Interesting alternative to the idea that Penny may have secretly abused Jaune's Semblance to allow her soul to persist after transferring the powers:

It wasn't Jaune's Semblance, but Ambrosius's power. Ambrosius is known for giving people exactly what they ask for regardless of their actual intentions, and Ruby specifically told him she wanted to "keep her (Penny) around longer than that". Ambrosius's powers don't really seem to be limited by the possible/impossible, so I could totally see this body that exists only due to a magical loophole having some kind of extended warranty due to Ruby's accidental request.

The only thing that kind of throws a wrench in this is Ruby saying "longer than that" in reference to the next time the Staff was going to be used. Ambrosius is known for taking requests literally and at face value, and Penny did, in fact, survive long enough for the Staff to be used again. However, this line could still be forshadowing even if it's not a direct contribution to the revival.

Overall I'm still leaning more toward it having been Jaune's Semblance at play due to the fact he was present over any of all of the people that were actually close to Penny, her being perceptive of Semblances has been noted in the past and given attention, she told him there was "something you can do" with a bit of emphasis on "you", the Aura transfer was mostly Jaune's color, and she just generally seemed okay with Jaune killing her while she had been extremely upset asking someone closer to her to do the same thing earlier. It just reads a lot to me like she saw him using his Semblance on her briefly and had an idea click but couldn't inform him of her intentions due to lack of time.

But given that we have two options with decent to really solid backing, I think one of them is going to have to turn out correct or really close to the truth.

Using Fairy Tales to explain RWBY Plots (Penny in Volume 8)

Pinocchio is supposed to die in his story, but his father obviously doesn’t want that. So how does this translate into RWBY? The father argues with the personification of death, The Grimm Reaper, to keep his child alive. The Grimm Reaper (Maria) responds, saying that it’s time for Pinocchio (Penny) to go.

While on the way to school, Pinocchio gets conned and hunted by the Honest Fox. Penny (Pinocchio) is being hunted by the Hound (who secretly is a fox)

Stromboli, runner of the puppet show, captures Pinocchio so he can perform for him around the world. Ironwood (Stromboli) is trying to capture Penny (Pinnochio) because he needs her power.

After proving himself brave, truthful, and unselfish, the Blue Fairy comes back to give Pinocchio a real body. Team RWBY gets a blue magical entity (Ambrosius) to turn Penny (Pinnochio) into a real girl.

Pinocchio was supposed to go to school, but got caught up smoking with Lampwick. How does this translate to RWBY? Well, Pinocchio (Penny) was supposed to go to school (Vacuo), but got caught up smoking (Cinder) with Lampwick (Neo, the new Torchwick)

I can definitely do that! I kinda based this on my own experiences when I was a little kid, looking back these interactions always felt very loving to me. So... I hope you enjoy!

~ “Ozzy? Ozzy, it's time to get up.” a soft voice murmured as little Ozzy grumbled and cocooned up in his blanket.

A soft amused chuckle met the toddler's ears as he felt two strong hands move over his blankets and pick him up. His small form was still bundled up and warm, but now even more comfortable in his papa’s arms. He sighed contently and wrapped his sleepy little arms around his papa’s neck with a little contented noise.

“Your dad made chocolate chip waffles.” Amrosious said softly, rubbing Ozzy’s back in small warm circles as he carried him. “Your brothers are already there, we were waiting on you sweetheart.” “But ‘m seeby…” he mumbled, cuddling up more in his blanket cocoon.

Ambrosius smiled and kissed Ozzy’s hair, “I know lovey. But try to wake up just a bit for breakfast.”

Ozzy just mumbled something, whining as his papa lowered him into a seat. He made weak grabby hands, wanting to go back to the warm arms and doze a bit longer.

“If you’re still tired after breakfast I’ll bring you back to bed, how does that sound?” he smiled, petting Ozzy’s hair and nuzzling his squishy cheek with his nose.

Ozzy grumbled but nodded, giggling as his papa gave him a big wet kiss on his cheek. “That’s my little sparrow!”

The fight during The Final Word is halted before it begins, and Ambrosius gives Penny a clue as to how she can turn the tides - there are no rules about indirect interference from the Relic spirits, after all.
