Barely a day after former President Donald Trump was indicted for the third time, some Senate Republicans are already trying to undermine the credibility of the federal judge who was randomly assigned to preside over his trial.
Here’s a detail they’re hoping you won’t notice: They unanimously voted to confirm her.
Sen. Ted Cruz (R-Texas), speaking on his podcast on Wednesday, accused U.S. District Judge Tanya Chutkan of being “relentlessly hostile” to Trump and claimed that she has “a reputation for being far-left, even by D.C. District Court standards.”
But Cruz voted to put Chutkan into her seat on the U.S. District Court for the District of Columbia in June 2014. So did every other Senate Republican when she was unanimously confirmed, 95-0.
That includes Sen. Lindsey Graham (R-S.C.), who nonsensically claimed Wednesday that “any conviction in D.C. against Donald Trump is not legitimate.”
“The judge in this case hates Trump,” Graham said in a Fox News interview. “You can convict Trump of kidnapping Lindbergh’s baby in D.C. You need to have a change of venue. We need a new judge. And we need to win in 2024 to stop this crazy crap.”
Aides to Cruz and Graham did not respond to requests for comment on how the senators square their votes to confirm Chutkan with their criticisms of her ability to be a fair judge.
Tuesday’s federal indictment of Trump accuses him of serious crimes related to the 2020 presidential election and the Jan. 6, 2021, Capitol insurrection: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Chutkan, a Jamaica-born former assistant public defender and an appointee of former President Barack Obama, has already been overseeing cases related to the Jan. 6 attack. She’s handed out some of the most aggressive sentences yet to rioters who took part in the violence that day. Of the 11 cases that have come before her, she imposed tougher sentences than those sought by the Justice Department seven times and matched what the Justice Department was seeking four times, according to an Associated Press review.
In all 11 cases, Chutkan sentenced the defendants to prison time.
This is what is likely driving the GOP attacks on Chutkan: They know she’s not likely to go easy on Trump now.
Beyond trying to discredit the judge, some Republicans, like Graham, are parroting Trump’s absurd demand for a change of venue. The former president has called for moving his case to the “more diverse” and “politically unbiased nearby State of West Virginia!” (Virginia and Maryland are much closer to D.C., for what it’s worth.)
Not a single Republican raised concerns about Chutkan during her nomination hearing in the Senate Judiciary Committee in February 2014. In fact, only one GOP member of the committee even showed up to the hearing: Sen. John Cornyn (Texas), who was only there to rave about a separate Texas judicial nominee on the schedule. He left before Chutkan was up.
Cruz and Graham were both members of the committee at the time.
Neither attended Chutkan’s hearing.

 Former President Trump is still the dominant figure in the Republican Party but his stranglehold is loosening.

Trump-backed candidates have had a mixed record in GOP primaries so far this cycle, with high-profile losses in Georgia, Nebraska and a key South Carolina district undercutting many other wins.
The work of the House Select Committee on Jan. 6 also places Trump’s role in the insurrection squarely in the spotlight. 
To be sure, Trump leads early 2024 polls by a wide margin. But there is no guarantee that the ever-unpredictable Trump will enter the race. And there is a growing consensus among Republican insiders that, if he does so, he will face a serious challenge.
So, if the 2024 GOP nominee ends up being someone other than Trump, whom might it be?
Florida Gov. Ron DeSantis
DeSantis is Trump’s most serious rival at this early stage. 
The Florida governor has a multilayered appeal. Conservatives loved his pushback against mask and vaccine mandates during the pandemic. He has embraced the culture wars with vigor, including his advocacy of legislation that liberal critics dubbed the “Don’t Say Gay” bill.
The mere fact that DeSantis sparks such ire from left-leaning voters is almost certainly an asset in a GOP primary.
More concretely, DeSantis is a prodigious fundraiser. He surpassed $100 million in his reelection war-chest this spring.
Some figures close to Trump believe DeSantis could be scared off, and would be reluctant to enter a head-to-head race with the former president.

Donald Trump faces more than 30 counts related to business fraud in an indictment from a Manhattan grand jury, according to two sources familiar with the case -- the first time in American history that a current or former president has faced criminal charges.
Trump is expected to appear in court on Tuesday.
The indictment has been filed under seal and will be announced in the coming days. The charges are not publicly known at this time.
Manhattan District Attorney Alvin Bragg's office has been investigating the former president in connection with his alleged role in a hush money payment scheme and cover-up involving adult film star Stormy Daniels that dates to the 2016 presidential election. Grand jury proceedings are secret, but a source familiar with the case told CNN that a witness gave about 30 minutes of testimony before it voted to indict Trump.
The decision is sure to send shockwaves across the country, pushing the American political system -- which has never seen one of its ex-leaders confronted with criminal charges, let alone while running again for president -- into uncharted waters.
Trump released a statement in response to the indictment claiming it was "Political Persecution and Election Interference at the highest level in history."
"I believe this Witch-Hunt will backfire massively on Joe Biden," the former president said. "The American people realize exactly what the Radical Left Democrats are doing here. Everyone can see it. So our Movement, and our Party -- united and strong -- will first defeat Alvin Bragg, and then we will defeat Joe Biden, and we are going to throw every last one of these Crooked Democrats out of office so we can MAKE AMERICA GREAT AGAIN!"
Trump was caught off guard by the grand jury's decision to indict him, according to a person who spoke directly with him. While the former president was bracing for an indictment last week, he began to believe news reports that a potential indictment was weeks -- or more -- away.
"Is this a shock today? Hell yes," the person said, speaking on a condition of anonymity as Trump's team calculated its response.
Bragg's office said it is in touch with Trump's lawyers.
"This evening we contacted Mr. Trump's attorney to coordinate his surrender to the Manhattan D.A.'s Office for arraignment on a Supreme Court indictment, which remains under seal," the district attorney's office said in a statement Thursday. "Guidance will be provided when the arraignment date is selected."
The legal action against Trump jolts the 2024 presidential campaign into a new phase, as the former president has vowed to keep running in the face of criminal charges.
Trump has frequently called the various investigations surrounding him a "witch hunt," attempting to sway public opinion on them by casting himself as a victim of what he's claimed are political probes led by Democratic prosecutors. As the indictment reportedly neared, Trump urged his supporters to protest his arrest, echoing his calls to action following the 2020 election as he tried to overturn his loss to President Joe Biden.
Trump has long avoided legal consequences in his personal, professional and political lives. He has settled a number of private civil lawsuits through the years and paid his way out of disputes concerning the Trump Organization, his namesake company. As president, he was twice impeached by the Democratic-led House, but avoided conviction by the Senate.
In December, the Trump Organization was convicted on multiple charges of tax fraud, though Trump himself was not charged in that case.
Trump's Republican allies -- as well as his 2024 GOP rivals -- have condemned the Manhattan district attorney's office over the looming indictment, and House Speaker Kevin McCarthy has vowed to launch an investigation into the matter.
GOP RALLIES TO TRUMP'S DEFENSE
Congressional Republicans quickly rallied to Trump's defense, attacking Bragg on Twitter and accusing the district attorney of a political witch hunt.
"Outrageous," tweeted House Judiciary Chairman Jim Jordan of Ohio, one of the Republican committee chairmen who has demanded Bragg testify before Congress about the Trump investigation.
Sen. Ted Cruz, a Texas Republican, called the indictment "completely unprecedented" and said it is "a catastrophic escalation in the weaponization of the justice system."
But at least one moderate Republican told CNN he trusted the legal system.
"I believe in the rule of law. I think we have checks and balances and I trust the system," said Rep. Don Bacon of Nebraska.
"We have a judge. We have jurors. There is appeals. So I think in the end, justice will be done. If he's guilty it will show up. But if not, I think that will be shown too," Bacon told CNN.
INVESTIGATION BEGAN UNDER CY VANCE
Bragg's office had signaled as recently as early March that they were close to bringing charges against Trump after they invited the ex-president to testify before the grand jury probing the hush money scheme. Potential defendants in New York are required by law to be notified and invited to appear before a grand jury weighing charges. But Trump ultimately declined to appear before the panel.
The long-running investigation first began under Bragg's predecessor, Cy Vance, when Trump was in office. It relates to a $130,000 payment made by Trump's then-personal attorney Michael Cohen to Daniels in late October 2016, days before the 2016 presidential election, to silence her from going public about an alleged affair with Trump a decade earlier. Trump has denied the affair.
At issue in the investigation is the payment made to Daniels and the Trump Organization's reimbursement to Cohen.
According to court filings in Cohen's own federal prosecution, Trump Organization executives authorized payments to him totaling $420,000 to cover his original $130,000 payment and tax liabilities and reward him with a bonus. The Trump Organization noted the reimbursements as a legal expense in its internal books. Trump has denied knowledge of the payment.

China's government can use TikTok to spy on American users and push propaganda at alarming levels, senators who received a classified briefing on the social media app told Axios.
Why it matters: The senators were hesitant to give details about Wednesday's briefing, but said Americans would be frightened by TikTok's ability to access and track their personal data.
One senator said national security officials described how China can harvest user data and weaponize it through propaganda and misinformation.
Another lawmaker said they were told TikTok is able to spy on the microphone on users' devices, track keystrokes and determine what the users are doing on other apps.
The big picture: Senate leaders are weighing what to do with a bill that would force China-based ByteDance to sell TikTok or face a ban in the U.S. The House passed the bill overwhelmingly last week after its members received a similar security briefing.
It's unclear whether the briefing from the FBI, Justice Department and the Director of National Intelligence office was a needle-mover for senators who may be skeptical of the bill.
What they're saying: Sen. Richard Blumenthal (D-Conn.) told Axios the briefing's "level of detail and specificity was extremely impactful."
Sen. Ted Cruz (R-Texas) said the briefing was helpful in "bringing some members up to date with the threats that China poses through TikTok."
"Their ability to track, their ability to spy is shocking," Sen. Eric Schmitt (R-Mo.) said.
Reality check: Such warnings from federal officials so far haven't been enough for senators to fast-track the bill.
Sen. Mark Warner (D-Va.), chair of the Intelligence Committee, said Thursday that it would take longer than the eight days it took for the bill to clear the House because that's "just the way the Senate works."
The legislation has been referred to the Senate Commerce Committee.
Sen. John Hickenlooper (D-Colo.), a member of the committee, said the TikTok legislation is "something we should move faster on, not slower."
