The Supreme Court on Monday declined to hear the case of a former Kentucky high school student and supporter of Donald Trump who said he'd been the victim of "cancel culture" after a video of his interaction with an elderly Native American man went viral in 2019.
That decision leaves in place a lower court's dismissal of a massive libel lawsuit filed by Nicholas Sandmann against Gannett, the parent company of USA TODAY, and other media organizations for their coverage of the incident.
Sandmann argued he was defamed by their reports on his confrontation with Native American rights activist Nathan Phillips at the Lincoln Memorial in January 2019.
INDIGENOUS PEOPLE'S MARCH AND MARCH FOR LIFE, STANDING NOSE-TO-NOSE
A video of Sandmann, then 16 and a student at Covington Catholic in Northern Kentucky, standing nose to nose with Phillips went viral and unleashed a firestorm of internet criticism that the student’s conduct was racially motivated, which Sandmann denied. Phillips was attending an “Indigenous People’s March” while Sandmann was walking in a “March for Life” event.
Sandmann filed lawsuits against eight media organizations, including the New York Times, ABC News, CBS News and Rolling Stone magazine, seeking a combined $1.25 billion for their coverage of the event.
A federal judge in Kentucky dismissed the suit in 2022, ruling that Phillips’ statement that Sandmann “blocked him and wouldn’t allow him to retreat” – as reported by the media – was Phillips' opinion for which they could not be sued.
The Cincinnati-based 6th U.S. Circuit Court of Appeals upheld the judge's dismissal.
In Sandmann's unsuccessful petition to the Supreme Court, his lawyer said the case has "come to epitomize the high-water mark of the `cancel culture.'"
Sandmann, his lawyer said, was transformed “from a quiet, anonymous teenager into a national social pariah, one whose embarrassed smile in response to Phillips’ aggression became a target for anger and hatred.”
That happened because of the media’s “careless failure” to investigate Phillips’ description of the encounter, his lawyer told the court.
A TEEN WITH A 'MAKE AMERICA GREAT AGAIN' HAT BECOMES A CONSERVATIVE CAUSE CELEBRE
The suit became a cause celebre for conservatives and talk show hosts.
Then-President Trump defended Sandmann and his fellow student on Twitter, claiming that they had been "smeared" with false reports by the media.
In a speech at the 2020 Republican National Convention, Sandmann accused the media of trying to “cancel” him because he backed Trump.
In the 2019 video that went viral, Sandmann was shown wearing one of Trump’s “Make America Great Again” campaign hats while smiling at Phillips, who was beating a drum and chanting.
Some social media at the time claimed the incident was racially charged on the part of the white teenager, which Sandmann and other witnesses disputed. Sandmann sued, saying the news coverage had unfairly defamed him.
But the suit was narrowed by the judge to focus only on whether the quote attributed to Phillips was defamatory.
“The media defendants were covering a matter of great public interest, and they reported Phillips’s first-person view of what he experienced,” U.S. Senior Judge William Bertelsman wrote when dismissing the suit in 2022.
When Sandmann appealed to the Supreme Court, the media outlets waived their right to respond.
The Washington Post, NBC and CNN had previously settled with Sandmann.

How people in the USA loved nature and knew the ways of the plants in the past vs. nowadays
I have been in the stacks at the library, reading a lot of magazine and journal articles, selecting those that are from over fifty years ago.
I do this because I want to see how people thought and the tools they had to come up with their ideas, and see if I can get perspective on the thoughts and ideas of nowadays
I've been looking at the journals and magazines about nature, gardening, plants, and wildlife, focusing on those from 1950-1970 or thereabouts. These are some unstructured observations.
The discourse about spraying poisons on everything in your garden/lawn has been virtually unchanged for the past 70 years; the main thing that's changed is the specific chemicals used, which in the past were chemicals now known to be horribly dangerous and toxic. In many cases, just as today, the people who opposed the poisons were considered as whackos overreacting to something mostly safe with a few risks that could be easily minimized. In short, history is not on the pesticides' side.
Compared with 50-70 years ago, today the "wilderness" areas of the USA are doing much better nowadays, but it actually appears that the areas with lots of human habitation are doing much worse nowadays.
I am especially stricken by references to wildflowers. There has definitely been a MASSIVE disappearance of flowers in the Eastern United States. I can tell this because of what flowers the old magazines reference as common or familiar wildflowers. Many of them are flowers that seem rare to me, which I have only seen in designated preserves.
There are a lot more lepidopterans (butterflies and moths) presumed to be familiar to the reader. And birds.
Yes, land ownership in the USA originated with colonization, but it appears that the preoccupation with who owns every little piece of land on a very nitpicking level has emerged more recently? In the magazines there is a sense of natural places as an unacknowledged commons. It is assumed that a person has access to "The creek," "The woods," "The field," "The pond" for simple rambling or enjoyment without personally owning property or directly asking permission to go onto another person's property.
There is very little talk of hiking and backpacking. I don't think I saw anything in the magazines about hiking or going on hikes, which is strange because nowadays hiking is the main outdoor activity people think of. Nature lovers 50-70 years ago described many more activities that were not very physically active, simply watching the birds or tending to one's garden or going on a nice walk. I feel this HAS to do with the immediately above point.
Gardening seems like it was more common, like in general. The discussion is about gardening without poisons or unsustainable practices, instead of trying to convince people to garden at all.
Overall, the range of animals and plants culturally considered to be common or familiar "backyard" creatures has narrowed significantly, even as the overall conservation status of animals and plants has improved.
This, to me, suggests two things that each may be possible: first, that the soils and environments of our suburbs and houses have sustained such a high level of cumulative damage that the life forms they once supported are no longer able to live, or second, that our way of managing our yards and inhabited areas has become steadily more destructive. Perhaps it may be the case that the minimum "acceptable" standard of lawn management has become more fastidious.
In conclusion, I feel that our relationship with nature has become more distant, even as the number of people who abstractly support the preservation of "wilderness" has increased. In the past, these wilderness preservation initiatives were a harder sell, but somehow, more people were in more direct contact with the more mundane parts of nature like flowers and birds, and had a personal relationship with those things.
And somehow, even with all the DDT and arsenic, the everyday outdoor spaces surrounding people's homes were not as broadly hostile to life even though the people might have FELT more hostile towards life. In 1960, a person hates woodpeckers, snakes and moths and his yard is constantly plagued by them: in 2024, a person enjoys the concept of woodpeckers, snakes and moths but rarely sees them, and is more likely to think of parks and preserves as the place they live and need to be protected. Large animals are mostly doing better in 2024, but the littlest ones, the wildflowers and bugs and birds, have declined steeply. It's not because "wilderness" is less; it seems more because non-wilderness has declined in quality.

The producer, artistic director, and an educator at The Freedom Theatre in Jenin were kidnapped alongside over 100 other Palestinians today (13 Dec 23). The Freedom Theatre is a hub of cultural resistance and artistic community in the occupied West Bank.
Join me in calling on theatre institutions to demand the immediate release of these kidnapped artists. Here's the email I'm sending; feel free to copy but please adjust the phrasing to avoid spam filters: "Today in Jenin refugee camp, The Freedom Theatre's artistic director Ahmed Tobasi, producer Mustafa Sheta, and acting teacher Jamal Abu Joas were taken hostage by the Israeli army alongside over one hundred other Palestinian civilians. This follows the murder of three Freedom Theatre artists in the last few weeks: Yamen Jarrar (17), Jehad Naghniyeh (26), and Mohammed Matahen (30). The global theatre community must stand up in support of artists persecuted by the occupation regime. There is extensive documentation of torture in Israeli occupation detention centers. 🚨📚 Today is release day for my new book Gender/Fucking: The Pleasures and Politics of Living in a Gendered Body!
Asking what we can learn from sexual arousal, the book takes an incredibly raw and thought-provoking look at community, queerness, fetishization, trauma, and hope.
I decided to go with an indie press that believed in the book and its transformative potential. But it means we don’t have the marketing budget of Penguin et al. I really need your collective help with spreading the word about it. Because it could benefit so many.
Early readers told me it’s a book that unmakes you and puts you back together piece by piece. It hurts, it troubles, and it nourishes. It gives voice to truths that were hidden deep in your bones. That’s how I felt writing it, and what I hope I get to share with all readers.
I’ve joked a few times with friends that this is a book best read one orgasm per chapter. But it has more than a grain of truth to it. I do believe that we can learn from arousal, instead of seeing it as the antithesis of knowledge. Don’t disavow the truths of the body.
The book is an ode to the messiness of human experience. I wrote it as a way of healing and of connecting with others. While I foremost wrote it with other queer and trans people in mind, everyone can see themselves in this book and gain from it. We all share in humanity.
This year has been rough, between the intense harassment, death threats, and hate hitting really close to home. Knowing that this book was coming out has sustained me. Knowing that I would have this moment of community, of shared passion, has been a balm on those psychic wounds.

2022 Writing Income
It’s that time again – for fifteen years now I’ve been writing an annual blog post about my income as a writer. Money tends to be an uncomfortable, even taboo topic, but I think it’s important to help counter the myths that we’re all multimillionaires living in Glass Onion-style mansions. (Side note: If anyone wants to pay millions of dollars for my book, I’ll happily update this blog post from my private island mansion.)
Remember, every writer’s career is different, and I’m only one data point.
Prior Years: Here are the annual write-ups going back to 2007: 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014, 2015, 2017, 2018, 2019, 2020, 2021.
In 2016, instead of a personal income write-up, I did a survey of almost 400 novelists about their income.
My Background: I’m a primarily “traditionally published,” U.S.-based SF/F author with 15 books in print from major New York publishers. The first of those books came out from DAW in 2006. I have an agent, and have been with them since about 2004.
I’ve self-published a middle grade fantasy and a few short collections. I’ve also sold about 50 short stories to different magazines and anthologies.
I’ve never hit the NYT or USA Today bestseller lists.
I’m currently the sole parent of a teenager (at home) and a 22-year-old (at college). I have a day job that’s just over half-time, both for the paycheck and the benefits.
2022 in Summary: There’s no gentle way to say this. The last several years have kind of sucked. Losing my wife to cancer in 2019 completely derailed my writing. I was hoping 2022 would be a comeback year, but life had other plans…
I did write and sell two new short stories and one nonfiction piece, which was nice. I’ve got a finished middle grade book that’s been on submission for a while. I finished a standalone fantasy that’s been sitting with my publisher for a while.
Normally, my editor is pretty quick about responding, but last year wasn’t normal for DAW, either. DAW was acquired by Astra House. A lot of their time and energy went into that deal. I’m hoping for the best, but things still haven’t settled into the new “normal.”
Last year did see the release — finally — of Terminal Peace, the third book in the Janitors of the Post-Apocalypse series. I’m thrilled and relieved to see that book in print, but it came out right in the middle of the Astra House acquisition, which may have impacted things like promotion and publicity.
I also finished the first draft and started revising a new standalone middle grade fantasy with series potential.
2022 Income: The biggest check was the publication payment for Terminal Peace. All total, before taxes and various expenses, the writing brought in $13,957.16. While that’s absolutely nothing to sneer at, and I’m grateful for the success, it’s also a dropoff from the past couple of years. To be blunt, if you look at the cumulative graph, things have been slumping a bit.

Patreon has been a small but steady and helpful source of income. My thanks to everyone for that!
As usual, my U.S. novels are the biggest piece of the pie. The short fiction category is a bit higher this year, thanks to those two new stories. I didn’t self-publish anything new in 2022, but if that middle grade book doesn’t sell, I’d like to publish that one later this year.

I mentioned earlier that things have been in a bit of a slump, and I need to focus on breaking out of that. Some things I can’t currently control. Tomorrow I could wake up to an offer from DAW on the book they’ve got, and maybe an email from my agent that the middle grade title he’s been shopping around went to auction and got a six-figure advance. But I can’t make these things happen.
Priority #1 is to keep writing. If I’m not doing that, other goals are pretty much moot.
Priority #2 is to figure out some alternate options. It may be time to put more time and effort into self-publishing as a complement to my traditionally published work.
The biggest thing making me anxious is that I’m pretty much out of contract. The paperback of Terminal Peace comes out this year, but for the first time in about 15 years, I don’t have the security, the luxury, or the deadlines of a signed contract. In some ways, this is freeing: I can write whatever I want. But there’s no guarantee as to when things will see print. Submitting to the traditional publishers is a long, slow process…
From talking to other writers who’ve been doing this a while, I’ve learned that pretty much every career has its ups and downs. Personal, pandemic, and publisher issues have been a bit of a perfect storm for me these past few years, but I’m not going anywhere. After 27 years as a writer, I’m excited to see what comes next.

From May ‘23 issue of Rock Hard Magazine. I will post the whole interview (mostly focused on Phantomime) later today when I get back from work, but for now the interesting bit:
Next August, you will tour in the USA with Amon Amarth. I noticed that they will not accompany you on the last date, in Los Angeles, on September 11, 2023. There is no opening act, you ask the audience not to use their phones, etc. That sounds like a live DVD!
Yes, we are indeed planning to film this show, but it won't be the end of the Impera era cycle, even if we will not have so many dates left after this concert. There will still be a few shows in South America and Australia.
