in 2021, I discovered pro-ana forums for the first time and I learned that there is a sub-section of proana that is actually pro-harm reduction. I resonated with it because I am not ready for help nor is it an option without losing my job and everything I worked hard for. I feel like I have no choice but to manage my symptoms and reduce the harm to my health the best I can on my own, and I am FAR from being the only person with an ED who feels like this. Many of us have a lot to lose if we seek treatment and that very fact prevents us from seeking help. The next best thing we can do for ourselves is change how we see and interact with disordered thoughts. Instead of starving yourself because you want to disappear what if you tried to slowly and steadily lose weight so that you can do something you always denied yourself, something that you always told yourself you weigh too much to do? I know from experience, that losing weight quick and dirty only makes you feel worse and DOESN'T LAST once you start to eat normally again. Sustainable lifestyle changes are the only way to prevent loose skin, stay on track with a bingeing problem, and keep your metabolism and hormones from going out of wack, (reducing the negative symptoms and long-term health effects of ED.) If you don't believe it's possible, I have lost over 60+lbs while struggling with Bingeing over the course 18 months and have maintained that loss for about 1 year with absolutely no period regain. I went from a US dress size 14 to a size 6 and in the last year that I have stayed 120lbs, I now fit into a size 4 from body recomposition.

How Did You Do It?

1. Address negative thoughts when you can, when you say sweeping statements like "I always mess up" or "Everyone hates me" Challenge those thoughts with facts. Is that really true or does it just feel that way in the moment? Be honest with yourself, not dalulu. Motivation is always coming and going and you can't rely on self-hate to keep you on your diet, people who hate themselves rarely take good care of themselves and stay on track.

2. You don't have to eat low res to lose weight, instead create a proper and sustainable calorie deficit. Use this link to find your BMR and look at the activity level to see how many calories you really burn in a day, most anas underestimate this number. Whatever that BMR number is, subtract 500 calories, this will give you the amount you can eat and still lose 1 lb per week! 3500cals of deficit = 1 lb of loss. 1 lb per week sounds slow but having consistent loss week after week is so healing for someone who has alot of ups and downs emotionally from weight fluxs. If that sounds like you, give slower loss a shot! 3. Stop punishing yourself and find things that you enjoy instead. If you are taking away food to punish yourself or using increased exercise to punish yourself, you are actively sabotaging the only things that help you with weight loss. If you use those things as punishments, you are less likely to want to do them AT ALL. It's so important to find an enjoyable exercise that you look forward to and that relieves stress. Exercise is there to help you maintain your health/weight and using it as a punishment takes all the joy away from it and makes it into a chore you dread and avoid. Instead of taking away food, focus on buying higher quality food in smaller portions, you will find it tastes better and you look forward to planning your meals around those ingredients. 4. Eat high volume low calorie whole foods. Alot of packaged "health" food is just as bad as junk food, they just put a trendy-looking design on the package and the word "natural" slapped on it. before you buy or eat anything you need to be looking at the label on the back. If you want to feel more satisfied with your meals, try to get at least 60g of protein a day and avoid food that is calorically dense especially when you don't have access to a food scale. Try to eat more foods that contain one ingredient and when eating a full meal, try to fill your plate with 2 large servings of vegetables, one serving of protein, and one small serving of a grain or starchy vegetable. This ratio of food helps you feel full and keeps the calories low! If you have any more questions feel free to use my inbox! If you need help to reduce harm and feel like you are beyond helping yourself, please get help from a trusted loved one. Your well-being is worth more than what ever trouble you might get in asking for help. Nothing you did could ever warrant or make you deserve to not live. You are worthy of love and good health and I hope this helps you get a step closer to that.

Yes, the calendar is hopelessly out of date, but the photos are meant to be turned into postcards. No box, unfortunately, it didn't survive the overseas trip:

Pre-order Fig (International Only): I felt bad that all my merch is stateside, and international shipping is prohibitively expensive for big items. So, you get your choice of any fig or fig set that are currently available for pre-order (there's some really good ones!). I'll send the winner a list of these figs.

Please note any pre-order can be expected to take months to be produced. I will direct ship these to your address from the SB warehouse when they are ready.
