When you first saw Azriel, cloaked in shadows, you thought death had finally come for you.

Instead, he offered you a new chance at life.

You couldn't help but develop a little crush. Gods, he was so handsome. Attractive and kind - you were done for.

And then there was Cassian. He was so easy to get along with, the two of you were fast friends, especially with the amount of injuries the male received.

You wondered if he was doing it on purpose, as a way to spend more time with you. You shake your head, trying to rid the thought from your mind. ‘Don’t be silly, why would he do that when his job requires him to be in peak physical condition?’

You managed to stay professional, for the most part. Cassian made it very hard with all of his flirting. You quickly realised it helped to take his mind off the pain while you were healing him. So, taking a holistic approach, you joined in on his games to help him through it.

Azriel, on the other hand, was always on his best behaviour. You got to see a side of him that’s usually kept hidden behind his shadows. A soft side. The two of you would talk and talk while you patched him up. You’d chat about everything, new books, music, that new bakery by the Sidra that made the most divine cakes…

Getting on with Cassian and Azriel was easy. What wasn’t easy was battling your growing feelings for both of them.

You’re working on restocking your salves and tonics, humming a song from your village as you grind magical herbs together. You’re interrupted by a sharp knock on the door. “Come in,” you say cheerily, stepping away from the work to greet your visitor.

The door opens and Cassian enters your small clinic with a bright pink nose and red, puffy eyes. “Y/N, I think I’m dying,” he sniffles.

You move closer and press your hand against Cassian’s forehead, letting your powers diagnose him.

“I’ve seen you with far worse ailments than allergies, Cassian.”

“You try not being able to breathe and see how you like it,” he responds.

“Take a seat, I was just finishing up a tonic that will help.” You gesture towards the stool on the other side of your workstation and you go back to mixing the tonic. Cassian watches you working in unusual silence. The only sounds in the room are the grinding of your mortar and pestle and the occasional sneeze.

“Remind me to stock up on this if we ever visit Spring,” you smile, handing Cassian the glass vial. He downs the amber liquid in one big gulp. Within minutes his symptoms start to wane. Cassian stands and lifts you into a big hug, spinning you around.

“Thank you, you’re a lifesaver, Y/N.” Cassian beams, planting a loud kiss on the top of your head as he sets you on your feet.

You laugh in response to his affection. “It’s nothing,” you say.

You both turn at the sound of a male cough. “I hope I’m not interrupting anything,” Azriel drawls.

“Just saving Cassian’s life. Again,” you wink.

“Thanks again Y//N.” Cassian kisses you on the cheek on his way out of the clinic, leaving you alone with the shadow singer.

You scan Azriel’s face. He’s got dark circles under his eyes and a haunted look on his face.

“What can I help you with, Az?” you ask.

“Just some scrapes, I’ve become such a baby since you’ve been around,” he smiles but it doesn't quite reach his eyes.

“It’s always my pleasure to help.” You turn to look through your jars of salves, grabbing one with numbing properties.

You turn towards Azriel, motioning for him to take a seat. You grab his hand, your powers doing a quick scan - you can sense he has some minor scraps on his knuckles, but he’s also got something wrong in his chest - your powers can't quite determine what it is.

You do your best to keep the concern from your face as you start to work the salve into his knuckles. Azriel shuts his eyes as you massage his hands.

“Az,” you say softly, approaching the topic hesitantly, “is there anything else I should know about?”

He opens his eyes, looking into yours, “like what? I’m fine,” he says.

“You haven't had any pain elsewhere?” You push.

“No, why would I?”

“Well, I don't want to alarm you but my magic has never been wrong before. It’s detected something other than these scrapes…” You point towards his chest, right over his heart, “There’s something wrong here.”

Azriel exhales through his nose, “Oh, that. It’s nothing I can’t handle.’”

You frown at the male, sighing. Illyrians were a stubborn breed, you decided. “Let me know if there’s anything I can do.”

Azriel nods and leaves your clinic, leaving you wondering what worries plague him and what you can do to help.

Azriel continues to mope around for a few days, the dark circles never leaving his face. Not even Mor can get him to smile.

With your worries only increasing, you turn to Rhys and Feyre for some answers.

You explain what you felt to Rhys, that you knew something was wrong but you couldn’t tell what.

Rhys props his chin on his hand pensively, “Azriel has always had his demons, thank you for bringing this to my attention. Just keep monitoring him and try to get him to talk. I know he feels fondly for you, it may just take him time to open up.”

You nod, taking in the High Lord’s words.

Feyre gives you a reassuring shoulder squeeze, “He’ll be alright. He’s got you.”

You give her a meek smile and exit the office, on your way to try and cheer up your friend.

“Az!” you call out in the House of Wind, “Where are you?”

He appears down the hall, a flurry of shadows swirling around him and towards you. “Yes, Y/N?”

“Can you please give me a lift to the city? I’ve got a few things to pick up, and I’m craving something from that bakery.”

Azriel nods, “Sure, are you ready to go now?”

“Sure am, lead the way.”

He scoops you up into his arms like he did the day he rescued you and launches into the sky. The wind rushes past your face and you scream out in joy, loving the exhilarating feeling of soaring through the air. You wrap your arms tighters around Azriel’s neck as he starts to descend.

You land and he places you down gently. ‘Thank you, kind sir,” you say, curtsying. Azriel rolls his eyes but can’t fight the smile creeping onto his face.

You grab his hand and break into a skip down the street, triumphant over your small win - getting a grin out of the spymaster.

Azriel follows after you, listening intently as you chatter away animatedly.

As you exit a shop selling different apothecary ingredients you spy a busker on the street playing the fiddle.

“Oh Az, will you dance with me?”

Azriel pauses, observing the crowd before taking your extended hand in his. The two of you dance clumsily in the street, letting the music flow through your body.

As the musician hits the crescendo, Azriel lifts you into the air and spins with you while you laugh loudly and unabashed. When he places you on your feet you notice a small crowd has gathered, they break into applause for both you and the fiddler as the song ends.

You take Azriel’s hand and make him bow with you. He smiles and shakes his head but humours you. You tip the busker generously and give him a small wave as you continue down the street, still holding onto Azriel’s hand.

As you approach your favourite bakery - Azriel’s mood has lightened. You can still feel the pain but it has lessened significantly.

With your treats in hand, you make your way to the Sidra and lean against the wrought iron banister edging the river.

Azriel said he’d get whatever you did - so you opted for two huge brownies with a generous dusting of icing sugar on top.

“These look so good,” you gush, grinning madly at Azriel.

The slice of cake is so thick that your nose brushes it as you take a bite. You cover your mouth as you chew and swallow.

“That is amazing,” you moan, turning to Azriel. “How is yours?”

Azriel takes one look at you - with sugar on your nose and chocolate in your teeth and bursts into a deep laugh.

“It’s brilliant, but how have you already made such a mess?”

“What do you mean?” You ask, “Is there something on my face?”

“Here let me.” He reaches up and brushes your nose softly, wiping away the sugar. “It’s still all in your teeth though.”

“I’m saving that for later,” you say with a wink and the two of you burst out laughing again.

Standing so close to Azriel, you can’t help but admire his gorgeous face. And his eyes - there are less shadows in them.

“Thank you for today,” Azriel says quietly, brushing a stray hair out of your face. “You’re good at that.”

“Good at what?”

“Knowing what I need.” He smiles, “Come on,” he beckons with his head, “Let's get back home before you make more of a mess of yourself.”

Emmanuel the Emu: A Story of HPAI Mismanagement

Emmanuel, the TikTok-famous emu owned by Taylor Blake of Knuckle Bump Farms, made national news last month when Highly Pathogenic Avian Influenza (HPAI) hit the farm. According to Blake’s initial Twitter thread, Knuckle Bump Farms lost 99% of their avian flock- over 50 individuals- in only three days. These deaths were attributed both to the disease itself and to a cull carried out by the Florida Department of Agriculture and Consumer Services, who did so with Blake’s permission. Emmanuel and a black swan named Rico were the only two survivors, with Emmanuel left unable to stand, unwilling to eat or drink, and quickly fading. Hundreds of thousands rallied behind Emmanuel on social media as Blake documented Emmanuel’s progress, reaching out to public figures like Dr. Pol of The Incredible Dr. Pol and Bindi Erwin of Crikey! It’s the Irwins for help when she failed to find any other sources for emu rehabilitation. But soon, controversy emerged.

Early on, avian influenza experts expressed concern that Blake was not wearing any PPE when interacting with a presumably HPAI-positive bird. Avian influenza is transmissible from bird to human which, combined with the virus’ ability to mix genes and rapidly change, means that PPE is universally recommended when dealing with a suspected or confirmed HPAI outbreak.

In response to concerns, Blake explained that “Emmanuel freaks out whenever we approach him wearing a mask” and that the farm is on a state-mandated quarantine for 150 days, which is the amount of time HPAI is estimated to survive in the environment under ideal conditions. This quarantine reportedly only allowed Blake, Blake’s girlfriend Kristian Haggerty, Blake’s family, and veterinary professionals to enter the property. “I have taken every precaution recommended by the FDA” Blake stated, referencing the Florida Department of Agriculture and Consumer Services (FDACS) rather than the Food and Drug Administration (FDA).

Many people, including HPAI experts, found this explanation unsatisfactory and instead decided to contact the FDACS and USDA directly. Both the FDACS and USDA work collaboratively to manage avian influenza outbreaks in Florida. Dr. Danielle Stanek of the Florida Department of Health clarified that the DOH can recommend that private individuals comply with CDC guidelines, which includes wearing full PPE when interacting with HPAI-infected birds, but they cannot mandate that they do so. Therefore, Blake’s decision to forgo PPE was hers to make, even if it wasn’t in accordance with the recommendations of the FDACS, CDC, USDA, and Florida DOH.

Just as discourse between experts and Emmanuel fans reached its peak, Blake announced that Emmanuel tested negative for HPAI. Instead, Emmanuel’s sudden decline was attributed to stress. “Emus are incredibly susceptible to stress. He was incredibly overwhelmed by the state coming in and euthanizing our flock . . . He stopped eating the day they depopulated.” His lingering issues- the inability to stand or walk independently, twisted neck (torticollis), continued inappetence and dehydration, and lethargy- were caused by a nighttime collapse that left Emmanuel “thrashing on the ground for hours, trying to get himself up”. “He never once had a single symptom of AI, other than not eating”, Blake stated.

HPAI symptoms in birds varies depending on the species and the individual. In chickens, HPAI often presents as respiratory and digestive distress, followed quickly by death. In other poultry species, symptoms may also include the nervous system, causing “tremors, twisted necks, paralyzed wings, laying down and pedaling”. Ratites- referring to the diverse group of keel-less birds that include emus, ostriches, rheas, kiwis, and cassowaries- also tend to develop neurological symptoms. Notably, emus can present with twisted necks (torticollis), ataxia (discoordination), leg and wing paralysis, inability to stand, decreased food and water consumption, purple discoloration or swelling of the legs and head, and lethargy. This corresponds with many of the symptoms Blake has documented in Emmanuel. And it should, considering that Emmanuel did test positive for HPAI.

Test results completed on October 27th, 2022 at the USDA’s National Veterinary Services Laboratories showed that Emmanuel’s serum sample, collected six days after the start of the outbreak, contained antibody levels that were consistent with recent infection.

When Blake announced Emmanuel’s stress diagnosis, she was likely relying on information provided by a rapid test, which can provide results within 48 hours. These tests detect viral proteins that indicate active infection and virus shedding. Serology tests, on the other hand, look for the presence of antibodies produced in response to infection, not necessarily active infection. For an indeterminate number of days prior to the sample collection (October 17, 2022) Emmanuel had an active HPAI infection that, rather than stress, likely led to his rapid decline.

Why, then, was Emmanuel not included in the state’s cull on Knuckle Bump Farms? An email between Dr. Michael Short, the FDACS’ Animal Industry Director, and Kassandra Curiel of the FDACS’ Office of the Commissioner, answers this question. Dr. Short states that “USDA guidance is that ratites (emus and ostriches), black swans and exotic pet birds do not have to be euthanized due to lower risk”. Blake echoes this on her Twitter, when she says that “the state only focused on the “super spreaders” which are poultry species and ducks. Ratites aren’t included because they typically aren’t as susceptible.”.

This allowed Knuckle Bump Farms’ four emus (Emily, Eliza, Elliot, and Emmanuel) and three black swans (two unnamed females and Rico), to be exempted from the cull. I cannot find any reference, either in USDA literature or anywhere else, that supports Dr. Short’s statement. In fact, all the literature that I reviewed and all the experts I talked to during my research only confirmed the devastating effects that HPAI can have on both ratites and black swans. This, coupled with the fact that three of Knuckle Bump Farms’ four emus and two of their three black swans died when “the virus hit them extremely hard and very quickly”, calls Dr. Short’s statement into question.

The USDA was also unable to substantiate Dr. Short’s statement. When asked how exemptions to culls were determined they explained that, rather than look at individual species, the USDA classifies HPAI-infected domestic birds as either commercial, backyard poultry, or backyard non-poultry. These definitions ascribe risk of potential HPAI spread by determining the level of contact a poultry premise has with other poultry premises. If a private farm or private household, where the poultry does not have any contact with poultry beyond the property, has an outbreak then they are classified as a non-poultry premises, even if they have chickens, turkeys, or other poultry birds. These non-poultry premises can thus be exempted from culling all their birds by being placed on quarantines by state officials, provided that they adhere to the quarantine and continue to not have contact with any poultry facilities. Knuckle Bump Farms does not sell poultry products; therefore, they were classified as backyard non-poultry and eligible for quarantine. The FDACS seems to have added their own interpretation onto this guidance when they specify ratites, black swans, and exotic pet birds as “lower risk”. I reached out to Dr. Short for comment but received no response.

This isn’t the only time Dr. Short and, by extension, the FDACS demonstrated faulty logic. In that same email between him and Curiel, Dr. Short used this comparison to explain why a citizen’s concern about Emmanuel’s exemption from the cull was unfounded.

“I have heard of only one report of a clinically ill human, over the past 1.5 years of a national response to the current avian flu outbreak. The risk of HPAI to the owner is much less than occurred with household pets that tested positive for SARS-CoV-2 (Covid). I am assuming no one would advocate to euthanize all pets testing positive for Covid (At least I have not heard of anyone asking us to euthanize pets).

The risk of avian influenza is constantly occurring with all the wild birds in South Florida. My understanding (not being a human health expert) is the risk to people, especially children and those immuno-compromised at public or private lakes, ponds and waterways from the AI being shed by water fowl is much greater than the sick emu at knuckle bump farm.”

Dr. Ben Golas, a VMD and postdoc with the USGS who is currently working on avian influenza research, weighed in. “It’s a bit like comparing apples and oranges to talk about risk of transmission of COVID vs. HPAI. With COVID, our primary concern is human-to-human contact. [. . .] With HPAI, farm animals are euthanized not only because the disease spreads within the farm flock like wildfire, but also to prevent spreading infection locally to other farms, because HPAI virus can be stable in the environment.”

The CDC agrees. “There is no evidence that animals play a significant role in spreading SARS-CoV-2, the virus that causes COVID-19, to people. […] It’s important to remember that people are much more likely to get COVID-19 from other people than from animals. There is no need to euthanize or otherwise harm animals infected with SARS-CoV-2.” When it comes to HPAI, however, they emphasize that human-to-human spread is rare and often limited to only a few individuals. Bird-to-human transmission is the primary method of human infection, with each new infection increasing the risk that a new, more virulent strain will emerge. This, along with the potential for massive bird-to-bird outbreaks that could devastate both wildlife and industry, is why complete depopulation (euthanasia) is standard for HPAI and not COVID-19.

The FDACS seems to be operating on contradicting and unsubstantiated information when it comes to managing HPAI outbreaks. Unsurprisingly, the employees seem equally conflicted in their internal emails regarding Knuckle Bump Farms. One Florida USDA representative noted, while forwarding a citizen concern about Blake’s lack of PPE, that “her face is real close to a bird that has HPAI”. Another USDA employee responded “actually, in one of the pictures she appears to be kissing it on the head.”. Dr. Kendra Stauffer of the USDA wrote, “. . . part of the allowing the pet bird to live was that there were rules the owner was to follow from DOH, which clearly she is not”.

Other employees, however, were eager to show their support. Commissioner Nikki Fried of the FDACS posted a photo of her, Blake, and Haggerty, and later posted a photo of herself drinking Knuckle Bump Farms’ branded beer while wearing an Emmanuel t-shirt.

Fried’s support generated a lot of concern, particularly amongst local farmers. One Florida emu farmer stated, “my disappointment and concern is 100% with the actions of Nikki Fried as Agricultural Commissioner to allow some birds to be exempt from depopulation, including emus, for no quantifiable reason. Emus are susceptible to HPAI. Emus in other states have contracted HPAI in this current outbreak and they either died on their own or were put down. Research shows they are susceptible to HPAI, and can spread it to other birds and humans. The decision by Fried and FDACS makes no sense and it sets a dangerous precedent.”

Considering that Blake has over 847.4K followers on Twitter, 938K on Instagram, and 2.4 million on TikTok, the precedent the FDACS and USDA have set here is, indeed, dangerous. Many of Blake’s followers learned about avian influenza for the first time through her documentation of Emmanuel’s illness and the state’s response to the outbreak. “I watch for Emmanuel updates every day! This has also been a great lesson for many people in farming education.”, one follower said. Another echoed this sentiment, saying “Thank you for taking the time to let us know what’s going on, and answering questions. You truly are an educator”.

Herein lies the problem. Knuckle Bump Farms is a small, backyard operation. Through social media, however, they reach millions. This specific outbreak of HPAI and its subsequent (mis-)management by the FDACS and USDA has now set the standard for many, rather than the exception. Blake’s public failure to comply with PPE recommendations, the lack of transparency regarding Emmanuel’s true diagnosis, a similar lack of transparency within the FDACS and USDA regarding this outbreak, exemptions to cull protocols made with seemingly no supporting data, and a publicly-elected official openly (and financially) supporting Blake through this process, all pose a serious threat to public confidence in HPAI management and future public health. The concerns of farmers, virologists, public health workers and organizations, wildlife rehabilitators, and animal sanctuaries have been ignored, particularly when they asked whether Emmanuel’s fame and the risk of public backlash led to the FDACS’ decision to leave him and several other symptomatic birds alive. It seems, through this research, that there is more support for this theory than the narrative we’ve been provided until now. It is my hope that, with the publishing of this information, the very real concerns raised by people directly effected by HPAI will be given the weight they deserve.

genuine question: how do you reconcile police abolition with marxism-leninism? isn't having police a notable feature of marxist leninist regimes? this isn't a gotcha I'm just curious about how you reconcile this or what flaws exist in my conception of marxism-leninism

so there's an obvious theoretical answer to this, a more in-depth theoretical answer to this, and a practical answer that derives from the latter. the obvious theoretical answer is that my police abolitionist stance is based on the role of the bourgeois police force as enforcers of private property law--as the front line of class warfare against the working class. there is a material difference in the incentives and structures of a socialist police force operating on behalf of the working class as an organ of class warfare against the bourgeoisie.

but this isn't a complete and satisfying answer. i mean, obviously. the idea that the soviet militsiya and nkvd were in any way worse than the tsarist police and secret poice that came before them--or, for that matter, meaningfully worse than contemporary capitalist police forces, or the capitalist police forces in the post-soviet bourgeois states--is an anticommunist fabrication. but the idea that the militsiya was without its problems, that ordinary citizens did not have to worry about effectively unaccountable brutality in their interactions with these bodies, is also pretty detached from material reality. i think we can safely establish that the existence of a proletarian state alone isn't enough to solve the problems of a police force.

so what's the more complex theoretical approach? well, in a little number called state & revolution, v.i. lenin talks about 'special bodies of armed men' as opposed to 'self-acting armed organisations'--essentially drawing the conclusion that the former (police & military) were essentially removed from accountability--by virtue of their unique position and special privileges afforded to them by their uniforms, they're able to act as if and consider themselves as external to society, and so they're invariably doomed to be detached from the working class even if they are operating in their ostensible interest. meanwhile, the 'self-acting armed organization' is more like a militia, in the traditional sense of being fundamentally made up of ordinary people. this was why the militsiya was named that, because although it did ultimately develop into a 'special body of armed men' it began life as a revolutionary milita.

& i want to be clear that the importance of the self-acting armed organization is not an embrace of 'community justice' or whatever thinly veiled mob justice in a nice hat that anarchists like to sing the praises of. these militias should still be organized and structured, so that they can be accountable. but the importance of them being self-acting organizations instead of special bodies of armed men is that they are not removed from society. lenin discussed at length the example of the paris commune, and how civil servants within the commune were paid exactly the same as anyone else--and discussed how the advancement of both technology and education could create a world in which any citizen could (and therefore, indeed, would) take up a role in the administration of their society.

i think it therefore follows from what lenin wrote that the theoretical model of policing as self-acting armed organizations should result in a socialist state in which nobody is professionally, as a career, a 'police officer'. the work that constitutes 'policing' in a post-revolutionary society should be simple enough that anybody can and does do it--not on pure self-initiative but in a mobilized and organized fashion. this prevents the elevation of police to a body 'above society' and therefore capable of and even inclined to performi mass violence against that society.

and of course, the eternal question for marxists, what does this look like in practice: i think there have been succesful and interesting experiments in this sort of thing in socialist projects across the globe. most notably, i think that the cuban committees for the defense of the revolution are a good place to start, & so are mao's eight points of attention and three rules of discipline & the processes (not always succesful) to create accountability to the masses among the red guards and red army during and after the chinese civil war.

& of course, once there are no more classes, there will be no need for a state, or an apparatus to suppress the bourgeoisie more generally, and so the police will wither away with the rest of it.

This might make me unpopular but I feel like badgering the developer team for changes to their property is cringe as hell.

There is one exception to this - and that’s because those fans were asking to improve a choice that was borne from listening to fans with biased racist opinions in the first place.

But literally taking time to email a professional, who has to then take time to log and reply to that email as part of their job when they’re trying to do development and bug fixes, about wanting to add romantic content that is completely unnecessary and could just be created in fanspace, as a formal request? I hate it. No, it’s not the same as writing a fan letter about what you love or your ship and your engagement and that person reading it after the fact. You are asking them to actively change something to your tastes!

I do not think that’s a good thing!

It has been said that female separatism is radical feminism's natural and logical conclusion. Most radical feminists have chosen not to follow their politics all the way to that end and do what they can to avoid, ignore, or deny it. Anti-separatist feminists engage in what has been called "thought termination," meaning the act of refusing to follow one's own thoughts to their logical conclusions, in order to justify their decision to stay connected to males. They also encourage this thought termination in other women, wanting to undermine female separatism as a legitimate political and personal choice for their own selfish reasons.

When making political and feminist analysis or when attempting to determine in your own life if a particular decision is feminist or anti-feminist, it is useful to ask the ancient Roman legal question: "Cui bono?" or "Who benefits?" Of course, women do stand to gain certain rewards and privileges from engaging in male loyalism, misogyny, and anti-feminist actions, but whatever the matter at hand, an anti-feminist and anti-female decision will ultimately benefit males the most. When we ask "Who benefits the most?" from women and girls choosing to lead male-inclusive and male-centric lives, the answer is clear: males do.

The most recent studies have found that heterosexual marriage makes men happier and women more unhappy overall. The overwhelming majority of domestic labor and childcare continue to fall on the wife's shoulders in heterosexual marriage throughout the developed world, and this is true even while most married heterosexual women in developed countries work full-time throughout adulthood. Heterosexual and bisexual women openly admit to experiencing sex in their heterosexual relationships that ranges from inorgasmic and boring to violent, humiliating, and painful. Outside of heterosexual relationships, women and girls often find themselves on the losing side of unequal relationships with male family members and friends who take advantage of their labor, emotional and otherwise, and do not reciprocate or bother suppressing their sexism.

The power struggle between males and females has always been sexual, both in the carnal and reproductive sense. Even the word patriarchy rests on the sexual, social, and familial arrangements that exist in a predominantly heterosexual, mixed society where men and women live in constant contact with each other: rule of the father assumes that women and girls are in a position to be ruled, both socially and physically. It assumes the presence of a man.

Female separatism is the unavoidable, ultimate conclusion of radical feminist politics for the simple reason that separatism alone prevents the male objective driving men's oppression and domination of the female sex: using women and girls as sexual, domestic, social, and economic resources. If this is the point of patriarchy, how can anything other than female separatism be the solution to it? In a system where males already have all the power and control, women and girls will never be able to change their own status or achieve liberation from oppression through cooperating with males and granting them everything they demand.

Males want sexual access to female bodies above all else, and furthermore, they rely on women and girls to perform the domestic labor, social labor, and professional labor that keep men comfortable physically, emotionally, and psychologically. For thousands of years, men universally made sure that women and girls could not survive independently of them by locking us out of education, paid work, and the political arena and refusing to give us basic rights to own money and property. They knew and feared that if women had the option to survive and thrive apart from men, most of us would choose to do exactly that.

The only reason women now have the legal rights and protections that allow us to reject heterosexual marriage and motherhood is because we fought hard for those rights and protections over the course of at least a hundred years in developed countries, and we are still fighting all over the world, not only to gain what we lack but to protect what we have. Men have never yielded any political concessions to women willingly, easily, or readily. They have resisted us every step of the way, and they will never cease their attempts to take back the progress we've made.

If female separatism was of no consequence to the male sex, they wouldn't have spent all of recorded history making it virtually impossible. They wouldn't now be going out of their way to destroy any and all female-only spaces, both physical and digital, in the name of transgenderism. They would not have lorded physical and sexual violence over us since the beginning of time as punishment for our resistance and disobedience.

Imagine you’re a property developer. Yeah, I know it’s a stretch, but you can probably conceive of the seething, impotent hatred the hypothetical you has for every human being on earth. What you want, because your parents never loved you, is to build a sports arena. Sports arenas, like all public infrastructure, contain approximately one fuckbillion dollars of grift opportunities on top of the already ridiculous asking price.

You don’t have that much money. Well, you do, but you’re not going to spend it on a sports arena. What do you look like, an idiot? The better thing to do is make someone else buy it for you. This is sort of the public-financing equivalent to going to a restaurant with your coworker, only to have forgotten your wallet. And also your gyro plate costs $750 million, and if they don’t pay it you’ll make some bros in the parking lot come in and kill them.

Once you have an arena bought for yourself, whether entirely financed by the public purse or just ninety-percent financed (with any overage covered by the public purse, of course) it’s time to start making it unnecessarily huge and ugly. Pull some sick stunts like cantilevered support beams. Wheelchair-inaccessible stairs. Bizarre references to Ayn Rand. If people are looking at the professional athletes playing inside the arena instead of the arena itself, then why did you even take all this money away from a hospital to build it?

You might think that I’m being unfair to the entire idea of forcing the government to build private infrastructure at immense cost to primarily benefit billionaires. And when I put it that way, I guess I can see your point. Tell you what, as long as there’s also an immense parking lot that I can pay thirty-six dollars a game to leave my shitty car in so the stereo can get stolen, I’m one hundred percent onboard.

Design of Midhope Distillery

The parts of document I'm showing in this post was presented and designed on June 26, 2020

EXECUTIVE SUMMARY

This Design and Access Statement accompanies a Planning Applica- tion for a new Single Malt Scotch Whisky Distillery at Midhope Castle which lies within the Hopetoun Estate on the outskirts of Edinburgh. It is intended this is the first of a series of applications containing proposals to regenerate the Castle, the surrounding listed buildings and landscape setting.

The overall project aims to create an environment to produce, share and market an exceptional whisky. Its success depends not just on the production of whisky but on the ability to invite guests to see the creative process, appreciate its origins and have the time to experi- ence the whisky and the environment. It is intended in the future that the castle will be the venue for a significant part of these activities.

Note, the clients Golden Decanters and Hopetoun estate are the original applicants. Golden Decanters changed their company name since April 2022

LOCATION

The site is approximately 11.5 miles West of the City of Edinburgh, 5 miles to the North West of Edinburgh airport, 3.5 miles to the West of the South Queensferry, and a little under half a mile South of the Firth of Forth. It has an overall area of 6.9 hectares within the beautifully managed Hopetoun Estate. Hopetoun House is approximately 1 mile East of the site.

SITE

The site is located within Hopetoun Estate but outside the area of the Designated Designed Landscape that surrounds Hopetoun House and Abercorn to the east. The site for the new distillery is located to the immediate west of Midhope Castle.

The Castle is reached via an access road runs for approximately a quarter of a mile, west from the road link between the hamlet of Ab- ercorn and the A904.

The site to the east of the Midhope Burn is largely dense woodland. A Fireworks manufacturing business is currently located in a large clearing near the entrance to the site. This clearing was formerly the location of a Saw Mill.

The access road arrives at a small car park. There is a path that leads to the outer wall of the Castle courtyard.

Midhope Castle is to the north-east of the site with a courtyard and a modest walled garden to the immediate South. Behind the castle, just to the north, is a small derelict Victorian, ancillary building.

In the space to the east of the castle toward the approach road there are two Victorian cottages and a doocot.

The site for the distillery building is to the south-west of the cas- tle and in an area that is currently occupied by a number of modern agricultural sheds and some hard-standing left from recent utilitarian ancillary structures. The area is functional and has no obvious sig- nificant historic structures. It currently houses the grounds for a tree climbing and chainsaw training company which is in the process of relocating.

HERITAGE CONTEXT

The original Midhope Castle (recorded as “Medhope Castle”) was built in the late 15th century. In 1587 this castle was partially rebuilt.

The castle was extended in 1664 and reached the general arrange- ment and form that can be seen today. Further extensions and altera- tions took place in 1678.

By the early 20th century the castle was in a state of disrepair and the interior timber staircase recorded as being in poor condition.

In 1988 a programme of consolidation and partial restoration was undertaken. A new roof was formed on the West Tower and steelwork was inserted within the shell of the castle to stabilse the structure. New window frames were inserted into the existing openings. This work seems to have arrested any further significant deterioration.

Today the building is in a ruinous state internally, and most of the in- ternal features have been lost, but is generally wind and water tight.

Midhope Castle was designated as a Scheduled Monument in 1950 and was given a Category A listing in 1971 . In 2018 the Scheduled Monument status was removed and the designation was simplified to the current Category A listing.

The Roy Lowlands map of 1754 shows the castle within the wider context of the Hopetoun House Estate. To the north of the castle are a series of geometrically arranged copses either side of an axis that relates to Hopetoun House to the west. Today some of these trees are still visible.

The landscape around Midhope Castle is also visible on this plan - the series of walls that form the courtyard at the castle, and the larger open area to the west.

The 6 inch map of 1854 more shows Midhope Castle in the form that it can be seen today. The approach path from the east, the Doocot, the gamekeeper’s cottage and the walled garden to the south of the castle are visible.

This plan also shows the state of the landscape to the west of the castle. A path or track extended out from the courtyard into the land- scape and a series of gardens were enclosed to the north.

The south edge of the site was defined by a row of trees that aligned with the walled garden.

The remaining traces of these landscape structures have informed the location of the new distillery building and the landscape strategy.

MASTERPLAN APPROACH

The current application is the first in a series of planned phased pro- posals for the site that will initially improve the setting, and stabilise the fabric, of the castle, and later seek to reuse and regenerate the castle.

The construction of the distillery and the production of the whisky need to be the first steps in order to establish the business and generate income in order to progress to the next phases of the wider project.

In the medium term there are also plans to open parts of the castle to facilitate some of visitors who currently visit the site due to the castle’s association with the “Outlander” television series.

There is the ultimate aim to use the castle for visitor functions that are complimentary to the new distillery – tasting spaces, dining, and potentially overnight accommodation.

All of these future works will carefully balance the repair and refur- bishment of the existing historical fabric of the castle and surround- ing landscape features. Further refinement of the timing and content of these next phases will reviewed as the project develops.

VISION

Initial works

The current Planning Application is for the new distillery building together with the immediate landscaping, a new access road and the change of use of Midhope Castle to visitor accommodation.

An application for Listed Building Consent will follow. This will include the repair and refurbishment works to the landscape features around the castle- the reinstatement of the damaged stone piers, the re- gaining of the walled garden and cobbled castle forecourt and the potential removal of derelict outbuildings. It has not been possible to gain access to the site to carry out these surveys due to restrictions imposed by the Covid 19 crisis.

Next steps

Future Planning Applications and Listed Building Applications are planned as the business becomes established. These include plans for a Maltings Building at the former Sawmill site, work to the castle and extensions as appropriate, repurposing of the Dovecot, and other facilities in the grounds of the castle and distillery.

SCOPE OF INITIAL PHASE

It is possible to conceptually divide the site into two areas, they can broadly be described as modern farm building land and the castle grounds. It is not intended that the physical distinction between the areas be over emphasised in the finished design but it is a useful tool in describing the approaches to the specific areas. The distillery is proposed to be on the farm building land, with the main road and the access road coming across the castle grounds.

The farm building land does not have any obvious structures of histor- ic significance, whilst the castle grounds are rich with elements that are historically significant and referred to in the category A listing of the castle and the Category B listing of the Doocot.

The historic influence on the farm building land is most strongly ap- parent in its relationship to the castle grounds. The land spreads in a relatively level expanse from the castle and forms the base of an approximate bowl. This reinforces the sense that the area that will house the distillery, despite being the larger area, is attendant on the castle as the most substantial historic structure on the site.

Very little work is proposed to the immediate castle grounds in this application. The client wishes to take the time to carefully consider the appropriate design and relationship with the existing buildings. The intention is to intervene in this area as little as possible at this point and only to the extent that is required to access the distillery site without negatively affecting the significant historic fabric.

The castle grounds are subject to ongoing analysis and will be the focus of future applications in subsequent phases.

DESIGN PROPOSALS

The distillery is seens as the first phase of a sequence of develop- ments on the wider site aimed at enriching the landscape and improv- ing the setting and fabric of Midhope Castle.

The aspiration is to create a unique place where the production of Whisky, the landscape it draws from and the heritage of the site can be enjoyed. The setting and location is key to the proposal.

The new distillery building will have two main functions. It will pro- duce over 500,000 litres of whisky a year from Barley grown on the Estate. It will also offer visitors the opportunity to see all aspects of the Whisky production process and to enjoy the unique historical set- ting and landscape.

The setting of the distillery is one that has many layers of history. It will be close to Midhope Castle, which is known to date from the fif- teenth century and along with the land around has been altered many times over the subsequent years. The castle was occupied until the 1920s and each periodw has resulted in change. The additions to the castle are clear to see, and there are buildings around the castle that date from the 1800s. The setting shows a timeline of agricultural use and castle shows evidence of the varied occupation that ranges from aristocracy to the workers on the land.

The castle is the embodiment of the historic significance of the site, and this position is to be carefully maintained. The orientation of the new design is lead by the influence of the existing fabric. It’s form will have a larger footprint but a lower height, it will not compete with the castle but rather work alongside it, and by looking toward the castle’s raised entrance create an exciting new dynamic.

SETTING & ACCESS

The approach to the site will be along the existing track which winds through dense woodland to a clearing that is currently used as a car park for visitors to the castle.

From here a new access route is proposed to take service traffic for the distillery to the south, away from the castle and existing cottages.

The existing footpath leads up to the castle courtyard past the listed dovecot building and existing Victorian cottage and outbuildings to the north.

The courtyard sits between the castle and the overgrown walled gar- den to the south. To the west of this enclosed outdoor space is the open area currently given over to light industrial and agricultural use. This largely flat area of land sits within a shallow depression relative to the surrounding wider agricultural landscape. This will be the site of the new distillery.

The distillery begins to be visible on moving through the courtyard. The new building will align with the traces of an route that once ran through this area out to the west.

SETTING & RESPONSE

The new building consists of three, simple shed-like forms.

The largest is a long, pitched roof building that edges the south of the site. This building will contain most of the distillery production areas and spaces for visitors – a display area containing whisky ma- turing in barrels, tasting spaces, and multi-purpose areas that can be used for exhibitions and functions.

To the north is a second smaller pitched roof form that contains the stills and shelters the worm tubs.

To the south a third pitched roof form encloses external tanks and barrel storage.

A service yard is located to the south of the distillery and sits be- tween the new building and the existing embankment. The service yard and the more industrial activity is hidden from view from the surrounding landscape and most importantly is invisible from the ap- proach road and castle. Access to the service yard will be provided by a new road formed to the south of the main site.

The public areas of the distillery will offer views back to the castle and the landscape to the north. The landscape around the distillery will reinstate paths and routes that we once on the site.

DESIGN DEVELOPMENT

The basic form of the new building has been influenced by common simple, robust utilitarian agricultural buildings. From a distance the distillery will appear as a grouping of simple, quiet forms in the land- scape.

The still house will be wrapped in timber giving it an abstract quality. This building will contain the stills and their copper forms will be vis- ible through the glazed gable facing the castle courtyard.

The still house sits in a cooling pond and forms a gathering place at the visitor entrance to the distillery. This entrance aligns with both the reinstated road and wall running east to west but also with the existing track that leaves the site to the north.

A large framed window on the first floor of the distillery offers pano- ramic views back to the castle, across the structured landscape close to the distillery and further to the agriculutral fields of the estate beyond. These large windows will be edged in bronze metal cladding,

The maturation display area at the east end of the building will be clad in stained or charred slatted timber that will allow in direct light into the space. On dark evenings this end of the building will glow and act as a lantern drawing visitors across the landscape from the castle.

As I showed in my previous post, these plans are now revised and filed again on 8 February 2024, awaiting a decision. This document was filed on 21 March 2024. There are some minor changes to the original plans which were already approved in 2021

Bucky was staring at your phone number on his iPhone. You had flirted with him. “Just in case you need me you can reach me.” Then you agreed to get a drink with him on Friday night. Was this some joke being played on him? Women don’t just go out with him without some expectations of being wined, dined, and bedded.

A sigh escaped his lips as he set his phone on the bedside table and laid back in bed. The last time he chased after someone he fell quickly, had his heart broken, and swore off dating. But you seemed different. All week long you worked hard, were incredibly detail oriented, and never fussed over the work you were given.

In between all that, there was the occasional flirting from you but mainly you were professional. Looking up at his ceiling he tried to steady his breath as he thought about taking you out for a drink tomorrow night. What if you backed out or worse what if you didn’t like him after hanging out? No, he wasn’t sure this was a good idea. Maybe he just needs to cancel to be safe. Better to keep you as an assistant than risk being hurt again. When he sees you at work he will just tell you something came up. Turning off his light, Bucky closes his eyes and hopes for sleep to take over.

Things went great your first week at the office and by the time you knew it, Friday was here. You promised to go out with Bucky tonight for drinks and felt nervous as time passed. What were you going to wear? Was this a casual meetup? Yeah, your boss was attractive, but that didn’t mean anything, right? By five o’clock you were packing up your things and swung by Bucky’s office. You knocked on his door and he waved you in.

“Hey sunshine, what can I do for you?” Bucky asked.

You stepped into his office and ran your hands down your skirt. “I was just making sure you still wanted to meet for drinks tonight?”

Bucky looked up from his paperwork. Was this real? Were you really wanting to hang out with him? “Of course I do. Are you having second thoughts?” He leaned back in his chair and ran a hand through his hair. This can’t be true he was going to cancel on her to save himself from being hurt. But she didn’t hurt him, she really wanted to hang out.

“No, no! I was just double-checking. Ummm, is it casual clothes for the bar?” You inquired.

“Yes, it is. It’s just a little hole in the wall where I go some nights. I promise it’s not sketchy or anything. Why don’t you text me your address and when I’m done here I will go home to change then come get you.” There now he sounded like the confident guy he was at the beginning of the week.

“That sounds wonderful James.”

“Now, now you know you can call me Bucky.” He smiled at you and all you could do was smile back.

“Thank you, Bucky, see you in a little while.”

When you got home you quickly showered and then changed into jeans and a casual sweater. Fixing your hair and makeup you were now satisfied with how you looked. This was just a friendly get-together you tried to tell yourself but you couldn’t help the crush you already had on your boss. He had been a gentleman all week long and never raised his voice at you if you made a mistake. Something inside you just melted when he looked at you with his blue eyes. You grabbed your phone and texted Bucky your address.

It was close to seven P.M. when Bucky showed up on your doorstep. He was dressed in jeans and a casual button-down shirt. You couldn’t help the inhale you took in as he was completely gorgeous out of work as well. Locking your door you walked to the car where Bucky opened the door for you. Once Bucky got in the car he pulled from the curb and headed the short distance to the bar. You both made small talk on your drive and once you arrived you felt nervous again as it was a little busy inside.

As soon as Bucky walked through the door people started to greet him. You couldn’t help but smile as he led you through the bar to a back corner booth. How often did he come here for these people to know him? Once you ordered your drinks Bucky started asking questions about your life. Where did you live before moving here? What is your favorite thing to do on the weekend? It surprised you how open you were with him, especially because he was your boss. But Bucky never judged your answers and in fact, he would tell you about his life. You thought this was the best conversation you had in a while. Time seemed to fly by when you stifled a yawn.

“Are you tired sweetheart?” Bucky asked as you shook your head.

“I am sorry. It’s just that I haven’t slept well all week long.” You confessed.

“No, don’t be we worked all day, so let me get you home.”

“Thanks, Buck.”

Bucky drove you home and insisted on walking you to your door. You could sense Bucky was nervous as you reached the door. “Thank you, Bucky for taking me out tonight. I really had a fun time.”

“It was my pleasure too. I was thinking if you are free this weekend you may want to go out sometime. I mean it’s not a date or anything but just a hang-out. What do you say? Bucky inquired.”

You stared into his eyes and offered a smile. “I would like that, text me tomorrow.” You opened your door and gently closed the door.

Bucky was over the moon that you wanted to hang out again so soon. This was probably inappropriate for a boss and an assistant to go out but it was innocent in his eyes. Just two coworkers hanging out even if one of them had a crush. God he hoped he wouldn’t chase her away. Bucky left her house once she was inside to head home.

After hanging out again the rest they say is history. Bucky and you hung out every chance you could. Both would share likes, and stories and made the other laugh. It had been a couple of months now since you had started on this road and you had to admit you were having the time of your life. Each weekend you would alternate who would choose where you went. It could be as simple as a flea market to an art museum. Neither of you complained about where you went. You were both secretly happy to spend time with one another. Two fools in love without the other knowing.

Steve picked up on the behavior at work one day and couldn’t help but smirk. He wanted to tell Bucky to take it slow but it was clear in the way you both looked at one another that there was a connection. Steve wondered if you each knew yet that this was more than a friendship. He hoped you two would figure it out soon.

The planning of Tony’s end-of-year party was stressing the men out as they went over security with how many bodyguards and police had to be there. After months of planning it was finished that this was going to be a secured event. Plus Tony had his A.I. that helped with looking for intruders. The event was planned for tonight and everyone at the tower was invited to attend. You had spent the day getting ready. You were dressed in a short black dress with stilettos. Bucky had offered to pick you up so you didn’t have to drive in alone. With how things were going you had planned to tell Bucky that night how you felt once and for all. Little did you know Bucky was planning for the same thing.

Bucky had picked you up at the time he said and when you answered the door you both looked at one another in awe. Bucky was in a black suit and tie. In your eyes, he looked like sex on a stick. Gosh, do you wish you could stay inside tonight and see where the night went? Bucky you noticed was taking you in as his eyes looked you over.

“Wow, you look beautiful sweetheart.”

“Thanks, Buck, you look very handsome yourself.”

You both left your house and were on your way to the party. As you arrived there were spotlights in the air and photographers at the main entrance. You felt nervous at the sight but Bucky reached over to grab your hand as he pulled up to the valet. The valet opened your door and Bucky came around the car, offering his arm to you. You slipped your arm around his and he walked you down the red carpet.

Bucky leaned close to your ear and whispered, “Just breathe. Keep your eyes down and not on the cameras.”

You did as he said and noticed the camera flashes weren’t bothering your eyes. As you made it through the doors your breath hitched as you took in how beautiful everything was. The ballroom though was breathtaking as you entered it. There were people everywhere along with elaborate fountains, ice sculptures, bars scattered throughout, and chandeliers that were probably worth more than you make in a year.

Bucky guided you around the room and pointed out the people he knew. After a stroll around the ballroom, Bucky says, “I need to join Steve real quick to check in on the security team. Why don’t you get yourself a drink.”

You nodded and headed over to one of the bars. You ordered yourself a glass of wine. You were admiring a painting on the wall when you heard a small group of people talking.

“Why did Bucky show up with his assistant?” One woman said.

Another woman joined in. “Don’t you know Bucky sleeps with any woman he wants and then leaves them high and dry?”

“No, are you serious?” The first woman asked.

“Of course I am. Ask Sharon Carter. He was sleeping with her for months and then suddenly called it quits. If you ask me I think he’s banging his assistant.”

You heard enough before you slipped away from them. Is that what Bucky was looking for? To use you just for sex? After all the time you spent with each other, was this his true colors? Downing your wine you headed outside to get air.

Bucky finished with Steve and the security team. The word was everything was running smoothly. With that out of the way, Bucky started to look for you in the ballroom. He looked everywhere for you and just couldn’t find you. You couldn’t have gotten far so he went to step outside. Sure enough, he found you.

“Sweetheart, what are you doing out here?” He asked.

You turned to face him and had tears rolling down your cheeks. “Don’t sweetheart me. I know who you really are and I’m not interested.”

“What are you talking about? What does that even mean?” He took a few steps towards you and you took one backward.

“I heard everything I needed tonight about you. This group was talking about us.” You wiped the tears away as you tried to sound brave.

“What group of people? You need to give me something sweetheart.” He pleaded with you.

“I heard you have been sleeping with Sharon. That you stopped so you could pursue me instead. You-you are just a playboy making your way through women. Well, I’m not like that Bucky. To think I actually had feelings for you.” The words hitched as you started to cry more.

“You have to listen to me sweetheart, I'm not that man anymore. Before you yeah that’s how I coped. I had someone break my heart and yes I reverted back into a man I wasn’t proud of. But then you came along and I knew I wanted to change if I was going to have a shot at you.”

“You’re just saying that Bucky.”

“No I’m not,” he interrupted. “I knew the first day I ran into you that there was something special about you. All the times we went out I wished we were an official couple cause I wanted to hold you close and kiss you. I would give anything for you to be mine so I could tell you I love you every day of the week.” He stood there looking at you with a pleading face. Bucky just wanted you to know how much he has fallen in love with you.

You stood in silence taking what he said to heart. Does he actually love you? You thought this was all one-sided. “You love me? I’m just your assistant, I'm no one special.”

Bucky smiled as he took a few more steps toward you. This time you didn’t move. “You may be my assistant at work but you are so much more than that to me. You’re my friend and I would love to call you mine. That’s if you feel the same.”

“I love you Bucky. From the first moment, we met I knew I wanted to be your girl.” You blurted out. “I’ve never felt this way about anyone before.” You took another step towards Bucky and now you were both close enough to touch.

“May I kiss you?” He asked.

“Yes..”

Bucky softly pulled you into his arms and kissed you. Your mouth opened and his tongue danced against yours. You were both pulling at the other as you each tried to dominate the kiss.

Steve came outside to find Bucky but instead, he found you both kissing. Smiling to himself he left you both alone.

One year later…

If you would have told Bucky he would’ve found the love of his life at work he would’ve called you crazy. Life has been the best it’s ever been for him once you agreed to be his best girl. You both dated for six months before he popped the question to you to marry him. It was an easy answer to give because you were head over heels for Bucky. Today you were both married and celebrating your life together. You had a baby on the way and that was something you both were excited for. There was no other place Bucky would rather be in this world. He thinks back to the day he met you and how he thought he was a fool falling so hard for you. Now he has no regrets for pursuing you and changing his life for you. Now, all there is to focus on is the baby on the way and a wonderful life with you.

Okay so I have been asked to cast an eye over SB197 in the WV legislature, which is a new bill introduced to both add a new section to WV law as well as amend an existing section about child neglect and abuse, to see what potential issues I see.

TLDR: this is not only really dangerous from a standpoint of people being trans publicly, since one of the big editions is making being trans a display of obscene material and punishable by law, particularly within school grounds, but I am also seeing a lot of parental rights additions that make me REALLY SCARED of how trans kids are going to be treated in WV. I’m going to go thru it section by section and break down why each section frightens me, so hopefully this is educational for folks.

My creds: I worked in family law as an attorney for three years, I was affiliated with a public defenders office for that same amount of time working primarily with juvenile offenders, and I am still an attorney even if I haven’t worked in those fields for the last six months. Plus I’m trans. And I love WV and wanted to live there. So.

WEST VIRGINIA'S FUN NEW SHITSHOW HORROR HOUSE TIME.

The new section (formally titled §18-5-29, Obscene matter in public schools prohibited [I will be calling it the Obscenity section]) is about 700 words of absolute garbage. Essentially what it distills down to is the following.

Section A: prohibiting anything they label as “obscene matter” in or within 2500 feet of any public school library, classroom, building, or other facility under the supervision of the state board of education and requiring that any school officials or personnel who become aware of the material remove it from school grounds. “Obscene matter” is currently defined in §61-8A-1 of the WV code, pretty fuckin broadly (unconstitutionally so in my opinion but ~that’s me~). So basically anything an “average person applying contemporary community standards would find taken as a whole appeals to the prurient interest or is pandered to a prurient interest” (basically, anything ~unwholesome~), anything that an “average person applying community standards” would find depicts sexually explicit conduct in a “patently offensive way,” or anything that a reasonable person would find “taken as a whole, lacks serious literary, artistic, scientific or political value” which basically means E V E R Y THING.

Section B. This is the one that scares the shit out of me tbqh, cause this is folding in the amendment section I mentioned earlier to another part of the WV code specifically relating to child abuse and neglect. This section mandates that any “school officials or school personnel while engaged in a professional capacity or activity” shall be found to be a “custodian of children” under WV law. This basically makes EVERYONE a mandatory reporter, which like…most professionals already are, but at the same time this is EXPLICITLY MAKING ANYONE WHO WORKS IN THE SCHOOL IN ANY CAPACITY (see: any school officials or school personnel) mandatory reporters regarding “obscene matter.” So if an adult working at the school even SUSPECTS that a child has been exposed to “obscene material “while in any public school facility (unclear from the phrasing if the exposure happened on school property, or if the professional just learns about it there) and they decide not to report it (or they “fail to make a TIMELY report” when there’s no real definition of what timely means) then they can be prosecuted for a misdemeanor and imprisoned.

Section C. The state superintendent is going to establish a procedure to file complaints alleging violations of subsection A. If they find that a violation occurred, they will TELL THE COPS THAT IT HAPPENED.

Section D. No government funds (state or federal) can be used to develop or operate programs “designed to promote or encourage sexual activity, whether homosexual or heterosexual” or “to distribute or aid in distribution of any legally obscene materials” within 2500 feet of a school building or facility. Which, woof. We could unpack everything about that one, but it’ll be most of the review.

Section E. If an adult is found to have committed a felony under the child neglect statute related back to this one (if they’re found to have neglected kids by allowing them to view or possess “obscene material” is my understanding, this bill isn’t written that well) then they will be subject to penalties set forth in a felony, which I’m guessing (on average) is at least a year in jail and a thousand dollar fine, from what I’ve seen of WV felony statutes.

Section F. THIS IS THE OTHER REALLY SCARY ONE TO ME FROM A LEGAL STANDPOINT. “Any student or parent, guardian, or custodian on behalf of a student shall have civil cause of action against a county board, public charter school, state board” if the entity caused or was negligent in allowing a violation of the preceding sections, basically if they let anything slide PARENTS CAN SUE THE SCHOOL which like…if you’re talkin about a trans kid who is not out to their parents, they’re found to have “obscene material” (fanfiction?? Fanfiction could qualify here??? Risque art that isn’t even definitionally pornography?? A book abut transitioning that they’re hiding from their parents???) the school is mandated to not only out this kid to their parents, but the parents can then sue the school if the school DOESN’T OUT THE CHILD. Just spinning a hypothetical here but I hate this.

The rest of the bill is adding in definitions to Article 8A of the WV code, which are as follows. Anything italicized is the new language that has been proposed to be added by the bill; anything NOT italicized was already in the law:

(g) "Graphic," when used with respect to a depiction of sexually explicit conduct, means that a viewer can observe any part of the genitals or pubic area of any depicted person or animal during any part of the time that the sexually explicit conduct is being depicted.

(h) "Identifiable minor" means a person: (i) who was a minor at the time the visual depiction was created, adapted, or modified; or (ii) whose image as a minor was used in creating, adapting, or modifying the visual depiction; and (iii) who is recognizable as an actual person by the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature; and shall not be construed to require proof of the actual identity of the identifiable minor.

(i) "Indistinguishable" used with respect to a depiction, means virtually indistinguishable, in that the depiction is such that an ordinary person viewing the depiction would conclude that the depiction is of an actual minor engaged in sexually explicit conduct.

(i)(l) "Matter" means any visual, audio, or physical item, article, production transmission, publication, display, exposure, exhibition, or live performance, or reproduction thereof, including any two- or three- dimensional visual or written material, stereopticon, moving picture, slide, film, picture, drawing, not exceeding $500 video, graphic, graphic novel, or computer generated or reproduced image; or any book, not exceeding $500 magazine, newspaper or other visual or written material; or any motion picture or other pictorial representation; or any statue or other figure; or any recording, transcription, or mechanical, chemical, or electrical reproduction; or any other articles, video laser disc, computer hardware and software, or computer generated images or message recording, transcription, or object, or any public or commercial live exhibition performed for consideration or before an audience of one or more.

(j)(m) "Minor" means a an person under eighteen years of age or a person representing himself or herself to be a minor. Any prosecution under this article relating to a victim who is representing himself or herself to be a minor shall be limited to investigations being conducted or overseen by law enforcement.

And the big doozy here is this one:

(k)(n) "Obscene matter" means matter that:

(1) An average person, applying contemporary adult community standards, would find, taken as a whole, appeals to the prurient interest, is intended to appeal to the prurient interest, or is pandered to a prurient interest;

(2) An average person, applying community standards, would find depicts or describes, in a patently offensive way, sexually explicit conduct; and

(3) A reasonable person would find, taken as a whole, lacks serious literary, artistic, political, or scientific value.

(4) For the purposes of any prohibition, protection, or requirement under any and all articles and sections of the Code of West Virginia protecting children from exposure to indecent displays of a sexually explicit nature, such prohibited displays shall include, but not be limited to, any transvestite and/or transgender exposure, performances or display to any minor.

(l)(o) "Parent" includes a biological or adoptive parent, legal guardian, or legal custodian. (underlining this one for the legal side note that remember that custodian language from before??? that's where this kicks in)

(m)(p) "Person" means any adult, partnership, firm, association, corporation, or other legal entity.

(n)(q) "Sexually explicit conduct" means a ultimate definitive sexual act, normal or perverted, between persons of the same or opposite sex, actual or simulated, including genital-genital, oral-genital, anal-genital, or oral-anal sexual intercourse, sodomy, oral copulation of any kind, sexual bestiality, sexual sadism and masochism, masturbation, excretory functions and lewd exhibition of the anus, genitals or pubic area of any person, or lascivious simulated sexual intercourse where the genitals, breast, or pubic area of any person is exhibited.

okay. well.

I mean. This is all just gonna be an absolute garbage hellscape if this gets passed. THE IMPORTANT THING IS IT HAS NOT BEEN PASSED. If you live in WV, you can call folks and say that you are AGAINST the passage of SB197. Call your state or county representatives! They are the people who vote on this! If your representative is on the Judiciary Committee, so much the better, that’s where the bill is being evaluated right now!!! Here is the list of delegates on the committee! Call them!! Make a point to be upset!!! Explain why you don’t want this bill to pass!!! Keep an eye on the Committee website for the dates that the public hearings will be held on this bill, because there likely will be a public hearing people can speak at!! You CAN actually do something, it’s not the end of the world.

Even if you do not live in WV and you live NEAR WV, then 100% reach out to folks you know who live there and give them a safe space to land if they need to get out of the state!!! There are things you can do. Just….a heads up to everyone that this is on the table and it’s something they’re going to be discussing.
