Murder, Robbery
In 2018 before Eighth Judicial District Court Judge Julie Kunce Field sentenced then 21-year-old Lawrence Greggs for second-degree murder and aggravated robbery she acknowledged that nothing she handed down could ever be true justice.
Justice, she said, would be to roll back the clock and allow for both Fort Collins victim Devon Smeltz and shooter Greggs to continue to live their lives.
"But I can't do that," she said.
She instead handed down a sentence that she thought was as close an approximation to justice as she could find: 80 years, the maximum sentence for Greggs' charges, in the Department of Corrections.
Greggs and two other co-defendants from Ohio were arrested for robbing and killing Fort Collins resident Devon Smeltz in a "drug deal gone bad."
Greggs and co-defendant Michael Gresham had made a plan to drive from Cincinnati, Ohio, to Colorado to purchase cocaine from Smeltz, and according to statements made to police, at the last minute, co-defendant Joshua Baker joined them to get out of his house.
The three met Smeltz in the early morning hours of Aug. 26, 2016, in the Timnath Walmart parking lot. Based on testimony from Fort Collins police detective Siobhan Seymour, the defendants, whose stories conflicted, stopped in Kentucky to pick up an AR-15-style rifle from someone in exchange for Xanax before continuing on to Colorado.
After arriving at the Walmart, Greggs got out of the Jeep and got into Smeltz's Mercedes. Smeltz reportedly did not bring the amount of drugs agreed upon, but Baker later told police the three had not brought much money with them.
Greggs had brought a Taurus revolver that he put in a bag — which may have been used to trick Smeltz into thinking there was money — and then shot Smeltz several times. Greggs returned to the Jeep where Gresham and Baker were still sitting and told them he needed to reload because Smeltz was not yet dead.
Greggs went back and shot Smeltz again, then got back to the car and said he needed help moving Smeltz's body into the trunk.
Smeltz had also been armed.
The men stole the Mercedes and drove to Smeltz's home to rob it but fled when Smeltz's mom heard a noise and went to see what was going on.
The three continued driving the Jeep and the Mercedes and dumped Smeltz's body in a field in Morgan County.
The two vehicles were later stopped by Illinois state troopers, and police said they found a bag of Xanax pills, a loaded semiautomatic pistol covered in blood, Smeltz’s phone and wallet, and a backpack that contained a revolver, Versace jeans, empty shell casings and $11,400 worth of cocaine (about 5 ounces). They also found more blood in the Mercedes.
In their investigation, police obtained surveillance footage from the Walmart parking lot and text messages from the suspects' phones and videos, some of which were played at the sentencing.
When Smeltz's mother, Dawn Becker, spoke at the sentencing, she implored the judge to give Greggs the maximum sentence allowed by the plea deal. Smeltz's father, Doug Smeltz, pointed out that the family members were opposed to the plea deal, which reduced the number of charges the defendants faced.
First Assistant District Attorney Mitch Murray told Field that Greggs' actions were "not an isolated error of judgement," referencing an Ohio incident Greggs was reportedly involved in, in which a drug deal was set up to then steal money, drugs and guns.
Murray said Greggs can spend his time in prison trying to make something of his life, which he took away from Smeltz.
Greggs' attorney Jeffrey Schwartz, however, painted a tragic picture of Greggs' life growing up.
He came from an impoverished home, in a "crime-laden community," in which he was abused by his mother, didn't know his father and later lived with his uncle. He was a victim to racism, even by his extended family, for being biracial. Greggs' mom, Schwartz said, used drugs while pregnant with Greggs and throughout his life and is currently serving time on federal drug charges.
But Greggs pushed forward, was the only one of his family to graduate high school, and joined the Army at 17 before having to be medically discharged because of an issue he could not control.
"Much like Devon Smeltz, (Greggs) had two different sides to him," Schwartz said.
While Smeltz was a loving father and son, he was also a drug dealer who at the time of the killing and was being investigated for his involvement in an apartment shooting, according to Schwartz.
Though none of Greggs' history excuses the horrific murder, Schwartz said, he felt it was important for the judge to "understand what created this person."
Schwartz said the court should consider that Greggs was 19 at the time of the murder, a time when his brain was continuing to develop, and was impacted by the traumatic incidents he faced as a child. In a few years, Schwartz said, he has already matured and is taking responsibility for his actions.
Greggs, who looked down during the majority of the hearing on Thursday, read a prepared statement in which he apologized to the court, the community and the family of Smeltz.
He said he wanted to be a productive member of society and that no matter what sentence he received, he would use the time to better himself and move in the right direction.
Field acknowledged the difficulty of the case, and the pain on all sides.
"I know there were no angels in this case," she said, adding that it was almost inevitable, with three guns and drugs, that someone would end up dead.
She said after balancing the goals of the criminal justice system and the circumstances of the killing, reviewing all the evidence and thinking "long and hard" about the sentence, it came down to a single action that was most impactful to her: Greggs went back to the Jeep to reload the gun after he had already shot Smeltz and then returned to shoot him.
Field said she does believe that Greggs has "a great deal to offer," but his choices on Aug. 26, 2016, limited what she could do.

Why are we here?
Well, that’s complicated and I can’t say I know the answer - but I do know why I’m recording this information via blog... 
The purpose of this page will be to document the journey of my first ever controlled (and self-administered) micro-dosing experiment using psilocybin. Certainly, not concerning enough for me to not carry our my micro-dose (MD)... but concerning in the type of way where I’d be worried about quantifying the results of my own experiment.
Now all of that being said,.. the results of my experiment will be completely empirical, but I’m aware they won’t carry an ounce of validity for true research purposes. My hope is that this can help someone establish a baseline (including myself) for legitimate MD therapies and help advance the production and deployment of pharmaceutical alternatives (more on that later)
Some Context
I’m a male in my mid-20s living in the Unites States. I work a high(er) paying and likewise high(er) stress sales job for a large corporation. I’m in good health, have a strong immune system, and have what I would call an “average” genetic risk profile when it comes to disease. I (try to) work out every day - which I’m looking forward to changing during this journey. Likewise I (try to) eat very healthy and limit red meat as much as possible. By and large my diet and exercise are certainly above average when compared to the average American, but I’ve got a lot of room for improvement.
I’m a more than occasional drinker, but not to excess. I have abused nicotine in the form of vapes and cigarettes, although I have not done so for about a month leading up to this research. The extent of my experimentation with drugs is limited to marijuana, cocaine, and sleeping pills - the bulk of which all took place in college.  I can thankfully say I’ve never been truly “addicted” to any one substance, despite prolonged or excessive use of some in the past.
As for psychedelics... it’s a class of substance I profoundly avoided for a long time. I was never worried about the horror stories we’ve all heard before... but more so my fear was getting too close to the inner-workings of my mind. I tripped for the very first time in Fall of 2019 after deciding I was ready. As it turned out... I absolutely was. After eating about an eighth of mushrooms and going off in to the woods for over 4 hours, I knew I had made the right choice. Exploring the recesses of my consciousness while listening to music and enjoying nature was like nothing I could have imagined - and even more revealing than anticipated.
Since then I’ve taken mushrooms 5-7 times (mostly to accompany live music) but have not had a full blow trip since my initial experience.

So if when u ask for an eighth u should be getting 3.5 grams. Some dealers are generous & push it up to like 3.75 or something, but anything more & it’s not an eighth. At that point your just buying how ever many grams your getting for whatever price your paying. At $40 for 6-7 grams it’s obviously can’t be top shelf. An 8 ball of coke is 3.5 grams of cocaine, which is one-eighth of an ounce or 25.34 grams. Drug dealers and people who buy coke also use the term 8 ball to refer to 3.5 grams of meth.

The punishment varies whether one has crack cocaine or cocaine powder, a higher prison time for the former.
Pharmacologically the same drug, crack and powder cocaine are treated very differently within the walls of our justice system. Current policy generates a 100 to 1 penalty ratio for crack-related offenses. For instance, possession of only 5 grams of crack-cocaine yields a 5 year mandatory minimum sentence, however it takes 500 grams of powder cocaine to prompt the same sentence. The article says there is a wide disparity of punishment if one has a crack-cocaine and when one has cocaine powder. For a first offender of crack-cocaine can trigger a federal mandatory minimum punishment of 5 years, while a first offense of cocaine powder carries only a misdemeanor offense punishable by a maximum of one year in prison. To eliminate the disparity, the U.S. Sentencing commission in 1995 recommended a more equitable ratio between crack and powder cocaine. However, Congress discarded the Commission's request and President Clinton also signed the rejection into law. And this was the first occasion in history that Congress rejected a recommendation from the U.S. Sentencing commission. The commission after that had tried to reduce the levels to 20:1 ratio, with the same effect, it was rejected.Because of this disparity, there has been lots of racial injustice, a 1007 report published by the U.S. Sentencing Commission found that nearly 90 percent of the offenders convicted for Crack cocaine were found to be African American, while the majority of crack-cocaine users are white.The report concludes that 'sentences appear to be harsher and more severe for racial minorities than others as a result of this law. The current penalty structure results in a perception of unfairness and inconsistency.'Also, the Commission thinks that powder cocaine can be easily converted into crack cocaine, and punishment higher for crack cocaine offenses,law enforcement and prosecutorial decisions that wait until powder has been converted into crack can have a dramatic impact on a defendant’s final sentence.'So to mitigate this disparity, the U.S. Sentencing Commission has come up with few other recommendations in 2002 to increase the minimum amount from 5 grams to 25 grams, and increase the punishment for cocaine users to 5 years. "The War on Drugs: Moral Panic and Excessive Sentences"
The title of this post is the title of this new article now available via SSRN and authored by Michael Vitiello.  Here is its abstract:
The United States’ War on Drugs has not been pretty. Moral panic has repeatedly driven policy when states and the federal government have regulated drugs.  Responding to that panic, legislators have authorized severe sentences for drug offenses.  By design, Article III gives federal judges independence, in part, to protect fundamental rights against mob rule.  Unfortunately, the Supreme Court has often failed to protect fundamental rights in times of moral panic.  For example, it eroded Fourth Amendment protections during the War on Drugs.  Similarly, it failed to protect drug offenders from excessive prison sentences during the War on Drugs.
This article examines whether it is time for the Supreme Court to rethink its precedent upholding extremely long sentences for drug crimes.  In 1983, in Solem v. Helm, the Supreme Court held that the Eighth Amendment’s Cruel and Unusual Punishment Clause applies to terms of imprisonment.  There, it found the imposition of a true-life sentence imposed on a repeat offender to be grossly disproportionate to the gravity of the defendant’s offense.   Whatever hope Solem created that courts might limit excessive sentences proved to be false.  Two Supreme Court cases dealing with drug sentences, bracketing Solem, demonstrate the Court’s unwillingness to override legislatures’ discretion in imposing sentences.  In 1982, the Court upheld a 40-year term of imprisonment imposed on an offender who possessed less than nine ounces of marijuana.  In 1991, the Court upheld a true-life sentence imposed on an offender who possessed 672 grams of cocaine.  The Court’s refusal to curtail such extreme sentences reflects its willingness to accede to the nation’s moral panic over drug usage.
Since the height of the War on Drugs, Americans have changed their views about drugs.  Significant majorities of Americans favor legalization of marijuana for medical and recreational use.  Many Americans favor a wholesale rethinking of drug policy.  Despite studies in the 1950s and 1960s, demonstrating beneficial use of drugs like LSD and psilocybin, Congress yielded to moral panic and included them in Schedule I when it enacted the Controlled Substances Act of 1970. Efforts are afoot at the state level to legalize the study of and to decriminalize the use of those and other drugs.
This article argues that the Court should rethink its Eighth Amendment caselaw upholding severe drug sentences.  The Court’s Eighth Amendment caselaw balances the severity of punishment against the gravity of an offense.  In turn, the gravity of an offense turns on its social harm and the culpability of the offender.  The Court upheld extreme drug sentences based on the view that drugs were a national scourge.  Moral panic led it to overstate the social harm and the culpability of drug offenders.  Scientifically based examination of drugs and drug policy should compel the Court to rethink its excessive punishment caselaw because the balance between severity of punishment and the gravity of drug offenses looks different when one has a better understanding of true costs and benefits of drug use.

A girl I fell in love with in high school took me to pick up my last car 11 years ago. The car was a 96 Toyota Corolla. It wasn't a bad car, as far as used cars go.
The trip from Ellicott City to Westminster was about forty minutes. Once I got the car at my father's house, she trailed behind me until she diverted to drive back to her house or wherever she went to after that.
She's one of my best friends. Allie. She's a hot girl. We used to talk a lot around that time. I'm sure she still thinks about me. I'd like to see her and talk to her again.
A few years ago, me and my friend Chris bought 3 to 4 eightballs. (which is equivalent to like an amount of cocaine or crack, usually in a bag./ To be more specific, an 8 ball is 3.5 grams, one-eighth of an ounce).
I was the one who bought it. $700. We bought crack. Really good crack.
We smoked it (we didn't buy it all at one time) over the course of a week or two.
4 weeks later, the President of the United States Barrack Obama said after a conference meeting, "Thanks Paul".
I mentioned the other day I thought Donald Trump is a pretty good president. I emphasized that the economy and society is doing well and the nasdaq is also up.
A few hours later, President Donald Trump was on TV seated in a chair and he said very serenely, "you think I've been a pretty good president??"
Me and my friend Chris lived in a tent at the time.
One time when I was at a Taco Bell on route 40, I walked through the drive-thru.
Once I walked into a Starbucks early in the morning and asked, "Yea, can I have the ready??"

Is That Marijuana? Ohio Cops Forced To Prove It.
Small-time marijuana busts are a waste of time for everybody, and that includes the Ohio state crime lab.
Possession of less than 3.5 ounces of marijuana in Ohio is still a crime, but it’s a lowest-level misdemeanor that’s punishable by no more than a $150 fine and possible suspension of a driver’s license. But even that piddling bust takes some police work. For one, the cop doing the arrest has to prove that the marijuana is in fact marijuana—and has to prove it in court.
Typical procedure goes like this: Drugs seized during an arrest or raid are “suspected drugs,” good only for establishing probable cause to make an arrest, until they’re sent to the state crime lab for analysis. Only after a lab test confirms that the contraband is the real McCoy (and of course this is already a marijuana strain name) can a drug conviction be won in court.
This has created what’s become an expensive dilemma for Ohio’s small-town police. Last March, the Ohio Bureau of Criminal Investigation’s crime lab stopped testing minute amounts of marijuana, according to the Toledo Blade. Or more precisely, they stopped running grams, eighths and other small amounts of cannabis through the machine just to prove that, yes officer, that’s cannabis.
Now, if a cop wants to make his $150 case, the police department has to pay for the test—and most aren’t. There’s now both an obvious loophole for defendants charged with low-level marijuana crime as well as a new cottage industry in “cannabis education” for local police.
Per the Blade:
Officers typically use a basic field drug test to confirm that a substance is marijuana, but that test only establishes probable cause. Further testing would be needed for evidence to rise to the higher standard needed for conviction. An officer can be certified through a two-day Ohio Peace Officers Training Academy course, but Waterville Township Police Chief Richard Bingham is unsure that would hold up in court.
“Some courts will not accept that,” he said. “Some courts want a chemist report.”
Thus far, 85 officers have taken the two-day course, according to the newspaper. Since most small-time marijuana cases result in a plea deal—and since the testing ending, prosecutors have more incentive than ever to offer a plea rather than pay for a test in order to take a case to trial—local courts have yet to encounter a case dismissed or delayed because nobody could prove weed was weed.
That said, one local judge seemed to suggest that it’s only a matter of time before defendants get wise and realize this is an escape route, as a two-day course does not an expert make.
“Whether you go through a training or not, you still have to qualify that a person is, in fact, an expert, and that’s a legal standard that has to be established,” local municipal court Judge Gary Byers told the newspaper. “Whether an officer going through some sort of crash course on identifying marijuana rises to that level, we have to take on a case-by-case basis.”
Ohio is one of the states hit hard by the opiate epidemic—and one of the heroin and prescription pill-wracked states that helped hand Donald Trump the White House. With so much heroin, fentanyl and synthetic opiates to test, the lab had to make a decision to cut something else out—and that was weed.
Seems smart. Who could argue with that? Police, of course: Chief Bingham told the Blade that his department would likely start paying the state crime lab to test small amounts of marijuana—because, he said, that’s how you find the heroin.
“I don’t think anyone is looking at a big picture,” he told the newspaper. ‘You are 50 times more likely to progress to heroin or cocaine if you start with marijuana.”
Let’s forget for a second the gateway theory and the Trump-like “50 times” figure conjured out of thin air, and let’s hope Chief B is right on—at least partially. Let’s hope Ohio police progress to busting heroin and cocaine after their chances of making petty pot busts approach zero.
