I’ve been thinking about choice again. In relation to Hordak, of course.

It’s been debated to death, but I still think about people’s insistence that Hordak confirmed himself an evil, irredeemable person once he decided, upon arrival, to conquer Etheria rather than living peacefully. I think about the nature of this choice from our human perspective and his clone perspective. I think about how these perspectives differ not only in terms of morality, but in terms of what making a choice really means. And I think of how all of this affects my personal judgement of him.

To most of us, the moral difference between “live peacefully” and “conquer the innocents” seems very clear. It seems a natural, obvious distinction, but something that I often consider is whether this distinction seems obvious because it is an irrefutable, natural law, or because of the heavy social conditioning each and every one of us, as fairly average human beings, undergoes from the moment we are born.

I think of our conditioning, which is pro-social and generally geared towards empathy, compassion, and equality, versus Hordak’s. I don’t know what Hordak’s conditioning was like. Not really. Not with any true certainty or accuracy (though I can make some really disturbing guesses). But I can pretty much guarantee that it wasn’t anything like ours. We are social animals raised to live in cooperative societies. Hordak is a manufactured clone soldier made to fight someone else’s war.

And I think that’s an important thing to consider, y’know? I think there is a difference between an individual raised with our understanding of good and evil choosing to do what Hordak did, and an individual raised as he was doing the same. Being taught, extensively, that an action is evil and doing it anyway is different from being taught that the same action is expected and acceptable before choosing it. That, to me, is the huge difference between us and Hordak, and indeed between Hordak and characters like Shadow Weaver and Catra: characters who had some level of socialization and guidance that adheres to our idea of morality rather than whatever fuckery Horde Prime instills in his clones.

Going further along this train of thought, I often consider what Hordak internally understood to be valid options. To you and me, “live peacefully” and “conquer the innocents” are, besides being morally opposite, both workable choices. “Workable” meaning that both can result in a stable, livable situation with an acceptable quality of life. Essentially: neither one means instant death when chosen.

Is this true for Hordak?

In my opinion: no. Knowing what we know about him, knowing where he comes from and whom he answers to, it’s not.

From Hordak’s perspective, whether due to conditioning via socialization or just plain programming, failing to serve Horde Prime in a satisfactory manner isn’t just dishonorable or shameful. It’s akin to death. And I don’t just mean in the practical “if you’re useless, you’re thrown away to die” sense, though we physically see that during his backstory. I mean in the mental, emotional sense.

Hordak makes it very clear that, in his mind, being useful to and valued by Prime is imperative for feeling at peace with himself. He needs to be accepted by Prime because otherwise his life isn’t just worthless, it’s... hm. I don’t truly know how to express the severity of it. It almost has the air of a deeply religious person being rejected by their god. Especially when one notes how reverently Hordak speaks of his Brother, how he borderline worships him. Essentially, failing Prime carries the weight of intense moral, almost spiritual failure. Which makes sense when considering that Hordak is a clone manufactured with the sole purpose of serving Horde Prime.

This is why I don’t buy the whole “he had a choice” argument as truly valid. It seems logical on the surface, but I think that once one really understands Hordak’s mindset, one can see that, to him, there isn’t really a choice at all.

And I understand that this might be hard to really grasp. Many of us, during our socialization, are taught again and again that we have many choices, many options in life. That as long as we try hard and apply ourselves, we can direct the courses of our lives. We can be whatever we want to be. Make of our lives whatever we wish. Hordak likely never received this sort of education. In fact, he likely never received any encouragement in making choices and directing his own life, if Horde Prime’s outburst upon hearing of Hordak’s will and self-naming is any indicator. Hordak wasn’t born into a life of possibilities. He was born a tool, manufactured to perform a task for his master.

To Hordak, there is one way to live life, one direction that leads to an acceptable existence: servitude to his Brother. Hence why he elects to conquer Etheria. And why he makes the abysmal, life-threatening decision to return to Horde Prime rather than... well, honestly, literally anything else would have been a safer bet.

The idea of his “choosing” to conquer Etheria rather than living a civilian life is a bit of an illusion. It exists to us, but to him, a defective clone woefully trapped in whatever abusive web Prime has woven, it’s simply not there. To Hordak, the choice is between “impress Brother” or “die in disgrace” and thus not a real choice at all.

Now, it is worthwhile to note that there is one point in time where Hordak does suddenly see a real choice, a way to live life that is outside of what he previously thought possible. It is perhaps the first time he is able to see a life for himself that does not include his Brother, and it is all thanks to Entrapta.

Entrapta, with her companionship, doesn’t play that stereotypical “turn the evil man good with the power of love” role. What she does is provide a real, true choice. Entrapta opens Hordak’s eyes to the possibility of living a life, a good life, without Horde Prime’s involvement. She essentially alters Hordak’s notion of what is and isn’t a viable existence. Through her companionship, he is able to entertain the notion that it is possible to be worthy and live happily without Horde Prime’s blessing.

Well. Until he believes that she is dead. Once he believes that, the option is null and void, and so he falls back to the only understanding of life he’s ever really had, returns to his Brother, begs him for acceptance, and loses himself to mental violation and erasure.

Because again: without an outside person’s help, Hordak really only has his own conditioning to go on, and that conditioning is very specific regarding what is and isn’t a viable life. Despite how the situation appears to us, the tragic fact of the matter is that said conditioning does not really afford Hordak truly equivalent options.

And that is such a major reason why I just can’t see him as an irredeemable monster: he still hasn’t had the chance to make a real, honest choice.

Vivy: Fluorite Eye’s Song – 02 – Narrowing the Mandate

The first episode didn’t so much end as pause, but because the second episode was immediately available, that wasn’t a concern. Diva is in time to take a bullet for Aikawa, but it’s only the first of dozens of time she’ll need to safe his life throughout this harrowing, pulse-pounding action-packed episode of Vivy, which due to the corporate skyscraper setting and terrorists could be called Die Hard: With a Vivy-engeance.

That is not a bad thing, as the people behind this production know what they’re doing and execute beautifully. Also, Aikawa’s pursuers are no two-bit op, but the well-trained and equipped anti-AI group Toak, represented by the younger, less-experienced Kakitani and the hulking Batou-like Kuwana. They’re not just there to kill AIkawa, but blow the whole damn building to kingdom come.

Diva conceals her identity by placing a disguising filter in Aikawa’s AR glasses, so all he sees is a generic AI drone. Diva and Matsumoto’s mission is simple: keep him alive. But between her tactical inexperience and the fact that she has the AI equivalent of free will with all its inherent unpredictability, Matsumoto soon decides it best to inject her with combat training a la The Matrix.

Diva severs the wire connection, angry that Matsumoto has only been offering a “slow drip feed” of the future and is now trying to override her singing mandate. But Matsumoto makes it clear there’s a reason he did that: he doesn’t quite trust her yet, even if the professor and researcher with whom he shares his name did.

In the midst of their quarrel, Kuwana gets the jump in her with a “Logical Bullet”, which scrambles her circuits and renders her inoperative. He then shoots Aikawa dead and shoots Diva for good measure, accidentally getting her blue “blood” on his boot. As the Toak team prepares to set the bomb timers, it looks like Diva failed her mission big time. At the same time, it soon becomes clear when Matsumoto hacks Toak bombs that Kuwana was tricked.

Matsumoto used his night-vision goggles to show him what he wanted to see: him killing Aikawa and destroying Diva. By the time Kuwana realizes there’s no blood on his boot, they’re already headed to the very Matrix-like imposing lobby. When they’re confronted by Kakitani, who clearly hates both AI and Aikawa with the hotness of the sun, Matsumoto detonates some of the bombs, bringing rubble down on him and the other Toak operatives.

But as a giant piece of concrete is about to smash Kakitani like a pancake, Diva runs under it and catches it, causing severe damage to her arm and tearing her jacket. Far from grateful, Kakitani seems disgusted and horrified an AI saves him, and later expresses that disgust verbally to Kurawa. Matsumoto, meanwhile, is frustrated that Diva continues to act erratically.

Of course, she isn’t: she’s acting according to her personal prime directive: make people happy with her singing. In order to do that, people have to be alive, so if a person needs rescuing—even a terrorist and her enemy—she’ll do what she can, as she does here. In the midst of all this chaos, Aikawa admits he doesn’t really care about AIs, but is paying lip-service to aid his political rise.

Matsumoto tells Diva that the professor was wrong to stake everything on her, but he had little choice. 100 years in the future, the only AI body that remained in complete form without evolution or modification was Diva’s, as her status as the first autonomous AI meant she was soon turned into a museum exhibit. This is a wonderfully awesome detail to me, as it has a parallel in the reboot of Battlestar Galactica: the human race was saved by an obsolete museum ship the evil Cylons couldn’t hack.

Matsumoto wants Diva to understand that even if she was originally programmed to be a singer, in the very near future she’ll be relegated to an inert, silent artifact, and become the longest of long shots of a researcher trying to prevent humanity’s destruction. He scolds her for letting “such a thing” as her singing mission jeopardize the Singularity Project.

But Diva tells him to take it back and defiantly shrugs the concrete off of her, and pulls off her torn jacket, saying it doesn’t matter for AIs how long they operate, but how they continue to operate. She still considers her mission is to sing. To accomplish that, Aikawa must live, but so must Kakitani. Also, she has to bring the whole building down.

So begins a rush from the lobby to the open observation deck near the top, where Diva takes Aikawa’s hand, breaks into a run as the bombs detonate (after all of Toak evacuates), and helps ensure Aikawa is able to leap from the one toppling building to the next. He lands hard, but he’s otherwise fine as Diva follows him with a bad-ass balletic leap. Kakitani catches her in midair with the full moon as a backdrop, shattered glass flying everywhere. Everything about this scene just owns so hard.

After Aikawa thanks her and they part ways, she asks Matsumoto if there’s a chance he could get the AI naming laws passed anyway, but Matsumoto assures her that won’t happen. Aikawa proved a more effective legislator in death than he’ll prove to be in life.

His career will flag and he’ll be voted out before any law sees daylight. And yet, the way Aikawa repeats to himself what Diva said about “not how long you live, but how you live”, I could almost see Aikawa suddenly growing a spine, thereby undermining Matsumoto’s mission.

While Diva’s mission is accomplished for now, Matsumoto playfully takes her to task for introducing far too many unpredictable variables, and strongly recommends she avoid “all or nothing” strategies when she’s all they—and humanity—have. Her “antics” in the Die Hard operation make him shudder to think what’s ahead for them. From a vantage point that overlooks the city, Matsumoto points out the colossal Arayashiki tower looming further out on the horizon.

He says the taller the tower gets, the more AIs in society will evolve. Call it a barometer of their progress; they want the tower to remain as short as possible—even bring it down if necessary. Diva and Matsumoto shake hands, and Diva agrees that she’ll continue helping him stave off the future war—but only as long as it isn’t in violation of her mission to make people happy through song.

Matsumoto is also quick to mention that while they did bring down a huge skyscraper tonight, the collapse caused no deaths and the overall changes to the timeline were within an acceptable range. He goes on to warn Diva that while they technically have the ability to alter history however they like, Diva’s actions will fall strictly within the limits of the Singularity Project.

When Diva looks as if she’s contemplating who and what else she can save in the present while also saving the future, Matsumoto commandeers an industrial power loader straight out of Aliens and, before even Diva can react, uses it to violently smash her against a far away wall. His tone becomes far more grave as he warn her “Let’s not do this.”

He cannot allow her “personal calculations” to unduly affect history or cloud the mission to prevent the excessive evolution of AIs, and that’s it. That means, despite seeing a newspaper article from a day from now in which a plane crash results in the death of her young friend Momoka, Diva is forbidden from tending to “every single accident in history.” Momoka looks out from her window seat and spots Diva moments before the plane explodes in a fireball, and all Diva can do is watch in horror and shed a tear.

Just when you thought Matsumoto would be a constant source of comic relief, he demonstrates his merciless devotion to sticking to the plan. It will be interesting to see if Diva remains cowed or if she finds small ways to rebel against Matsumoto’s—let’s face it, inhuman inflexibility. The future must be saved, but how it’s saved matters to Diva—just as how she continues to live is more important than how long she lives.

With this one-two punch of thrilling opening salvos, the curiously-titled Vivy: Fluorite Eye’s Song has already established itself as an early contender for Best Anime of 2021. I can’t wait to see how it shakes out.

Free speech under threat as India clamps down on farmer protests | Agriculture News

When Vinod K Jose, executive editor of The Caravan, India’s leading investigative magazine, logged onto Twitter on Monday, he was shocked to find the magazine’s account had been blocked.

Jose was already dealing with a case of sedition and other charges against him, the magazine owners and a freelance journalist. At the heart of the allegations is the magazine’s coverage of the ongoing farmers’ protests that have gripped India for more than two months.

As the farmers camp out on the edges of the capital, protesting against new agricultural laws they say will devastate their earnings, mainstream and social media have come under unprecedented attacks from Prime Minister Narendra Modi’s Bharatiya Janata Party (BJP).

Critics say the government has used the mass demonstrations to escalate a crackdown on free speech, arresting journalists and freezing Twitter accounts.

“It’s a very chilling development for the press,” said Apar Gupta, executive director of the Internet Freedom Foundation, a digital rights advocacy group.

The government first came after Muslims because they are an easily visible minority. But now it is coming after anyone who has an informed, intelligent expression.

Jose shared a screenshot of the blocked account from his personal handle. Soon, outrage ensued. Activists, journalists and media watchdogs rushed to condemn Twitter, which said it had acted upon a “valid legal request” issued by an Indian authority.

Hundreds of Indian Twitter accounts, including those of news websites, activists and a farmers’ union, were suspended on Monday. Some, including The Caravan’s, have since been restored.

Offline, at least nine journalists have been charged in the last few weeks for covering the protests.

The trigger for the clampdown was the death of a protester, Navneet Singh, when the largely peaceful rallies turned violent on January 26 after a group of farmers veered from an agreed protest route and stormed New Delhi’s historic Red Fort.

Hundreds of police and farmers were injured in clashes. Farmer leaders condemned the violence but refused to call off the protest.

Authorities say no shots were fired and that Singh died because his tractor overturned. His family alleged he was fatally shot. Their account has been published by several outlets, including The Caravan.

Ministers in Modi’s government accused the journalists and a prominent opposition parliamentarian of inciting hatred and endangering the nation’s integrity through inaccurate reporting and tweets. It led to the filing of colonial-era sedition charges, which carry a maximum five-year prison term.

The law, like its equivalent in other former British colonies, is viewed as draconian and was revoked in the United Kingdom in 2010.

Prosecutions on sedition charges are rare but their use to silence journalists, critics and dissenters in India are not new and previous governments had also resorted to it.

But official data shows Modi’s government has used the law more than any other – up by nearly 30 percent. It has also repeatedly rejected demands to repeal it.

Calls and messages seeking comment from four BJP spokespeople went unanswered, said The Associated Press news agency, adding that calls to the party’s media office were also unsuccessful.

Media watchdogs and rights groups, including Human Rights Watch, condemned the government’s actions as censorship. The Editors Guild of India said the cases against journalists were “an attempt to intimidate, harass, browbeat, and stifle the media”.

Daniel Bastard, the head of Reporters Without Borders’s Asia-Pacific desk, said the government was trying to impose its own narrative.

Critics say India under Modi is growing intolerant. Its ranking on the World Press Freedom Index has fallen every year, and it ranked 142nd out of 180 in 2020.

Reporters Without Borders noted “police violence against journalists” and increased “pressure on the media to toe the Hindu nationalist government’s line” as key reasons for the demotion.

But similarly, Twitter’s reaction to the suspension of accounts has also “set a terrible precedent” for free speech and press, said Jose.

“We like Twitter to stand neutral as opposed to being vulnerable to the pressures of power,” he said.

India’s Ministry of Electronics and Information Technology in its notice to Twitter on Monday said it directed the company to take down accounts that had used incendiary hashtags during the January 26 violence.

But Jose said The Caravan never used such hashtags and Twitter did not notify the magazine before suspending its account.

The ministry did not respond to calls and emails but issued another statement on Wednesday, accusing Twitter of “unilaterally” restoring the accounts “despite orders to withhold them”.

It said the platform had to adhere to the authorities’ directions and may face criminal charges “for not complying with government orders”.

Twitter declined to comment.

Gupta from Internet Freedom Foundation said the information technology law the government invoked to freeze the Twitter accounts gives it the power to direct online intermediaries and internet service providers to block certain content without providing any explanation.

“In the past, governments have blocked individual journalistic accounts, but the blocking of an account of an entire publication is a level of escalation,” said Gupta.

The government’s response to the farmer protests has gone beyond India’s borders.

On Wednesday, India’s foreign ministry condemned “vested interest groups trying to enforce their agenda” after pop star Rihanna and teenage climate activist Greta Thunberg tweeted in support of the protests.

Muslim comedian Munawar Faruqui was jailed for more than a month on unproven charges

Entertainers in India have not been spared either.

On January 1, Muslim comedian Munawar Faruqui was arrested for allegedly insulting Hindu sentiments before he could even begin his performance in Indore, a city in Madhya Pradesh state that is governed by Modi’s party.

In India, intentionally hurting religious sentiments is a criminal offence. But Faruqui was arrested preemptively before his performance even began.

“Before he could even make the joke, before he could even really start the show, police came and dragged him away,” said Anshuman Shrivastava, Faruqui’s lawyer.

The show was cancelled and police have since admitted they have no evidence against the comedian. He was granted temporary bail by the Supreme Court on Friday, after three lower courts refused to do so.

The Associated Press reached out to five prominent comedians who did not want to speak on the record but said they were increasingly scared of making jokes against the government and Hindu religion.

“What we are witnessing right now is a blatant violation of free speech in India, which the government has legitimised in full public view,” said Sanjay Rajoura, a prominent Indian satirist.

“The government first came after Muslims because they are an easily visible minority. But now it is coming after anyone who has an informed, intelligent expression.”

The ire of Hindu nationalist groups aligned with Modi’s party has also caught streaming platforms off guard. Many of their shows have faced boycott calls and legal cases.

Recently, the Supreme Court issued a notice to Amazon Prime over its show Mirzapur after a petition claimed it hurt cultural sentiments.

Such incidents have not inspired much faith in the courts, said The Caravan’s Jose. He and the owners are still battling criminal charges.

“I hope the courts see that the world is watching how the largest democracy’s judiciary defends personal liberties,” Jose said.

More than 11,695,500 people in the United States have been infected with the coronavirus and at least 251,100 have died.

The number of people who have died from Coronavirus in the U.S. is equivalent to 84 times the number of U.S. citizens who died in the attacks on Sept. 11, 2001. It is 56 times the number of U.S. soldiers who died in the war against Iraq. It is 7 times the number of U.S. citizens who died from the flu last year.

On Nov. 18: 1,923 deaths (+52% 14-day change), 172,391 infections (+77% 14-day change)

The rates of infection and death remain disproportionately high in the Native American communities across the country. Just last weekend, 600 Native people died on the Navajo reservation.

Second of all, I think she’s right. Socialism and gender/queer theory are intertwined in so many ways.

And I think she’s right about this, too. Socialism and gender/queer theory all are an attack on the cis-hetero white supremacist capitalist patriarchy.

“Bring back manly men.“

Okay, this is where I think she’s wrong again.

1) "Manly men” haven’t gone anywhere...

2) Is she basically arguing that a couple of men wearing dresses means every man is no longer “manly?” This makes no sense.

3) In a society, “manly men” can coexist with “feminized” men. There is enough room for everyone. And there will always be men who want to take up the “manly” MANtle. And there will be queer/trans masc people who will want to do the same, though I’m sure Candace would hate that.

Brunetti’s lawyer, John Sommer, promised in his merits brief that references to “vulgar terms” will be not be necessary during oral arguments, or if necessary, “the discussion will be purely clinical, such as when medical terms are discussed.”

At the end of the hour, he will turn out to be right, though the lawyers and the justices will perform some mental gymnastics to avoid the use of Brunetti’s trademark and other profane or vulgar terms.

Sommer has pre-empted the warning that has typically come from the court about not using profane or vulgar language during arguments in past cases involving Paul Cohen’s “F**k the Draft” message on the jacket he wore in a courthouse, George Carlin’s “Filthy Words” routine (or the “seven words you can’t say on the public airwaves”), and the “isolated utterances” of obscene words on television.

An amicus brief on Brunetti’s side from the Cato Institute, besides offering its own thoughtful take on the importance of vulgar language in society, directs readers to a fascinating article in a 2012 issue of the William & Mary Bill of Rights Journal by Thomas Krattenmaker, who was a law clerk to Justice John Marshall Harlan. In Cohen v. California, Harlan (and mostly Krattenmaker, by his account) wrote the opinion for the court that said the anti-draft message on the jacket was protected from criminal prosecution by the First Amendment.

Krattenmaker relates the well-known fact that before oral argument in Cohen in the fall of 1970, then-Chief Justice Warren Burger sought to head off the use of the offending word by telling Cohen’s lawyer that the justices were familiar with the facts of the case. But the lawyer, Melville Nimmer, used the word in response to the first question he received. Krattenmaker further relates that Nimmer worried that court security personnel might jump up and say, “He said F*** in the Supreme Court, grab him!”

No one grabbed Nimmer that day, of course.

Today, Erik Brunetti is in the courtroom. If he is wearing one of his infamous T-shirts, it isn’t evident. He’s in the second row of the middle section of the public gallery, right behind the front row that almost always is kept empty. He will listen intently to the argument.

There’s another person who has caught our eye this morning. George Conway, the sometimes news-making husband of Kellyanne Conway, a counselor to President Donald Trump, is in the last row of the bar section. Conway, a partner with Wachtell, Lipton, Rosen & Katz, appears to have more of a connection to the second case for argument today: Emulex Corporation v. Varjabedian, a securities case. Conway is the counsel of record for an amicus brief filed by the U.S. Chamber of Commerce and the Business Roundtable in support of Emulex.

As the argument in Brunetti gets going, there is a derby of sorts among the justices and the lawyers for creative ways to avoid mentioning the trademark at issue in the case. (I’m generally using “Brunetti’s mark” as my polite substitute.)

Justice Ruth Bader Ginsburg refers to “what’s involved in this case,” and mentions the U.S. Patent and Trademark Office’s standard of refusing trademark recognition to a mark under the scandalous provision when a “substantial composite of the general public” would find it shocking or offensive.

He agrees some segments of the population would be less shocked than others. But the PTO, he says, determined that “this mark would be perceived by a substantial segment of the public as the equivalent of the profane past participle form of a well-known word of profanity and perhaps the paradigmatic word of profanity in our language.”

A little later, Stewart will refer to George Carlin’s “Filthy Words” monologue as “a paradigmatic example of profane copyrightable expression.”

“Now our society has reached a good accommodation where people who find the Carlin monologue funny or thought-provoking can buy the CDs, they can buy the DVDs,” he says, dating his technology frame of reference a bit. “When Carlin was alive, they could watch live performances. All that can be done without forcing the profanity upon anybody who finds it offensive.”

One thing the justices seem to agree on this morning is that the Trademark Office has been thoroughly inconsistent in its treatment of trademark applications involving the “seven dirty words” and their variations.

Justice Neil Gorsuch refers to the appendix at the end of Brunetti’s merits brief, which provides a four-page guide to those inconsistencies with examples that would make any sailor blush.

“There are shocking numbers of ones granted and ones refused that do look remarkably similar,” Gorsuch says.

(The appendix is part of the printed “red brief,” but is a separate document in the court’s docket for the case. Parental Guidance suggested. And by that, we mean that some parents may need to consult their 20-something children for explanations.)

“I don’t want to go through the examples. I really don’t want to do that,” he says to laughter from the courtroom.

Justice Stephen Breyer raises a serious concern about “racial slurs” and he gets a bit clinical.

“I’ve looked into [it] a little, and there are certain ones that have exactly the same physiological effect on a person, if any, as the word we’re using here, and there is a physiological effect.”

It becomes clear he is talking about the N-word, which he and Stewart want to avoid mentioning even more than Brunetti’s trademark.

Stewart will say later that even after the court’s decision in Matal v. Tam found that the Lanham Act’s disparagement provision violated the First Amendment, the PTO is holding back on approving any trademarks related to that word as potentially violative of the scandalous provision.

Sommer, whose day job is as general counsel of the Stussy line of clothing, takes to the lectern, and Breyer soon continues his clinical discussion of the effects of certain words on the brain, including forms of Brunetti’s mark and certain racial slurs.

“They have a different physiological effect on the brain,” Breyer says of these words. “They’re stored in a different place. They make a difference in the conductivity of your skin, which shows emotion, and above all, they are remembered.”

Why can’t the government say it doesn’t want to be associated with such words, by refusing them trademark recognition, Breyer asks.

Sommer argues repeatedly that the government is making viewpoint-based distinctions. When he says that his client’s mark “isn’t exactly one of the seven dirty words,” Alito objects.

“Oh, come on,” he says. “Be serious. We know … what he’s trying to say.” Would any “clever way” of avoiding a list of seven banned words be okay?

Sommer points out that there are other variations of Brunetti’s mark that have won trademark recognition, such as “FCUK,” by the French Connection UK clothing chain.

Alito agrees that the PTO has inconsistently applied the standards, but asks whether going forward there can be a list of prohibited words and “you just can’t use those. And your position is that would be unconstitutional?”

“I think so,” Sommer says. “If Congress were to pass that, we’d be here again in a few years to determine whether that’s true.”

Sommer mentions that his client’s goods are not exactly sold at Walmart. (Actually, Brunetti has said in recent interviews that they’re now sold exclusively online, with new products each month that usually sell out within days. Still, it’s our general impression that Brunetti’s line is somewhat past its prime.)

Chief Justice John Roberts tells Sommer that even if Brunetti’s shirts aren’t sold at Walmart, they’re “going to be worn on people walking down through the mall. And, you know, for parents who are trying to teach their children not to use those kinds of words, they’re going to look at that and say, well, look at that, and then, you know, they’re going to see the little trademark thing and say, well, it’s a registered trademark.”

“Well, they won’t say that,” the chief justice adds, “but you understand my point is that the government’s registration of it will facilitate its use in commerce, not necessarily speech, but as a commercial product, and that has consequences beyond … where the product is sold.”

“Well, that may be the audience he’s targeting,” Roberts says. “But that’s not the only audience he reaches.”
