スエードは自分にとってカッコ良さを巡るめちゃ巨大な指針だが、実は長いことこのアルバムの良さがわからなかった。長いし暗すぎる。でも今はこれしか聴けない。もうダメかもしれない。爆裂するバーナードの自意識とのたうち回るギター、悔恨と憂鬱を死ぬほど美しく表現できるブレットの歌唱。薔薇の香りにむせながらベットに伏せ、自らの過ちを悔みながら死ぬ。

中学生の頃に聴いて、アメリカの郊外に暮らす孤独なティーンエイジャーが泣きながらナイフ振り回してるみたいだなとか思った。自分は80年代後半のマイブラの感じが一番ゴスなんじゃないかとか考えてる（どこにでもいそうなのに陰りと華があり、芯を持って怖い音楽を奏でている人たち）ので、その時点でこのジャンル／概念の門外漢なのかもしれない。

ヒップホップ好きな友人にこれを薦めまくって辟易された思い出からもわかるように、これはもはやヒップホップではなくニックドレイク的な何かなのかもしれない。Tigers Jawからここに至る彼の軌跡を考えると、泣きそうになる。自分と誕生日が近いのもあって謎の親近感がある。未だに見た目ただのお兄さんって感じだし、たぶん全然タトゥーを入れてないのも良い。

この映画が好きな奴とは分かり合えるという謎の確信がある。サントラ自体は80～90年代に至る暗くて華のあるロックの総進撃的な内容だが、それよりも劇中で主演のブランドン・リーが雨の屋上で楽器始めたての中学生みたいなギターソロを披露して勝手にエモさ極まった挙句、ギターをアンプに叩きつけて壊すシーンを見て欲しい。ここにゴスの、ロックの全てがあると勝手に思ってる。↓

ここにきてやっとみんなの知ってるゴスがきた、お前はそう思ってるだろう。もはやタイトルに全てが集約されてる気がする。自分にとってゴスは生きるための熾烈な戦いという側面がある。たとえ一人だけになっても美学を保って生き残ってる奴がホンモノだと思う。あと誰も言及してないけど、ドラムがこのバンドの要な気がしてる。

黄耀明「愈夜愈美丽」1995

英題は「Legend - Late Night Beauty」らしい。すごいタイトルだと思う。達明一派を経た香港のポップスターが、西洋への憧れを夜の匂いの中に纏わせた名盤、なのかもしれない。どっちにしろこの人は日本では完全に見過ごされてるので誰かに再評価と言及をお願いしたい。ペットショップボーイズやデビッドボウイらに影響を受け、何かを誤解し、そして作られたのはあまりにもオリジナルすぎるオリエンタル電子歌謡。とにかく關淑怡とデュエットしてる曲を聴いてほしい。あまりに美しいから。彼は故レスリー・チャンとの共作もあり、そちらも素晴らしい。

余談だが、達明一派の片割れの劉以達もすごい才能の持ち主なのでチェックして欲しい。彼のソロアルバム「麻木」は香港のポップシーンと地下音楽界が交錯する凄まじい怪作なので必聴…だけど聴く方法がほぼ無い（YouTubeに昔アップされてたんだけどいつの間にか消されてた）彼が音楽を手掛けたAutumn Moonという映画のサントラも素晴らしい。

Caroline K「Now Wait Fot Last Year」1987

ジャケの曖昧な視線が全てを物語っている。人生の一枚ってくらい大好きだけど、ここまで曇り空と考え事が似合う音楽って無いと思う。ノイズ／インダストリアル的な文脈で語るよりも、初期のFeltやYMGに通ずる諦念と憂鬱を感じる。

そしてこれも余談…。去年の5月にSPREADにアレッサンドロ・アドリヤーニが来た時、彼が何してる人なのかよくわからないまま見に行ったんだけど、まさかこれ再発してる人だとは知らなかった。サンキューとか言えば良かった。

Joseph Fitzgerald Robotnik, also known as Joe Robotnik, or JFR, is the (fictional) junior United States Senator from Florida, the second of nine children of Dr. Ivo "Eggman" Robotnik, and a friend of Sonic the Hedgehog. He is the leader of the "Herobotniks", the Hero faction of the Robotnik family, which is a group dedicated to defending freedom and democracy in the world. He currently serves as Commander in the United States Navy Reserve. A member of the Republican Party, he served as U.S. Representative representing a district for which the town of Green Hill, Florida, is a part of. Joe is currently 35 years old.

Born in Boston, Massachusetts, to a wealthy Polish-American Catholic family, as the second-born child and son of Dr. Eggman and Rose Robotnik (nee Fitzpatrick), Joe is a child prodigy, like the rest of his siblings. His siblings are Ivo Jr., Rosemary, Kathleen, Eunice, Patricia, Robert, Jean, and Theodore, and their grandfather, Patrick Robotnik, was a U.S. Senator from Massachusetts. At the age of 9, he suffered a lab accident that was caused by his father, Eggman, and his older brother, Ivo Robotnik Jr., and the accident gave him the power of super speed, which he used for good, fighting against villains he encounters. He met Josephine "Josie" Graffeo, the oldest daughter of Dr. John Graffeo, an Italian-American businessman and scientist from New York City. Joe and Josie fell in love, and they started dating. He attended Harvard University at the age of 10, with Ivo Jr., graduating with a bachelor's degree at the age of 14. At the age of 15, after receiving his Master's degree in Public Administration, Joe attended Harvard law school, graduating with a Juris Doctor degree at the age of 18, joining the U.S. Navy afterwards, and becoming a Navy SEAL like Ivo Jr. Joe deployed on his first mission to Pakistan. He later became commissioned as an officer and was promoted to Ensign at 19, and would later be promoted to Lieutenant at 21, Lieutenant Commander at 23, and Commander at 25. At the age of 20, Joe married Josie Graffeo, and they purchased a new house in Green Hill, Florida. They would go on to produce 8 children: Arabella, Caroline, Joseph Jr., Anthony, Patrick, Angela, Charles, and John Paul. As a Navy SEAL, he would sometimes fight alongside his brother, Ivo Jr. He served in Pakistan, Somalia, and Nigeria. He was wounded by an IED attack in Somalia, and earned a Purple Heart. He later earned a Navy Cross and a Congressional Medal of Honor. When he was 23, and serving in Nigeria, Ivo Jr., who was serving with him, suffered an IED explosion, which severed his arms and legs. Joe rescued his brother, though the attack costed Ivo Jr. his limbs. Joe later became a Judge Advocate General, or JAG, at the age of 25.

At 29, he left the JAG Corps of the Navy and transferred to the Reserves., and started his election campaign as a Republican, for a seat in the House of Representatives, representing a district in Green Hill. He defeated his Democratic opponent, Leslie Bowden, in the race, with 70% of the vote. During his time as U.S. Congressman, Joe saw his father kidnap animals for roboticization, and he saw a factory that Eggman built in the area. He also saw Sonic the Hedgehog for the first time when he observed him fight against Eggman. After these events, Joe began to rebel against his parents, and he introduced a bill that designated acres of land in Green Hill, as federal conservation area, which passed with bipartisan support from Republicans and Democrats, including his brother, Ivo Jr., who only sponsored, and voted in favor of it to keep his career intact. Joe also started the "Herobotniks" with his sisters, Rosemary Vasquez and Kathy Dalton and their uncle, Gerald Robotnik III (Eggman's cousin). Joe's other sisters, Eunice Schmitt and Jean Donovan, and Joe's brothers, Bobby, and Ted would later join him in the Herobotniks. Joe and his immediate family later met Sonic, and the latter's sidekick, Tails, in person when they were purchasing chili dogs from a chili dog stand, and they became friends, with Joe and the Herobotniks helping Sonic and his friends on their quests.

At 34, Joe launched his campaign for U.S. Senate in Florida. When Sonic was falsely accused of stealing a Chaos Emerald, Joe and Bobby set out to clear his name, with Joe risking his career and election campaign in the process, and that led them to the Space Colony ARK. After the events of Sonic Adventure 2, Joe made governmental reforms as part of his campaign platform, and included the promise to reform GUN as part of his campaign promises. His Democratic opponent was William H. Lodge, a member of the Eggman Empire, which Joe himself is opposed to. Eggman used Lodge to attempt to fold Joe into the Eggman Empire. Sonic and his friends gave their support to Joe, encouraging Floridian voters to vote for him. Joe won the Senate election with 85 percent of the vote, and was sworn in as U.S. Senator, while Bobby was elected as a Congressman to take Joe's place.

While Joe is as ambitious and intelligent as his father, unlike Eggman, Joe does not want to be evil like his father, and he opposes the idea of a dictatorship. A devout Catholic, Joe is a member of the Knights of Columbus, and conducts charity work for the fraternal organization.

Joe Robotnik is loosely based on John F. Kennedy, the 35th President of the United States, and Ronald Reagan, the 40th President of the United States.

Tyrann und Märtyrer

In der deutschsprachigen Bild- und Rechtswissenschaft ist Carolin Behrmanns Buch Tyrann und Märtyrer. Bild und Ideengeschichte des Rechts um 1600 von 2015 ein aktuelles Standardwerk. Das Buch ist ein Must-have. Carolin Behrmann hat am Max-Planck-Institut eine Forschungsgruppe zu Recht und Bild geleitet, inzwischen ist sie Kunsthistorikerin in Bochum, einer ihrer Schwerpunkt lautet dort: Visuelle Kulturen des Rechts vom Spätmittelalter bis in die Gegenwart.

In einem Epilog zu ihren Buch schlägt sie eine Brücke zur Gegenwart, unter anderem zu Texten von Walter Benjamin, Giorgio Agamben, Carl Schmitt und Aby Warburg. Das ist die gegenwärtige Seite, was ist die vergangene Seite, die Seite um 1600?

Das ist ein Bild des Janus bifrons, der für Behrmann Ambivalenz, Vielschichtigkeit und Interpretationsoffenheit zum Ausdruck bringe. Behrmann assoziiert also dieses alte Bild des zweigesichtigen, anfänglichen, römischen Gottes mit Autoren, die sich mit Recht und Differenz in den spezifischen Form der Zweideutigkeit, Ambiguität, Paradoxie, Aporie beschäftigt haben. Behrmann schreibt, in der Rechtsgeschichte liesse sich ein "Dualismus und eine Spannung " ausmachen. Dafür nennt sie eine Reihe von Begriffspaaren, führt also Trennungen und Austauschmanöver vor:

Das ist eine Kaskade aus Trennungen und Austauschmanövern, ein Teil der Kaskaden, denen das Recht aufsitzt, aus denen Recht besteht und die das Recht effektiv machen.

Wenn man davon ausgeht, dass Recht ein Modus der Normativität sei und das beides der Effekt operationalisierter Differenz sei, dann ist beides unterschieden und unterscheidend, getrennt und trennend. Beides kann sich austauschen, weil beides Austausch ist. Unterscheidungen gehen durch Normen, sie trennen noch Normen durch, machen Normen zu mindestens zweiseitigen, zweideutigen, zweischichtigen, zwielichten Stellen, zu Stellen eines Zwistes. Normen tragen Konflikte aus, so, wie man auch Zeitungen austrägt. Insofern gehen die Grenzen des Rechts mitten durch das Recht, auch weil Grenzen durch Recht, dank und mithilfe von Recht gezogen werden. Die Grenzen der Normativität gehen mitten durch die Norm, weil Normen präzise, Präzisionen sind: Sie machen die Trennung vor, wie man anderen etwas vormacht und niemals sicher sein kann, ob und wie sie das mit- und nachmachen. Normen sind das, was Bredekamp einmal über die Kunst gesagt hat: sie sind Medium eines Konfliktes. Weniger hart ausgedrückt sind Normen Medien der Kontingenz, denn sie richten Unterscheidbarkeiten, Unterschiede, Unterscheidungen, also Umgang mit Differenz, vor allem auch unterschiedlichen Umgang mit Differenz ein. Normen lassen Streit führen, sie führen Streit. Sie ziehen die Bahnen, auf denen gestritten wird. Dieser Streit, dieser Konflikt, das kann eine Auseinandersetzung sein und diese Auseinandersetzung kann ein analytischen Zug haben. Differenz, die nicht wahrnehmbar, nicht greifbar, nicht bestimmbar, nicht abstimmbar, nicht eingerichtet, nicht konturiert, nicht gestaltet und nicht gebildet ist, die wird durch juridische Kulturtechniken gegliedert oder zergliedert. Die Differenz wird 'differnziert', sie wird formiert und damit wahnehmbar, (be-)greifbar, sichtbar, effektiv. Die Effektivität dieses Vorgangs hängt daran, inwieweit das, was an der Norm möglich ist, übersetzbar ist.

Ob Behrmanns Liste vollständig ist oder nicht, ob die Begriffspaare Beispiele, Fälle, Besonderheiten oder alles Elemente des Allgemeinen sein sollen: In allen Fällen kann man Behrmanns Epilog auf Theorien beziehen, die unter Normativität nicht einen Wert und nicht ein Sollen, nicht das deontologisch Andere des Seins verstehen oder mit Verbindlichkeit in eins setzen. Man kann sie auf die Forschungen beziehen, nach denen auch das Recht Distanzschaffen und eines von vielen normativen, konkurrierenden und rivalisierenden, widerständigen und instistierenden Phänomenen ist, von denen schon deswegen strittig ist, inwieweit sie unersetzlich oder ersetzbar sind, weil sie diese zweiseitige Form haben. Wer scheidet, kann nicht wissen, auf welcher Seite der Unterscheidung er landet - anhand von Fritz Schulz Vorstellungen über die "Scheidekünste" des Rechts, über Anaxagoras und die "Isolierungen" des römiscen Rechtes, das heißt, an einem von vielen Beispielen, einem auch tragischen Beispiel, habe ich das einmal gezeigt Man Behrmanns Brücke zwischen dem Janus Bifrons und den Begriffspaaren auch auf anderen Theorien beziehen, sie das Recht und die Normativität ähnlich betrachten, sei es Duves Theorie des Rechts als einem Wissen von normativen Regimen oder Möllers Theorie der Normen, Jost Triers Theorie des Nomos oder Luhmanns Theorie der Dogmatik, Vismann Theorie des Rechts als einer "Referenzialität", Hamachers Vorstellung von "Trennungsmacht" oder die psychoanayltisch geprägten Theorien zur Normativität und zur symbolischen Ordnung.

Bei Aby Warburg blättert der Dualismus auf und verzweigt sich, auf Tafeln, als wären dort gleich mehrer Karten (Kartographien) aufgeschichtet. Die Spannung wird sowohl mehr als auch weniger als dualistisch und zweiseitig. Mit einem seiner amtlichen Schreiben, nämlich dem zu der Sitzung des Kuratoriums der KBW im August 1929, wird noch einmal besonder deutlich, dass Warburg, wenn er von Polarität spricht, mehr als zwei Pole im Blick hat und die Vorstellung von Polarität auch auf unterschiedliche Phänomene bezieht. Allein in diesem Schreiben lässt sich ein vierfacher Sinn für Polarität unterscheiden, ein historischer, ein geographischer, ein psychischer und ein gesellschaftlicher Sinn für Polarität.

AXIS Dance Company

AXIS Dance Company was founded in 1987 in Oakland, California, as a company that not only integrates disabled and non-disabled dancers. The company not only integrates dancers of varying abilities but has been guided from its beginning by artistic directors with disabilities. AXIS Dance Company’s first artistic director (appointed 1998) was Judith Smith, a former equestrian who after suffering a car accident in 1977, branched out into dance through contact improvisation (“Activating National and Local Connections to Further Physically Integrated Dance”). Their second artistic director, Marc Brew (appointed 2017), was a dancer who suffered a spinal injury, and was paralyzed from the chest down, but continued to dance and create work (Searle 2018). Judith Smith started the company out strong, commissioning Bill T. Jones to choreograph for AXIS’s first season, grounding the company’s repertoire solidly in the contemporary dance heritage of contact improvisation. Internationally recognized, AXIS continues to tour and educate individuals with all levels of ability (“Mission.”).

Divide was created by Marc Brew for AXIS in 2014 with an original score by Caroline Penwarden, Lighting design by Alan Wilner, and Costume Design by Keriann Egeland for a trio of three dancers (“Divide”, 2014). Its themes of exploring the “divide in human interaction in movement, space and time” were inspired by three designs by minimalist artist Carl Andre: Spill, 8 cuts, and Copper Ribbon, which Penwarden said inspired Brew by their “architectural use of space” (Penwarden, 2014). 

The work fits into post-modernism in a few different ways. One aspect is the extremely minimal set: a completely empty black box except for one jagged line of white tape which divides the space. The costumes are also fairly minimalist; roughly the same regardless of gender (although the men wear pants and socks and the woman’s legs are bare) blue and purple tunic style leotards, with open backs and metallic geometric designs. The focus is instead concentrated on the selective lighting design and the patterns the dancers create through their interaction within the space. 

Another is that the dancers (Nick Brentley, Sonsherée Giles, and Dwayne Scchueneman)(cited incorrectly in the video, correctly listed in “Productions: Divide”) are credited as co-choreographers with Marc Brew, fitting into the post-modern concept of the performer as not just a mouthpiece for the author of a work, but a collaborator (Schmidt, 216). 

In Panaibra Gabriel Canda’s Borderline, the post-dramatic affinity for the “body at risk” uses actor’s disabilities to comment on social “interdependence,” a history of colonialism and suffering, the memories of which are literally “inscribed into performer’s bodies” (Schmidt, 209). While AXIS obviously value the context of disabilities and the support those who have been disabled need, as demonstrated by their entire educational division, and how they make a point of performing for and reaching out to support veterans (“AXIS Dance Company”), inversely, the aesthetic of Divide fits much more into the “disability studies perspective” Tobin Siebers describes as post-dramatic, diminishing disability to a “pure form,” ignoring the “social, historical, and political aspects of [being disabled”(Schmitt, Abstract/Introduction, 206). 

It is evident however throughout Divide how much “disability shapes the artistic form” (Schmidt, 211). Since the dance is structured around what movement the performers can execute, the piece is intrinsically built around the post-dramatic question of “how” (207); how do I accomplish a handstand, a jump, a slide—in a wheelchair? with one arm? The repertoire is inherently post-dramatic because of its research-based and experimental structure (Schmidt, 207). Because each performer’s ability poses new questions, challenges, and possibilities, the choreographer must build an entirely new movement language around each performer’s unique disabilities. Furthermore, Divide has been performed by multiple different casts besides the one in this video, with diverse abilities, so the choreography must be able to continue to change to match that ability (Divide at the San Francisco Movement Arts Festival (SFMAF)). Within the minimalist movement language in which all the dancers perform roughly the same movement, the main interest, and variation of the piece come from the differences in how each dancer accomplishes the same tasks. While you would think this environment in which their abilities set them apart from one another would emphasize their ineptitudes, instead it showcases what each can do best, and simply emphasizes what is present in any dance performance: that the unique way a dancer moves is what personalizes and humanizes us.

Mostly Mezzo Mondays: a recurring (though not weekly) feature where, on Monday nights, I blog a list of the upcoming broadcasts that have caught my eye on World Concert Hall. My interests: baroque vocal music, art song recitals, and a list of favorite singers.

Alice Coote and Michael Schade are scheduled to sing the vocal solos in a performance of Mahler’s Das Lied von der Erde by the Orchestre Philharmonique de Radio France. Olari Elts conducts. Live broadcast Thursday, October 25 on France Musique.*

Karen Cargill is on the program of a concert with the BBC Philharmonic, singing Berlioz’ La mort de Cléopâtre. (Those with an interest in living and/or female composers might like to take note that the program sandwiches two Berlioz pieces between two pieces by Saariaho.) Dame of my heart Sarah Connolly sings the role of Fricka in a deferred broadcast of Wagner’s Das Rheingold from Covent Garden. Her co-stars are too numerous to list in full but one must mention John Lundgren as Wotan, at least; Johannes-Martin Kranzle has been getting rave reviews for his performance as Alberich, and Lise Davidsen (playing Fricka’s sister Freia) made a very positive impression in her recent Verdi Requiem with Dame Sarah. Saturday, October 27 on BBC Radio 3.*

Schumann’s oratorio Scenes from Goethe’s Faust doesn’t seem to be performed often; at least, I cannot say it has ever come to my attention before. A couple of the names in this cast caught my eye, though: I really like Christian Gerhaher and Franz-Josef Selig. I’m less familiar with the distaff side of the cast. If you want to give this rarity a try, it will be broadcast live from the Staatsoper Hamburg this Sunday, October 28 on NDR Kultur. 

Living composer Lucia Ronchetti and her choral piece Inedia prodigiosa are both far from my usual interests, but the title of the work caught my eye and the description on the composer’s website piqued my interest. It reminds me of Caroline Walker Bynum’s book Holy Feast and Holy Fast, one of the most fascinating historical studies I have ever read. I’m not saying I’ll definitely listen—MMM is always a list of what catches my eye as I pore over the schedule prospectively, not a log of my actual listening—but if you’re interested, you can listen to a deferred broadcast this Sunday, October 28 on Rai Radio 3.

Subiu de 116 para 218 o número de desaparecidos após a tragédia que devastou a cidade de Petrópolis no Rio de Janeiro. O número de mortos chegou a 126, segundo o Corpo de Bombeiros. Bild- und Rechtswissenschaften

In den letzten Jahren haben verschiedene Autorinnen und Autoren die Aufmerksamkeit darauf gelenkt, inwiefern bei Aby Warburg Bild- und Rechtswissenschaften ein Verhältnis eingehen. Schon Gombrichs Kommentare in seiner Biographie, insbesondere seine Deutung von Tafel 79, lassen deutlich bestimmte Gesellschaftsmodelle, also auch Modelle über das Verhältnis von Bild, Recht, Religion, Opfer mitlaufen und stellen Warburg als Propagandisten einer römischen Säkularisierung vor. Auch dort berühren sich Vorstellungen vom Bild mit Vorstellungen vom Recht.

A.S. Bruckstein Coruh wiederum hat Warburg als exemplarische Figur einer juristischen Methode vorgestellt, die die Autorin mit einem Warburgschen Wort als Schlitterlogik bezeichnet. Bei Warburg, so legt das Bruckstein-Coruh nahe, werde man Zeuge einer "atomare[n[, a-lineare[n] Form der Denkbewegung, die "nicht von These zu These voranschreite[...], sondern sich vielmehr in der Unbestimmtheit des Textes" aufhiehlte.

In jüngerer Zeit hat Daniel Damler zwar Warburgschen zentrale Fragen und Kernmotive von Warburg aufgegriffen, aber gleichzeitig die Bezüge zu Warburg nicht expliziert. Er nutzt ihn nur, aber immerhin, als stillen Teilhaber seiner Ausführungen über den Laokoon, über Fragen der Verkörperung, über Umgang mit Phobien und Bildern im Recht. Carolin Behrmann wiederum hat ihre großangelegte Darstellung zu Bild und Ideengeschichte des Rechts um 1600 in ihrem Fazit auf prägnanten Deutungen Aby Warburgs und einem Vergleich zu Carl Schmitt hinauslaufen lassen. Dort rückt sie Begriffe der Dualität und Spannung ins Zentrum.

Mir scheinen zwei Dinge wichtig: Zum einen kann man das Verhältnis zwischen Bild und Recht bei Warburg auf der Ebene der Gegenstände thematisieren, mit denen er sich explizit beschäftigt.

Ob das die eher randständigen Bemerkungen zum Bildrecht sind, die Warburg um 1902 herum schreibt, oder ob das die Beschäftigung mit dem heiligen Stuhl, dem Königreich Italien, der römischen Frage und den Lateranverträgen, römischem Verwaltungsrecht und modernen Gründungsmorden ist: Diese Auseinandersetzung würde ich auch dann als eine Explikation, als explizite Auseinandersetzung mit dem Recht verstehen, wenn und wo sie über Fotografien und Tafeln und Tagebücher und Zettel läuft. Obschon es eine Reihe von Autoren gibt, die diesem Material die Sprachlichkeit absprechen würden und es als stummes oder sprachloses Material verstehen würden, obschon es darüber hinaus Autoren gibt, die zwischen Bild und Text auch jene Linie ziehen würden, die das Dogma der großen Trennung tragen soll und vom Dogma großer Trennung geschützt werden soll, nach der also angeblich Bilder im großen Sinne andere Medien seien als Texte, würde ich allen diesen Autoren nicht folgen. Nochmal: meine These ist, dass Warburg hier Recht zum Thema macht, expliziert und sich wie ein Jurist oder Wissenschaftler mit dem Recht befasst.

Das ist aber nur die eine Ebene. Die zweite Ebene betrifft Kulturtechniken, auch solche Routinen, die durchaus stimmlos sein können, die deswegen aber noch lange nicht sinnlos sind. Es betrifft Vorgänge, die außerhalb der Sprache liegen und dennoch wie Sprache strukturiert, symbolisch und normativ sein können. Auf einer zweiten Ebene operiert Warburg nämlich auch dann juridisch, wenn die Gegenstände, mit denen er operiert, gegenüber der Frage danach, ob sie Recht seien oder nicht, ob sie etwas anderes seien als Recht oder nicht, indifferent sind. Er operiert auch jenseits eines manifesten (juristischen) Gesetzes und jenseits eines juristischen Codes juridisch. Warburg operiert juridisch, wenn er (was man auf Tafel besonders gut beobachten kann) protokolliert und wenn er (was auf Tafel 79 besonders gut beobachtbar ist) kommentiert. Diese juridische, kulturtechnische Ebene kann man von der Ebene der Explikation noch einmal unterscheiden. Man kann das die Ebene des impliziten, die Ebene der tacit knowledge bezeichnen. Wenn man das tut, dann wäre wichtig, dass diese implizite Ebene nicht darin aufgeht, das Explizite zu tragen, ihm eine Form oder ein Geschick zu geben oder gar zu beinhalten.

Kurz gesagt arbeitet Warburg also über das Recht, wenn er über die Lateranverträge arbeitet. Er beschäftigt sich mit juristischen Dingen. Und er tut dies juridisch. Beide Ebene kann man unterscheiden, aber sie laufen nun einmal über Stellen, die sie teilen. Man möchte sagen: beides läuft gleichzeitig an einem Ort, das kann man auch sagen, aber die Geschichte ist sedimentär, die gleiche Zeit steckt schon voller Asynchronien und Ungleichzeitigkeiten, Orte häufen etwas an.

Wenn zum Ideal der großen Trennung die Vorstellung gehört, dass ein Wissenschaftler nicht zu engen Kontakt zu seinem Gegenstand aufnehmen darf, und wenn man unterstellt, dass die theoretsiche Reflexion eine erfolgreiche Abtrennung voraussetzt, dann stimmt etwas bei Warburg nicht. Er arbeitet wie ein römischer Schreiber über das römische Protokoll. Er arbeitet wie ein Diplomat über Diplomatie. Er arbeitet wie ein Falter in Falten. Wie wenig sich Warburg an das Dogma der großen Trennung hält, das wird aus Tafel 78 schon auf grelle Weise deutlich. Hier steht römisches Recht vor den Augen, und es steht vor den Augen, wie die notitia dignitatum vo den Augen stehen. Warburg wählt eine tabellarische, kalendarische Darstellung, deren Ähnlichkeit und Referenzialität zwar auch über die frühneuzeitlichen Krönungsdiarien (mit ihren Protokollen des Protokolls, den Zug- und Tafelszenen laufen, die sich aber noch mehr in der Ähnlichkeit zu einem Material und einer Referenzialität verdichtet, deren bekannteste Dokumente aus der Zettelwirtschaft römischer Kanzleikultur stammen und die die modernen Juristen aus ihrer Vorstellung vom römischen Recht verbannt haben. Die großen Reinigungssarbeiten der Editionsprojekte des 19. Jahrhunderts, mit denen die notitia dignitatum bis auf weiteres nicht mehr im Zusammenhang mit den Konstitutionen, den Editionen, den Digesten/ Pandekten und Novellen abgedruckt werden, haben den Stolz der modernen Juristen so befeuert, dass auch so das Dogma gefestigt würde, römisches Recht sei eine Sammlung von Sätzen und Texten, die von römischen Juristen verfasst worden seien. Bis hin zu Fögens Thesen von der Enteignung der Wahrsager, Vec' Thesen vom Ende des decorum, Vestings Konzentration auf Leit- oder Großmedien wie Sprache, Schrift und Buchdruck und schließlich Röhls und Mareks Thesen von der Reinigung der Bilder aus dem Recht hält sich das Dogma der großen Trennung in den deutschsprachigen Literaturen.

Unterstellt man die Thesen der eben genannten Autorinnen und Autoren, dann liegen folgende Schlüsse nahe: Entweder versteht Warburg nichts vom römischem Recht, wenn er statt der Verträge und der Rechtsquellen die Diplomatie, das Protokoll und das decorum zeigt und wenn er glaubt, die notitia dignitatum und der Kalender des Filocalus seien römisches Recht gewesen. Oder aber Warburg ist nicht modern gewesen. Oder man hat mal wieder mit etwas zu tun, was als Ausnahme deklariert werden muss. Oder aber man diagnostiziert mal wieder eine Degeneration der großen Trennung, einen Verlust der Ausdifferenzierung.

Wir können auch anders. Wir, das wären in dem Fall etwa Cornelia Vismann und die Kulturtechnikforschung. Anders als zum Beispiel Vesting hat Vismann nicht die großen Medien, nicht die Medien der großen Trennung, des Take-Offs und der Ausdifferenzierung ins Zentrum ihrer Aufmerksamkeit gerückt hat, sondern die die kleinen, niederen oder "schwachen" (Hensel) Medien, also die Akten, Zettel, Listen, Tabellen und Protokolle ins Zentrum der Aufmerksamkeit gerückt hat.
