#Repost @ssenv2022 ・・・ Link in story 💨💨✌️ After a recent exposé by NY Cannabis Insider found conflicts between the actual and advertised levels of THC in several strains of legal recreational cannabis available for sale, the state of New York has changed testing guidelines – seemingly in an attempt to ward off future litigation based on false marketing of THC levels as seen in other states. With licensed growers failing to meet testing requirements as the deadline to launch retail sales approached last fall, the Office of Cannabis Management (OCM) relaxed its guidelines and implemented line testing so growers could more quickly test and market their products. Line testing is a process that allowed flowers and pre-rolls to go to market more quickly with a label of “anticipated potency” rather than actual potency. Anticipated potency is a number based on the midpoint of the seed’s expected range of THC output, as opposed to the cannabis flower’s, and can be inaccurate. Line testing was temporarily implemented to speed up the process of certifying dispensaries so legal cannabis could be available to the public by the end of 2022. New York Expands Eligibility for Medical Marijuana Qualification
New York expands its eligibility for medical marijuana qualifying conditions. The state set up a new cannabis registration and certification system on January 24, 2022. This program will allow patients to get certified for a Online Medical Card from healthcare professionals, for any condition they deem necessary.
This means that medical marijuana patients no longer have to stick to a list of qualifying conditions. The new system shifts the complete control of marijuana from the OCM (Office of Cannabis Management)and focuses on expanding the program in accordance with the Marijuana Regulation and Taxation Act (MRTA).

The new eligibility criteria will not only allow more patients to get a prescription for medical marijuana but also permit practitioners other than MMJ doctors to take consultations. Dentists, podiatrists, and midwives should also be able to prescribe medical marijuana. These improvements may likely spark a surge in the number of registered New York MMJ patients.
The OCM Executive Director Chris Alexander commented on how the new patient certification and registration system have added significant steps to forward the OMC’s program. He said, “We will continue to implement the MRTA and ensure that all New Yorkers who can benefit from medical cannabis have the access they need to do so. It’s important for New Yorkers to know that even as we shift the medical program to the OCM, your access will not be disrupted and the program will continue to expand.”
Local doctor James Saperstone commented on the upside of the situation. He said, “I think it’s great that they have taken the control of this substance away from the government and given it to the practitioners who are trained to know how to dispense any drug and to treat anything.”
The National Organization for the Reform of Marijuana Laws (NORML) has called for this system over and over again. The organization’s State Policies Manager Jax James said, “Doctors already possess wide discretion when it comes to recommending and prescribing other medications, many of which pose far greater risks to health than does marijuana. A patient’s treatment options should not be limited by the government, but rather should be determined in confidence between a patient and their doctor. Doctors should be fully empowered to decide what treatment options are best — free from political interference.”
What Does This Mean For New and Old MMJ Patients in New York?
New patients certified through the new system will receive certification from the OCM. Those who already have a New York MMJ card from the Department of Health can continue to use it to access medical marijuana until it reaches its expiration date.
After the old MMJ cards reach their expiration, the OMC would be responsible for their reissuing. The current caregivers will receive their new registry ID cards, printed with their authorized patient’s identity.
Some recent adjustments were also made to the New York cannabis laws:
Permitting the sale of whole flower medical cannabis products.
Broadening the kinds of clinical providers eligible for certifying MMJ patients.
Increasing the limit of legal medical cannabis that may be dispensed to a patient from 30 days to 60 days.
This is great news for New York citizens as recreational sales are not expected to begin until 2023, despite being legalized in 2021.

Chris Alexander, executive director of the New York State Office of Cannabis Management (OCM), told the CCB on March 2nd that officials now plan to increase the number of adult-use cannabis retail licenses in the first licensing round to 300. However, a federal lawsuit has frozen adult-use licenses in five regions of the state, barring many licensees from opening their doors. N.Y. Governor Kathy Hochul Bill to Speed Up Marijuana Cultivation

New York Governor Kathy Hochul signed a conditional cannabis cultivation bill into law on Tuesday, which will allow some growers to begin production this spring. The license conditionally grants accelerated access for adult-use programs while also helping the state's farmers who have been waiting patiently in anticipation of legalization.
“I am proud to sign this law, which positions New York’s growers to be the first to grow cannabis and catalyze the new safe, fair and inclusive industry we are building,” Hochul said. 
“The State of New York will continue to lead in fulfilling our commitment to bring economic opportunity and growth to all New Yorkers in every corner of our great state,” Hochul added.
The governor's office says that with a conditional adult cannabis cultivation license, growers can grow outdoors or in a greenhouse for up to two years from the issuance of their card. They are also allowed to produce and distribute products without obtaining an additional processor/distributor license until June 1, 2023.
When it comes to the legal limits for outdoor and greenhouse growing operations, there are a few things to know. State officials say growers can have up to one acre of their outdoor flower canopy or 25 thousand square feet in a greenhouse and can use up to 20 artificial lights. 
The Office of Cannabis Management (OCM) will be working hard to create an application process and open up their program as soon as possible. To qualify for a conditional adult cannabis cultivation license, you need to have been approved as an industrial hemp research partner by the Department of Agriculture and Markets over two years out of the last four years, and in good standing as of December 31, 2021.
The governor announced that license holders must also participate in a social equity mentorship program where they provide training to people who are interested in cannabis cultivation and processing. Farmers will have met sustainability requirements so hemp can be grown in an environmentally conscious way.
In New York, cannabis became legal under a law known as the Marijuana Regulation and Taxes Act (MRTA). However, there is still no licensing for the adult use of marijuana. The current law in New York allows for medical use only. The scope of eligibility has recently been expanded, and this program will create a new system that certification/registration with cannabis as an appropriate condition to treat by any practitioner who deems it necessary.
