Introduction
Recently, in Umar Khalid’s Case, a former JNU student, researcher, and activist who has been accused as the chief instigator of the 2020 Delhi riots has taken a new turn. The Supreme Court in its recent judgement regarding the case has adjourned the hearing of the accused bail plea. Khalid who has been arrested under the charges of the Unlawful Activities (Prevention) Act as he was protesting against the Citizenship Amendment Act, 2019, is awaiting trial and has been behind bars for the past 2 years and eleven months. A division bench comprising Justice A.S Bopanna and M.M Sundresh is looking into the decision of the Delhi High Court that denied him bail last year. During the brief hearing today, the counsel representing the Delhi Police sought more time to file a counter-affidavit. As a protest, Senior Advocate Kapil Sibal who is appearing for Khalid questioned the counsel on what basis would the counsel file a counter, as the man has been in custody for almost 3 years. Initially, the bench agreed to the request for adjournment of the plea and said the matter would be brought into court this Friday. However, the police counsel requested more time to prepare as the charge sheet was given to him 2 days ago stating that it is 'voluminous' consisting of thousands of pages. The bench finally agreed to adjourn the hearing till Monday, which is the 24th of July with Justice Bopanna firmly saying, "Whether, on Monday, the board is heavy, we have to decide." "May take 1-2 minutes for this", Justice Sundresh added. The case against Umar Khalid continues to unfold, with court proceedings and hearings taking place to determine his guilt or innocence, we need to understand the facts and issues of the case leading up to this decision. This article will provide a brief overview and provide insight into the legal aspects of this case.
What’s Happening In The Umar Khalid’s Case?
Umar Khalid’s Case: Recent Developments Facts of the Case: In April 2020 after the violence that transpired in the Northern part of India, a First Information Report (FIR) came to be registered by the Crime Branch alleging that the riots which took place in North East Delhi were pre-planned by Umar Khalid along with his acquaintances from different organizations. It has been alleged that Umar Khalid had made provocative speeches at different locations and had requested the people to come out to protest and block the streets of Delhi during the visit of US President Donald Trump to shed light on an international level that minorities were being discriminated against in India. Khalid and many others have been charged in connection to the communal riots which took place. According to government statistics, fifty-three people died during the protests and more than five hundred people were injured. Six months after the FIR was registered, Umar was arrested by the Delhi Police on September 2020 under FIR 59 and charged under various sections of the Unlawful Activities Prevention Act (UAPA), which included terrorist activity and conspiracy. He was also charged under the provisions of the Indian Penal Code (IPC) for murder, rioting, sedition, conspiracy, and promotion of communal enmity. Umar Khalid was formally arrested in October 2020 under FIR 101 but had been granted bail in April 2021 On October 18 last year, the High Court rejected Khalid’s bail plea, saying he was in constant touch with other co-accused and allegations against him are prima facie true. The Court also mentioned that the actions of the accused prima facie had qualified as a ‘terrorist act’ under the UAPA law. The Delhi Police had argued that Umar’s speech was ‘very calculated’ and brought up various issues that indicated the alleged suppression of Muslims and the Citizenship (Amendment) Act (CAA) and National Register of Citizens (NRC). Issues: Whether there is any prima facie or reasonable ground to believe that the accused had committed the offence of instigating and conspiring the 202 Delhi riots. Whether there is a danger of the accused absconding or fleeing if he were to be released on bail. Whether there is a likelihood of the offence being repeated. Des étudiants de l'Université de Delhi ont été emmenés par la police du campus vendredi soir alors qu'ils cherchaient à projeter publiquement une série documentaire controversée de la BBC sur le Premier ministre Narendra Modi et la prétendue politique communale du BJP. Cela s'est produit deux jours seulement après que des scènes similaires ont été observées à l'Université Jawaharlal Nehru (JNU) à Delhi. Des militants étudiants ont déclaré que la police avait agi violemment même si l'intention était que les étudiants regardent pacifiquement le documentaire. I have never made a political post on my blog. It's always been about just my poetry and writings. However, today I feel that if I don't write about this and use the platform to tell you guys about what's happening in my country, I will be ashamed of myself as an Indian and more importantly as a human.
Yesterday, the students of JNU (Jawaharlal Nehru University), Delhi, were brutally attacked by a mob who entered the campus by force. These mobsters are die hard supporters of Modi's Hindutva ideology and were heard asking students to identify themselves. Students and professors were beaten with iron rods, and the campus property completely destroyed. The injured were taken to AIIMS Trauma centre but still the Delhi Police remained silent all throughout. It's been more than 24 hours and protests have erupted all across the country in support of JNU students. However, the police has still not made a single arrest.
In the recent times, India has witnessed all kinds of violence and discrimination. Against students, against minorities, against Muslims, against citizens. Whether it's JNU or Jamia Milia Islamia or Aligarh Muslim University or the whole state of Jammu Kashmir, or asking citizens to prove their citizenship. This government is doing everything they can to turn the country into one theocratic nation and citizens are opposing it with everything we have.
This video is of one of the many protests happening across India. I went to this one and I can honestly say that I have never felt more empowered. We sang, we recited poetry, we chanted slogans and we were one. A few Bollywood celebrities turned up restoring my faith that not all of Bollywood is stuck under our prime minister's thumb. Today, Bombay stood with JNU and we will continue to do so. We will not let the fascist government win.

Des policiers en tenue anti-émeute bleue et des camionnettes équipées de canons lacrymogènes ont atteint les portes du collège dans le sud-est de Delhi. Dans une ordonnance rendue mardi, les autorités de Jamia ont déclaré qu'elles n'autoriseraient aucun rassemblement non autorisé sur le campus après que la Fédération des étudiants de l'Inde a annoncé la projection sur Facebook. Le documentaire, basé sur le mandat du Premier ministre Narendra Modi en tant que ministre en chef du Gujarat lors des émeutes de 2002, a déclenché une tempête, le gouvernement interdisant le film et demandant aux sociétés de médias sociaux de supprimer les liens vers celui-ci. L'opposition a qualifié cette décision de censure flagrante. Une projection similaire organisée par certains étudiants de l'Université Jawaharlal Nehru hier soir a rencontré des problèmes avec Internet et l'électricité coupée dans le bureau du syndicat des étudiants. Une foule de centaines de personnes s'est plutôt rassemblée dehors dans le noir pour regarder le documentaire sur les écrans de téléphone ou leurs ordinateurs portables, et la soirée s'est terminée par une marche de protestation. Les autorités de la JNU avaient mis en garde contre des mesures disciplinaires si le documentaire était projeté, affirmant que cette décision pourrait perturber la paix et l'harmonie sur le campus. Le gouvernement du Premier ministre Modi a qualifié la série documentaire en deux parties « Inde : la question Modi » de « morceau de propagande ». Il a été innocenté de tout acte répréhensible par des enquêtes sur les émeutes du Gujarat. L'année dernière, la Cour suprême a rejeté un appel contre sa disculpation dans l'une des affaires liées aux meurtres. Plus de 1 000 personnes ont été tuées dans les violences de trois jours au Gujarat en 2002 et la police d'État a été accusée de ne pas avoir fait assez pour arrêter les émeutes qui ont commencé après qu'un wagon transportant des pèlerins a été incendié à Godhra, tuant 59 personnes.
