The Supreme Court on Friday invalidated President Joe Biden’s student loan debt relief plan, meaning the long-delayed proposal intended to implement a campaign trail promise will not go into effect.
The Justices, divided 6-3 on ideological lines, ruled in one of two cases that the program was an unlawful exercise of presidential power because it had not been explicitly approved by Congress.
The court rejected the Biden administration's arguments that the plan was lawful under a 2003 law called the Higher Education Relief Opportunities for Students Act, or HEROES Act. The law says the government can provide relief to recipients of student loans when there is a “national emergency,” allowing it to act to ensure people are not in “a worse position financially” as a result of the emergency.
Chief Justice John Roberts said the HEROES Act language was not specific enough, writing that the Court's precedent "requires that Congress speak clearly before a department secretary can unilaterally alter large sections of the American economy."
The plan, which would have allowed eligible borrowers to cancel up to $20,000 in debt and would have cost more than $400 billion, has been blocked since the 8th U.S. Circuit Court of Appeals issued a temporary hold in October.
About 43 million Americans would have been eligible to participate.
The student loan proposal is important politically to Biden, as tackling student loan debt was a key pledge he made on the campaign trail in 2020 to energize younger voters.
The ruling will immediately put pressure on the Biden administration to find an alternative avenue to forgive student debt that could potentially withstand legal challenge.
Advocates, as well as some Democrats in Congress, say the Education Department has broad power to forgive student loan debt under the 1965 Higher Education Act, a different law to the one at issue in the Supreme Court cases.
Separately, the student loan repayment process is set to begin again at the end of August after having been put on pause during the COVID-19 pandemic, although first payments will not be due until October.
The court considered two cases: one brought by six states, including Missouri, and the other brought by two people who hold student loan debt, Myra Brown and Alexander Taylor. The court ruled that the program was unlawful in the case brought by states but found in the second case that the challengers did not have legal standing.
The three liberal Justices on the conservative-majority bench dissented, with Justice Elena Kagan saying that by ruling against the plan, the Court had "exceeded its proper limited role in our nation's governance."
She said the states bringing the challenge did not have legal standing to even bring the case, and in analyzing HEROES Act, the conservative Justices ignored the clear language of the law.
"The result here is that the Court substitutes itself for Congress and the executive branch in making national policy about student-loan forgiveness," Kagan wrote.
The Court decided the case in part based on a legal argument made by the challengers that the conservative majority has recently embraced called the “major questions doctrine.”
Under the theory, federal agencies cannot initiate sweeping new policies that have significant economic impacts without having express authorization from Congress.
The conservative majority cited the major questions doctrine last year in blocking Biden’s COVID vaccination-or-test requirement for larger businesses and curbing the authority of the Environmental Protection Agency to limit carbon emissions from power plants.
The challengers argued that the administration’s proposal — announced by Biden in August and originally scheduled to take effect last fall — violated the Constitution and federal law, partly because it circumvented Congress, which they said has the sole power to create laws related to student loan forgiveness.
Biden had proposed canceling student loan debt during the 2020 presidential election campaign.
The administration ultimately proposed forgiving up to $10,000 in debt for borrowers earning less than $125,000 a year (or couples who file taxes jointly and earn less than $250,000 annually). Pell Grant recipients, who are the majority of borrowers, would be eligible for $10,000 more in debt relief.
The administration closed the application process after the plan was blocked. Holders of student loan debt currently do not have to make payments as part of COVID relief measures that will remain in effect until after the Supreme Court issues its ruling.
The nonpartisan Congressional Budget Office estimated in September that Biden’s plan would cost $400 billion.

Dick puts everything on the line. He's the last one standing. The rest of the Titans are down. He dies making sure that they, and the world, can live.
Then he wakes up, staring at a ceiling dotted with glow in the dark stars, very confused.
There's a redheaded teenager who calls herself Jazz, who seems suspicious of him. He had parents, ghost hunters who are definitely breaking many, many laws, who love him dearly.
He has a pair of very close friends, Tucker and Sam, who also do not trust him.
There was a funeral for Dick Grayson, he looked it up. There was a corpse and everything, cremated exactly as he had demanded after learning what had happened to Jason.
Just in case it's a fluke, and he's about to be thrown out of a body that isn't his, he doesn't reach out to anyone in the hero community just yet. Instead, he decides to look into who, exactly, is Daniel Fenton, and why do his friends and sister keep looking at him like he's a spy?
Or; Danny, growing more and more powerful as a halfa, was starting to have his ghostlyness leak through to his human form. He asked Clockwork if there was a future where Jack and Maddie would ever accept him being half ghost, and Clockwork informed him that no, there was not. So Danny worked with the Yetis in the Far Frozen to make a lifeless clone of himself, with the intent to fake his death and live on in the Realms. So when Jazz came into his room, fully expecting a lifeless clone, only to find the clone not only alive but fully functional, she's suspicious.

Cause obviously. Their completely legit research disproves multiple peer reviewed and factual papers.
Tucker made the fake account. No real names or numbers. So. They couldn’t know it was him right?!??
He just wanted people to see how wack the papers were and bring to light the very not accurate papers. He figured using botched research to counter claim others would do something.
But??? Why was the flash in his living room arguing with his parents about scientific articles. And proper research??

I think a lot about Leo’s tendency to push his way into the spotlight despite clearly being a natural in the shadows. Hell, you could argue that his worst moments are when he’s forcing himself onstage, and his best are when he does things no one notices until it’s already been done.

Danny squints at his tiny hands, eyes narrowing as Clockwork hums in the kitchen. Which he wasn’t even aware of having been in LongNow. Maybe it wasn’t. He huffed, voice too squeaky for him to continue complaining. Stupid time accidents. 
Which wasn’t even starting on the other figure awkwardly sitting at the table. 
He glowered at the Ghost King, who kept glancing at him with an unreadable look in their eyes, then looked back towards where Clockwork was. His scowl deepened over his cup of tea- which wasn’t fair, he wanted coffee but nooo, that’s not healthy for ‘little ghostlings’. Ugh.
Sometimes he wished he was fully ghost so he didn’t have to apparently worry about his living body having to grow back up.

The GIW have found out about Danny being half ghost. However, due to the dangers of getting caught Danny has a plan.
Danny some time beforehand manages to successfully figure out how to duplicate himself. Each one is just as strong as the others and the last duplicate remaining becomes the real Danny. Any duplicate the disappears will have all its memories return to the other copies.
The plan is simple: the Dannys all split up and set themselves up in different parts of the world, far away from one another. Should one get caught, it will simply vanish before the GIW can do any serious and traumatizing damage. Plus, Danny won't have to try and build another life for himself should he need to abandon one.
However, what Danny didn't consider is the fact that the copies don't have any kind of mental connection aside from when their memories are redistributed. They also don't keep in contact, as that would defeat the purpose of having them split up.
When the various superheroes around the globe find a child with incredible power who is all alone, they tend to try to help them. And since Danny doesn't want the GIW to find him, he tends to pick a different hero name than Phantom.
Needless to say, its a very interesting meeting at the Watchtower when they belatedly discover that several new heroes that had were being mentored by several heroes were all the same person.

It was sweet that Astarion was under the belief that no one would figure out he was a vampire before his big reveal. Most of us took one look at him and said "yep, that sure is a vampire right there." Most, however, doesn't include the party members. Some of these characters are supposed to be perceptive and intelligent, and I'm still convinced that if you press your ear against theirs you'd hear elevator music.

Young Justice is always a little...concerned. With Phantom's living situation. Now they're outright afraid for him, and Bart has decided it's time to Ask An Adult.
It was the little quips. The tiny little things. Stuff that didn't seem to matter to Phantom at all, or appeared to be normal for him, that he didn't realize weren't normal at all.
"Oh, better not hope my mom catches me." "Doing what, staying out past bedtime?" "Nah, using my powers; she'd vivisect me!"
"Another stab wound. Great." "Don't worry Phantom, I've got the med kit-" "Oh, I'm not a baby or anything, I can handle it just fine. Just gimme a sec to take it out."
"My dad has better aim than that." "...Like, when he's hunting, right?" "...At what other times would he be shooting at me?"
"Huh. Not as bad as my parents place. Look; they have a decontamination shower!" "Phantom, this lab has been vandalized to the point of needing a hazmat suit." "Did I stutter?"
Finding out each others identities did nothing to soothe the worry. Tim quietly told the others that every time he tried to run facial recognition, he kept hitting a government firewall he couldn't breach. Phantom never told them his last name, just his first, and 'Danny' is super common.
The thing that really did it though, the thing that made Bart snap and run off to ask Max, was when Danny had a nightmare.
He was talking in his sleep.
"No. Don't-stop. Stoooop. I need...my skin. Mom, no. You can't...peel off...my skin..."
Bart didn't even wait for them to wake Danny up before he was standing in front of Max, talking a mile a minute as he tried to figure out what to do, with Wally staring in horror over a plate of waffles as he computed everything that Bart was saying.

Danny had a dream about his mom and Skulker arguing about how to skin him. He wouldn't really call it a nightmare, because it was just Skulker, but the scariest thing was Skulker insisting to his mom that it was possible to skin him with a potato peeler. Dream mom was arguing that it was not, and that from a scientific standpoint that was a really piss poor way to preserve a specimen.
He hadn't been begging them to stop hurting him, he'd been whining at them to knock it off.
But when he wakes up, it's to a room full of worried friends and an old man who calls himself Max.
"Kid, I think we need to talk."

Baby Banshee
Halfa is just Danny's overall classification due to him being a human/ghost hybrid. However, if we go into what species he is classified into, he is a Banshee.
More specifically, Danny is a Baby Banshee. Although some consider that the Banshees are bad luck, in reality they usually scream to warn of great catastrophes. However, because Danny was just a baby ghost he was learning it now and had random impulses that led him to scream in the most random places, he couldn't control his wail.
Realizing how weird the halfa was (a male banshee, and a ghost baby at the same time), the ghosts decided to set him up with babysitters for when he went through his ghost childhood. Due to how powerful the child was he ended up being cared for by the Ancients. Which had no problem adapting to his needs and tried to keep him out of trouble.
On one of those occasions, Danny felt the urge to go in a specific direction. He ended up in a portal that guided him to the DC universe and wailed as loud as he could, which baffled the heroes.
He was obviously a child but had destroyed an entire complex with his scream and because of that they decided it was better to contain him. Danny was confused, he was warning them about the danger! Why weren't they listening?
Constantine understood what was happening instantly and warned the heroes to get away from the Banshee immediately. Hal mocked at the wizard's paranoia and encased the boy in a bubble. Which let out a cry when he was trapped and sent a danger signal from his core.
This ended with the Justice League facing off against obviously upset Ancients who were demanding their baby back.
