Busola Dakolo Gives Update On Her R*pe Case Against Pastor Biodun Fatoyinbo
Busola Dakolo, wife of singer, Timi Dakolo, has given an update on her r*pe case against clergyman, Biodun Fatoyinbo.

Recall that in June 2019, she publicly accused the clergyman of violently raping her when she was a teenager and was worshipping in his church in Kwara state. She filed a suit against him but it was thrown out by the court. In an update posted this afternoon on her Instagram page, Busola shared a copy of the letter she received from the police stating they have completed investigations into the case and have forwarded the case file to the Director of Public Prosecution of the Federation (DPPP) for legal advice and further necessary action. She alleged the Ministry of Justice has since received the case file for Fatoyinbo’s prosecution but has remained silent.  She said her team has sent a letter to the Ministry of Justice over a month ago but no response yet. Read the letter from the police sent to her and her post below ”It is now officially one year after since I came out and told the most important story of my life up until this point. That when I was a teenager, Biodun Fatoyinbo violently raped me. It wasn’t just me. In the media, on social platforms and in private, women have been sharing stories of how this man either destroyed their lives or tried to. A lot has happened in that time: and my heart is glad that consciousness continues to be raised about the great evil that sexual abuse is, and how widespread it is, and how much women are at risk, and why we need to ensure justice for those who find the strength to speak out. Awareness is victory. But we are pushing to another even great victory: Justice. When the courts last year decided to rule in favour of the man who assaulted me, people were crestfallen. I understood. What they didn’t know however is that before we even began, we had been prepared for a long haul battle that may take years because the Nigerian legal system isn’t wired to help sexual abuse victims get justice. Today, I have a major update. The police has concluded its investigation. And handed over its report to the Ministry of Justice in Abuja for onward prosecution of Biodun Fatoyinbo. He clearly has a case to answer. But there has been silence from the ministry. Silence. A loud silence! We have written a letter but for over a month we have no response. Instead, my lawyers and my family have heard about all manner of manipulation and foul play being attempted to stop the ministry from beginning prosecution immediately. Or even to get the police report manipulated. My name is Busola Dakolo, a survivor of one of the most horrific acts -rape. My voice will not be shut down. My case will not be silenced.   Busola Dakolo has vowed to appeal the Abuja Federal High Court over the rape allegation she filed against the Senior Pastor of the Commonwealth of Zion Assembly( COZA), PAstor Biodun Fatoyinbo. Busola who alleged that she was raped by Fatoyinbo in 2002 stated that the judge failed to appreciate the significance of the case. Dakolo’s lawyer Pelumi Olajengbesi, said that the court in its decision did not appreciate the magnitude of the case. On Thursday, Oathman Musa of the Bwari Division of the High Court of the Federal Capital Territory, stating that it was statute barred because it happened decades ago. The renowned photographer and wife of Nigeria singer, Timi Dakolo, took to her social media to thank those who stood by her and also reiterated that justice has not been served. Busola Dakolo has reacted to the decision of the High Court of the Federal Capital Terriroty Abuja to dismiss her rape case against the Senior Pastor of COZA, Biodun Fatoyinbo.   In a statement released this evening, Busola expressed her reservations over the court's decision.   Read her full statement below   I have just been briefed by my lawyers on the court’s ruling in the matter before it pertaining to my stand against injustice represented by the reprehensible actions of Mr. Biodun Fatoyinbo and, in light of the present and anticipated inquiries from friends, family and well-wishers, it is pertinent to convey my sincere reaction to said ruling. When I set about confronting one of my biggest fears and a horrible experience from my past, the first hurdle was finding the confidence to. Victims usually do not find a place for their voice, certainly not in our deeply conservative country where might is right and a virtue while innocence is a licence for abuse and disregard. I had no illusions about the herculean task before me in not only openly confronting the man behind the mask but seeking remedy and sanction against him before the court. I set out to ease the hurt, the sense of shame and abuse, the nightmares and traumas not by securing judicial victory only but by boldly sharing my story and calling out my transgressor robed in the vestiges of clerical power and pretence. I understood and accepted that by voicing out I was silencing the screams in the night.   Ever since my story broke, the reactions were mixed but largely comforting. I noted that otherwise hushed victims of rape and sexual abuse were taking a cue from my stoicism in the face of ridicule and opposition and sharing their equally appalling stories. It is in this response that my victory was sealed, in knowing that one woman’s boldness could encourage others and challenge the institutionalized silence and the repression of the victim’s narrative by a culture of guilt-tripping, stigma and an inexplicable clamour to make irrational excuses for sexual offenders.   Even so, there is much to be said about what transpired in court. In the court’s wisdom, my legal action is statue barred and that means the time has passed within which I could or should have initiated the suit. The substance of the suit which is my allegations of sexual abuse leading to emotional distress on my person against Mr. Biodun Fatoyinbo has neither been entertained by the court nor ruled up

I believe that the effect of the injurious claim is a continuous one that transcends time and place. This has only made me to wonder more what a country we have? I was particularly surprised at the hearing of the case when the court said the file was missing and later when the court said my own processes cannot be found and finally the case is out of time. This only shows that we have a lot to address to bring sanity to our country. Today, I am glad that my voice is not silenced and this is victory for me. I must encourage every woman out there to keep the pace and never stop voicing out against the evil of rape and sexual abuse. Do not be dispirited by today’s court decision.

Commonwealth of Zion Assembly (COZA) founder Pastor Biodun Fatoyinbo is currently being interrogated by detectives at the Force Criminal Investigation and Intelligence Department (FCIID) in Abuja over alleged rape of Busola Dakolo. Mrs. Dakolo in June accused the pastor in a bare-it-all interview of allegedly raping her when she was a teenager inside her family’s sitting room one early morning he came visiting. She gave horrid details of the encounter and explained how the pastor went on to exploit her vulnerability from that day, adding that a few pastors were aware and tried to assuage her family after her siblings took the war to Fatoyinbo back then. Although Fatoyinbo denied the allegation claiming it was a calculated attempt to rubbish him, Dakolo’s case saw many other victims of the pastor’s alleged sexual assault speaking out on social media. Efforts by the Pentecostal Fellowship of Nigeria (PFN) to wade into the matter was said to have been frustrated following the refusal of the pastor to honour their invitation. Already, The Nation gathered that the police have located Mrs. Dakolo’s siblings including the sister she alleged was upstairs the day Fatoyinbo allegedly raped her at her family’s residence. It was gathered that detectives chose to invite the pastor after following other clues to verify certain claims. The pastor whose team was said to have been sent out of the department, was interrogated for several hours by a team specifically tasked to handle the case by the Inspector General of Police (IG) Mohammed Adamu through the DIG Investigation. It was gathered that the detectives may detain the pastor unless there were guarantees he would not jump administrative bail by the police. Confirming the development, Police spokesman Frank Mba, a Deputy Commissioner (DCP) said It was too early to say if Fatoyinbo would be detained, adding that only the investigators can arrive at that decision based on their findings. He said: “Yes, he is currently at FCIID undergoing interrogation. We have been conducting discreet investigation. We are making efforts to reach one or two other pastors she alleged intervened then. “It was a deliberate investigative strategy to bring Fatoyinbo much later after we must have gotten other things. Some Nigerians were thinking we did not want to talk to him but that is not so. “He is with us now and I cannot say if he will be detained nor not. Investigators will have to determine that. They might choose to detain him or grant him bail while investigation continues. “We have the statement of Busola Dakolo already. She earlier made a statement to the police. We’re equally observant of the fact that the Court failed to address the cause of action/subject matter of the suit in determining whether it has jurisdiction to entertain the matter. 3. While we acknowledge the time of the Court, we know in accordance with the Nigerian Judicial system that the Court's decision is not final as it is glaringly contestable. 4. For all intent and purposes and having seen several sponsored misleading reports in the media, we are duty bound to state that the court has not and did not exonerate Mr Biodun Fatoyinbo. As it stands, the substance of the matter has not received any judicial attention. 5. Mr. BIODUN FATOYINBO, through his lawyers, has only argued that the court should not allow the matter to proceed to trial because it is an event that occurred long ago and hence out of time. 6. We shall therefore in this circumstance approach a superior court to intervene for a better appreciation, and take a more expansive view of the suit considering that the subject matter is one that is novel in our clime.” First the case was riddled with reports by the court registrar of missing case files.
