the coffee shop encounter
This is Part 2. Part 1 will be linked below.
t/w: sugar mommy!reader & sugar baby!Bada, adult!reader & minor!Bada, accusations, little bit of angst
a/n: hi guys! I hope you enjoyed part 1, and if you haven’t read it yet then please read that before you read this but for the best understanding (linked above)!!
=====================================
You hadn’t heard from Bada or her parents in a few days, so you just assumed that they said no and Bada forgot about it, that was until one day you received a phone call from Bada.
“Hi unnie, can you come over to my house today? My address is ***” “sure! I can come, do you need me to bring anything?” “Umm.. I don’t think so” “okay I’ll see you later” “okay bye unnie!”. She sounds cheery, maybe her parents decided in favour of you.
You’re currently in your company building so you decide that it’s probably best to grab some documents before you go just in case Bada’s parents aren’t sure about you.
After grabbing everything that you may need, you get into your car and drive to the address that Bada told you on the phone. It’s a beautiful little house and you gather your belongings before walking up to the door, you quickly fix your clothes before ringing the doorbell, you looked professional as you always do for a day at the company.
Bada opens the door, flashing her gorgeous smile to you and welcoming you in, she points to a pair of slippers she has at the door for you so you slip your heels off and replace them with the comfy slippers before following Bada into the main room where both of her parents are sat.
“Hello Mr and Mrs..” “Lee” the man replies, “ah Mr and Mrs Lee and.. random person it’s nice to meet you, I’m Y/N L/N” “it’s nice to meet you Y/N, this is our lawyer” “so we want to know the basic arrangement first off” “I understand, I would like to support your daughter financially to help her to gain as much experience as possible to help her gain her dream job, all I want in return is to spend time with her” “and about global opportunities?” “I want her to have a look for opportunities that she’d like to do and I’ll pay for the trip and I will go with her, if she’s not comfortable I will get 2 hotel rooms but it’s completely up to Bada”.
“I’ll completely support Bada financially, I’ll pay for her trips, opportunities, dance classes and living expenses, she’ll also have disposable income from me”. “How often would you want to see her?” “At least 1 hour, once a week but it’s completely up to Bada, I am flexible so if there is a week where maybe she’s ill as long as she contacts me to let me know beforehand”.
“Do you have limitations?” “Obviously nothing sexual as she’s a minor and anything that Bada is uncomfortable with is a limit as far as I’m concerned. I would want this to be as comfortable for her as possible”.
“Hmm something seems fishy” “eomma” “you’re a 20 year old millionaire and you’re not a chaebol (nepo baby), how can we be sure you wouldn’t be dragging our daughter into some illegal activity?” “Eomma stop!!” Bada complains before running off to her room. “I understand your concern and I have documents with me which prove I am who I say I am and my profits are correct if you want to see them? I haven’t taken part in identity fraud, embezzlement or tax evasion”.
You hand the documents over to Bada’s parents as they have a look at them. They then hand the documents to their lawyer who confirms that the documents are correct. Bada’s mom holds your hands “Bada has been so excited about this opportunity, now that I’ve made sure that this is safe for her, who would I be if I took this away from her?” “That’s great, thank you!”.
“Could you go fetch Bada from her room?” Bada’s mom asks you “sure I’ll fetch her”. You walk towards Bada’s room, the door labelled with her name and a cute drawing of a wave to match. You knock on the door, “Bada, you okay?” The door is unlocked so you walk in to see Bada lying on her bed facing towards the wall so you can’t see her face.
“Bada” you lay a hand on her shoulder and she flips round to face you. She has obvious tear stains on her cheeks and red eyes. “Aw honey, it’s okay” you give her a hug, “I just can’t believe that my parents would accuse you of something like that”. “It’s okay baby, I completely understand your parents, you’re their little girl, they just want to protect you”.
She hugs you tightly, “I’m glad I’m not going to lose you”, “me? Or this opportunity?” “No you unnie, I noticed you as well in the cafe and I thought you were pretty and when you spoke to me I thought you were really nice and soft spoken”. “That’s so cute Bada, you’re so sweet” “do you think my parents would mind if I kissed you?” You chuckle, “I think so, I’m an adult and you’re a minor, I don’t think they’d be very impressed”. Bada leans closer, “well unnie, to be honest, I don’t care what they think” she turns her head and moves even closer, kissing your lips.
“Bada” “please be quiet unnie” she kisses your lips again. You can’t take it anymore and you pull her closer by her waist and kiss her passionately. Good thing her parents didn’t see.

i've been putting this off for a while since idk i felt kinda weird about it but. things are really ramping up at my graduate school as we prepare for the possibility of a strike. as a board member, it's been an incredibly tough semester that, combined with the amount of work i'm doing to prep for my qualifying exam this december, has kept me from being able to offer commissions at a regular enough rate to combat the rising cost of living.
i want to say that while i'm going to plug my kofi, i also want to plug our strike fund. all use of the funds collected will be voted on by our members, but we're setting up a hardship system for urgent expenses for our members and prepping to feed people and pay for our lawyer and ensure that our most vulnerable students, international students, are able to get ahead of any challenges to their visas.
in the meantime, we're looking at the following possibilities (almost certain for board members, as the university has direct access to our names whereas our broader membership is harder to track in a strike):
we won't be paid during the period of the strike
we'll be charged for tuition remission during the strike
our health insurance will be prorated and we will have to pay daily charges on it during the strike (in a global pandemic)
the university can hire anyone they want to work as scabs
i hate hate hate asking for anything, and please know you are not in any way obligated to donate, or even to reblog and share. i'm paid better than a lot of the people who work here, and i want to be transparent about that. but the fact is that we are fighting an incredible amount of union busting rn and the university board has far more resources than we do. they're working with the law firm that attempted to break the PMA's strike (unsuccessfully) while our contract pays the majority of workers between 19-21,000 a year (before taxes) to live in a city where the current cost of living is calculated at 38,000. international students legally cannot work elsewhere unless it is under the table. we have no dependent healthcare coverage, and to provide for family members throughout the year with the current dependent plan would take 60% of the average annual paycheck. we have only 5 days of paid parental leave, and 15 days unpaid. other universities in the city have recently increased their stipends by massive amounts, while ours continues to say they are happy with the contract as it is, offer us "generous" raises of 300$ a year (which is what some of their negotiation team make in a few hours), and treat us like children.
i'm sorry this has ended up so long, but it's really pretty stressful right now. the next few months are complete unknowns, and the only option is to move forward. thanks for listening and reading.

Over the past decade, Donald Trump has alleged or amplified the idea that the following things are “hoaxes”: Barack Obama’s presidency, global warming, a CNN story about the Secret Service, accusations of sexual assault against him in 2016, allegations that his 2016 campaign colluded with Russia, the hacking of the Democratic National Committee by Russia, Russian interference in the 2016 election, the dossier of reports compiled by Christopher Steele, allegations against Supreme Court nominee Brett M. Kavanaugh, the Ukraine impeachment probe, Russia’s support for his candidacy, Russians offering a bounty on killing U.S. troops, a story about NASCAR driver Bubba Wallace, a funding gap at the Postal Service, claims he disparaged military dead, mail ballots, the election, a former staffer’s description of his administration, claims about his tax payments and Democratic responses to the pandemic.
These charges have often been rebutted either in immediate response to Trump’s comments or, as in the case of his claims about the investigation into Russian interference, repeatedly and in a multitude of contexts. But Trump nonetheless continues to both present many of these situations as “hoaxes” and to classify various other things using the same word — to the point that it’s impossible to take such claims seriously.
In the abstract, Trump’s general lack of credibility on what may or may not be a hoax is not terribly important. But in the context of a lawsuit centered on allegations that he sexually assaulted author E. Jean Carroll several decades ago, Carroll’s lawyers found it useful to point out that Trump simply says everything is a hoax, even when he obviously doesn’t think it is.
As when he said that about Carroll’s accusations.

THE KIDS DON'T BUY IT... (the US propaganda machine is really actually dead)
The Great Nation of America the Make Her Great Again has lost the propaganda war against herself. This is both good and very bad news. Because, for as long as I can remember—and likely as long as you can too—Western media was virtually the only dog around. It kept us on the same page. From the same nightly briefing around the tube with Dan Rather to the series finale of the Sopranos, we were all in it together. Not anymore. Now, we’re tribal viewers, tribal in our propaganda tastes. And this means, of course, we’re ripe to be balkanized by savvy media overlords.
In many ways, our media unity was a strength. We knew ourselves as American citizens, not as members of the global tribe. The ubiquity of net technologies changed this a little, introducing some to foreign news sites or blogs or even social media. But the arrival of the global identity is ultimately brand new. Here in the states especially, Tik Tok has allowed for the proliferation of global opinion like never before, but even as recently as the last pandemic, something like public shaming and outright censorship kept American hearts firmly rooted in we’re the good guys territory. And this was despite the whole rabid Trump vs. Decency sentiment shared by half the country. Throughout it all, Americans huffed their own propaganda, content on the same old supply. Fastforward to the end of Biden’s first term, and everything has changed.
Somehow, Americans themselves have turned on their own propaganda machine.
Not merely the straightforward uncut propaganda coming out of the Pentagon. Surely, we’ve bucked that stuff before. Suddenly it’s the whole goddamn thing we’ve had enough of—Disney, Nickelodian, Fox and other media giants have all been demoted. Rather than trusting their worldview and accepting their products in good faith, Americans have waged a bipartisan information war against the giants. Viral exposes, memes, and good taste leave the Disney and their ilk struggling in a new geography of total suspicion, digilence, high accountability, and a newfound self respect.
Devastatingly for the machine, all this change has raised America’s collective expectations when it comes to our own entertaining propaganda. America’s total denial of the half assed bunk being pushed for propaganda these days really is a problem, however.
Tumblr media
The truth is that US foreign policy in the Middle East and our military spending in Ukraine, coupled with the massive systemic failures at home—from immigration and border issues to inflation and economic pressure—average Americans are disgusted. We cannot watch our tax dollars being poured into the genocidal military campaigns being waged by Israeli PM Netanyahu’s regime and simply nod along.
Incredibly, the Biden administration acts oblivious to the bipartisan disgust. It’s no wonder. Since Bush the Younger, every president has embraced largely the same psychopathic cadre of arms dealers, bankers, and warmongers. Examples like Bush-era lawyer Philip Zelikow, who led the 9/11 Commission while being instrumental in designing the invasion and strategy of the Iraq war, and he’s likely to be picked to lead the upcoming Covid-19 Commission.
Only this time, we remember the lies about Iraq’s non-existent nukes, and we all see what’s really playing out in Gaza. Many see the same horrifying disregard for human life in our military support for Ukraine despite hundreds of thousands of losses and the total leveling of a culture with almost no real chance of victory. We all see the callousness of the gunrunners that control our foreign policy, and we’re tired.
The danger now is real, and it’s clear.
By breaking away from our own establishment’s narratives, we both win and lose the propaganda war. Two things are bound to happen:
Our own rogue system and its panicking agents will do anything necessary to stay in power, and the slipping grip on our minds and souls will be supplemented by a new grip on our wallets, freedoms, and bodies.
The second part is this: when our elite lose the propaganda war, it’s a global loss. As ordinary people, we can’t broadcast ourselves effectively to the whole of the globe like our sinking mess of an establishment can. Foreign adversaries and any others looking to fill the vacuum will absolutely profit and benefit enormously from America’s losses.
Attempts at fomenting chaos inside the country will come both from our own establishment and intelligence agencies and known and unknown foreign actors. We can be sure of that. Much of the time, the most effective propaganda is simply the truth—half cocked, emulcified and cut with baby powder, but a version of real events none the less.
A real break with the machine’s narratives at the critical mass we seem to have reached is, in my lifetime, unprecedented. It doesn’t make me giddy, though. I’m wary of it all. There’s an paranoia, a tension in the climate. More and more, a growing dread.
Now is the time to keep your head. Apply pressure. Regimes do not die peacefully in the Land of Make Wall Street Great Again Land. Act accordingly.

At this stage, we should bear in mind main benefits of investing in Istanbul and other cities of Turkey.
Is Turkey a Good Investment Because of Fast Growing Economy?
It is critical to note that Turkey is recognized as being in the top 20 economies in the world. Therefore, the Turkish country attracts numerous foreign investors from every single region. Besides, Turkish authorities attach a high priority to the encouragement of foreign investment. The Country provides a broad range of initiatives for FDI.
Is Turkey a Good Investment through High Youth Population Rates
Compared to 10.6 percent of the European Union, despite a slight decrease, Turkey’s youth population constitutes 15.3% of total population. This makes Turkey a good place for large-scale investments.
Expand Your Business through High Workforce Rates

Hence, the Turkish environment is very close to the properly functioning markets from the east and west. Investing in İstanbul is seen as a gateway between different continents by business lawyers and entrepreneurs.
Is Turkey a Good Investment In Terms of Income Tax Commitments?
The question of how foreign investments are taxed in Turkey is open to discussion. In that respect, it is significant to note that the Turkish taxation system is based on residency.
In accordance with the Law on Income Tax, natural persons who are not resident in Turkey are only taxed on their earnings generated in Turkey.
Taxation rules dramatically change if the relevant natural or legal person has a permanent residence in Turkey.
Also, there are regulations and international agreements preventing double taxation and promoting trade in Turkey.
In accordance with the Law on Corporate Tax, that is also the case for legal entities. In this sense, foreign companies are only taxed on their earnings generated through their operation in Turkey.

United States Senator Kyrsten Sinema (I-Arizona) is embroiled in a tough 2024 reelection fight due to her defection from the Democratic Party last December and her controversial closeness with corporate lobbyists. This week, The Intercept's Daniel Boguslaw reported that Sinema also has ties to billionaire Leon Black, who stands accused of raping a sixteen-year-old girl inside now-deceased sex-trafficking financier Jeffrey Epstein's Manhattan townhouse in 2002.
"In 2018, Black and his wife together made a $5,400 donation to Sinema's campaign, the maximum legal contribution at the time. Three years later, Black was out from the top post at Apollo Global Management, the firm he helped found, after it was revealed that he paid the disgraced financier Epstein more than $150 million for estate planning and tax services," Boguslaw wrote. "The Senate Finance Committee is currently investigating that payment and whether it involved tax evasion."
Support from "private equity leaders like Black quickly evolved into a full-scale industry feeding frenzy," Boguslaw explained, noting that "Sinema has raked in well over $3 million from investment and private equity firms in the past six years."
READ MORE: 'Red flags': Kyrsten Sinema ramps up security spending with company owned by Tulsi Gabbard’s sister
Boguslaw learned from data furnished by Open Secrets that "employees at Apollo Global Management represented the single largest corporate donor base to Sinema’s campaign committee between 2017 and 2022, contributing a combined $172,025," adding that Sinema's "coziness with the industry has guided her hand against key Democratic priorities, including those designed to raise taxes on the wealthy in an effort to balance the federal budget. Sinema's obstinance has soured her standing in her own state."
Meanwhile, Boguslaw continued, "The Senate committee interrogating Black's finances has accused the former executive of consulting with Epstein to avoid hundreds of millions in taxes with payments that 'were inexplicably large; well in excess of what Black paid any other financial advisors and far higher than the median compensation of Fortune 500 CEOs at the time.'"
Boguslaw noted that the Senate probe commenced within days of Black's third rape allegation, which "alleges that Epstein confidant and convicted sex trafficker Ghislaine Maxwell had trafficked the then-16-year-old girl to that location. Black's lawyer denied the allegations and said that the plaintiff holds a 'vendetta' against him."

Indiana Attorney General Todd Rokita filed a lawsuit this week against a national Black Lives Matter charity for failing to fork over information about its finances.
The lawsuit is part of an investigation Rokita launched against the Black Lives Matter Global Network Foundation in February that is seeking to determine whether the embattled charity violated Indiana state law by deceiving donors and misapplying its assets.
“Protecting Indiana consumers from this house of cards is critical,” Rokita said in a statement Thursday. “There are concerning patterns of behavior from this organization, and we will do what it takes — including this lawsuit — to get to the bottom of it.”
BLM ACCOUNTING GIMMICK FURTHER DELAYS DISCLOSURE OF ITS $60M BANKROLL
The foundation claimed to have raised $90 million in 2020 in the aftermath of George Floyd's killing, but the charity has yet to file an IRS Form 990 disclosing what it did with the funds. The charity was exposed in early April for trying to conceal its cash purchase of a $6 million Los Angeles mansion with donor funds in October 2020, which a watchdog group alleged could be a violation of IRS charity laws.
The Black Lives Matter Global Network Foundation has also yet to announce publicly who has been in charge of the charity since its co-founder Patrisse Cullors resigned in May 2021 amid the scrutiny of her own real estate purchases. However, the group did disclose in filings to California and New Mexico in February that Bill and Hillary Clinton insider Minyon Moore and the law firm run by Democratic lawyer Marc Elias had taken up key roles with the charity.
And in February, the foundation shut off its ability to raise funds amid legal threats from California and Washington over its lack of financial and operational transparency.
Rokita sent a civil investigative demand to the charity on Feb. 23 that requested the charity to disclose all of the property it owns in Indiana, as well as produce a general ledger showing all payments and the recipients of those payments that the charity has made since January 2020.
The foundation did not respond by Rokita's March 25 deadline, he said in his lawsuit Tuesday. The attorney general's lawsuit requested state courts to compel the Black Lives Matter Global Network Foundation to comply with his records request.
“There are many Indiana stakeholders and donors who have been impacted by these allegations. This lawsuit will allow for a court to swiftly and efficiently resolve the state’s request for information,” Rokita said.
He added that the foundation could be barred from future fundraising in Indiana if the charity fails to comply with his demand.
Cullors, who was in control of the foundation while it raked in $90 million in 2020 and spent $6 million on its Los Angeles mansion, said during an event in early April that she finds it "triggering" whenever she hears terms such as IRS Form 990, which is the document charities are required to disclose to the public detailing their financial activities.
She added that activists suffer trauma and their lives are put at risk when their charities are required to disclose publicly what they did with their tax-deductible donations.
"This doesn't seem safe for us, this 990 structure — this nonprofit system structure," Cullors said. "This is, like, deeply unsafe. This is being literally weaponized against us, against the people we work with."

Accordingly, value added tax will be reduced from 10% to 8%. This reduction will create conditions for consumers to increase spending, through which businesses will sell more products.
The value-added tax reduction will be applied to groups of goods and services currently subject to the 10% tax rate, except for the following groups of goods and services: (i) Telecommunications, financial and banking activities commodities, securities, insurance, real estate trading, metals and prefabricated metal products, mining products (excluding coal mining), coke, refined petroleum, chemical products; (ii) Products, goods and services subject to excise tax; (iii) Information technology under the law on information technology. However, if the goods and services are not subject to value-added tax or subject to value-added tax of 5% according to the provisions of the Law on Value-Added Tax, the provisions of the Law on Value-Added Tax shall be applied and not entitled to value added tax reduction.
It is important to note the value-added tax calculation method to apply. Accordingly, if the enterprise calculates value-added tax by the deduction method, the value-added tax rate of 8% shall apply; and in case the enterprise calculates value-added tax according to the percentage method on sales, collected, it will be reduced by 20% of the percentage rate for calculating value-added tax when issuing invoices for goods and services eligible for value-added tax reduction as prescribed.
The value-added tax reduction will be implemented quickly and businesses and consumers will immediately benefit. This tax reduction is expected to help reduce the cost of products and services, thereby stimulating consumer demand. Besides, it will help increase production output of enterprises and create more jobs for workers. Therefore, the reduction of value added tax is considered necessary solutions to promote the economy to recover soon after a long time affected by the pandemic.
The value-added tax reduction policy will be effective from February 1st, 2022 to the end of December 31st, 2022. Previously, value-added tax was only reduced for a few specific products, but with this policy, the object of tax reduction has been expanded in most fields of business and production. Therefore, the impact of this policy on the economy in the future is very large. However, in order for the value-added tax reduction to reach consumers, tax authorities need stricter inspection and control to meet the set goals. When in doubt, it is important to consult with tax lawyers in Vietnam for solutions and advice.

(I copied this from the Financial Times so you don't hit the paywall) The sultan, his family and a $15bn dispute over oil in Malaysia
The heirs to the last ruler of Sulu have seized state-owned energy assets in a lawsuit that dates back to colonial Britain
Oliver Telling in Singapore and Leo Lewis in Tokyo
It is an unlikely setting for a legal fight over a British colonial holdover. But at lunchtime last Monday, a bailiff walked into a serviced office building in the Avenue John F Kennedy in central Luxembourg to serve an asset seizure notice on two subsidiaries of one of the biggest energy companies in the world, Petronas.
It was a stunning salvo in a $15bn legal battle that centres on a Malaysian state about 11,000km away, and involves descendants of a former sultan, a land deal with British colonialists, a publicity-shy London-based litigation fund and a dispute 144 years in the making.
That same afternoon, the bailiff, appointed by claimants in the Philippines, visited the headquarters of nine banks dotted around Luxembourg, handing financiers across the European tax haven the same demand to freeze the accounts of the two Luxembourg-based subsidiaries — Petronas Azerbaijan (Shah Deniz) and Petronas South Caucasus.
Unless Malaysia acknowledges the legitimacy of their claims, say the claimant’s lawyers, there will be more seizures of state-owned assets like Petronas in the coming weeks. Other units from the company’s vast global business network or even insolvent state investment fund 1MDB could be a target.
When word of what was happening in Europe reached the Petronas headquarters in Malaysia — the twin 452m-high glass towers that dominate the Kuala Lumpur skyline — a terse statement from the company confirmed the delivery of the saisie-arret and vowed to fight for its assets.
The case, which until now has attracted little international attention, centres on competing claims over the oil-rich Malaysian state of Sabah. The eight claimants say they are the heirs of Jamalul Kiram II, the last formally recognised sultan of Sulu, a small archipelago in the nearby Philippines. For several years they have been seeking compensation for the land that their ancestor leased to a British trading company before the discovery of vast natural resources in Sabah. The heirs, backed by a London law firm, have been bankrolled by a UK investment fund, Therium, in a litigation process that has now cost in excess of $10mn.
Petronas, whose business generates 11 per cent of Malaysian government revenues, was only dragged into the case with the seizures on Monday. The proceedings have been described by legal experts as one of the most unusual international arbitration disputes in history.
It does not seem to have a precedent, says Colin Ong QC, a prominent arbitration lawyer not involved in the case. “No one could have predicted 144 years ago that an agreement signed in Borneo during British colonial times would give rise to such a dispute today.”
In March, an arbitrator in France, Gonzalo Stampa, ruled in favour of the sultan’s heirs and found that Malaysia, which inherited the obligations of the 1878 lease agreement upon securing independence from the UK in 1963, must pay them $14.9bn in compensation. An earlier hearing in Spain had stalled after Malaysia complained that communications were not properly handled.
Malaysia is appealing against Stampa’s ruling and has condemned the case as an attack on its sovereignty. Some Malaysians have even questioned whether the claimants are the genuine heirs of the Sulu sultan.
A day after the seizures, a Paris judge suspended the enforcement of the $14.9bn award until the appeal is concluded. This prompted Kuala Lumpur to declare that the award could no longer be enforced anywhere in the world. But independent legal experts and a Spanish PR company, Estudio de Comunicación, which is representing Malaysia in Europe confirmed that the suspension only applies in France.
Although the arbitrator made his decision in February, the Malaysian government was caught off guard by the asset seizures in Luxembourg and by the prospect that they could now continue elsewhere. The move sparked panic in Kuala Lumpur, with two Malaysian MPs seeking an emergency debate in parliament and the government announcing plans to launch a Sulu “task force”.
The Sulu heirs’ representatives argue they were pushed to take these measures after Malaysia refused to engage. Paul Cohen, lead counsel for the claimants and a lawyer at London-based 4-5 Gray’s Inn Square, says litigation was the “final resort”.
“More than one Malaysian government refused to respond to our clients’ direct approaches in the past few years,” Cohen says. “Given that the Malaysian government knew who they were, and knew every aspect of a 140-year-old contract, this was clearly a tactic to freeze off confrontation and resolution.”
Bankrolling the sultan’s heirs
The award could also deliver a windfall for London-based investor Therium, which according to multiple people close to the case is backing the Sulu heirs financially. The cost of pursuing arbitration cases over a number of years represents a substantial financial gamble on the outcome of each case, and would typically run into tens of millions of dollars. The eight descendants, who live in the Philippines, are not wealthy and include several retirees according to their representatives.
The litigation fund, which says it has raised $1.1bn to finance various cases since it was founded in 2009, declined to comment. In the past, it has publicly backed less geopolitically sensitive cases, such as last year’s high-profile appeal against the wrongful conviction of UK Post Office workers.
The case has come at a critical time for Malaysia, which has had three prime ministers in as many years. The south-east Asian country has been embroiled in a political crisis since 2015, amid subsequent revelations that billions of dollars had been embezzled from 1MDB. Petronas, one senior Malaysian minister recently suggested, will be central to the government’s efforts to rebuild the post-pandemic economy.
The state-owned enterprise has this year cashed in on soaring oil prices sparked by the war in Ukraine. In the first quarter, its pre-tax profits surged 114 per cent to $7.1bn compared to the same period in 2021. Zafrul Aziz, Malaysia’s finance minister, told the Financial Times in April that the boom in commodity prices could help Malaysia reduce its debt.
But additional seizures by the Sulu heirs could set back Malaysia’s recovery.
The present value of the Luxembourg holding companies seized by the Sulu heirs is unclear. In February, they liquidated a 15.5 per cent stake in Azerbaijan’s Shah Deniz offshore gasfield, previously valued at almost $2.3bn. Petronas said the proceeds from this sale were “repatriated”, but declined to comment on how much the subsidiaries are worth now.
As long as Malaysia refuses to accept the award, its debt to the claimants is likely to increase. For every year it goes unpaid, the money owed will increase by 10 per cent, it was decided in Paris.
Zafrul dismissed the significance of the French ruling in April. “The Malaysian economy size is RM1.5tn. The $15bn is about RM40bn . . . Our country, [will] we crash after [losing] that 3 per cent?” he asked sarcastically. He dismissed the claim as “a frivolous, no-basis case”.
Legal fight goes global
The case has touched a nerve in Malaysia, which has fended off claims to Sabah, a region measuring roughly 74,000 sq km with a population of almost 4mn, for decades. The Philippines, which lies to the north east, has a historical claim to the state that some politicians have continued to revive.
Jamalul Kiram II died in 1936 without leaving a direct heir, but since then a procession of Filipino citizens have made claims to the throne that for centuries ruled a region spanning modern day Malaysia and the Philippines. One man, Muedzul Lail Tan Kiram, reportedly still claims to be the living sultan of Sulu.
In 2013, the followers of one self-proclaimed heir arrived in Sabah to lead an invasion that plunged the normally peaceful corner of Malaysia into violent chaos. During the ensuing fight with security forces, at least 60 people were reported killed before the invaders — who numbered no more than 180 — retreated.
Up to that time, the claimants said Malaysia had paid them an annual stipend of $5,300, in recognition that they were relatives of the late sultan and successors of the 1878 agreement. After the attack, Kuala Lumpur halted the payments, despite a former Malaysian attorney-general later acknowledging there appeared to be no evidence linking the armed invaders with the heirs who had been receiving the yearly fees.
In 2017, the descendants declared their intention to take legal action, a move that has reignited anxiety over Sabah in Malaysia and exposed Britain’s messy colonial legacy in the country.
“This case is the history of colonialism, with a twist,” says Elisabeth Mason, a lawyer at 4-5 Gray’s Inn Square.
“Imagine that, instead of buying Manhattan for 60 guilders, Peter Minuit signed a perpetual lease,” says Mason, referring to the Dutch colonialist who acquired Manhattan Island from the Lenape Native Americans. “Surely by now, the Lenape tribe would have looked from Wall Street up Broadway to Lincoln Center and Central Park and concluded: ‘60 guilders isn’t anywhere near enough. It’s high time to renegotiate this deal.’
“That’s exactly what’s happened here,” she adds.
Malaysia has on several occasions attempted to shoot down the proceedings. It now says it has opened a criminal investigation into Stampa, who began the proceedings in Spain but moved the case to France after it was suspended in Madrid. Stampa declined to comment. According to Ong, international law allows arbitration hearings to be relocated when they become “unduly difficult”.
Following the arbitrator’s ruling in February, independent lawyers were bemused by Kuala Lumpur’s decision to send “diplomatic notes” to every signatory of the New York Convention on enforcing arbitration awards, of which Malaysia is a member. Such a move, they said, suggested that Malaysia hoped it could influence foreign courts.
“How can that even be done?” asks Roger Chin, partner at Chin Lau Wong & Foo and president of the Sabah Law Society. Malaysia is “in a way [undermining] judiciaries’ independence by saying: ‘don’t look at it’. That is obviously quite wrong”.
A representative for Malaysia said the country is taking “every action it deems necessary to make known its position regarding the conflict”. They added that the arbitration was not valid after Stampa’s appointment was overturned in Spain, and the award’s suspension in Paris is grounds for other countries to refuse its enforcement.
The right heir?
Stuck in the middle of the legal wranglings are the people of Sabah, Malaysia’s poorest state, where according to government data almost a fifth of the population lived below the poverty line in 2019. While those the FT spoke to were strongly opposed to the Sulu descendants’ claims, they also felt let down by the national government.
A revolving door that has delivered three governments in three years has impeded efforts to challenge the case, according to Chin. “With different attorneys-general and each one coming in without having served for a very long time, that really has an effect.”
The national government needs to bring the people of Sabah into the discussion, says Shari Jeffri, a banker who has been researching the region’s history for 20 years. He says he has historical records showing the land was never the Sulu sultan’s to lease in the first place, as it belonged to the sultan of Brunei.
“Why are [the Sulu heirs] bringing up the historical claim? I would rather the Malaysian government give the money to Sabah,” he adds. “We need the infrastructure.”
The claimants say they intend to dedicate a “sizeable percentage” of the proceeds to addressing issues in the region spanning the former sultanate of Sulu, including education, healthcare and housing.
The case has also reignited fears about the Philippines reopening its claim to Sabah. Its new president, Ferdinand Marcos Jr, is the son of the late dictator who once argued Sabah belonged to the Philippines.
“The arbitration ruling has given ordinary Filipinos [the idea that] they have a chance of success,” says Yong Teck Lee, former chief minister of Sabah. “Among ordinary Malaysians in Sabah, at the back of our mind is this anxiety.”
The most pressing issue for the government in Kuala Lumpur is how to prevent the Sulu heirs from hoovering up more of the state assets that form the backbone of the national economy.
The claimants’ lawyers warn that more state assets will be pursued unless a resolution is reached.
“International law doesn’t let you pick and choose,” says Cohen. “Either Malaysia honours its international obligations, or it goes ‘full Russia’.”
“The seizure process is a rolling programme that is designed to meet our clients’ financial demands,” he adds. “But we hope Malaysia will see the cost of being a legal pariah state and come to terms.”
Additional reporting by Eleanor Olcott in Taipei
Anyways, guess who lives in Sabah and is seeing the consequences of colonialism and their stupid ass poorly worded contract legalese?
Also I'm cranky, the supposed heirs are a bunch of impoverished people living in a backwater village in Southern Philippines where the villagers have been generationally brainwashed into serving them hand and foot; the news broadcasts featuring these heirs making statements from their nicest sofa in decrepit wooden homes are somewhere online but they were going around especially during the incursion where I was praying the reporters I know, who went down to the area to cover it, won't get MURDERED by the followers of this so-called heirs of a long dead sultanate ruling over nothing but demanding money endlessly like a extortionate loan shark. And yes, there's cellphone footage of the gun fights between the heavily armed invaders (they brought bazookas?!) and the armed forces. (One of the reporters was my classmate who sat next to me for all of Form 5 in high school)
My unproven and personal theory that the Philippines government have done nothing to deny the claims of a contemporarily non-existent sultanate kicking around in the part of the country that they've usually scorned is because they want to hold a card to some day have all the shiny shiny gloopy petroleum deep sea reserve off the coasts of Sabah, and strip bare all our already declining virgin forests.
Anyways, it is extremely telling that these people (scammers) are going after the oil and money, and not the right to govern over the land and its people.
