हाल ही में प्रधानमंत्री ने राष्ट्रीय श्रम सम्मेलन को संबोधित करते हुए देश में शीघ्र ही 4 श्रम संहिताओं को लागू किये जाने की आवश्यकता को रेखांकित किया।

भारत में श्रम कानून का विकास

भारत में आधुनिक श्रम कानूनों की शुरुआत को ब्रिटिश शासन के दौरान वर्ष 1881 में लागू 'फैक्ट्री अधिनियम' से जोड़कर देखा जा सकता है। हालाँकि इसका उद्देश्य ब्रिटिश नियोक्ताओं के हितों की रक्षा करना था। इसके बाद वर्ष 1929 में लागू व्यापार विवाद अधिनियम के तहत हड़ताल से जुड़े अधिकारों को सीमित कर दिया गया।

स्वतंत्रता के पश्चात् भारत में श्रम कानूनों में व्यापक बदलाव के प्रयास किये गए जो स्वतंत्रता सेनानियों की विचारधारा, संविधान सभा की बहसों तथा अंतर्राष्ट्रीय संधियों एवं मानवाधिकारों आदि के समन्वय से प्रेरित थे।

वर्ष 1990 के दशक में हुए आर्थिक सुधारों का प्रभाव श्रम कानूनों पर भी देखने को मिला तथा इसके बाद के सुधारों में श्रम क्षेत्र में सरकारी हस्तक्षेप को और कम कर किया गया।

संवैधानिक प्रावधान

भारतीय संविधान के अध्याय-III (अनुच्छेद 16, 19, 23 और 24) के तहत मौलिक अधिकारों और अध्याय IV (अनुच्छेद 39, 41, 42, 43, 43A और 54) के राज्य के नीति निदेशक सिद्धांतों के माध्यम से मानव श्रम की गरिमा के महत्त्व और श्रमिकों के हितों की रक्षा की आवश्यकता से जुड़े प्रावधानों को शामिल किया गया है।

UPSC Prelims 2021 morning paper analysis: Civil services paper as tough as previous years

The Union Public Service Commission, UPSC is conducting the UPSC Civil Services Prelims 2021 examination today in two shifts across 77 cities in the country and in two shifts. As per an expert, the UPSC prelims paper was as tough as previous years but the cut-offs could go higher than usual.

"Almost one-third of the questions were tough. While economy, modern history and polity questions were doable if you have studied the standard sources, the majority of environment, science, and ancient and medieval history questions were tough as they were not from the standard sources and required both conceptual clarity and the application of intelligent guessing," explains Sajal Singh, Founder of CivilsDaily.

Nine questions were asked on medieval India which continues to be a focus area, says Singh.

“Environment questions have a bent towards traditional knowledge. Basic understanding of phylums, symbiotic relationship etc has more focus. And the trend has been same like more focus on the big bodies like UNEP, UNFCCC etc. So, a basic knowledge will be helpful,” he says.

He adds that science and technology questions seem to be inspired from the current affairs.

“However, these questions checked the fundamental understanding of candidates in questions such as types of viruses, bacteria, recombinant vector vaccines, etc.” Sajal Singh says.

“Aspirants are expected to be aware of not only current happenings, but also their background to be able to solve such questions,” he adds
