Illinois Becomes the First State to Abolish Cash Bail for Criminal Defendants
Illinois Governor J.B. Pritzker signed into law, HB 3653, the first bill in the United States eliminating cash bail for criminal defendants. The Illinois Pre-Trial Fairness Act will eradicate cash bail, requires all law enforcement agencies statewide to wear body-worn cameras, and establishes clear guidelines and definitions for the use of force by police officers. The goal of the bill is to shift focus on pre-trial bail from the ability to afford bail to public safety. The bill also focuses more resources to officer preparation, mental health services, and officer well-being and health requires the permanent preservation of police misconduct records, and eliminates license suspensions for unpaid fines due to traffic offenses.

Regarding bail, judges at bond hearings will now be making determinations on criminal defendant’s bail based on their threat to the community and the prior history related to failures to appear for court hearings instead of the accused ability to pay. Cash bails have long been argued to unfairly handicap poor and minority defendants who cannot afford to post cash bonds. A criminal defendant who could not afford a $100 bond would sit in custody until the resolution of his or her case, sometimes for weeks or months. Some of these defendants, after sitting in jail for weeks or months, would have their cases dismissed or be found not guilty but would still have served unnecessary jail sentences.
Opponents of the bill argue that the bill releases violent criminal defendants onto the streets, makes the jobs of law enforcement more difficult, and endangers public safety. The fear is that the new law will make Illinois less safe and force good police officers to retire and quit the profession. The new law will go into effect in July 2021.

Knowing what the officer is looking for when he pulls you over is the first way to prevent being arrested for DUI. If you are pulled over for committing a traffic violation such as not signaling before turning, speeding, or changing lanes unsafely, the officer’s training will kick in. He will approach the vehicle and start smelling for drugs or alcohol. His eyes will scan the inside of the vehicle for cans, plastic cups, or bottles. Even having a wristband from a bar or festival is a clue to an officer that you were possibly drinking and may be under the influence (take those off as soon as you leave the venue). It is enough for the officer to continue his investigation into a possible DUI. He will ask for your license and insurance. Along with checking if you are legally driving and insured, the officer is checking to see whether you can find your identification and insurance and how long it takes you to produce it. If the officer smells alcohol coming from the car (not necessarily from you), he will ask you to exit the vehicle. At this point, he is watching how you exit the vehicle. Did you use the door or frame for balance? Once you step out of the car, he will ask you questions related to your alcohol intake that day. “Small talk” you think, but no. The officer is watching whether you are swaying, what your pattern of speech is and what your eyes look like."

People v M.T. Charges: Bomb Threat under 720 ILCS 5/26-1
Outcome: CASE DISMISSED
Description: M.T. was at a Chicago Transit Authority (CTA) train station when he attempted to open his briefcase. He could not get the briefcase open and asked the kiosk employee for help. She recommended he slam the briefcase on the ground and the locks would possibly pop open at this point. My client followed his directions and as a result, cans of soda exploded and made a noise that alarmed the CTA employee. M.T., seeing the employee’s alarm, unfortunately told the employee, “It’s not a bomb”. In these days and times, any mention of a bomb in a public area is cause for alarm.As a result, the CTA employee called the police, shut down the train stop and arrested my client charging him with felony disorderly conduct under 720 ilcs 5/26-1.
Mr. Bhatt was able to meet with the State’s Attorney, the attorneys for the Chicago Transit Authority and the court and was able to convince the court and the lawyers that M.T. had no intention of relaying a bomb threat to anyone and that his statement to the CTA employee was in fact an attempt to relax the CTA employee’s alarm.
The felony matter was dismissed

  The Trial - Not Guilty!
M.T. just got 31 years of his life back because he was found not guilty.  In an instant, after being found not guilty of the attempted murder of a witness in his brother's murder investigation. After 5 days of testimony by the State's witnesses. After a day of contentious questions to family members. Even after the witness identified my client as the shooter in open court.  The jury was not convinced of the State's case against him and returned a verdict of not guilty. A single witness identification? Police responded to the area almost instantly, my client nowhere to be found. With a strong alibi defense. Specifically, M.T. was attending his uncle's funeral the day of the shooting.
The State presented a ballistic expert whose testimony was that the bullets fired were all fired from the same gun. The detectives took statements from M.T. and as any lawyer would say about their client, he talked too much. Still he was found not guilty because the jury was a Cook County jury. And as they saying goes, "ain't no jury like a Cook County jury." Comprised of 7 women and 5 men. Black, Mexican, Polish, Filipino, Indian and Asian. Old and young. Most importantly, a wonderfully diverse jury.
Sentencing Enhancements
But still, you never truly know your jury until you hear the verdict. M.T. was facing charges of attempted murder, aggravated battery with a firearm and witness intimidation therefore, all class X felonies that carried sentences of 6-30 years in prison. On top of that, M.T. faced a sentencing enhancement because of the discharge of the firearm and the firearm causing serious bodily harm. Because of those conditions, M.T. was facing a minimum of 31 years in prison. As a 24 year old, M.T. had his best years ahead of him. A conviction would take all of that away. He wouldn't be released until he was 55 years old.
The Verdict
The jury didn't roll over and believe the State just because they made an arrest. The jury forced the prosecutors to present the evidence thereby proving they had M.T. as the one who shot their witness. The State could not. In the end, with prosecutors who were high-fiving each other and a judge who rolled his eyes after reading the "not guilty" verdict forms, the jury found M.T. not guilty and most importantly, sent M.T. back to his family.

Defendant was arrested and charged for possession and distribution of controlled substances including cocaine and heroin after being observed by officers entering and exiting the home. Firearms were recovered from the home that was within 1000 ft of a school. A defendant with no criminal history was charged with 720 ILCS 570/402 and unlawful use of a weapon under 720 ILCS 5/24-1 and was facing a mandatory minimum prison sentence of 6 years.
Attorney Purav Bhatt, after questioning officers revealed that the State could not establish that Defendant lived at the home that was searched and none of the cocaine, heroin or firearms could be tied to Defendant.
All charges were dismissed.

If you have the unfortunate experience of being questioned by the police or being placed under arrest there is one thing above all others that you should remember. KEEP YOUR MOUTH SHUT. A judge I am in front of regularly and was a prosecutor before would routinely ask defendants, “Do you know how the fish got caught? He opened his mouth. Now be quiet.” It sounds simple enough but for most people, under such a stressful situation as being arrested, the natural instinct is to try to explain and over-explain.
If you are being questioned by the police, know you have the right to an attorney before answering any questions. “I want my attorney present before answering questions” carry the weight of almost being magic words. This is because, after your invoke your right to an attorney to the police, if the police ask you questions and you answer, those answers may not be used against you. So, if you are being questioned by the police and your options are to talk and being silent, pick being silent.
But while to have the right to remain silent, some of my clients do not have the ability to remain silent. I advise my clients to also keep their mouths shut include:
Facebook and online social media – Privacy settings do not mean a thing if one of your “friends” decides to share your information with someone else.
Do not discuss your case on the jailhouse phone. Believe it or not, your calls are being recorded.
Do not discuss your case with other inmates to pass the time.
Do not discuss your case of how you were wrongly accused with your friends.
Understand that you are being recorded in the police car so when the officer is being friendly and tells you “I wanted to let you go but the Sergeant was here” do not explain to him how you ended up in the back of a police car.
Discussions with your lawyer are privileged conversations and are protected by the law. Your conversations with your lawyer cannot be used against you. Overall remember to: Be quiet, Call an attorney and do not discuss your case with anyone else aside from your attorney.
