Okay as a disabled trans man, let me tell you how this sounds a lot better than it actually is.
The ADA is an amazing bill, it took a lot of work from disability activists to pass. It is still seen as a bit too progressive for a lot of corporate America because it requires businesses to accommodate their employees and to let disabled people use their services.
It is unique to disability because of accommodations. It needs to exist separately from other rights bills because disabled people cannot simply get equal access and have actual equality obtained. This bill is one of the few that focus on equity.
I have yet to be actually protected by the ADA as a disabled person. All of my progress and accommodations are from Section 504, which has a limited reach but is more enforced by the U.S. government.
Here are some reasons why this ruling has me incredibly conflicted:
Putting the protection under the diagnosis of gender dysphoria allows employers and other authority figures to require trans people to have that diagnosis to request "accommodations." Which will likely be seen as being able to change their name at work or school without a legal name change, go by pronouns other than their agab, use the correctly gendered spaces, etc. It puts the entire transgender identity into the hands of doctors.
Meaning that if a trans person wants to get basic respect, an employer can require them to get a doctors note for it. You need healthcare, time, and luck getting a doctor that will diagnose you if you are not already diagnosed.
This should be obvious but yeah, requesting accommodation gives employers the right to have some access to your medical records. Many people do not know that it's against the law for an employer to request medical records unrelated to disability, and employers will try to do that with trans people.
It has been stated by researchers that gender dysphoria should not be diagnosed unless specifically requested by the patient for health insurance coverage because of the stigma it causes and because how little health providers are informed on it.
This legal ruling for the United States puts all trans people under a medicalized view. It puts our rights not in our hands but in the hands of medical authority. A lot of trans people do not have a good fucking time at the doctors office despite the overwhelming support that transition should be seen as medically necessary.
It clarifies that gender dysphoria is seen as a mental disorder like other disabilities. If American society ran on the social model of disability, where disability is seen as a natural variation, this would be fine. Sadly, it runs on the medical model, where disability is seen as something to get fixed. This ruling implies that gender dysphoria is unnatural instead of a normal reaction to having a gender identity that does not match your birth-assigned one. This goes against the view that even medical practitioners take with gender dysphoria.
The ADA needs to be enforced by the individual in courts. If you are discriminated against, you need the time and money to go to court for years on something that is usually hard to prove. I got fired from a job for requesting accommodations but never did anything about it because even if I did have a case, not many lawyers would bother taking a reward from a minimum-wage job.
Small businesses (businesses with under 15 employees) do not need to abide by the ADA. At all. Under this, a small business denying trans people services is still completely legal.
"Analysis of cases decided under Title I of the Americans with Disabilities Act (ADA), which addresses employment discrimination, reveals that defendants have consistently prevailed in well over 90% of cases since the ADA’s inception."
Luckily the amended ADA in 2008 allows for the protection of those who are perceived as disabled, so even without diagnosis, there can still be a case when it comes to discrimination from strangers.
Still, even though it's disability pride month, it is not good to be lumped in with us regarding rights because often it's "hey that's illegal" and nothing comes of it. Public attitudes influence how laws are enforced, and public attitudes on disability are abysmal.
I am not trying to play the oppression Olympics, I am trying to give a good overview. This can be an improvement for some trans people, and it especially helps with the constant healthcare bans we are seeing. I am incredibly worried about this, though, and I need to share why that is.

The executive order, which immediately went into effect, commands state agencies not to assist other states' attempts to seek civil, criminal or professional sanctions against anyone seeking, providing or obtaining legal abortion services in Minnesota.
Additionally, the governor said he would decline to honor requests to extradite people accused of committing acts related to abortion that are not criminal in Minnesota.
Immediately after the high court's historic ruling, Minnesota became something of an island of abortion rights in the Upper Midwest. Every state that borders Minnesota either had laws to trigger an abortion ban (directly or indirectly) or plans to outlaw or greatly reduce access to the procedure.
Thought that this would be useful for people to know!

This should go without saying, but if you're someone who has to travel to an abortion safe state for whatever reason DO NOT TALK ABOUT IT. Don't let a single fucking person on social media know. Protect yourself and cover your tracks.

We all know that this Roe.vs.Wade ruling is about controlling women, White women specifically, because they maintain the legacy of white supremacy through their wombs. Yesterday, Abortion clinics in West Virginia were immediately closed down after the ruling even though there’re were White women scheduled months out to have procedures that day. They already know that some women will travel outside of the state to seek terminations but most poor White women will not have the means & will just end up giving birth.
This is why the U.S. granted an exemption to Ukrainian asylum-seekers into the country while simultaneously keeping BIPOC asylum-seekers back-logged & waiting outside of Mexico. U.S. conservatives want the offspring of Ukrainians to assimilate into “American whiteness”. They want White babies to continue this reign of White power they have in the United States. That’s what Amy Coney Barrett means by “Domestic Supply of infants”.
This is also why illegal hysterectomies were performed on Central American/Latin women at Immigration detainment centers & the Black maternal mortality rates is not addressed within the government & the medical field.
Louisiana Senator Bill Cassidy: Our Maternal Death Rates Are Only Bad If You Count Black Women. “Cassidy said that while Black people make up a third of the state’s population and experience higher rates of pregnancy-related deaths, “if you correct our population for race, we’re not as much of an outlier as it’d otherwise appear.”
A lot of Black/POC are taking this news to heart (as they should because this decision means 33% rise in pregnancy related deaths for Black women) However, BIPOC were never a factor in any of this. This time it’s not about destroying us ⚫️ this is about preserving them ⚪️. But as usual we are the collateral damage.
This ruling was in the works for a long time WITH the cooperation of the Democrats & White women in power …..because White preservation is ALWAYS this Country’s priority.
Since we were not a factor in this heinous decision. The colonizer shouldn’t be a factor and how we choose to create life. Prior to colonization the concept of we now call “doulas” included the role terminating unwanted pregnancies. My mother grew up on a farm in the Caribbean & when a fetus was threatening the life of the mother, A skilled member of the community would be summoned to end that pregnancy.
I am in 100% support of mutual aid providing contraception as the first line of defense. But, also an underground network of Black & POC reproductive service providers because (it’s apparent) that the system that currently provides our services can care less whether we (Black women & femmes) all suffer and die.

one thing i do have to say in light of the SCOTUS decision: do not blame or exclude or accuse people in the south. there are plenty of people in the southern US who aren’t advocating for the abortion ban that has now been thrust upon them by members of the radical religious right. there are plenty of people who can become pregnant who would choose to terminate the pregnancy for any number of reasons. there are plenty of unwanted pregnancies that now will be forced to carry to term because the south is, if i’m not mistaken, the poorest region of the US, and people here can’t necessarily afford to take the time off work or the trip to a state where abortion is now protected. dismissing the south as a place to blame implies that all of those pregnant people here somehow are less deserving of rights and bodily autonomy than those in states where the majority of the population votes blue.
i know people who have had abortions. i know people who would choose to have abortions. all of us just lost that right.
tl;dr: if the south is your scapegoat for politics, you need to seriously reevaluate and i WILL unfollow the people who come in the comments and tell me that i somehow deserve less rights because of where i live.

Listen - I will rarely get political here. But this is not just a political matter.
I've never liked the concept of abortion. Never. Even as I grew, I have not once been comfortable with the idea of ending the life of an unborn fetus. Call me backwards, call me conservative, but that's how I feel.
BUT - and this is a big but.
My beliefs do not prevent me from being an open minded adult who recognizes that not everyone thinks like I do.
Just because I wouldn't want to get an abortion doesn't mean I should expect the same from everyone else. You learn pretty quick in the world that not everybody agrees with you and acts exactly like you. This is a world full of different minds, different bodies, different individuals, and different choices.
The U.S. has failed to recognize this fact in its overturning of Roe vs Wade.
And the sad part is that no one can completely ban anything; they can only ban something legally. This court decision will see unsafe abortion practices, limited freedom, and an unconstitutional merging of church and state. We kept them separate for a reason, people. And most importantly, this is trying to undo years of fighting that people have undergone to give us the power to choose. This is not right.
If you're like me and hesitant to speak out on this matter, I understand that making yourself heard is scary. But I implore you to think of others.
Think about victims of rape who are coerced into carrying a child not conceived from love.
Think of those who can't give their child the necessities to survive and thrive.
Think of those who are victims of incest and pregnant as a result.
Think about those who are suffering from the thought that they are a terrible person for making a decision that they have the right to make and that no government should interfere in.
Don't just think about yourself. Think about all of us, too.

Nothing to see here - just trying to be a capable, working adult while both pukey and paralyzed in fear over the horrifying (potential, yet LIKELY) verdict on a woman's right to bodily autonomy while a handful of invalid SC justices dance on the ashes of Roe v Wade.
