Former President Donald Trump and two of his aides were hit with new charges in the Mar-a-Lago documents case on Thursday.
A grand jury in South Florida returned a superseding indictment adding four charges to the prior indictment against Trump and aide Walt Nauta. Another aide, Carlos De Oliveira, the Mar-a-Lago head of maintenance, was also added to the obstruction conspiracy charged in the original indictment.
The indictment alleges that De Oliveira told another employee that "the boss" wanted the server with Mar-a-Lago surveillance footage deleted and asked how long the footage was stored.
"What are we going to do?" he allegedly said.
The alleged exchange came after Trump's team received a subpoena for the security footage, according to the indictment.
The new indictment charges Trump with two new obstruction counts and with allegedly possessing the classified document he was heard discussing in an audio recording of a meeting at his Bedminster, N.J. golf club. Trump in the audio bragged that he had a classified Iran war plan that he could not show others because he hadn't declassified it. He has since denied that he was in possession of the document.
But the new indictment alleges that he did have it and that it was marked "TOP SECRET" and involved a "Presentation concerning military activity in a foreign country."
Trump and Nauta pleaded not guilty to the earlier charges against them.
National security attorney Mark Zaid said the indictment "reads like organized crime activity," citing the "compelling" text messages and video footage cited in the document.
Former Manhattan prosecutor Karen Friedman Agnifilo told CNN that the indictment "reads like a spy novel."
"That's what you would do. You would try to… wipe out the video footage," she said. "I mean, it's just astonishing that this is what Trump wanted to do! He wanted to destroy evidence of a crime! I mean, that's really what this is."
CNN legal analyst Elliot Williams said that the timeline laid out by the indictment is "devastating."
"They start communicating about what the boss' wishes are and immediately took steps to delete this footage," he said Friday. "All of that is pretty lock, stock and barrel evidence of obstruction of justice."

Fellow CNN legal analyst and former federal prosecutor Elie Honig argued that the charge related to the Iran document was the "single most important" part of the indictment.
"Those papers he was shuffling, yes, they were classified documents, they're related to war plans, and DOJ has that document. That is now a new charge in this indictment," he said.
"And that makes that incident so much worse than just Donald Trump exaggerating or bragging or bluffing, as he has suggested," Honig added. "This means he actually had that classified document in his possession. He was showing it to others, he was bragging about it, he was disseminating it, to use the legalistic word."

But some legal experts also warned that the new charges could delay the trial in the case.
Defense attorney Ken White told Insider that adding De Oliveira was a "big change" that could "delay things a couple of months."
"I think it's an appropriate move," adding that considerations about the election timeline is "not a legitimate line of inquiry for a prosecutor."
"One thing is clear from today's superseding indictment — Jack Smith is more concerned about making the best possible case he can against Donald Trump than he is about rushing to the finish line," tweeted former federal prosecutor Renato Mariotti. "Adding another defendant can slow things down, but it also strengthens his hand."

Some allies of former President Donald Trump are urging him to publicly release surveillance footage of FBI agents executing a search warrant on his Mar-a-Lago residence, a proposal that has drawn mixed reaction inside his orbit, CNN has learned.
The CCTV footage has been so closely held that aides to the former President aren't sure if he has seen it in full himself, said a person close to Trump.
"I don't think it's been shared by anyone outside of the attorneys," this person said.
Yet when asked earlier this week by Fox's Sean Hannity whether the footage would be released, Trump's son Eric said, "Absolutely Sean, at the right time. "
Some of Trump's aides and allies have encouraged the former President to make some of the footage available to the public, believing it could send a jolt of energy through the Republican Party's base. One person familiar with the conversations said there have been discussions about featuring the August footage in campaign-style ads, believing the footage could bolster Trump's claims of political persecution.
Another person close to Trump said it's not a matter of if the former President and his team release any of the footage, but when, noting it could be released before he makes a campaign announcement.
Others in Trump's orbit have warned of the potential risks to the former President if he does release the tapes. A second person close to Trump cautioned that releasing the footage could backfire by providing people with a visual understanding of the sheer volume of materials that federal agents seized from his oceanfront residence, including classified materials.
"It's one thing to read a bunch of numbers on an inventory list, it's another to see law enforcement agents actually carrying a dozen-plus boxes out of President Trump's home knowing they probably contain sensitive documents. I don't see how that helps him," said this person, who spoke to CNN on condition of anonymity in order the speak candidly.
Trump could also spend the next several months simply raising the specter of releasing the footage to be used as a political weapon without ever actually doing so.
CNN has reached out to FBI and Justice Department for comment.
Federal prosecutors disclosed in recent days that the investigation "implicates highly classified materials" and that their work continues on, potentially toward criminal charges.
While it is unclear exactly what the surveillance footage could show, Trump and his attorneys say they taped the August 8 search by federal investigators even after agents asked them to turn off the security cameras. Jay Bratt, the chief of the counterintelligence and export control section at the Justice Department who visited Mar-a-Lago in June, was the official who made the specific ask the day of the search, a source familiar tells CNN.
The Justice Department had previously subpoenaed surveillance footage from the club as part of its ongoing investigation, including outside the room where documents were kept.
On Tuesday, Trump wrote on his Truth Social platform that FBI agents "demanded that all security cameras be turned off... We said no!" It's not uncommon for the FBI to try to make sure any cameras are not capturing a search of this nature when there are classified materials involved.
As the former President and his team weigh whether and when to release any of the surveillance footage, his impending 2024 presidential campaign announcement could be a factor in that timing, said one person familiar with the matter, who requested anonymity to discuss closely held matters. The former President is widely expected to make another run for office, though he is still deciding when to formally launch his campaign.
It is unclear if he has consulted with his current legal team on the potential implications of releasing the surveillance footage. The former President has reportedly been searching to hire experienced attorneys to help him navigate the federal investigation into his keeping of presidential records at Mar-a-Lago.
"If someone can persuade him this is somehow good for him and bad for his enemies, he'll do it," said Ty Cobb, a former White House attorney under Trump. "He doesn't have the lawyers to help him sort through these things strategically and is really thinking through them on his own."
Trump attorney Christina Bobb declined to comment on the record.
Among the Trump allies clamoring for him to release the surveillance footage either in full or curated versions is former White House chief strategist Steve Bannon, who told CNN in an interview that he favors releasing the footage, saying "Red-Pill the Nation" in an apparent reference to the film, "The Matrix."
A second Trump ally who spoke to CNN on condition of anonymity has also encouraged the former President's team to make the footage public, telling CNN it would "drive the base fucking bananas" to see FBI agents "milling around Mar-a-Lago while President Trump was out of town." (The former President was at Trump Tower in New York City when the search occurred last week.)
Trump and his allies have repeatedly claimed on social media that Republicans are benefiting from a surge of enthusiasm among base voters who believe the Justice Department abused its authority by executing a search warrant at the former President's residence.
But releasing the tapes could neuter some of the most conspiratorial excuses for the search that MAGA personalities have been circulating in recent days, including the baseless notion that the FBI planted evidence at Mar-a-Lago -- a claim the former President himself has repeated and which there is no evidence to support, especially after Trump's own lawyer signed off on the FBI's seizure receipts at the end of the search.
Prior to revealing he kept his surveillance cameras on at Mar-a-Lago, Trump also claimed that "nobody" was allowed to watch the FBI conduct its search of his home.
"I think the folks in New York -- President Trump and his family -- they probably had a better view than I did. Because they had the CCTV, they were able to watch," Bobb told the right-wing network Real America's Voice last Thursday. Days later, Bobb told right-wing commentator Tomi Lahren she had misunderstood the situation and wasn't aware of who saw the surveillance footage -- live or taped.
Trump's former lawyer Cobb said he is skeptical that Trump will eventually release the footage.
"If anything problematic happened, like it showed somebody planting evidence or something like that, then it would be really explosive," said Cobb. "That's the main reason I doubt they will make it public, because I'm sure it doesn't show them planting evidence and it takes that crazy claim off the table."
USING IT AS LEVERAGE
As Trump mulls a third presidential campaign, the more politically potent move for him could be to keep teasing the existence of security footage without ever making it public. It would be a familiar strategy for Trump, who routinely promised to provide exonerating evidence when faced with sexual harassment allegations during his 2016 presidential campaign but rarely followed through.
"It loses its power as leverage once it gets out," said Cobb.
Trump already pushed to release the warrant that led FBI agents to search his Palm Beach estate last week and the list of items they seized while on the property -- both of which were unsealed last Friday at the behest of the DOJ. The former President has also urged Magistrate Judge Bruce Reinhart to release the underlying affidavit that was central to federal agents obtaining a search warrant for Mar-a-Lago.
Writing on Truth Social Monday, Trump said, "In the interest of TRANSPARENCY, I call for the immediate release of the completely Unredacted Affidavit pertaining to this horrible and shocking BREAK-IN."
The Justice Department responded this week to oppose media outlets' request to unseal the affidavit, arguing that doing so could compromise its ongoing investigation and discourage future witnesses from cooperating.

late March, 1979.
Someone gets off work at Hawkins Lab and stops off at the store on their way home to buy a pack of cigarettes.
"My son drew that," the cashier volunteers, pointing to a crayon drawing taped up by the register.
They smile politely and barely glance at the drawing, but when they do, they double take.
"Your son?" they hold out their hand for the change without looking. "Quite an imagination."
"He's only eight," she beams proudly.
Lighting up a cigarette, they rush the rest of the way home to make an urgent phonecall.
"Does someone wanna tell me how some elementary school kid from town drew a picture of something Top Fucking Secret?"
By April, HNL is surveilling young William Byers, son of the Melvald's cashier. They wiretap, they film, they learn routines, they pose as school officials to monitor his academic and creative output. He may be exactly the sort of talent they scout for across the world, quite literally in their own backyard.
Acquiring a new subject is always tricky, so they can't be hasty. They need evidence that this wasn't merely a coincidence, a fluke. They watch to see if the boy exhibits any other strange behavior.
They're still waiting in September of that year, when the HNL program... hits a snag. Its focus narrows to its lone survivor and most promising subject. Funding can't be secured for any new subjects at this time, however the Byers boy still poses a potential security risk, and continues to be monitored.
He is last observed the morning of November 6, 1983, travelling on Maple Street by bicycle, on the day when finally he does do something else strange. He vanishes.
A kid going missing isn't the strangest thing that happens on November 6 - curiously, there is another major incident at the Lab the same day.
When it becomes apparent that the two events are in fact connected, damage control is necessary. If local law enforcement is allowed to continue to search for the boy, the investigation could lead back to the Lab, attracting an undesirable level of public attention.
A fake body is created with very convincing attention to detail using surveillance obtained the morning of the boy's disappearance.
With the search over, the Lab should now be at its leisure to investigate Will Byers' whereabouts on its own terms. If the boy merely dies, irretrievable, at least the security threat is neutralized; if he can be privately recovered for study, all the better.
Unfortunately not visible in those surveillance photos of a long-sleeved Will Byers on a November morning: the birthmark on his right arm.

ok I'm not entirely seriously proposing that this happened, but hear me out anyway about a few things
That fake body.
to know what Will was wearing on the day he went missing, they had to have seen him wearing it. how then, unless they were already watching him? why would the Lab be watching some random child?
Some lab kids are wild-caught, like Kali.
In order to merit being taken for the program, must they not first do something to attract the Lab's interest - display some curious behavior, some sign of potential psychic ability?
Will loves medieval fantasy.
DnD and Lord of the Rings. he's always drawing things like battles and knights and dragons and wizards. his life, his friends, but through a lens of medieval type fantasy. so when Joyce tells the story of little Will drawing a spaceship, it bothers me. a spaceship, even a whimsical one, is such a conspicuous break from Will's usual genre.
Kids draw from a variety of inspirations.
Sometimes they draw from their imagination or their feelings.

What if little Will saw the rainbow spaceship in his mind, but not in his imagination.
So, what am I saying, Will had a vision of a spaceship? The upside down is another planet and the demogorgon is an alien? No.

But really, no, Stranger Things isn't that genre.
So whose spaceship is it? Is Hawkins Lab building a spaceship? No. The lab's interest is in the human mind, not the space race.
I don't think there is a spaceship. But there could be something within Hawkins Lab (or somewhere similarly top secret) that a kid with a vague vision and a box of crayons might interpret as looking like a spaceship.
Just, I don't know, some kind of big metal Thing.

I'm not saying it would have been NINA or equivalent, but I'm saying there could be a Thing that could look like a spaceship out of context. In perhaps a vision, an accidental remote-view, a now-memory.
why would a Thing at Hawkins Lab have a rainbow on it? idk, it's not like they have a history of that.

Plot twists require hints.
Big reveals are no fun if there wasn't a clue in plain view the whole time. We have few flashbacks and anecdotes about Will's past, and if we're due some revelation in s5 about him either having powers or having more of a history with HNL or Henry than we thought, that is where a clue would be.
Joyce's rainbow ship story is littered with details that bother me.
Do you know what March 22nd is? It's your birthday. Your birthday. When you turned eight, I gave you that huge box of crayons. Do you remember that? It was 120 colors. And all your friends, they got you Star Wars toys, but all you wanted to do was draw with all your new colors. And you drew this big spaceship, but it wasn't from a movie. It was your spaceship. A rainbow ship is what you called it. And you must have used every color in the box. I took that with me to Melvald's and I put it up and I told everyone who came in, "My son drew this." And you were so embarrassed. But I was so proud. I was so, so proud.
Will being 8 may matter because he turned 8 in 1979. idk, of all ages to attach to this story why the one in the landmark year of 1979? his eighth would be his last birthday before the lab massacre (Sept 8, 1979). this scenario might not work with Will any older - perhaps whatever the "spaceship" was was eliminated post-massacre. or there's something to Will being the same age as El. I'll get back to you on this one
drawing with crayons on ST is so often associated with something not simply seen or imagined, but perceived in some strange way:
Will drawing his vision of the Mind Flayer in black/red crayon
Will scribbling the nowmemory tunnels feverishly with whole crayons
these aren't the only times he uses crayon, but contrast some of his noteworthy "normal imagination" drawings - Will the Wise, Zombie Boy - done in pencil instead, as are a lot of his other misc filler drawings. (when Will's fireball/cabbage drawing where crayons are prominently mentioned turns out to be a vision of season 5 I'll get back to you)

Henry's drawing of the spider is in pencil, and the Mind Flayer in charcoal, but when he's drawing with crayons I don't know what he's drawing but the lights flicker
when Max draws her vision of the Creel house, she calls attention in the dialogue to Holly letting her borrow her crayons
Will lacking interest in his new Star Wars toys makes sure we know, in case we don't remember all the Will art we've seen, that he isn't especially interested in space.

Joyce even says it with this little eyeroll like "these punk ass kids think MY son is a space nerd? please. I know the Castle Byers password and it's a LOTR reference"
which is what makes this so conspicuous - why in the same breath as establishing Will isn't very interested in space stuff does she say Will drew a spaceship and emphasize that it isn't something he saw in a movie. that it came from his imagination. like.. yeah, isn't everything he draws? why was a spaceship on Will's mind if he isn't interested in space? am I wrong that we've never seen one single other drawing of space stuff among all his artwork?
finally, Joyce not only put this drawing up in public but told all her customers about it. this is the only anecdote of Will's pre-vanishing history I can think of that could suggest any adult outsiders (so potentially the Lab) taking notice of something he did.
