SCG reveal strengthening strategies with Ai & Startups

SCG’s 2018 Operating Results showed overall profit decrease from Chemicals Business while Packaging Business exhibited consistent and robust growth and Cement - Building Materials Business enjoyed favorable prospects. SCG is thriving to push forward two key strategies in 2019, focusing on financial stability and long-term growth management by delivering integrated solutions and new business models that harness digital and deep technologies, and collaborate with leading startups in various regions and research and development institutes worldwide. SCG is also seeking new opportunities to meet consumer needs throughout the region. Mr. Roongrote Rangsiyopash, President and CEO of SCG, disclosed the company’s unaudited Operating Results for FY2018, with registered Revenue from Sales increase 6% y-o-y to 478,438 MB. Profit for the year registered 44,748 MB, a decrease of 19% y-o-y from global economic uncertainties, primarily driven by trade war, volatile oil market and a strengthening Thai baht, in which affected the overall performance of SCG. In 2018, SCG’s Revenue from Sales of High Value Added Products & Services (HVA) reached 184,965 MB, representing an increase of 5% y-o-y and accounting for 39% of total Revenue from Sales. Spending on Innovation Research & Development totaled 4,674 MB or 1% of total Revenue from Sales. SCG’s Revenue from Sales of Q4/2018 dropped by 4% q-o-q to 117,223 MB from the lower chemicals product prices but increased 3% y-o-y from increased chemicals sales volumes, and the domestic growth in the Cement - Building Materials Business. Profit for the Period rose 11% to 10,468 MB q-o-q, attributed mainly from seasonal dividend contribution from the investment business in Q4/2018 but decreased 17% y-o-y, mainly due to the decline in performance from the Chemicals business. SCG’s Revenue from export Sales registered 130,895 MB or 27% of total Revenue from Sales, a rise of 6% y-o-y. The performances of SCG’s businesses excluding Thailand in 2018: SCG’s Revenue from Sales in ASEAN registered 118,014 MB, representing 25% of total Revenue from Sales which is an increase of 11% y-o-y. Furthermore, SCG’s Revenue from Sales in other regions outside ASEAN, registered 86,155 MB, amounts to 18% of total Revenue from Sales. The total assets of SCG as of December 31, 2018 amounted to 589,787 MB, while 28% representing assets in ASEAN. The 2018 operating results by business units are as follows: Chemicals Business recorded FY2018 Revenue from Sales rose 7% y-o-y to 221,538 MB from higher product prices and sales volume. Profit for the year stood at 29,166 MB, a decline of 29% y-o-y due to weaker petrochemical cycle and higher feedstock costs with lower equity income from associated companies. Meanwhile, Q4/2018’s Revenue from Sales declined 7% q-o-q to 53,905 MB mainly from lower product prices, but grew 4% y-o-y. Profit for the Period in Q4/2018 recorded 5,415 MB, dropped 28% q-o-q and 43% y-o-y due to lower equity income from associated companies, and inventory loss. Cement - Building Materials Business recorded FY2018 Revenue from Sales increased 4% y-o-y to 182,952 MB, attributed to the government’s public infrastructure which drove the growing demand for cement as well as the recovery in real estate projects and construction expansion in the region. Profit for the year stood at 5,984 MB, a decline of 7% y-o-y, derived mainly from the asset impairments in Q3/2018. Without these impairments, SCG would still have recorded 7,304 MB in Profit for the year. Revenue from Sales of Cement - Building Materials Business in Q4/18 dropped 1% q-o-q to 45,728 MB but increase 5% y-o-y, attributed to the operational expansion of Thailand and international. Profit for the Period recorded at 1,558 MB, up 488% q-o-q from the asset impairments which occurred in Q3/2018, an increase of 49% y-o-y from the higher sales in Thailand and ASEAN. Packaging Business recorded FY2018 Revenue from Sales increased 7% y-o-y to 87,255 MB. The business unit registered Profit for the year increased 36% y-o-y to 6,319 MB from cost saving initiatives of Packaging chain and steadily rising demand for packaging in domestic and international markets. Revenue from Sales in Q4/2018 of Packaging Business weakened 4% q-o-q to 21,283 MB and 1% y-o-y owing to lower sales volume both Packaging Chain and Fibrous Chain. Profit for the Period in Q4/2018 registered 1,492 MB, a decrease of 13% q-o-q but grew of 23% y-o-y. Mr. Roongrote said, “In 2019, SCG will continue to focus on two key strategies. One is Stability which the company has maintained continuously and acted promptly to cope with recent global economic volatility, resulting in the overall 2018 SCG’s Profitability Ratios at 9%, a considerably strong figure compared to the overall industry performance. In addition, the financial position remains robust, with Net Debt to EBITDA ratio of 1.7 times, while most loans are in Thai Baht with over 90% of them are at a fixed rate. The cash flow is stable due to the healthy performance of core businesses. Another strategy is Long-term Growth Management. In addition to heightening the development of innovative high value added products and services to raise the living standard and build a sustainable business growth, this year, SCG will focus on delivering solutions to more adequately fulfill customer needs. A series of solutions are from its core businesses: Chemicals Business that offers energy-saving industrial furnaces coating service, floating solar solution for solar power generation with a comprehensive range of services including space design, Installation and after-sales service; Packaging Business, a total packaging solutions provider, that aims to drive the circular economy approach in its services and practices such as customer-engaged packaging design service, Raw materials recycling process; And Cement - Building Material Business that introduced Construction Solutions which combined high-quality production expertise with advanced technologies to develop 9 core solutions, namely, Life-time solution that provides precise assessments of buildings prior to method design, building expansion and structural strengthening with help of advanced engineering equipment. Furthermore, SCG also aims to develop new business innovation models to improve competitiveness and stay relevant in a fast-paced ever-changing world. SCG harnesses a broad range of digital technologies which include Artificial Intelligence (AI) to help analyze consumer insights; Blockchain, a digital ledger automatically connecting financial institutions to vendors, That enable efficient information sharing; Robotic Process Automation (RPA) development and Machine Learning that help resolve production system complexity, allowing adequate productivity to meet the market demand; Deep Technology investment to reap knowledge of future trends i.e. New advanced materials and Clean technology to help streamline the production process throughout the value chain and cut reduction costs; and the path toward the development of Industry 4.0 with a series of internal staff capability development programs “Internal Startup,” To create agile organization and encourage design thinking and startup work practices to help acquire customer insights. This program has helped guided solution for over 40 out of 100 teams of clients and businesses to successfully develop business models that meet the market demand. The success stories include the platform for meal box delivery, logo design service for all business and customer management system and sales tracking for construction equipment stores. Another sustained effort is forging Open Collaboration by investing in leading startups in various regions that own technologies or innovations in line with 3 SCG’s core business through “AddVentures,” as well as enhancing potentiality to the invested startups. SCG has made direct investment in 10 startups that own distinctive technologies such as tech expert matching platform to further digital businesses, robot developer on top of investing through funds focusing on startups. Furthermore, SCG also extends more commercial deals with almost 100 projects with tech companies, aiming to leverage innovation to strengthen core business or create new businesses. Also, it will accelerate investment projects to help generate business growth in the future in both growing ASEAN market and new emerging and potential market, such as chemical export to the Chinese market, conducting retail and logistics business in the region.” In addition, the Board of Directors of SCC approved to submit for approval at the Annual General Meeting of Shareholders a full year 2018 dividend payment of 18.00 Baht per share for a total amount of 21,600 million Baht, or 48% of profit for the year on consolidated financial statements, of which 8.50 Baht per share totaling 10,200 million Baht was paid as an interim dividend on August 22, 2018. The final payment of dividend will be 9.50 Baht per share, totaling 11,400 million Baht. The above dividend distribution shall be paid to the shareholders entitled to receive the dividend according to the Company’s Articles of Association and who are listed in the record date on Thursday April 4, 2019 (The XD, or the date on which a purchaser will not be entitled to receive the dividend, will be on Wednesday, April 3, 2019.)  SUMMARY OF FACTS –
A twenty-three-year-old woman, a para-medical student, who had gone with her companion to watch a film at PVR Select City Walk Mall, Saket, on a breaking cold night got into a means of transport at Munirka transport stand to be dropped at a specific spot; One of accused persuaded them to get on a vacant transport with colored/tinted windows. Where they were attacked by six guys, one of whom was a minor, aged 17. The companion, when he attempted to secure Nirbhaya (“Nirbhaya” is the pseudonym used for the rape victim)., was pummeled and beaten by the culprits. Nirbhaya was explicitly damaged and sexually violated, her body was mutilated, and private parts were ruptured to give vent to their degenerate sexual appetite. Her intestinal tracts were pulled out, and private parts were ruined and mutilated and she became a prey to the lust of gang of six and brutal assault. The companion of the young lady was able to survive regardless of being tossed outside the transport alongside the young lady and the endeavor of the charged appellants to run over them got vain as Nirbhaya and her companion, by their slight movement, could escape from being squashed under the transport, and the appellants left them believing that they were not anymore alive. Lying exposed, as the garments were expelled from their bodies, they yelled for help and as favorable luck would have it, the late evening patrolling vehicle, a motorcycle, showed up and the said man, Raj Kumar, gave the shirt to her companion and reached the control room from which a Bolero watch van came and they brought a bed sheet and torn it in two sections and gave a piece to each so that they could cover themselves and feel civil. The PCR van took the victims to the Safdarjung Hospital where treatment initiated. Later, Nirbhaya died of various organ failure, internalbleeding, and cardiac arrest on the 29th December, at a hospital in Singapore where she had been taken to with the expectation that her life could be saved. There was a great deal of social shock because of the gruesome occurrence. There was a great deal of candlelight march, solidarity movements, and protests. The shock was not confined to India, the entire world had formed an opinion about India.
ISSUES RAISED- 
Whether rape as defined under section 375 of the IPC covers the offence entirely?
Whether death penalty can be given to the convicts as punishment for such heinous crime?
Whether a juvenile committing the offence should get punishment equivalent to the adult?
Whether public outrage can influence the judgement in a case?
Whether the sexual offences against women is tried appositely in India?
 CONTENTIONS FROM BOTH THE SIDES
The contention of the defense counsel was that the DNA report was deficient and contended that DNA test can’t be treated as precise as the victim had experienced blood transfusion during the treatment and when there was a transfusion of blood, DNA profiling was probably going to vary. The contentions of the defense counsel that the bite marks were stage-managed.The contention of Defense counsel was that the victim could not have given any dying declaration because of her health condition. The defense counsel and amicus curiae were reproachful of the withering announcements, saying they ought not to be considered as they do not rouse certainty due to irregularities and enhancements in them. They also argued that the third dying declaration made through signals needs believability and it ought to have been video-charted, needs substance. Invoking Mahatma Gandhi’s name, legal advisor A P Singh says, “God gives life and only he can take it and not man-made courts” Life imprisonment is the standard, and death punishment is a special case.  Death is irreversible; the purpose of justice is reconciliation and reform. All the arguments of the defense counsel were rejected by the supreme court and the prosecution has made it very clear that it needs death punishment for all the four convicts. The prosecution has contended that there is no motivation to show the convict’s benevolence. The prosecutor says they have killed a vulnerable young lady when even she asked for mercy. The prosecutor says there ought to be ‘no benevolence for cruel convicts’. The crime committed by them was against the society.
JUDGMENT OF THE CASE
The court held that there should be consideration of both mitigating and aggravating factor and there should be a balance between the two. In this case there were mitigating factors like the dependent and ailing parents, the age of the convicts, behavior in jail, no criminal antecedents, post-crime remorse but the aggravating factors outweighed them. The court held that the conspiracy involving gang rape and murder inside moving bus was brutal, barbaric, and diabolic and the victim’s companion was assaulted and brutally beaten and robbed. Moreover, they tried to run the bus over her after throwing them out of the bus naked on a wintery night.  The evidence clearly displayed that the victim’s internal organs were perforated and slayed open due to repeated insertion of iron rods and hands and caused grave injuries to the victim who later succumbed to her injuries. The convicts had also tried to destroy evidence by washing the bus and burning the clothes of the deceased after that they distributed the loot among themselves which confirms death sentence. A committee was formed and criminal law (amendment) act, 2013 was enacted to tackle sexual offences effectively. The court mentions that the mitigating circumstances were not enough to take the case out of the category of rarest of the rare case and hence, affirmed death sentence.
COMMENTS ON THE CASE
After increasing huge amounts of national and worldwide attention, Delhi’s “Nirbhaya” rape case turned into an urgent defining moment and a turning point for India’s women’s activist and the feminist movement. In the time since this case, India’s administration has found a way to propel laws and policies with respect to violence against ladies. Her case started a momentous movement, known as the “Nirbhaya Movement,” which caused to notice the prevalence of sexual viciousness against women in India. Fights, protests, and public pressure, both nationwide and global, pressurized the Indian government to make a move. They made an elevated high-level committee; run by the previous Chief of Justice of India, Justice Verma, called the Verma Committee. Their key suggestions were to enlarge the meaning of “rape” to incorporate non-penetrative sex, make new offenses for acts, for example, acid attacks and sexual harassment, and increment punishments for those sentenced for rape. These proposals were completely brought into the Indian Penal Code (IPC) through the Criminal Law Amendment Act of 2013 likewise called the anti-rape act. The National Crime Records Bureau (NCRB) came out with an announcement saying that rape reports had risen, while conviction rates had diminished, the National Commission for Women finished up a need to redesign provisions for sexual assault in the IPC. These provisions included reclassifying consent, rape, and molestation.

Inclusion of Section 354D, which covers the offense of stalking. The Age of consent has been increased from sixteen years to eighteen years. 
The meaning of rape has been broadened after the Nirbhaya Case. The Amendment Act has included more activities under the domain of what comprises rape, for example, unconsented penetration of mouth, urethra, vagina, anus with the penis or different items by anybody and unconsented application of mouth to vagina, urethra, and anus. Inclusion of Section 376 (2) (c), which covers the offense of Rape by personnel of the armed force. Inclusion of Section 376A, which deals with the offence of Rape which can result in death or vegetative state. Insertion of Section 376D, which deals with the offence of gang rape. Repetition of offences is punishable with life detainment or death. Employment of a trafficked person can pull in penal provisions also. It has additionally been explained that penetration signifies “penetration to any extent”, and the absence of physical resistance or such different resistances is unimportant for comprising the offense of rape.

The Himachal Pradesh government chose to set up state and region level committees to check the assaults committed against women in the state. The National Council of Education Research and Training has since created course readings/ textbooks and lesson plans concentrated on “gender sanitization,” which intend to bring issues to light of gender issues among school-going children. After the Nirbhaya movement, gender sanitization turned out to be popular and was carried out through various projects and workshops. Delhi’s taxi drivers and rickshaw drivers are currently required to take a gender sanitization course so as to renew their business license. WBNUJS organising Indian Mediation Week (IMW)
West Bengal National University of Juridical Sciences Kolkata (NUJS) is organizing  Indian Mediation Week (IMW), a pan India mediation awareness campaign, in collaboration with ODRways which is in the list of top 12 ADR centers of India recognized by  Department of Justice, Government of India. The campaign is supported by Ministry of Law and Justice Government of India, and Hon’ble Justice Madan Lokur, Supreme Court Mediation and Conciliation Project Committee. In the last one year, the Indian Mediation Week campaign has spread to 102 cities across India and directly sensitized more than 2,00,000 people about the benefits of mediation. IMW has launched the first of its kind online platform, Mediation Embassy, where you can track the level of mediation awareness in each city. In order to prevent commercial disputes from getting caught in complicated procedures of the court, IMW is organizing Business-Mediation Summit in all four metro cities of India:
1) Kolkata (10th December 2018), at National University of Juridical Sciences, Kolkata. 10 AM- 2 PM,
2) Chennai (12th December 2018), at Madras Managment Association, 10 AM- 2 PM,
3) Mumbai (14th December 2018), at IMC Chamber of Commerce and Industry, 10 AM- 2 PM
4) Delhi (15th December 2018), at PHD Chamber of Commerce and Industry, 10 AM- 2 PM
The highlight of this event is going to be the  “Start Smart Awards” in collaboration with Atal Innovation Mission (AIM), NITI Aayog, Government of India. The aim is to recognize the top 3 startups each from 4 zones of India, North, South, West, and East. The award ceremonies of the zones will be held in Kolkata, Chennai, Mumbai and Delhi respectively. The top 3 startups from each zone will be provided incubation support by AIM, NITI Aayog, Government of India. The aim is to sensitize the startup industry and the MSMEs with better dispute resolution practices and management tools. There will be two panel discussions in each summit: 1) How to make doing business easier?, 2) How to make solving disputes easier?.
The target audience for this event includes Startups and MSMEs and the guest list for the event will include CEOs, Industrialists, MNCs, Banks, Traders associations, lawyers, mediators, Law Firm Partners,  arbitrators, judges, ADR centers across India etc.
