Vague-blogging ahoy!!

Yeah, I know, vague-blogging is such the evil nasty and threatening thing to do these days, innit?  Not giving any incriminating details out that link to the people perpetrating the 'wrong-doings’ yet seeing a vast rippling of responses in return that just . . . scream out loud to me and others about how guilty they are feeling.  But vague-blogging also doesn’t give out anyone’s personal information in any way that is threatening or damaging. If it does, it’s not vague.  Unlike what I’ve seen on other remaining unnamed blogs in the last couple of days.

My name. My wife’s name. My MINOR CHILD’S legal deadname first name initial have been publicly shared in order to intimidate, incriminate and to cause emotional distress.  Now, I understand that my mate and I put ourselves out in public to a degree, her by her authorship, myself through other online means, but the children are not. Nor should they be. Esp since the reference is to a deadname and incorrect gender that, frankly, WAS made public knowledge by myself and wife many times. But also, there’s a lot of significant emotional distress that’s been happening in our household as a result of what’s been going on these last few weeks.  Because of direct actionable information that’s being presented about our household online.

In Florida, as well as many other jurisdictions, reports of cyberstalking have grown exponentially in recent years. You may have heard people, or even yourself, say things along the lines of, “my girlfriend broke up with me, but I still stalk her and her new guy on Facebook and Twitter.” But at what point does such online activity amount to criminal cyberstalking? Well, pursuant to Florida Statute §784.048 (1)(d), “Cyberstalk means to engage in a course of conduct to communicate, or to cause to be communicated, words, images, or language by or through the use of electronic mail or electronic communication, directed at a specific person, causing substantial emotional distress to that person and serving no legitimate purpose.” Cyberstalking can involve communications over the Internet and electronic communication forms including, but not limited to: email, instant messages, text messaging, blog, website or online forum postings, and communication on social media sites (e.g. Facebook, Twitter, YouTube, etc.). While Florida law has not specifically defined the phrase “substantial emotional distress,” other courts have interpreted that same language to mean, “the offending conduct must be such as would produce a considerable or significant amount of emotional distress in a reasonable person; something markedly greater than the level of uneasiness, nervousness, unhappiness or the like which are commonly experienced in day to day living.” Wallace v. Van Pelt¸ 969 S.W.2d 380, 386 (Mo. Ct. App. 1998). “
