In honor of Throttled’s three-year anniversary, here are some Slade family head cannons!

Noah does the cooking in the house.

Maya’s responsibility is to read out the recipe he’s making.

Noah always participates in Maya’s vlogs when she asks and threatens asks everyone else with him to do it as well.

Maya realizes she gained 10K followers overnight when she posted an Instagram story with Noah walking around shirtless behind her in the frame.

Shirtless Noah is then banned in the household.

Maya’s parents favor Noah over both Santiago and Maya, and Noah never stops flaunting it.

Noah watches soap operas with his mother-in-law and does not stop talking about the plotline for days.

Whenever they fight, Maya retaliates by wearing Santiago’s number again.

Noah’s equivalent to sleeping on the couch during fights is hanging at Santi’s place till he gets kicked out to go “make up with his wife”

Occasionally, Maya is the third wheel in Noah and Santiago’s bromance.

After retiring, Noah only comes back to Bandini as Team Principal after James Mitchell retires from the post.

Having Liam and Sophie as neighbors means lots of joint dinner parties, festival celebrations, emergency midnight crisis contacts and accidental witnessing of things like -

Noah and Maya witnessing Liam and Sophie trampoline jumping into their pool from the roof.

Liam and Sophie watching Noah discuss the latest soap opera in heavy detail over barbeque with a full outline of the characters, plot twists and the villains (Sophie doesn’t know but Liam asks about the channel and the time it airs after dinner).

Because of his issues with his parents, Maya is first anxious to tell Noah that she’s pregnant.

Noah bursts into tears with happiness when she does tell him though.

Maya’s cravings make Noah a professional chef who sometimes races.

Noah tries to stop Maya from travelling with him and only allows her to do it till her second trimester.

Maya never tells Noah, but she thinks he looks hot carrying a baby bag filled with essentials.

Noah is on the podium when Maya’s water breaks.

Maya is carried by Noah to the car with Santi and Jax clearing out the way.

The two hours Maya is in labor are the most excruciating of his entire life and he hates that he agreed to let her be present at the race where so many things could have gone wrong.

Noah cries when the Doctor tells him his wife and son are both in good condition. Noah cries harder when he holds Marko for the first time.

Marko has the most loving and doting parents in the world, the best grandparents and the coolest uncle.

Marko develops a love for racing at a very early age.

Unlike his own father, Noah lets Marko take it at his own pace. He is proud of his son and even more proud that they love the same sport, but he does not want to be controlling and obsessive.

Maya loves setting up playdates with Sophie’s twins the moment she finds out about Marko’s little crush.

Initially, Marko chooses his mother’s birthday date as his car number.

He is offered a contract from Bandini at the age of 20. Noah takes a backseat from being the Team Principal, becomes a strategist instead.

Tio Santi is his go-to person for everything. When his parents come off as overbearing? Sleepover at Tio Santi’s. Love advice for a girl’s he crushed on his whole life? Tio Santi. How to bail him from trouble without letting his parents know? Tio Santi.

Marko is a vivid reader after he borrows Stephen King's books from Liam one time. He also takes suggestions from Sophie about the romance books her daughter is currently into.

When Maya finally conceives their daughter, Noah nearly passes out from hearing the news.

When Baby Slade is born, no one loves and dotes on her like Marko does. Whatever she wants, she will get.

A 12-year age difference means Marko is very protective of her.

Baby Slade is fawned over by her father and spoiled rotten by both the Slade men.

When she starts pre-school, Noah is a rare father in the hordes of mothers trying to get his wailing daughter to go inside.

Noah does not notice all the women fanning themselves when his daughter rushes into his arms but Maya having already witnessed this during Marko’s preschool does after which Papa Slade is banned never to pick his daughter up alone.

Maya sings her daughter to sleep in spanish most nights.

Baby Slade follows everything her older brother does -

Starts writing with her left hand because “Koko” does.

Wants her hair styled like Koko’s.

Wants to race as well as Koko (cue heartbroken Noah).

When her date for prom does not show up, Marko flies in on the eve of a Grand Prix to take her and flies her out for his race later the next day.

The older she gets, the more she teases her brother about his one-sided love.

They are openly proud of each other’s achievements; he posts about the school awards she’s won on his stories, and she always keeps tracks of her big brother’s races.

Maya loves how they are as close as Santi and her.

Her first boyfriend has to be escorted out of their home, sniffing and on the verge of tears, by an apologetic Maya thanks to the Slade men drilling him incessantly.

After which Noah and Marko have to earn the youngest Slade's affection back and ask for forgiveness not less than a hundred times.

Tio Santi is her favorite adult and like her older brother, she loves calling him her superhero.

Both Slade siblings are fluent in atleast 3 languages. Their motto is - Spanish, sexy and Slade.

No matter how old they get, Noah still calls Marko “monkey” and his daughter “princess”

No matter how old they get, the Slade children never not love how involved, cherished and loved their parents make them feel.

No matter how old they get, Noah and Maya still dance in the kitchen to soft music with dimmed lights constantly reminding each other how loved they are and how there is no other place they’d rather be.

THIS WAS A LOT LONGER THAN I PLANNED FOR IT TO BE AND BY THE END OF IT I DIDN’T PLAN TO GET SO EMOTIONAL. THIS SERIES MEANS SO MUCH TO ME AND I LOVE ALL THE CHARACTERS SO MUCH THAT IT IS OVERWHELMING AT TIMES

This story starts a year after liam leaves the Mccoy team .

#Characters

*Jax Kingston - The kindest person i have come across yet from the dirty air series. The pouty lips, hazel eyes man with frizzy hair and soft curls. One who can play piano. Loves his parents the most. He loves sunrises and gets up early to see one everyday because he believes that everyday is a new start.

One thing that Jax kingston is hiding from most of the people around him in his daily life is his anxiety issues, and the main reason for them. Although he wants to be good, but it is like his defence mechanism to keep his worries at bay. He has negative views because of his mom's Huntington's disease. He feels he shouldn't bother her, or making memories with her is useless because later there will be nothing. She will wither away and it will all be too much for him to bear. Therefore he keeps to himself and his career, but then his anxiety leads him to taking too many pills and sometimes he consumes alcohol which leads him to do humiliating things in public.

This year elena is coming to take care of him, but he thinks its a bad idea, because as soon as she comes into his life, he can't resist her, she is interesting and annoying and her smile makes him forget his worries, and the worst of all is she makes him calm, he doesn't need his pills when she is around. She is a bad news for him according to him because he feels he doesn't deserve someone to love, someone by his side because he will burden them, a total nuisance.

Jax is full of anger, frustration, he "hates himself and has never ending worries which is a dream team of worst kind". He is afraid of getting himself checked for the huntington's disease because he is afraid to know that all that he holds dear in life, everything and everyone will be forgotten one day and he will wither away. He doesn't want someone to just let them go through the pain which he and his father is going through and someone who would have to take care of him all their lives till he forgets them and dies.

He is forced to tend to a sport psychologist Tom, who helps him overcome his own voices. He gets attached to elena during his schedule and they both end up in his house for the vacation. He realises that he is too deep in love with this woman, who writes notes for him so he doesn't have to take his pills. Woman who is knocking on his heart and mind without invitation. During their vacation he sees his mom, dad and elena bond. His mom is a reader( yes she is a part of us) and well she is a total romantic finatic. She tells him that elena is the one for him and that their story is the perfect hate to love story which they can tell their kids one day 😉.

As Jax and Elena's relation takes turns he wants to get checked because he feels positive and he wants to be sure of this disease and the future that he is dreaming of. But the worst happens and he gets a positive report because of which he distances himself from elena. But you know when elena doesn't give up on him, he comes through on the last day of the grand prix. He also gets most of his support from his best friend Liam, who makes him realise that he is losing something wonderful, because he is afraid of losing it in the future which is far away, and that he deserves love, to be happy, to feel and share. At the end he overcomes his anxiety a lot, he leaves racing and directs his attention to getting better and his family/friends. He proposes to elena when both of them have gone to much to and fro from his place to hers (different countries) and decides to surprise her. He adds a new shelf of snowglobes ( elena's hobby of collecting globes of memories as souvenirs) ,one each of the notes she had given him in this pill bottle and one special globe with her favorite song (Thinking out loud by ed sheeran) and there is a note asking her to marry him. He doesn't want to wait anymore for something he knows will happen sooner or later and spend anymore time away from her. In the end he builds a house with all of their dream points. One with pool, treehouse, golf course, piano, library and more.

I love Jax because his character teaches that one should cherish everything in their lives, and never give up on a chance of happiness. And everyone deserves a beautiful life, a partner to love, memories to hold forever.

*Elena Gonzalez - She is the perfect mix of her parents best features with dark natural wavy hair, average height, brown eyes with long lashes and lots of curves. A girl who loves rain but hates darkness ( or rather is scarfed of it). Her dad was ambassador for mexico and mom a housewife, both murdered in cold blood, shot in the dark when she was little and hiding in a cupboard to read her favorite bedtime story.

Well this little girl and her dad saw a dream together, to let her study abroad (u.s), so while she was living with her grandmother she took a loan and went to the U.S. It was very difficult to replay a big loan and work and also take care of your grandmother who was suffering from alzheimer's disease. It was too much making ends meet every month, to pay rent and hospital bills altogether. She established herself and made it into PR business. And thanks to her very sweet Gay friend(Elias and yes we love gay people they are the sweetest), she gets into PR business with the formula one teams. Elias is her best friend forever is a new F1 driver along side Jax kingston. Last time elena comes to help liam for a month to help him and this year again when she needed help god listened to her and sent her to jax's way. But this time is different, jax is a person she can't stand, also this year she has to share the room with him and stick to him like a glue even during the holidays( specially because he tends to do awful things for his reputation).

In the start she doesn't get to know about jax's anxiety problem as he chooses to not to tell her, but she after some time she makes sure to know everything about him. Both of them always argue in the morning and evenings when they are around each other in the room (two seperate bedrooms). Elena does her best to make jax seem a good guy other than on the racing track, she organizes these PR events, which includes donations, charity events for him as well as other friends of his who are also in the sport (maya/noah, elias, liam/sophie), as they are famous and rich so people tend to follow them and this helps with their rep. As she keeps getting to know jax she realises he is a good and kind person, and is hard only on the outside, and she somehow always finds herself looking for him, and his attention.

Elena finds herself lonely whenever she is around the friend group. She never really had friends except elias, she was always busy studying and making money to survive. She always knows how to keep herself busy, even in the private plane that they use for the racing schedule, she indulges in a ridiculously large puzzle which jax finds very disturbing and too colourful. She helps jax fight his anxiety by anonymously making him attend psychology sessions every weekend. She knows that whenever he is on a call with his family he gets anxious the most. She gets to know about his mother's disease when she accompanies him to his house for the holidays. She bonds so well with his mother and father both. They celebrate jax's birthday at his home and also she gets to have a heart to heart conversation with his mother, because she seems to get the feeling that they are meant for eachother and jax seems to be himself when he is with her, she tells elena about marriage and love and how it makes a person stronger.

However, other than all of this there are dark days for elena too. The girl who loves rain and keeps a snowglobe for each of her memories in life. She is in deep pain, for her grandmother who doesn't seem to recognize her every time she visits her, rather refers her as her mother and always ask about her father as well, which brings a lot of memories and pain for elena. There are days she spends alone with herself, remembering her parents on their death anniversary. And once when jax mistakenly switches off her room lights thinking she slept without noticing them, she awakens so scared and with a scream. That night jax soothes her and sleeps with her. Elena always finds relief and stillness in jax. They make each other better everyday.

Overall, it is a closed proximity, sports romance book. It contains a lot of triggers, i actually had tears in my eyes in several intervals because of Jax specially. I love how family is also a part of this book. It is shown that they are important for each other, their love gives them strength each day to move forward. Other than being a romance novel, it gives us a clear image of how a person cannot be pulled down by their health, disease. You can find happiness in a person. They help each other overcome fears, and they hope and dream together for a brighter tomorrow even if it is concrete they make beautiful memories today because one can never and should never forget to live their present in the fear of tomorrow. And remember "when someone tries their best and refuses top give up on you, you try to be better and work on it". For them and yourself.

**Fun Fact -Jax gets jealous of Elias and gets embarrassed about it when he gets to know that Elias is gay and just her best friend. 🙈🙈

If asked what did she truly loved doing with her time, she would reply music. It had encompassed her life since she was a young girl living in Guadalajara. Maria Elena remembered her mother singing soft lullabies for her when she was just a baby and how the music had been all but stolen from her when the woman had unceremoniously passed away, leaving behind a lot of heartache. In her attempts to grasp bits of her mother, and maybe to be more like her than her drunk and deadbeat father, Maria Elena had all but continued with their little tradition, still singing the same songs her mother once did to her, except now, her sometimes not so eager audience was on the sidewalks and tourist-y points of London, where she'd run off to in search of a better life, with all her siblings on her coattail. If anything, being the eldest of many made her think first and foremost about them which kept her way down on the bottom of the barrel, so to speak.

Putting her vintage Hummingbird on the case, Maria Elena sat down on the sidewalk to count the bucks that had been thrown there while she was performing. It hadn't been so bad this time around. There were a few bucks and a card with a phone number of a supposed music producer. She had fallen on those more than she cared to admit. Call it hopeful or naive, at that point, she didn't really care. Maria Elena didn't look up until a shadow blocked the lamppost from illuminating her. Glancing at the culprit, Maria cleared her throat. "Uhm━ hi," she had a small smile on her lips, "think you can scoot over a few steps? I could really use some light right now."

" I look up at the star-filled sky, tears pricking my eyes as I think of my parents. “When will it get easier? Every year I try to pretend it’s okay, but instead I end up avoiding everyone. I feel guilty I’m here while you both aren’t. MEXICO CITY.- In a conference called by Senator César Cravioto to address the legal issue of the María Elena Ríos trial, and after a series of rumors that the activist herself admitted, the saxophonist accepted the possibility of being nominated by Morena for a candidacy for a federal deputy, for which he expressed his willingness to participate through the survey process.

“If the Mexican people wanted me to represent them, it would be through a survey and it would be through principles, not Western principles, principles from this India,” he highlighted.

For his part, Senator César Cravioto admitted that the activist has every right to seek a candidacy in her party: “In Morena, candidacies do not occur. In Morena, all candidates go through surveys and, as a citizen, if she wants to compete in a survey she has every right, because she has also gained a lot of social recognition.”

However, Senator Cravioto said that the conference had not been held “for any candidacy,” while the activist clarified: “I clarify, it is not my interest. “I am a student, I am a proud saxophonist from UNAM.”

For her part, the activist's lawyer, Diana Cristal Gonzalez Obregón, justified the removal of Judge Teódulo Pacheco from her client's hearings, despite what was established in the resolution of the Collegiate Chamber of the Superior Court of Justice of Oaxaca, which determined: “As can be seen from the audio and video of the hearing to review the precautionary measure, chaired by the Control Judge Teódulo Pacheco Pacheco, it is noted that the direct victim referred insults and accusations to him, a situation that implies violence against authority, transgressing the right conferred by Article 5.1 of the American Convention on Human Rights.”

Finally, Senator Cravioto asked the media not to victimize the Judiciary of Oaxaca and the activist reiterated the request to appoint a collegiate court for the development of her process, in addition to requesting a new removal, now of Judge María Teresa Quevedo Sánchez.

Before this story goes on I suppose we should go back to the beginning. The first time I met Pedri and Gavi.

The first one, Pedri, I met three months ago…

I was getting ready for my friend, Val’s birthday party. Val and I had known each other for years. Our fathers worked with Barça and our families had always been close, but she and I had only gotten closer when we started uni, a year ago.

I was putting on my earrings when my mom, Elena, walked into my room. -Guapa! That dress looks beautiful on you.- she said. I smiled and turned around. -It’s not too much?- I tugged down at the hem of the dress. She rolled her eyes and smiled. -Sara, it looks amazing on you.-

My mom stood there and smiled as I put on my heels. -You’re making me nervous.- I said. My comment was met with a low chuckle from my mom.

-I’m just excited you’re finally going out.- she said as she walked closer to me. She placed a small kiss on my cheek. -Be safe but have lots of fun. Dad is ready to take you if you want.- She began to walk towards my bedroom door.

I smiled at my mom as I grabbed my purse and told her I would be downstairs in a few minutes. I looked at the mirror one last time and added lipstick before putting my phone in my purse and walking out.

My dad drove to the front of the club and dropped me off. -I’ll take a car back home.- I told him, as I placed a kiss on his cheek, so he wouldn’t worry and began to walk into the club.

The club was dark and the music was blasting. I looked around and quickly found the stairs leading up to the private parties where Val and a few others were already dancing.

-Felicidades, Amiga.- I said when I found Val and took her in for a hug. Val was already a few drinks in. -Sara, Sarita … you look so hot.- I blushed as she spun me around. -Stop, Valeria!- we both laughed and hugged again.

I went over to the bar to grab a drink as I watched Val dancing. I knew I could never be as free as she was. I had always been shy compared to her. She lit the whole room with her laughter. I sat down and began to make conversation with a few people around me. Suddenly I was startled by Val’s hand trying to pull me out of my seat.

-Put the drink down.-

-Val, wait … what’s going on?-

-Vamos Sara! There’s someone I want you to meet.- Val dragged me to the middle of the dance floor and we stopped in front of a young guy who was looking down at the floor. When he senses our presence he looked up and smiled.

He was wearing dark blue pants with white sneakers, a white shirt and a Jean button up over it. He smiled nervously as he looked at me. I bit my bottom lip. Val stumbled over to him and said something into his ear which caused him to smirk. I stood there looking at both of them. Val walked over to me and yelled over the music -This is Pedri. He’s hot. Show him a good time.- she winked causing my cheeks to begin to burn imagining what she had told him. Val began to walk out of the dance floor leaving us both, two complete strangers, standing in front of one another.

I took a small step to come closer to him.

-Pedro Gonzalez.- he said as he took my hand.

-Sara Torres.- I smiled. When our hands met it sent electricity all over my body.

-Would you like to dance?- I asked as I began to move my hips to the rythm of the music.

-I would love to but you’ll have to help me.- he said nervously as he chuckled.

He followed my lead and began to move to the rythm of the music. We laughed at how awkward he was being.

-I have two left feet.- he said.

-Nothing we can’t fix with a little practice.- I said as I continued to move with him. His eyes met mine and he smiled.

After a few songs I led Pedri back to the bar to grab a drink. He held on to my fingers as I lead the way. I could feel him staring at my legs. I turned around catching him by surprise and he smirked. When we got back to the group we saw Val dancing on top of a table. Pedri and I looked at each other and began to laugh.

-Is she always like this?- he asked taking a sip of his drink. I giggled.

-Only when she’s having fun.-

-You two seem very different. I can’t believe you’re best friends.- he said.

-We’re like night and day.- I said.

-So you won’t be dancing on top of the tables anytime soon, I suppose?- I looked over at Pedri and shook my head.

-That might be for another time.- he smirked sending butterflies to my stomach.

The boy was gorgeous and the more I looked at him the more butterflies I felt. He took another sip of his drink, liquor courage, and leaned into my ear. -You’re unbelievably beautiful, you know that?- I felt myself blush and looked over at him with a smile. I placed a small strand of hair behind my ear as I looked down at the ground. His stare still on me.

A few minutes later Pedri and I were once again on the dance floor. Pedri had gotten better or maybe now he just felt more comfortable with me.

This time with a little more confidence I got closer to him. I could smell his cologne. I placed my arms around his neck as we both began to move in unison. He was nervous and didn’t know where to place his hands. I moved my hips and got closer to him. His breathing was much closer to me now. I looked up at him and smiled. It was almost as if he had been waiting for that moment, that sign. He took one step closer and placed his hands around my waist. My breathing became heavier.

As the song continued Pedri’s hands began to go lower on my body eventually arriving at my upper leg creeping closer to my inner thighs from behind. His mouth close to me, his eyes piercing through mine. The club was hot but Pedri’s hands felt cold and sent shivers down my body.

The club was full of strangers and the music played loud but in that moment it felt as if it was just Pedri and I. I looked up at him. I wanted to forever remember his eyes, his eyebrows, his nose, his lips, all of him. He leaned down and our noses touched. He lifted my nose up a bit with his and he continued on to my lips for a quick kiss. I felt as my heartbeat began to rise. I smiled as Pedri’s lips left mine and we continued to dance.

Pedri didn’t leave my side for the rest of the night and I didn’t mind it. We danced and laughed as we celebrated my friend. At one point taking pictures with my phone as he draped his arm over my shoulder and I laughed letting my hair fall over a part of my face leaning in against him.

Slowly the club began to get empty.

-It’s getting a little late.- I told Pedri as he took a sip of his drink. Before he could say anything Val approached us.

-Sarita. I’m going home. Do you need a ride?- She held her boyfriend, Marco’s hand. I smiled and told her to enjoy her night. I saw how eager Marco was to leave and I was sure they wouldn’t be going back to Val’s home. -I’m going to order a car.- I said as I hugged Val and gave her a kiss on her cheek.

She walked over to Pedri and gave him a hug as well. -Thanks for coming, Pepi. Take care of Sarita.- She winked. Pedri smiled and said his goodbyes. I rolled my eyes at Val as she grabbed Marco’s hand and the two began to walk away.

-Did I hear right? You’re ordering a car?- asked Pedri as I took my phone out of my purse. I nodded. He placed his hand towards my phone. -Let me take you home.-

Minutes later I was getting into Pedri’s car. He started to drive after I gave him my address. The windows in the car were rolled down a little allowing a small breeze to come in and hit my body. The club had been so hot I could feel as the sweat was drying up with the breeze. I looked out the window.

No matter how long you live in Barcelona, the nights in the city were always magical. They were breathtaking. Like the boy sitting next to me.

I looked over at Pedri and kept my gaze on him.

-You know it’s bad manners to stare.- he said catching me off guard and causing me to blush. Maybe I wasn’t being as subtle as I thought I was. I smiled.

-I’m sorry.-

-Is there something on my face?- we both chuckled.

-No, it’s just th- before I could go on Pedri interrupted me. -You don’t have to answer that. I’m just giving you a hard time.-

Nemesis by Quevedo began to play in the car. I began to sing and Pedri looked over at me with a smile asking if I liked Quevedo. I nodded. -This song always breaks my heart.- I said.

-Who broke your heart?- Pedri asked.

-No one yet.- I responded wanting to add, no … wanting to plead to Pedri that he wouldn’t the first.

Pedri continued to drive as we both sang. Before I knew it Pedri was turning into my street. I grabbed onto my purse thinking he would stop right in front of my house and let me off. To my surprise he drove past my house and parked under a tree. He turned his car off.

I undid my seatbelt and turned over to face him. -Gracias.- I smiled. -I had a good time tonight.- Pedri smiled but said nothing. I’m not sure what I was expecting but it had been more than a smile. I turned around to open the door to his car and I felt a hole in my stomach. Suddenly I felt as Pedri’s hand tugged at mine. -Espera.- wait he said.

I turned around to face him and as soon as my body turned his lips came crashing down on mine. The one thing I had been craving since he had first kissed me hours ago at the club. His kisses were sweet and innocent but at the same time full of passion. I felt as his tongue darted into my mouth. His hands cupping my face. He moved his seat back a little and helped lift me over onto his lap. I looked at him for a second before our kisses continued. I could have gotten lost in his beautiful brown eyes.

I began to leave small nibbles on his neck. He threw his head back. His hands moved slowly up my legs until they got to my thighs. He slowly pushed my dress up revealing my underwear. I felt as his hands went to my ass and he helped me move against him. His tongue inside of my mouth. I could feel him getting harder under me.

His hands went to my waist and he twisted his fingers on the side of my underwear. I continued to move over him. -I wish I could take you home.- he growled.

-Pedri.- I said as he pulled my underwear down a little now resting halfway over my ass. I continued to grind into him as I let out small moans which quickly began to fog up the car windows.

He knew I lived with my parents and taking him up to my room wasn’t an option. And I knew leaving to his house wasn’t an option either. We continued to kiss. But Pedri knew better, I knew better despite both of us wishing we could let our desire control us for the next few minutes. After a few more kisses I managed to get off of Pedri’s lap. I pulled my dress down.

-Hope to see you soon.- I said as I looked over at him and placed a small kiss on his cheek. He smiled back. I grabbed my purse and opened the door. This time he didn’t hold me back. I felt the cold air hit my body as I stepped out of his car. I heard the door close shut and then as the car drove away.

I went to bed that night thinking of the way he touched my skin. The way his lips made mine their captive. My dress still smelled a little like him. I wanted to see him again. I couldn’t wait to see him again.

The next morning I was woken up by a call from Val.

-What?- I groaned into the phone.

-You must have left a good impression on him.- she said. I could hear her giggling.

-What happened?- I asked finally opening up my eyes and sitting upright on my bed. The light from the sun was shinning in through my curtains.

I smiled from ear to ear when Val told me Pedri had texted her asking for my number earlier in the morning. -He woke up thinking about you, Sarita.-

-It’s only fair. I thought about him all night.- I said as I proceeded to tell Val about everything that had happened between Pedri and I after leaving the club. Omitting some intimate details like him pulling my underwear down a bit.

-Shut up.- she yelled at me through the phone. -And you didn’t go home with him?-

-I couldn’t. My parents were waiting for me and they would have called your parents if I said I was going with you.-

-Well my parents thought I stayed over at yours.- she laughed. -So I guess it was good you didn’t say that.-

-I was just being a good friend.- I said to Val who responded with a grunt. -Sara, next time that Pedri Gonzalez tells you he wants to take you home, you go home with him, do you understand?- we both began to laugh.

I spent the rest of the day waiting for a message or a call to come in. But it never did. I thought about asking Val for his number but something told me not to. As each day passed and Pedri made no attempt to reach my hope died. Eventually, days later, a message did come in from him… but maybe by then it was too little too late.

When the US Supreme Court agreed to hear Gonzalez v. Google, its first case involving Section 230 of the Communications Decency Act, the tech-policy world was laser-focused on its implications. The week before oral arguments, in February last year, the Brookings Institution held a panel touting the case’s “power to reshape the internet.” The New York Times wrote that the case “could have potentially seismic ramifications for the social media platforms that have become conduits of communication, commerce and culture for billions of people.” Google’s general counsel wrote that the “decision could radically alter the way that Americans use the internet.”

Those predictions fell short a few months later when the court released its opinion and completely punted on any interpretation of Section 230, the 1996 law that protects platforms from liability for user content. In a 2019 book, I called this statute “the twenty-six words that created the internet,” because it gave internet companies the flexibility to build their business models around user-generated content. As tech companies gained more power, critics on the left and right increasingly attacked the law, which they see as a get-out-of-jail-free card. But the Supreme Court was reluctant to resolve the heated debate. “We really don’t know about these things,” Justice Elena Kagan said during oral arguments. “You know, these are not like the nine greatest experts on the internet.”

Despite their reluctance to decide lofty cyber issues, there is a good chance that another internet law dispute will come before the justices in the next year. And this time, it will be difficult for them to avoid directly deciding the issue and having a huge impact on how the internet looks for decades to come.

The disputes involve two similar Texas and Florida laws which both restrict platforms from moderating certain speech and require transparency about user content policies. The Texas law, for example, states that large social media platforms “may not censor a user, a user’s expression, or a user’s ability to receive the expression of another person” based on viewpoints or the users’ location. NetChoice, a group representing tech companies, has challenged both laws.

Last year, the US Court of Appeals for the Eleventh Circuit struck down Florida’s moderation restrictions. Judge Kevin Newsom wrote that platforms’ content moderation choices “constitute protected exercises of editorial judgment,” so the law likely violates the First Amendment. But later that year, the US Court of Appeals for the Fifth Circuit upheld the Texas law. “Today we reject the idea that corporations have a freewheeling First Amendment right to censor what people say,” Judge Andrew Oldham wrote.

The Florida and Texas laws are not identical, but it is impossible to reconcile the courts’ opinions. In the Eleventh Circuit, tech companies have a First Amendment right to moderate user content as they see fit. In the Fifth Circuit, they do not. Lawyers refer to this problem—having different legal rules depending on what part of the country you’re in—as a “circuit split.” And a circuit split is particularly problematic for issues involving the internet, which reaches across state borders.

The Supreme Court receives more than 7,000 requests to review lower court decisions each year, and typically grants less than 1 percent of them. But the chances of the Supreme Court reviewing the NetChoice cases are greater than those of an average dispute. A circuit split—particularly a high-profile one such as this—makes the Supreme Court more likely to take interest. Assuming that the court agrees to hear the cases, we could expect an opinion next June.

A Supreme Court opinion in the NetChoice cases, far more than Gonzalez v. Google, has the potential to upend the laissez-faire approach that courts have applied since the internet’s infancy. The NetChoice cases are about more than just liability in lawsuits; they will require the Supreme Court to decide whether online platforms have a First Amendment right to moderate user content.

No court had ever before allowed the government to force websites to publish speech. “If allowed to stand, the Fifth Circuit’s opinion will upend settled First Amendment jurisprudence and threaten to transform speech on the internet as we know it today,” NetChoice wrote.

Platforms should be free of any direct or indirect government restrictions on their ability to distribute constitutionally protected user-generated content, even if that content is distasteful or objectionable. But the platforms also should have the flexibility to set their own policies, free of government coercion, and create the environments they believe are best suited to their users. The free market—and not the government—should reward or punish these business decisions.

The outcome of the cases could reach far beyond content moderation disputes. NetChoice repeatedly relies on a 1997 Supreme Court decision, Reno v. ACLU, to argue that the Florida and Texas laws are unconstitutional. In Reno, the Supreme Court struck down a federal law that restricted the online transmission of indecent images. The federal government had argued that just as the government can restrict television stations from broadcasting indecent content, it also could limit such material on the nascent internet. But the Supreme Court disagreed. The internet, the Court wrote, is “a unique and wholly new medium of worldwide human communication.”

This conclusion led the justices to rule that the internet is not like broadcasting, and deserves the full scope of First Amendment protections. “As a matter of constitutional tradition, in the absence of evidence to the contrary, we presume that governmental regulation of the content of speech is more likely to interfere with the free exchange of ideas than to encourage it,” the Court wrote. “The interest in encouraging freedom of expression in a democratic society outweighs any theoretical but unproven benefit of censorship.”

But that was more than a quarter-century ago, when online platforms were not as central to everyday life and business. Big Tech back then was Prodigy, CompuServe, and AOL. The Supreme Court could use the NetChoice cases to rethink—and possibly limit—the hands-off approach to the internet that it articulated in Reno. Texas, for instance, argues that platforms should receive the less rigorous First Amendment protections that are afforded to cable companies.

Weakening Reno could open the door to more state attempts to force platforms to carry user content that the platforms believe violates their policies. But it would do more than that. If the Supreme Court were to conclude that First Amendment protections are weaker on the internet, it might allow other states to pass laws that make it more difficult for certain users to post, or that prohibit user content that would otherwise be constitutionally protected.

This is not hypothetical. In the past year, some states have passed laws that require all social media users to verify their ages, threatening the ability of people to post anonymously. Blue states have proposed bills to crack down on misinformation, hate speech, and algorithms. While these proposals could face substantial First Amendment obstacles under current precedent, they might be more likely to survive in a world without Reno.

Had the Supreme Court’s ruling in Gonzalez caused substantial harms, Congress could have stepped in and fixed the problems by amending Section 230. But because the First Amendment—and not a statute—is at the heart of the NetChoice cases, the Supreme Court’s ruling will be the final word. So it’s vital that the justices, regardless of whether they actually are the nine greatest experts on the internet, get this one right.
