The US Constitution's Fifth Amendment protection against self-incrimination does not prohibit police officers from forcing a suspect to unlock a phone with a thumbprint scan, a federal appeals court ruled yesterday. The ruling does not apply to all cases in which biometrics are used to unlock an electronic device but is a significant decision in an unsettled area of the law.
The US Court of Appeals for the 9th Circuit had to grapple with the question of "whether the compelled use of Payne's thumb to unlock his phone was testimonial," the ruling in United States v. Jeremy Travis Payne said. "To date, neither the Supreme Court nor any of our sister circuits have addressed whether the compelled use of a biometric to unlock an electronic device is testimonial."
A three-judge panel at the 9th Circuit ruled unanimously against Payne, affirming a US District Court's denial of Payne's motion to suppress evidence. Payne was a California parolee who was arrested by California Highway Patrol (CHP) after a 2021 traffic stop and charged with possession with intent to distribute fentanyl, fluorofentanyl, and cocaine.
There was a dispute in District Court over whether a CHP officer "forcibly used Payne's thumb to unlock the phone." But for the purposes of Payne's appeal, the government "accepted the defendant's version of the facts, i.e., 'that defendant's thumbprint was compelled.'"
Payne's Fifth Amendment claim "rests entirely on whether the use of his thumb implicitly related certain facts to officers such that he can avail himself of the privilege against self-incrimination," the ruling said. Judges rejected his claim, holding "that the compelled use of Payne's thumb to unlock his phone (which he had already identified for the officers) required no cognitive exertion, placing it firmly in the same category as a blood draw or fingerprint taken at booking."
"When Officer Coddington used Payne's thumb to unlock his phone—which he could have accomplished even if Payne had been unconscious—he did not intrude on the contents of Payne's mind," the court also said.

Claudia’s “mistake”
Touched on this here but the whole “Claudia should have known what she was getting into with the coven” claim falls apart when you remember that she was very much hunted and sought out by the coven, the existence of which she was unaware and for which she was not actively searching at that time. (Side track: I think had she known that there was a community of vampires living and performing theater in Paris, the tone of her diaries in the first 5 months there would have been less despondent. At this point she thinks her dream of finding a vampire community is unattainable, and she’s miserable in those first 5 months. The fact that she is so hopeless makes it clear that she does not know the thing she’s been looking for not only exists, but is nearby.)
It’s only after Armand approaches Louis in the park and SPECIFICALLY TELLS HIM TO BRING CLAUDIA that she learns about the coven. At this point, they already know a lot about her. They’ve been studying her like prey, and now they’re laying bait to lure her into their trap. They know all her vulnerabilities, her tension with Louis, and once she’s at the theater they see how to exploit her desires for community and vampire pride.
Claudia has no reason to be proud of vampirism. It’s been horrible for her. It’s just another way she has been exploited by individuals and societies which deny her personhood. The idea of being proud to be a vampire is new for her in Paris. Although she enjoyed the power vampirism seemed to give her in the early rue royale years, we never see her express pride or excitement about being a vampire. And why should she? All it’s brought her is severe trauma and perpetual disenfranchisement. But here, she’s met with the idea of being proud of vampirism, which very much attracts her to the coven. It’s an opportunity to not only survive, but feel fulfillment.
With Louis’ simultaneous emotional dependence on her and emotional neglect of her, she is desperate for companionship. She also needs an adult companion, as being trapped in a child’s body means she can never live safely and autonomously. She needs protection, but she also knows that being in a conventional family inherently threatens that protection.
The distribution of power in the nuclear family places her at immediate disadvantage, because theres’s only one way it can be exercised, and that’s by pushing down. Claudia hopes she can circumvent this by joining the coven, which is larger and appears to distribute power (or the lack of power, more accurately) more equally.
Community vs unilateral domination, individuality vs her identity being inextricable from lestat and Louis, autonomy, equality, pride. Freedom in being part of a flock rather than a possession. If Claudia can be said to have made a “mistake”, it was in hoping too badly that power is diffused differently in a community than it is in a nuclear family.
But focusing on things Claudia could have done differently is not helpful. This is because it wouldn’t have mattered if she hadn’t made any regrettable choices. She could have made every decision perfectly, using the optimal balance of logic, pragmatism, compassion, practicality, and foresight. And it wouldn’t have mattered. The power the coven holds over her is structural, due to the axes of oppression upon which she lives, it stems from the society in which she exists. The structure of the coven and the nature of vampiric power compound her marginalization.

feel like a broken record saying this but truly why does so much of this fandom react to being presented with complex characters by flattening them into the most one dimensional, black and white version of that character? yes armand underwent horrible trauma. that trauma informs who he considers himself to be and how he moves through the world. centrally, it informs his abuse and the underlying need for control, purpose and love he tries to fulfill through said abuse. i don’t think armand is evil plotting at all times - that’s not how abuse works lmao- i think he is someone who is intimately familiar with powerlessness and now has access to tools (his position as coven leader. his powers.) to make sure he is never put in that position again. his use of those tools is horrific and violent. his violence of care also directly mirrors marius’ treatment of armand. i just feel like the root and the effect of the abuse can and should be considered together, without one taking away from the other. everything else is boring
