Do you think Section 230 is pretty much going to be passed? I've been thinking about leaving the internet completely over this.

...Well, like many things, the answer is "It's Complicated,"

Firstly, for the most part, efforts to screw up Section 230 aren't direct repealing all of it so much as carve-outs that majorly weaken it, in ways that could still deeply screw up free speech.

The recent Kids Online Safety Act/EARN IT Act is being pushed for, and while it's not in committee, given the former was sent to the Commerce Committee last time and the latter to the Judiciary Committee, they're probably gonna send it next time, and you're probably going to want to call your senators if they're in said committee to tell them to kill those bills.

Exxon lobbyist confesses to his crimes

50 years ago, Exxonmobil’s scientists warned that continued use of fossil fuels would render our planet uninhabitable by humans. Exxon’s response? They buried the reports and embarked on a disinformation campaign modeled on the tobacco industry’s cancer denial.

That campaign continues, even as floods-of-the-century crop up every month or two, as thousand-year heatwaves strike again and again, as wildfires stain our skies the color of blood and zoonitic plagues shut down all activity for years at a time.

Exxon, of course, claims that they’re good corporate citizens, committed to preserving the habitability of the only known planet in the entire universe capable of supporting our species.

It’s a total lie.

Exxon spent millions on corruption: disinformation and influence campaigns (AKA “bribes”) to make tens of billions — and imposed trillions in costs upon the rest of us, and incalculable losses in the form of lost human lives and natural wonders.

Exxon denies this — in public. In private, the people who direct these campaigns are immensely proud of their work and keenly aware of the fact that other large, corrupting industries are always on the lookout for talent who can corrupt on their behalf.

For the past eight years, Keith McCoy has been the top Exxon lobbyist in Washington, DC. When Unearthed (Greenpeace UK’s media arm) contacted him pretending to be a corporate recruiter with a lucrative offer, he jumped at the chance to boast about his corrupting accomplishments.

The resulting nine-minute video confirms everything that Exxon’s critics — and anti-corruption campaigners — have said for decades. It’s a gleeful, boastful confession that catalogs the company’s many lies and cheerfully identifies them as such.

In the video, McCoy describes how Exxon uses front-groups to sow doubt about the climate emergency and the need to eliminate fossil fuel consumption.

He names the senators whom he has (successfully) lobbied to blunt or remove climate protections from Biden’s $2T stimulus. It’s a heartwarmingly bipartisan parade of biddable officials-for-hire whom Exxon has helped out with an often lucrative side-hustle.

On the Democrat side, there’s Joe Manchin (D-WV), Kyrsten Sinema (D-AZ), Jon Tester (D-MT), Maggie Hassan (D-NH), Chris Coons (D-DE) and Mark Kelly (D-AZ).

While the Republicans are Shelley Moore Capito (R-WV), John Barrasso (R-WY), John Cornyn (R-TX), Steve Daines (R-MT), and Marco Rubio (R-FL).

McCoy is especially fond of Joe Manchin, whom he calls “a kingmaker” whose office holds “standing weekly check-in calls” with Exxon lobbyists.

McCoy speaks fondly of the Trump years, and invites the interviewer to google “trump exxon” to get a sense of just how many gifts his employer received during 2016–20.

He also frankly admits that Exxon front groups like the American Petroleum Institute are “whipping boys” sent to hearings in Exxon’s stead, to absorb the performative criticism of lawmakers who nevertheless fail to take substantive action to curb Exxon’s slow genocide.

And he describes how Exxon secretly funded “shadow groups” to “aggressively fight against some of the science.” He stresses — probably correctly — that nothing that Exxon did was illegal.

He neglects to mention the work Exxon has done to ensure that this unimaginably terrible conduct remained legal.

But he isn’t shy about Exxon’s ability to influence policy otherwise. For example, he admits that the only reason Exxon has publicly endorsed carbon taxes is that they know they can prevent any carbon tax from becoming law — it’s all a show.

Exxon corporate, confronted with the video, claimed that it was all reflective of Greenpeace’s bias against giant, sociopathic polluting companies and asks who we’re going to believe, an oil company or our own lying ears?

Do watch the video, if only to hear McCoy describe how he baits the hook for senators and then “reels them in.”

“I make sure I get them the right information that they need so they look good. And then they help me out. They’re a captive audience. They know they need you.”

McCoy has since posted a groveling retraction on Linkedin, claiming his “statements clearly do not represent ExxonMobil’s positions on important public policy issues.” He doesn’t explain why he made those statements if they’re not true.

Mr McCoy described a lobbying strategy in which he claims ExxonMobil uses third parties to mask its interests from public view and accountability.

He said: “We don’t want it to be us, to have these conversations, especially in a hearing. It’s getting our associations to step in and have those conversations and answer those tough questions and be for, the lack of a better term, the whipping boy for some of these members of congress.”

He added: “There was something we were working on earlier this week where we, where our CEO was invited to a hearing from a member of congress who we know is just going to rip him to shreds when he goes there. So, we look at it and we say: well, why us?”

Mr McCoy claims that ExxonMobil lobbied Congress to dilute the climate provisions of President Biden’s Infrastructure Bill.

He said: “That’s a completely different conversation when you start to stick to roads and bridges. And instead of a $2 trillion bill, it’s an $800 billion dollar bill. If you lower that threshold, you stick to highways and bridges then a lot of the negative stuff starts to come out.”

“Why would you put in something on emissions reductions on climate change to oil refineries in a highway bill? So, people say yeah that doesn’t make any sense, so then you get to the germane of saying that shouldn’t be in this bill.”

ExxonMobil said: “Our discussion on the bill are not accurately portrayed. Our lobbying efforts are related to a tax burden that could disadvantage us businesses.”

Mr McCoy appears to suggest that ExxonMobil’s public support for a carbon tax is underpinned by the conviction it will never happen, allowing the company to “support” it in order to appear green.

He said: “I will tell you there is not an appetite for a carbon tax. It is a non-starter. Nobody is going to propose a tax on all Americans. And the cynical side of me says yeah we kind of know that. But it gives us a talking point. We can say well what is ExxonMobil for? Well we’re for a carbon tax.

“Carbon tax is not gonna happen. I have always said, and I’ve worked on climate change issues for twenty years. There’s a lot of talk around it and the bottom line is it’s going to take political courage, political will in order to get something done. And that just doesn’t exist in politics. It just doesn’t.

While many oil companies are diversifying with natural gas, it appears ExxonMobil is going all-in battling to keep "big oil" alive and well.

"Keith McCoy is a senior ExxonMobil lobbyist on Capitol Hill and has represented the company in its liaison with the U.S. Congress for the last eight years," explained the report.

"Senator Shelley Moore Capito, Senator Joe Manchin, Senator Kyrsten Sinema, Senator Jon Tester, Senator Maggie Hassan, Senator John Barrasso, Senator John Cornyn, Senator Steve Daines, Senator Chris Coons, Senator Mark Kelly and Senator Marco Rubio," were all cited.

A month ago, Republicans were insisting that they wouldn't "take the bait" on a big infrastructure proposal in two pieces, doing some of it that might get Republican support through regular order and the rest of it through budget reconciliation to avoid a GOP filibuster. "If this is what they decide to employ, it's a pretty cynical ploy to try and appeal to Republicans to vote for all that stuff, and then do reconciliation to do all the other hard stuff," Senate Minority Whip John Thune said at the time. "[I]f they decide to do that as a ploy to lure Republicans in to vote for the easy stuff and then do all that stuff, the controversial stuff through reconciliation, I don't think our guys are going take the bait on that," Thune added.

Fast forward a month and here's Sen. John Cornyn, a Texas Republican, on Fox News Sunday: "There is a core infrastructure bill that we could pass. […] So let's do it and leave the rest for another day and another fight." That would be an $800 billion in what they call "real" infrastructure and a separate one for all the stuff they're going to refuse to pass. Exactly what they weren't going to take the bait on last month.

Since then, however, polling for Biden's performance is "pretty damn good," as Kerry Eleveld wrote, the result of a COVID-19 vaccine rollout that has worked efficiently and quickly and a $2 trillion rescue plan that has the majority of Americans feeling, well, rescued. As of the beginning of this week, four national polls show Biden's approval rating above water. Support for his infrastructure plan specifically is high as well, at 56% approval in the latest NPR/PBS NewsHour/Marist survey.

So Republicans are working on their counterproposal to Biden's American Jobs Plan, which will fall somewhere between $600 and $800 billion and will contain the things they would support to pass through regular order. They reject the very popular corporate tax hike in Biden's plan and instead want to pay for the bill by—get this—punishing people who drive electric vehicles and by taking away any of the unspent state and local assistance they hated in the coronavirus relief bill to spend here.

They want to tax people who are trying to save the environment by driving electric- and hydrogen-powered vehicles like gas-powered cars for the wear and tear on highways. Biden has ruled out a gas tax hike in part because it is regressive, disproportionately hitting low-income and rural people who don't have access to public transportation and have to drive. That's sure going to go over well with businesses like Amazon, which is building an electric fleet and which has endorsed the proposed corporate tax hike in Biden's plan. Republicans once again are completely missing the mark on this.

There are 10 Republicans, led by West Virginia's Shelley Moore Capito, on the effort. They say their proposal could come as early as the end of this week. Capito claims that "lines of communications are open" between Republican senators and they will likely "settle on a conceptual sort of idea" for their proposal this week. She's also endorsing the plan that Thune rejected last month: bipartisan cooperation on the stuff they can agree on and leaving the rest for Democrats to do by reconciliation.

"I'm already engaged with Senator Carper on the water bill and also on the highway bill so you know these engagements are not just—they've been ongoing, in some areas," Capito said, referencing the water infrastructure bill under consideration in the Environment and Public Works Committee, with Chair Tom Carper. "So hopefully we can use our committee process to work through that and do it the old fashioned way. Give and take," Capito said. Good luck with that. A $287 billion, five-year highway bill like she’s talking about passed unanimously out of committee in 2019, but died afterward because Republicans couldn't come up with a way to pay for it. Finding consensus among Republicans on a way to pay for this could be the largest obstacle to getting even the GOP behind this effort.

They are, however, paying lip service to getting Democratic support. Mississippi Republican Sen. Roger Wicker told reporters Tuesday that he wants a bill at $600 billion or less, but acknowledged: "If we want bipartisanship, it's on us to make a good faith effort." Less than $600 billion as a "good faith" counter to Biden's $2 trillion. Right.

Democrat Chris Coons, a close ally of Biden and a constant problem with his blue dog tendencies, is playing along. "Out of the whole, more than $2 trillion worth of things proposed in the jobs and infrastructure plan, that means we would take, let's say $800 billion of it out, move that is a bipartisan bill, partly paid for with fees. And then several weeks later passed by reconciliation, a Democrat-only bill that would do the rest of that agenda," Coons told reporters. Never mind getting the fee-based stuff passed by Democrats and in the House. And never mind Republicans like Wicker low-balling the package.

And never mind that Republicans, spearheaded by Lindsey Graham, are already plotting how they won't let Democrats pass anything by reconciliation. For now, though, Coons and his magical bipartisan unicorns aren't the story.

The story is that Republicans have a glimmer of an idea that they've been losing. Sure, Mitch McConnell might bluster on the floor, declaring, "It won't build back better. It'll build back never." But the thing Republican leadership said they absolutely wouldn't do last month, they're doing now. When the whole thing crumbles because 10 Republicans can't agree among themselves, much less get any of the remaining 40 on board, Democrats like Coons and Joe Manchin and Kyrsten Sinema are going to get the clue. It's time to cut them out, and time to end the filibuster.

I did a little bit of an explainer about this year’s Senate map here. Basically, Democrats needed to keep all their seats and flip 4 seats to reach a 51 majority. However, Doug Jones from Alabama, who narrowly won his special election last year because his opponent was a pedophile, predictably lost his seat. 

Every election year, approximately 1/3 of the Senate is up for reelection (they serve 6 year terms). This year there were a total of 34 seats up, plus the special election in Georgia. Here is a list of every Senate race. North Carolina and Alaska haven’t technically been called, but the Republican has a giant advantage. The incumbent is on the left, and the winner is in bold.

As you can see, we only flipped 2 seats, and neither Georgia race was called. Georgia state law says that in order to win, the candidate has to ear over 50% of the vote, which none of them did due to third party candidates. Both Georgia races are going into runoffs which will take place on January 5. 

That means right now, the senate power stands at 48-50. If both Dems win in Georgia in January, that put us at 50-50. If the Senate ties in a vote, the VP casts the tie-breaking  vote. 

This means that the Georgia races are VERY important. Without both of those seats, the Turtleman will continue to be in charge of the Senate and can stand in the way of a lot of things - any legislation he doesn’t like, any judge or cabinet nomination, literally anything. If we do win those two seats, then Kamala Harris gets to break any ties.

As you probably noticed, a hell of a lot more Republicans are defending their seats or stepping down in 2020, including THE SENATE MAJORITY LEADER WHO KEEPS SITTING ON BILLS THAT WOULD HELP THE AMERICAN PEOPLE, MITCH MCCONNELL. If you live in any of the states above, either vote for your Democrat incumbent to avoid a Republican taking their seat, or, more importantly, VOTE YOUR REPUBLICAN INCUMBENT OUT. We NEED to flip the Senate just as much as we need to get rid of the current president, maybe even more so, and we have that opportunity this year. Don’t. Waste. It.

If passed, the Equality Act would ban discrimination on the basis of sexuality. The immediate implication: lgbtq+ people could not be denied service on the basis of who they love.
