Self-Shipping Reference.

I have been debating on creating a self-shipping reference for these two, but since I am certain of our dynamic at this point, I wanted to delve right in; I love Will and Jakob so very much and I wanted to create a little collection of our relationship like I’ve done before in the past. Most of all, this is for me so that I can have it as a reference, so there is absolutely no obligation to interact with this post. If you do, thank you for showing us so much love and care, I really appreciate it more than anything. This community is so welcoming of self-shipping and that means a lot to me<3.

Ship name?

Our collective ship name is Grimmrose, for obvious reasons (my poly heart can hardly take it😭✨💛)

I do not feel I should need to say this (as it should already be implied), but since I do not want angry anons in my ask box about this, I will state: Will and Jakob are not romantically involved in our dynamic; the love they have for each other is familial only. They both share me, but that is as far as it goes. There is absolutely no incestuous aspects of our relationship.

Date you got together?

Jakob: May 26, 2021. The open honesty and security within our vulnerabilities were what prompted Jakob and I to jump in headfirst. We knew how we felt almost immediately; Jakob believes in love at first sight and I value that sentiment. It was a mutual understanding that the two of us were meant to be together (even if I hadn’t already known, the darling would have convinced me - he is extremely persuasive and given to a dreamer’s mindset.) The two of us easily came to an agreement on beginning a relationship because of how similar we have found ourselves to be. It was not difficult to access what each other was thinking and how we chose to approach those thoughts and feelings. Jakob is driven by those, after all, and his bright spirit and general interest in the things that cannot be so easily explained drew me to him.

Will:

Platonic: May 26, 2021.

Romantic: June 14, 2021.

Will was, to my surprise, not as difficult to access as I expected. He has a much different personality to Jakob’s; the two are near opposite ends of the spectrum. Will’s mission has been to protect Jakob, mostly from himself, but Jakob does not understand that the reason Will is so hard on him is because Will feels helpless around him. Jakob’s mind is so bright and open, while Will does not understand how to compete with that nor how to understand or fit into Jakob’s world of folklore and mythical, magical beings. He feels weak in comparison to Jakob’s spirit; Will values my ability to cross those lines and connect with both him and Jakob. Will has never known another to be so well-suited for his brother and he is respectful of how we interact, since until now he has been the only one who has been able to reach Jakob. We were platonic for several weeks out of respect for Jakob, but soon entered into a mutual agreement to share the love that we all have for each other; the brothers agreed to share me since they have both developed such strong feelings.

Favorite personality trait?

Jakob: His sense of security within vulnerabilities. Jakob is more given to childlike excitement and the thrill of action whenever it is of a magical quality. He fidgets, has a distinct nervous energy/uncomfortable body language, a clear mind but one that fancies fiction over reality. Whenever he drinks, he’s giddy and excited; the only one who can get through to him in these moments are Will and I. The thing is, Jakob has never tried to be anybody but himself. He is aware that these qualities are not valued by the vast majority and are perhaps seen as weaknesses or even are simply frowned upon (much of this he experienced as a result of the way Will treated him over the years), but even all of that has never caused his personality to shift or made him close himself off. Jakob has always found security within who he is, regardless of whether those around like it or not.

Will: His protective commitment to those who he loves. Even though Will canonically admitted his frustrations over Jakob and how he “hates” his younger bother, stating how Jakob “drives him mad”, he is fiercely protective of him and committed to maintaining their relationship in spite of any disagreements or arguments. Will does not give up on those he loves. Even though it would have made sense for him to toss Jakob into the streets and leave him if he truly hates him, but Will does not. Despite his confession, he has never actually hated his brother; Jakob makes him feel weak, helpless and inferior because Jakob’s comprehension of things beyond Will’s understanding or compulsion to understand or look beyond what is right in front of him is too different and unusual to him.

Favorite physical trait?

Jakob: His eyes. Jakob’s eyes are so expressive; they sparkle in the light and his irises twinkle. His soul appears as if it were made from stardust and every bit of him glows. His eyes reflect the innocence and playful mischief bound within him; he is a dreamer at heart and his eyes mirror that.

Will: His smile. There is a scene when Jakob and Will first arrive at Marbaden and they are confronted by the townspeople with weapons, uncertain of who these two strangers are, and when Will tries to explain who they are his smile is simply dazzling. I believe that was the moment I found myself in love with him; I have not seen a smile so bright in a long time. Here’s a screenshot of his smile (Jakob’s expression in the background is so funny😂):

Couple song

We do not have a couple song yet; we have couple albums.

Taylor Swift’s albums Folklore and Evermore are sister albums, so it only makes sense that they are representative of the two brothers respectively: Folklore for Jakob and Evermore for Will.

Both albums are suited to the three of us; the feelings provoked from both establish the tone of our relationship.

Pet peeves…

There is only one: their constant bickering/arguing and fights. It is natural for siblings to fight, but the longer I spend with these two, the more consistently they seem to fight in front of me. I do not believe the fighting affects their relationship as perhaps it did in the past; they seem very content, even after they’ve been fighting a while, and neither of them holds a grudge anymore.

Favorite outfit on them?

I will share photos since it would take some time to explain in enough detail; I am a sucker for older/medieval clothing (perhaps this is why this movie spoke to me in such a way?)

Favorite meal?

Jakob: This bit is indicative of all of us and I was the one who introduced the brothers to this meal - vegetable soup; beef/broth, noodles, peas, carrots, tomatoes, corn, green beans, potatoes. The brothers are used to eating whatever is being served them at the pubs they visit and the inns at each town they stay and, needless to say, are not often prepared a meal especially one to their specific tastes. The first time I made this for them, they ate heartily and it has been their favorite since.

Will: This is less of a specific meal and more of a eating habit of his, but Will is partial to sweet treats and desserts of all kind. His favorite treat is soft bread with a sticky, sugary glaze (wait until I tell him about glazed donuts😂)

Early bird or night owl?

Neither of the Grimms are particularly one or the other. They both have been known to stay awake all hours of the night for one reason or another; Jakob stays up writing most nights when brand new ideas flood his mind and prevent sleep. He works whenever inspiration strikes and if that is the middle of the night, then Will or I will find him hunched over his desk, pen scratching away across the page as he squints to read what he has written under the low candlelight.

Will stays awake late born out of a habit he has yet to change. He does not like to sleep very soundly until he knows that Jakob and I are either asleep or keeping each other company; Will takes responsibility of us quite seriously. Since we’ve begun a relationship, they do not go out as much as they once had and when we do, they are awake nearly the entire night and whenever they crash, they are both out cold.

If I wake up throughout the night, Jakob sleeps so soundly that he would not know (he wears earplugs if we’re staying at an inn because the noise bothers him.) Will always wakes up whenever I do; the shifting around wakes him, but he does not usually open his eyes or speak to me until I come back to bed and he settles me back into my spot.

Snorer or sleep talker?

Jakob: SLEEP TALKER! Jakob talks in his sleep nearly every night, most especially if he has had something to drink beforehand or if Will has gotten under his skin about something. Stress/anxiety also trigger it; I don’t hear him often, because he only does it in a deep sleep which is usually whenever I’ve already fallen asleep.

Will: Will does not snore or talk in his sleep; he is unusually quiet, however, he will groan or mumble softly if he’s turning over or something like that. He does not move a lot when he’s sleeping either.

Do you have any pets together?

No, our lifestyle is not suited to pets, unless horses used for transportation count.

How often do you fight? What starts fights?

I have yet to have any fights with either of the brothers (though I have had mild disagreements with Will over the way he speaks to Jakob.)

Jakob and Will fight often and about everything, but more often than not, the source of the argument is their personality difference. Their interests clash significantly and they find it difficult to coexist at times because Will feels he must fill the role of Jakob’s caretaker, while Jakob simply wants Will to be his brother and believe in him.

I usually do not get involved in their squabbles unless Will speaks out of turn. He can be somewhat hateful in the remarks he makes to his brother and I am not afraid to set the record straight. Jakob has gotten much better at standing up for himself; he is not afraid to get physical if things escalate to that point, though I have yet to see them lay a hand on each other. Jakob knows that one swift punch is all that he needs to deliver for Will to fall in line and understand that he is serious; he saves them for when he needs them and has only punched Will outright one time, that I am aware of.

Who apologizes first?

This depends on who feels they are “wrong”. Will does not like to apologize, so usually it is Jakob who initiates the apology. Occasionally, neither will apologize and it is implied that they both have and things will continue on like normal as if nothing ever happened (this is best case scenario.)

I have not known them to simply not apologize to each other for wrongdoing; Will has apologized to Jakob on a number of occasions where I have been present. If Will apologizes, it is usually for speaking too harshly to Jakob or bringing up the “magic beans” he has terrorized Jakob with for years.

Big spoon or little spoon?

Jakob: Jakob adores being the little spoon. Even though he likes to hold onto me at night, nothing seems to compare to being held. Jakob has gone the majority of his life without being shown affection and tender love; he is so touch-starved that he asks to be held almost every night.

Will: Will is the only F/O (aside from J) who I allow to be the big spoon on a regular basis. I trust him implicitly and know that he will keep me safe; he likes to hold onto me while we sleep so that he knows and can feel he isn’t alone. He does not like to sleep whenever it is too cold and he wants a warm body pressed against him.

Dom or sub?

Jakob: Submissive.

Will: Dominant.

Will has had his misgivings over Jakob and I, both being submissives, entering into a relationship together, but it has not presented an issue so far. Most of the time, Jakob and I love all over each other so it doesn’t matter one way or another😂 It is rare for Jakob and I to be sexually intimate.

Will takes on the more dominant role, since he has been so with Jakob over the years of their lives before they’d met me. Will is the nurturer and takes care of us both; he remains protective of us despite certain insecurities and fears. Will takes on more of the sexual responsibilities of their relationship with me because of his experience with women.

What are their kisses like?

Jakob: Jakob’s kisses begin as achingly shy, reverential ones that develop into slowly sensual, spontaneous or exploratory ones. Jakob likes to hold my hands when we kiss and I like the way his facial hair pleasantly scratches my face; he is always extremely gentle and never oversteps. I especially love when he kisses me with such eager impulsivity that our cheeks turn red and we laugh when it’s over.

Will: Will’s kisses can either be covetous and greedy, fervent, and deeply passionate or chaste and flirtatious. He always cups my cheeks, chin or tangles his fingers in my hair at the back of my head while kissing me; his lips often taste sweet or sugary from how often he indulges on sweets. My favorite of Will’s kisses are the languid, open-mouthed ones when he uses his tongue.

What do they smell like?

Jakob: Parchment, books and ink, candlewax, earth just after it has rained, sweet basil, a vaguely sweet musk, warm skin.

Will: Warm sugar, sweat/spicy musk, pine, flame.

What are their hugs like?

Jakob: Bear-like, full-bodied, fiercely affectionate and warm.

Will: Long, tight, unexpectedly powerful and almost needy.

Who is more protective?

Will.

Both brothers are fiercely protective of me and I know that, in spite of their differences, neither would ever let anything happen to me. As long as they are facing danger together, they would willingly take on any enemy (Jakob would never let Will face danger alone and vice versa.)

Interested in children?

No. Will says that Jakob and I are enough like children as it stands😂

Who needs the most TLC when sick?

Will AND Jakob. They are both huge babies whenever they are sick and all they want is to be taken care of. Surprisingly, they bicker a lot more whenever they’re sick; mainly, they fight over who gets to cuddle me first.

Whenever I am sick, I tend to react the same way and the brothers are more than obliged to take care of me in any way they are able. Will takes the more ‘hands-on’ work like fetching me a drink, food, blankets, etc. and helping me move about as I need. Jakob does not like to leave my side and he will not do so unless instructed by Will and he will fetch me whatever is needed and then return to cuddle with me.

Who says ‘I love you’ first?

I was the first one to say ‘I love you’ to either of the brothers. I told Jakob first; we nearly admitted it at the same time. We knew how we both felt upon the first of our meetings.

It took me a while to say ‘I love you’ to Will. Our relationship began platonically; I did not feel comfortable saying so to him until I spoke with Jakob about it first. Intuitive of human emotions is he and he was already well-aware of how we felt about each other and, with his blessing and consent, the brothers agreed to share the love and, well, me.

Which of you is more accident prone?

I bet you’re thinking either me or Jakob. WRONG! It’s Will. Jakob and I are very steady on our feet because we are full of rambunctious energy; Will is more laid back than either of us and he gets more indignant whenever he does accidentally hurt himself.

Bed hog?

Jakob is more of a bed hog than Will or I. He is consistently moving around in his sleep, talking, etc. There is one unspoken rule: Jakob sleeps on the left side of the mattress, I am in the middle and Will is on the right. Both use me as a barrier and do not cross to the other’s side of the bed at any point and they each take turns cuddling with me until we all fall asleep.

Who loves the other the most?

As if it even needs to be said, we all love each other equally, but in different ways. Jakob’s and Will’s relationship and love for each other is strictly familial, while the brothers’ relationships with me are both romantic.

Will understands and accepts that my relationship with Jakob takes priority, as we began ours first and I am unspokenly Jakob’s above all else. Any and all major decisions are made between Jakob and I; we of course always consider Will’s emotions, well-being, etc. but Jakob prefers to take the reins in terms of calling the shots, in spite of Will being the dominant and more protective one. He feels like Will owes him this and Will is happy to allow his brother this courtesy, considering this is Jakob’s first true relationship.

literallyyyy like only after it won a grammy? after going on for years about artist rights and production credits? really taylor? i'm sorry to say but this makes me doubt the william bowery schtick too

I still don't think its any sort of conspiracy but the fact that she hasn't spoken about it at all, or made any clarification about the credit changes is a bit odd. I trust her generally, but transparency and consistency in her values would be good considering the context of her ongoing fight for artists' rights, the recent campaigns going on in the industry for fair songwriting credit assignment, and the controversy surrounding the fairness and legitimacy of the Grammys process this year. I wasn't taking it so seriously before but with the contextual elements and the weight of a Grammy clicking into place yeah.. it's not great. If she doesn't speak on it soon, or it DOES turn out to be a ploy to secure a Grammy for Alwyn undeservingly I will be incredibly disappointed..

3. Stunning beaches

Nothing new for Mexican destinations, but Puerto Vallarta has a great story to tell. In 1964 American film director John Huston, chose Mismaloya beach in Puerto Vallarta, as the location for his film The Night of the Iguana, starring Richard Burton and Ava Gardner. Huston also brought in, his soon-to-be-wife Elizabeth Taylor, putting Puerto Vallarta in the international spotlight and making its beaches world famous. But Mismaloya is only one of a plethora of enchanting beaches that offer something for all walks of life. Whether you're an adrenaline junkie looking to do some kite surfing or simply someone that likes to lay by the water being tended to, Puerto Vallarta has the right beach for you. You just can't get bored with it. The mixture of indigenous traditions with Spaniard customs has produced an amazingly rich culture, an explosion of color, spirituality, flavors, images and sounds that will never stop impressing you. Slowly discovering the little idiosyncrasies of this beautiful culture is one of the best rewards for visiting Puerto Vallarta and once you start to understand Mexican culture, you will only want to learn more. But don't look only for the exotic side of it, the "Día de Muertos" or the religious pilgrimages, for instance, even when those celebrations are actually quite impressive, there are is much more to discover on the day-to.day life of Mexico. You might travel for the beaches and just to have some relaxing vacations, but if you are open to it, Mexican Culture will surprise you.

6. The people

You have to travel a lot in order to be qualified to compare people and cultures. Well, I have done it, and I can tell you that, there are no warmer people in the world. Mexicans always smile, they always say "please" and "thank you", they will kiss and hug you, so be prepared; they will touch you all the time, they are a happy people and they like to show it. You will have a lot of fun around them, they will make you feel at home, you just have to let go and learn from their laid-back and unpretentious attitude towards life. This way to understand life, where people work to live and not live to work, might be arguable, but for a place like Puerto Vallarta, where people travel to forget for a while about the problems of daily life, it's just perfect.

7. Things to do

There is almost everything to do, except maybe those boring winter games that include snow and cold, Puerto Vallarta offers to visitors a formidable variety of activities. Eco-tours, golf (7 courses), ATV's, scuba diving, canopy, whale-watching, swimming with dolphins or sea lions, a theater, museums, plenty of art galleries, gourmet restaurants, festivals (film, food, wine), surfing, botanical gardens, old towns to visit, a zoo, lots of discotheques and nightclubs, and much, much more. I am telling you, this place is worth the trip. Whether your dream vacation consists of lounging by the beach or zipping from tree top to tree top Vallarta has it. If you want to enjoy a five star gourmet dinner or just have tacos at a stand, this is the right place to come. The culture scene the little coffe shops in old town add to the incredible allure of this great city. Many visitors come because the large array of Puerto Vallarta tours and activities.

8. Accessibility from USA and Canada

Accessibility is not to be forgotten when planning a vacation. There are some other incredible corners in the world, but somehow they are always plenty of flight hours to Puerto Vallarta. Many cities in the US and Canada have direct flights to Puerto Vallarta, making it so easy and cheap to come down there, that it makes it even harder to invent excuses for not spending a week or maybe just a weekend in such a beautiful place. Puerto Vallarta is just a three hours flight from Los Angeles, and that is all it takes to feel like you are in a complete different world, the mountains, the rivers and the ocean make their presence felt at every corner, but you won't miss civilization a bit, as luxury hotels have everything in place to make you feel at home. On top of that the ongoing commercial relationships provided by NAFTA allow for crossing of people and goods without mayor hassles.

9. Services

This point is mentioned quite a lot by the large expat community in Puerto Vallarta (nearly 50,000 and growing). One of the biggest fears of those moving abroad USA and Canada is that they might not get the same quality services at the places they move to. But that's just not the case with Puerto Vallarta, as the city has defined its identity as a perfect place for retirees and developed the proper infrastructure to please them. You will find excellent medical services, a big focus on security, a diversity of financial businesses and all kinds of information and technology services, such as high-speed internet, digital cable TV and everything to help you avoid missing home while you are on vacations in Mexico.

10. The nightlife

Especially on Spring Break, but not limited to it. The "Malecon", a beautiful boardwalk by the beach, has been called "Puerto Vallarta's Bourbon Street" because it has club after club open all night long. World famous club brands as Hard Rock Café, Señor Frog's or La Bodeguita del Medio (where Hemingway used to go in Havana), compete with local clubs such as Mandala, Zoo or Punto V, to see who throws the best party in town. There is the world famous "Foam Party" at Collage every Tuesday and many salsa discos to feel the Latin vibe. Puerto Vallarta also has its own share of electronic festivals with some of the best DJs in the world, playing outdoors till dawn, with people dancing and jumping in the sand just a few steps away from the ocean.

Henry Goldrich, Gear Guru to Rock Stars, Is Dead at 88 When asked about his musical ability, Henry Goldrich would often demur, “I play cash register.” His stage was Manny’s Music in Manhattan, where Mr. Goldrich, the longtime owner, supplied equipment to a generation of rock stars. But even though he sold instead of strummed, Mr. Goldrich secured an important role in rock by connecting famous musicians with cutting-edge equipment. “To these guys, Henry was the superstar,” his son Judd said. “He was the first guy to get gear they had never seen before.” Mr. Goldrich died on Feb. 16 at his home in Boca Raton, Fla. He was 88. His death was confirmed by his other son, Ian, who said he had been in frail but stable health. Manny’s, which closed in 2009 after 74 years in business, was long the largest and best-known of the cluster of music shops on the West 48th Street block known as Music Row. It was opened in 1935 by Mr. Goldrich’s father, Manny, and it was a second home for Henry since his infancy, when the shop’s clientele of swing stars doted on him. Ella Fitzgerald would babysit for him in the shop when his parents went out for lunch, Ian Goldrich said. John Sebastian, founder of the Lovin’ Spoonful, recalled in an interview how Mr. Goldrich in the mid-1960s helped him select the Gibson J-45 he used on early Spoonful recordings like “Do You Believe in Magic?” Mr. Goldrich similarly matched James Taylor with a quality Martin acoustic guitar early in his career, his son Ian said. And Sting used the Fender Stratocaster Mr. Goldrich sold him to compose “Message in a Bottle” and many other hits for the Police before donating it to the Smithsonian Institution. In 1970, he sold the Pink Floyd guitarist David Gilmour the 1969 black Stratocaster he played on many of the band’s seminal recordings. It sold at auction in 2019 for a record $3,975,000. Pete Townshend of the Who would order expensive electric guitars by the dozens from Mr. Goldrich, who was not happy when he heard about the guitarist’s penchant for destroying his instrument onstage for theatrical effect. “It was good business,” Ian Goldrich said, “but my father was annoyed that Pete was breaking all the guitars he was selling him.” Unlike many of his flamboyant rock-star customers, Mr. Goodrich always dressed conventionally in a sport coat and kept a blunt demeanor that put his customers at ease. “He had a gruff personality; he treated them all the same,” Ian Goldrich said. “He’d tell Bob Dylan, ‘Sit in the back and I’ll be with you in a minute.’” There was the day in 1985 — it was Black Friday, and the store was packed — that Mick Jagger and David Bowie stopped by together, creating a commotion that halted sales. An annoyed Mr. Goldrich quickly sold them their items and rushed them out. “My father was like, ‘What are you guys doing here today?’” Ian recalled. “He didn’t throw them out, but he was not happy.” When the band Guns N’ Roses asked to shoot part of the video for their 1989 hit “Paradise City” in the store, Ian Goldrich recalled, his father agreed only reluctantly, saying, “OK, but we’re not shutting down for them.” Ever opinionated, Mr. Goldrich told Harry Chapin in 1972 that his new song “Taxi,” at nearly seven minutes, was too lengthy to be a hit. (It reached the Top 40 and is now considered a classic.) And he told Paul Simon, who as a boy had bought his first guitar at Manny’s, that he thought Simon and Garfunkel was a “lousy name” for a group. But he also advised new stars in a fatherly way not to squander their newfound wealth. “He’d take them aside and say, ‘You’re making money now — how are you going to take care of it?’” Ian Goldrich said. Henry Jerome Goldrich was born on May 15, 1932, to Manny and Julia Goldrich, and grew up in Brooklyn and in Hewlett on Long Island. After graduating from Adelphi College, he served in the Army in Korea in the mid-1950s and then went to work full time at Manny’s. His father opened the store on West 48th Street, a location he chose because it was close to the Broadway theaters and the 52nd Street jazz clubs, as well as numerous recording studios and the Brill Building, a hub for music publishers. In 1999, Mr. Goldrich sold Manny’s to Sam Ash Music, a rival store, which largely retained the staff until Manny’s closed in 2009. In addition to his sons, Mr. Goldrich is survived by his wife, Judi; his daughter, Holly Goldrich; seven grandchildren; and a great-granddaughter. Mr. Goldrich often used his celebrity clientele to market the store. “He recognized value of these people being in the store and it made the business, certainly,” his son Judd said. When a young Eric Clapton, then with the group Cream, was stuck in New York without the money to fly home to England, he offered his amplifiers to Mr. Goldrich to raise funds. “He said, ‘I’ll buy them from you as long as you stencil them with the Cream logo,” Ian said. Then there was the store’s Wall of Fame, thousands of autographed publicity photos of famous customers that constituted a Who’s Who of popular music. Mr. Goldrich helped cultivate the photos, many of which were inscribed to him, and often kept his staff from stacking merchandise in front of them. Mr. Taylor, in a video interview, described being mesmerized by the photos as a teenager and being proud when his own was added. “It was sort of an inside thing, not as celebrated as a Grammy or a gold record or a position on the charts,” he said. “But definitely you had arrived if you were included on that wall.” Mr. Goldrich became close friends with many musicians, including the Who’s bassist, John Entwistle, who attended Judd’s bar mitzvah in New Jersey and hosted the Goldrich family at his Gothic mansion in England. Ian remembered the band’s drummer, Keith Moon, sitting on his father’s lap while drinking cognac at a screening of the film “Tommy.” In a video interview, Mr. Goldrich described selling the violinist Itzhak Perlman an electric violin. When Mr. Perlman tried bargaining, Mr. Goldrich parried by asking if he ever reduced his performance fee. “He said, ‘It’s different, I’m a talent,’” Mr. Goldrich recalled. “I said, ‘I’m a talent in my own way, too.’” That talent was palpable to Mr. Sebastian when he asked Mr. Goldrich to allow him to test out his stock of Gibson acoustic guitars in a merchandise room. “Henry’s famously prickly demeanor receded slightly,” Mr. Sebastian recalled, and he agreed to open early the next morning to allow him in. “He knew exactly what I wanted,” he said. “And I’ll be damned if I didn’t catch Henry smiling as he made out the bill.” Source link Orbem News #Dead #gear #Goldrich #Guru #Henry #rock #stars

Role of IP in Protecting a Brand

IP plays a crucial role in devising the brand protection strategy. Different IP routes can be taken in furtherance of the achievement of this goal. They are:-

1) Trademarks: To put it straight, trademarks and brands are not the same and hence, cannot be used interchangeably. Where a trademark will help differentiate between the goods of two proprietors and identify the source of origin, brands have more complex features. The image building, status, value of the personality of the brand, and consumer association are all the intrinsic features that constitute a brand. A brand not only helps in consumer association but also develops the corporate existence of an entire company to fulfill a wide range of goals. However, both trademarks and brands help in identification; they play different yet overlapping roles.

A trademark is a device, brand, heading, label, ticket, name, signature, word, letter, numeral, shape of goods, packaging or combination of colors or any combination thereof, which helps differentiate between the goods and services of one from that of another. The use of a trademark helps secure the exclusive right to use the brand name or device and prevent misuse by imitators. It also helps build brand loyalty amongst existent and potential consumers, which adds-on to the feature of the 'quality' of the mark.

Therefore, a trademark helps a brand to shift from a product-level brand to a corporate-level brand by attaining a certain amount of goodwill, which also depicts the interplay of trademarks and brands. The same is the most commonly adopted strategy due to its ease of operation and registration. A few examples include Nike's Swoosh, Chanel's representation of 'C,' Twitter's bluebird, and Adidas' three stripes logo.

2) Trade Dress - A brand can also be identified by the use of a distinct trade dress. The way a trademark helps identify the source of a product, a trade-dress serves an identical purpose. Trade dress often takes the form of labels and designs of packages like the Coca-Cola bottle (Tm. Reg. No. 1,057,884). The dress is composed of the look and feel of the product with distinct yet consistent specificity. A functional feature or a design aiding the function of a product cannot be protected. Other brands that have considered trade dress protection include Converse for its 'hi-top' shoes, Hershey's for its 'Hershey Kiss' chocolates, Burberry for its check pattern, Christian Louboutin for its red sole, and the list goes on.

The threshold for seeking protection is often higher than trademarks, and therefore, requires a 'secondary meaning' to be proven, which means that the public identifies the design or the trade dress and relates it to a specific source. Hence, where a trademark may ensure immediate protection, seeking protection of a trade dress may relatively take lolonger. The Federal Court of the United States recently established the six-factor test in the Converse Inc. vs. ITC case where Converse alleged that the midsole design of its Chuck Taylor shoes had gathered sufficient goodwill and reputation. These factors are:

· Association of the trade dress with a particular source by actual purchasers (typically measured by consumer surveys);

· Length, degree, and exclusivity of use;

· Amount and manner of advertising;

· Amount of sales and number of customers;

· Intentional copying; and

· Unsolicited media coverage of the product embodying the mark

Once the secondary meaning is established, the trade dress can prevent illegitimate copying and infringement and can be a great branding strategy to build the reputation of a brand.

3) Design Patent: A design patent is granted for the ornamental features of a product, which are non-functional. It is for this reason why the court decided to invalidate two of Ford's design patents covering the automotive-body parts for its F-150 truck (Auto. Body Parts Ass'n vs. Ford Global Techs., LLC, 293 F. Supp. 3d 690 (E. D. Mi. 2018)). The pre-requisite is that such a design should be new and non-obvious to the existing craft. It plays a crucial role in branding since the design forms the element that gathers the attention of the eye before actually using it. It helps appeal and lure consumers towards buying some specific product, and over time, it reduces the search-cost when the consumers adopt the product and absorb the brand image that comes with it.

Design patents form a determinant role in the field of automotive and cellular devices to safeguard their branding and image. It is for this reason why Apple succeeded in a lawsuit against Samsung for Samsung infringed upon three of its design-patents covering its smart-phone technology inclusive of its appearance, as well as, the arrangement of the icons on its home screen. The protection afforded by design patents is a better alternative to trade dress protection since it does not mandate proof of established 'secondary-meaning.'

4) Copyright: Seeking Copyright Protection is a good strategy in furtherance of brand protection where the product involves original works of authorship, such as visual art, music, and literary works. It goes beyond the simple creation of works and can help in brand promotion and protection by safeguarding distinctive and original logos/emblems, labels, product-use manuals, and even advertisements. For example, in Maple and Co. vs. Junior Army and Navy Stores, an illustrated catalog for advertisement, which was not for sale, was held to be a subject matter of copyright.

However, not all types of artistic expressions are worthy of being protected under the law. In a case where the artistic elements of uniforms of cheerleaders were brought forth, the court held that the feature could be copyrighted if:

(i) It can be perceived as a work of art separate from the useful article; and

(ii) It would qualify as a pictorial, graphic, or sculptural work eligible for protection if imagined separately from the useful article.

Therefore, before resorting to such protection, the strategists should keep in mind the points (mentioned above) of consideration to prevent contrasting objections to their claims. Copyright can be beneficial in the creation of a brand image in the long run since once the protection is sought, the brand's entity has the exclusive right to reproduce, copy, display, perform or create derivative works from their copyrighted work.

5) Trade secret: Brand protectionists can undertake to choose an alternative to mandatory disclosure, which is required for all other kinds of IP except trade secrets. The same is more prevalent in the food & beverage industry.

Let's take some widely known examples where brands have endorsed protection under trade secrets. The most common is the Coca-Cola secret recipe. Other examples are Listerine's formula of Lambert Pharmaceuticals, the recipe of the Twinkies, McDonald Big Mac special secret sauce, Google's search algorithm, KFC's original recipe hidden in a safe. These choices also influence the marketing strategy of the brand.

6) Overlapping IP: The best kind of protection that an entity can choose to protect and confine its brand against unlawful use is by deploying IP in layers. Let us take a hypothetical example of a food chain for better clarification. What kind of branding strategy aligned with IP be the most suitable in this scenario?

The food chain can trademark its logo (device) and trade name (word).

It can also claim Trademark Protection of its mascot, if any - for instance, Pillsbury's Doughboy, Ronald McDonald, The Geico Gecko, and the Starbucks Mermaid. These can help in further merchandising options in the form of toys, stationery, apparel, etc.

The employees' uniform can be design protected.

The recipe can either be copyright or a trade secret, depending on the purpose of taking either route.

The cutlery and utensils for presentation can be design protected.

The layout of the food-chain/restaurant, after having attained and established a certain degree of reputation through securing a 'secondary meaning,' can be protected in the form of a trademark.

If there's any jingle used for advertisement, the tune can be copyrighted. If distinctive, the tagline or jingle can be trademarked.
