“Parachute” Goes After YouTuber for Disparagement  
Marico Ltd., one of India’s leading FMCG (Fast Moving Consumer Goods) company, had recently filed an application at the Bombay High Court, seeking an interim injunction against Abhijeet Bhansali, a YouTuber/V-Blogger who operates the YouTube channel “Bearded Chokra”. It was alleged by Marico that Abhijeet Bhansali in his video, made comments disparaging or denigrating Marico’s Parachute Coconut Oil, thus infringing its trademark “Parachute”. The Bombay High Court while passing an injunction against Abhijeet held that there was unauthorized use of the trademark “Parachute” and under the garb of educating the public one cannot provide misleading information to disparage any product. The court also ordered to take down the YouTube video uploaded by Abhijeet and emphasised the need for higher responsibility on the part of a social media influencer.

OK Boomer Trademark Registration by Fox not Ok                  
Fox Media’s plan to cash in on the catchphrase OK Boomer seems to have hit a snag. The US Patent and Trademark Office (USPTO) in an initial office action, has denied trademark registration for the term. The American television network had filed an application for the registration of the trademark “OK Boomer” and had intended to launch a TV series under the same name. The USPTO while refusing the registration held that the term “OK Boomer” was a widely used message that merely conveyed ordinary concept or sentiment and did not serve any source indicating function. However, this is not a final denial by the USPTO. Fox now has six months to respond to the objections raised.
Cyprus Re-registers its ‘Halloumi’ Cheese Mark in the UK
Halloumi, a semi hard cheese, originating from Cyprus, has found its way back home. The Cypriot Ministry of Energy, Commerce and Industry, has regained the trademark rights for Halloumi (a certification mark for cheese produces) in the UK. The Cypriot ministry had first secured trademark protection for ‘Halloumi’ at the UK Intellectual Property Office in 1990. However, an application to invalidate the trademark had been filed by John & Pascalis Ltd, the largest importer of Cypriot cheese to Great Britain. Thereafter Cyprus ended up losing its trademark due as its Government failed to respond to the legal requests of the UK Intellectual Property Office in a timely manner. They have however now re-registered the Halloumi trademark in the UK and have also applied for the Protected Designation of Origin (PDO) status at the European Commission for their cheese products.

‘Co-Lab’ Launched by GQ India and Raymond
GQ India, the leading men’s lifestyle media and fashion brand, has collaborated with Raymond, the forerunners for men’s apparel in India, to launch ‘Co-Lab’, a new men’s apparel brand. Apart from providing cutting edge design for Indian men, the collaboration will also include events at its flagship stores, influencer engagements, interactive masterclasses, as well as fashion shows to promote the brand. The masterclasses will be held in New Delhi, Bengaluru, Kolkata and Hyderabad.
Freightliner Truck Vrooms into Sound Clocks
Mark Feldstein & Associates, Inc. (MFA), an American product development company has entered into a licensing agreement with Freightliner Trucks, a US based truck manufacturer, to bring out a new line of sound clocks. The deal was brokered by the corporate trademark licensing company Equity Management on behalf of Freightliner Trucks. Under the licensing agreement, MFA will design, manufacture and distribute wall as well as desk clocks. The initial products to be introduced in the market would include the clocks, featuring Freightliner Trucks on the dial and authentic truck sounds at the top of every hour. The merchandise will likely be in the market in the second quarter of 2020.

Mercedes-Benz Unveils New Dealership Concept in India
Mercedes-Benz, the German automobile giant has launched a new dealership, Christened Global Star, in New Delhi’s Green Park. It is the first showroom in the country which is based on the new brand presence in retail. The showroom is spread over an area of 12,000 square feet and intends to deliver top class facilities for which the brand is known for such as  hospitality lounge and bar area, as well as digital assets like a digital wall, interactive touch table, touch TV and a digital-spec stand. With the new showroom, the number of outlets for the German brand in India has gone up to 97.
DOMAIN NAME DISPUTE UPDATE
Italy’s Art Museum Uffizzi Galleries Claims its Domains
 Uffizzi Galleries (also called The Gallerie degli Uffizi), a prominent art museum located in the historic centre of Florence in the region of Tuscany, Italy, has won a legal battle against BoxNic Anstalt (an Arizona US based company) to protect its domain name www.uffizi.it. BoxNic Anstalt had registered numerous domains containing the word Uffizi including uffizi.com and uffizi.net through which they invited users to buy museum tickets online and skip the huge queues. The Arizona Federal Court has banned BoxNic Anstalt from using Uffizi’s name and logo and ordered the transfer of the domains to Uffizi Galleries.

Assamese Gamocha Filed For GI
Assamese Gamocha, a traditional textile product commonly known as Gamocha in Assam, has been applied for GI registration. The Gamocha is a rectangular piece of handloom weaved white cloth (known as Khioni in Assamese), having multiple thicker red coloured stripes along its side border (known as sotia in Assamese), multiple thinner red coloured stripes along its cross border (known as Pooli in Assamese) and mostly having red colour motifs along its cross border. It is primarily used as a sacred object at holy places in Assam and also as a felicitation article, clothing and as an absorbent cloth. The Handloom Research and Designing Centre, Ambari, Guwahati, Directorate of Handloom and Textiles, Government of Assam has applied for the GI registration in the ‘Textiles’ category.

INDIAN TRADEMARK STATISTICS
The Indian Trademark Office had a slow week as can been seen from the table below. The total number of registrations granted has decreased by fourteen percent (14%). Similarly, there has been a decrease of eleven percent (11%) in the total number of hearing notices issued. However, we also saw an increase of ten percent (10%) in the total trademark applications examined.

This week’s Patent & Design data has been compiled from the Official Journal of the Patents and Designs Office published by the patent office on the 7th of February 2020. These statistics are presented to you by the Patent attorneys and experts of BananaIP Counsels, India’s leading Intellectual Property Firm.
INDIAN PATENT STATISTICS
A total of 791 patent applications have been published in the 7th issue of the Patent Journal, 2020. Out of the 791 applications published in the journal, 163 applications account for early publications while 628 applications account for ordinary publications or publications occurring after the 18 – month period. A total of 781 applications have been granted last week as compared to 589 grants in the week preceding the last thereby marking an increase of about 32.59%

“boAt” Splashes Competitor’s Unjust Enrichment Dreams
Delhi High Court has passed an interim injunction against Exotic Mile, an audio-gadgets business firm, for violating the registered trademark “boAt” of Imagine Marketing Pvt. Ltd. Imagine Marketing is the proprietor of boAt, a well know electronic products supplier in India. It contended that Exotic Mile had dishonestly adopted the trademark “BOULT”, which is phonetically and deceptively similar to “boAt”. Further, it alleged that the usage of the tagline ‘UNPLUG YOURSELF’ by Exotic Mile was confusingly similar to its tagline ‘PLUG INTO NIRVANA’. The Court while considering the presence of both companies one-commerce platforms,passed an interim injunction restraining Exotic Mile from using the trademark “BOULT” as well as the tagline ‘UNPLUG YOURSELF’.

Brexit Not to Affect the UK Trademark System for Now
During the recent ratification of the ‘Withdrawal Agreement’ between the United Kingdom and the European Union, the Intellectual Property Office (IPO) of the UK has clarified that there will be no disruption to IPO services or changes to the UK IP system during the transition period (1st February, 2020 till 31st December, 2020). Accordingly, the UK will remain part of the EU trademark system and the UK legal representatives will continue to have the right to represent clients before the EU IPO. The International registrations for trademarks and designs designating the European Union via the Madrid and Hague systems will also continue to extend to the UK. The IPO has further informed that the businesses, organisations or individuals, that have applications for a EU trademark which will have a period of nine months from the end of the transition period to apply in the UK for the same protections.
‘Mambacita’ Trademark Filed by Kobe Bryant Weeks Before Death
Kobe Bryant, the legendary basketball player, had filed a trademark application for the word mark “Mambacita” at the United States Patents and Trademarks Office, just weeks before his and his daughter’s death in a tragic helicopter crash in California. Kobe Bryant, who went by the self-proclaimed nickname “The Black Mamba”, had affectionately dubbed his 13-year-old daughter Gianna, “Mambacita”.The trademark “Mambacita” was filed for sportswear including athletic shirts, shorts, hats, jerseys, sweatpants, sweatshirts, t-shirts, etc.

McDonald’s Ties up with Joester Loria Group to Bring Out Fashion Collection
McDonald’s Corporation, the world’s leading global foodservice retailer, is collaborating with the Joester Loria Group,a premier full-service brand licensing agency, based in the New York to develop collaborations and collection of fashion, accessories and collectibles for adults. McDonald’s first ever brand license was during the 1980’s and ever since has a history of partnering with leading fashion brands and retailers. By entering into the recent licensing agreement, Joester Loria Group would work closely with the McDonald’s global marketing team to tap into the brand’s unique cache, popular characters, and iconic brand campaigns.
Smiley Coming Out with Collectibles for Kids Through Game Maker
The Smiley Company, a London based brand licensing company, is collaborating with toy and games brand ‘Splash Toy’ to launch its first series of The Smileys collectibles. The collaboration will target kids in the 6-12 years age group and help them explore their emotions through a unique mix and match play pattern of The Smileys. The first series will be launched with blister packs, which include a secret Smiley and also blind boxes for toy distribution, and for kiosk distribution.

Little Caesars Pizza Ventures into India with Veg Only Option
Little Caesars, the world’s third-largest pizza chain, headquartered in Detroit, Michigan has forayed into the Indian market with two stores in Ahmedabad, Gujarat through franchisee Phoenix Nexus. Little Caesars which is popular for its Hot-n-Ready pizza and bread has rolled out its vegetarian menu in the Indian market and is currently focused on the dine-in format of quick service restaurants. With its Indianised menu, consumer-focused strategies and affordable pizzas, the company has aggressive plans and looks forward to join hands with interested entrepreneurs to continue rapid growth throughout India.

Lamborghini Stops Fraudulent Domain from Impersonating It
Automobili Lamborghini, the popular Italian luxury sports car manufacturer, had filed a complaint with the WIPO Arbitration and Mediation Center against jjoest, based in the US. Lamborghini alleged that the domain name “lamborghlni.com”, which is similar to its domain name “lamborghini.com”, was connected to a fraudulent email scheme by jjoest.  The scheme used the mark and the email address to impersonate an employee of Lamborghini to obtain  misdirected payments. The Administrative Panel headed by Nicholas Weston was convinced that the disputed domain was confusingly similar and jjoest used the domain name in bad faith. Thus, the Panel ordered the transfer of the disputed domain name to Lamborghini.

Spiti Chharma (Sea buckthorn) and Its Products Filed for GI
Spiti Chharma (Sea buckthorn) is a perennial, woody, nitrogen fixing and thorny deciduous shrub covered with silvery scales. Sea buckthorn which grows in cold regions is naturalised to snowfall or low temperature conditions. Sea buckthom grows in Lahaul Spiti, upper Kinnaur and Pangi in Chamba District of Himachal Pradesh.While, the Chharma (Sea buckthorn) fruits are used in cosmetics, the high concentration of vitamin C in its juices and squashesare useful for treating blood pressure, heart diseases, ulcers of the intestine, skin diseases, bronchitis and cancer. The Spiti Sea buckthorn Society of Kaza, Spiti, has filed an application for Spiti Chharma and its products under the agriculture, horticulture and forestry products category.

The Indian Patent Office issued a public notice on 31st January 2020 indicating the Office of the Controller General of Patents, Designs and Trademarks (CGPDTM) is likely to conduct the Patent Agent Examination in June 2020.The notice also reads that further information will be made available on finalizing the schedule and certain other requirements. Federal Jury finds VMware guilty of patent infringement, awards $236 Million as damages to Densify
A Federal jury in Delaware has ruled in favor of Densify, a software company based in Canada, and has awarded $236 Million by way of damages in a patent infringement lawsuit involving VMware. Densify had instituted a case in April, last year, alleging that VMware’s products – vRealize Operations Manager (vROps 7.0/7.5) Predictive DRS had infringed two of its patents, namely, US8209687 and US9654367. In addition to this, Densify had also stated that the latter had used the name “Densify” while referencing its own products. On Friday, last week, the jury announced its verdict before the Judge at the U.S District Court for the District of Delaware and held that VMware was guilty of patent infringement. VMware, in its statement said, “While we appreciate and respect the judicial process, we continue to strongly believe that we do not infringe the patents asserted against us in this case, and intend to vigorously pursue all legal remedies that are available to us to prove that we are not liable here.”
Caltech awarded $1.1 Billion in patent infringement case against Apple and Broadcom
California Institute of Technology (Caltech) has been awarded $1.1 Billion in a patent infringement case against Apple and Broadcom. The University, in 2016 had instituted a suit for patent infringement against the two tech giants in the Federal Court in Los Angeles, U.S.A. In its lawsuit, Caltech had alleged that the tech giants had infringed four of the University’s patents relating to Wi-Fi data transmission. Four years later, a jury has found the companies guilty of patent infringement.
The jury has awarded Caltech a sum of $1.1 Billion where Apple is bound to pay $837.8 Million and Broadcom is liable to pay $270.2 Million, as damages. According to reports, Apple has confirmed that the company will file an Appeal.
International Patent News
UK Government says Brexit will have no implications on IP system during the transition period
Following the ratification of the Withdrawal Agreement by the EU and U.K, EU law will continue to operate in the UK until 31st of December 2020. The Intellectual Property (IP) system will continue as it is during the transition period, i.e., 1st February 2020 to 31st December 2020. The official website of the U.K Government also confirms that no disruptions will be caused to IPO services. At the end of the transition period, the IPO will convert almost 1.4 million EU trademarks and 700,000 EU designs to comparable UK rights, and these will come into effect from 1stof January 2021.
Brief implications of Brexit on Patents & Designs have been provided below for our readers’ quick reference:
Registered Community Designs (RCD)
The UK will remain part of the EU registered community design system throughout the transition period. Comparable UK designs will be created at the end of the transition period under the terms of the Withdrawal Agreement.
Businesses, organizations or individuals that have applications for an RCD which are ongoing at the end of the transition period will have a period of nine months from the end of the transition period to apply in the UK for the same protections.
Unregistered designs
Unregistered community designs arising before the end of the transition period will continue to be protected in the UK for the remainder of their three-year term.Designs disclosed in the UK after the end of the transition period may be protected in the UK through the supplementary unregistered design
International registrations designating the European Union
International registrations for trademarks and designs protected via the Madrid and Hague systems and those which designate the European Union before the end of the transition period will continue to extend to the UK after 31 December 2020. 
Rights of Representation
UK legal representatives will continue to have the right to represent clients before the EU Intellectual Property Office (EUIPO), in cases that are ongoing at the end of the transition period.
Patents
An applicant may apply for European patent through the U.K Patent office or direct to the European Patent Office (EPO) to protect the patent in more than 30 countries in Europe, using the (non-EU) European Patent Convention (EPC). As the EPO is not an EU agency, leaving the EU does not affect the current European patent system. Existing European patents covering the UK also remain unaffected.

EPO publishes grounds for rejecting two patent applications that designated a machine as an inventor
In the month of December, last year, the EPO refused two European Patent Applications numbered EP 18275162 and EP 18275174 which designated a machine as an Inventor. The applications named a machine called “DABUS” as the Inventor and described it as – “a type of connectionist artificial intelligence.” The applicant stated that they acquired patent rights from the inventor by being its “successor in title.” After considering the interpretation of the legal framework of the European patent system, the EPO refused the application on the grounds that the inventor was not a natural person. The Office has emphasized on the fact that the internationally accepted standard appears to accept the term ‘inventor’ as a natural person. The Office also states that it is essential for the inventor to have a legal personality to benefit from the rights derived from the patent.

This week’s Patent & Design data has been compiled from the Official Journal of the Patents and Designs Office published by the patent office on the 31st of January 2020. These statistics are presented to you by the Patent attorneys and experts of BananaIP Counsels, India’s leading Intellectual Property Firm.
Indian Patent Statistics
A total of 1007 patent applications have been published in the 5th issue of the Patent Journal, 2020. Out of the 1007 applications published in the journal, 102 applications account for early publications while 905 applications account for ordinary publications or publications occurring after the 18 – month period. A total of 589 applications have been granted last week as compared to 556 grants in the week preceding the last thereby marking an increase of about 5.93%.

Nike Wants its Swoosh Back
Delhi District Court has passed a permanent injunction against three footwear companies, G.B. Shoe, Vishal Footwear and New Hira Shoes, located in Agra, the Defendants, for violating the trademark(s) of Nike, the celebrated sports shoes manufacturer. Since its adoption in 1971, Nike has been using its brand name continuously worldwide and is the registered trademark holder of marks such as NIKE, SWOOSH (logo), etc. Based on the evidence and the reports submitted by the appointed Local Commissioner, the Court noted that the Defendants’ adoption and usage is creating undue enrichment  by creating confusion in the minds of customers. The Court further ordered the Defendants to pay Nike a nominal damage of Rs. 50,000 each.
INTERNATIONAL TRADEMARK UPDATES
New Dark Mode Icons by Apple
Apple, the American technology major, has recently applied for registration of three new trademarks in China, one of them being the Apple’s music logo in dark mode. The logo comprises of a black square with rounded edges with a blue, purple, and pink stylized musical note in the center. This filing might open up the possibility of dark mode icons coming to Apple devices in the near future. Further, Apple also filed for the figurative version of Apple Music for Business and lastly a Chinese mark roughly translated as ‘Deep Integration’, which is specifically for the Chinese market.
The US Olympics Committee Claims Psychologist Cannot Use Olympics Logo
The US Olympics Committee, a federally chartered Non-profit Corporation, has filed a federal lawsuit accusing Steven Ungeleidera, an American Sports Psychologist, of misrepresenting himself as a psychologist affiliated with the US Olympic Committee, in several of his emails to journalists and the US State Department. The suit alleges federal trademark infringement and that despite the Committee’s cease-and-desist letters, Steven Ungeleidera continues to use the Olympic logo mark on his website, Twitter and Facebook pages.

H&M’s First Global Collaboration with Indian Designer Sabyasachi
Hennes and Mauritz (H&M), the global fashion retailer, has announced its collaboration with the iconic Indian designer Sabyasachi Mukherjee. The Sabyasachi x H&M collection themed “Wanderlust” will be a mix of modern and traditional silhouettes with the Indian textile and print tradition as a key highlight of this collection. The collection will be available in all H&M stores in India as well as select H&M flagship stores around the world and online.
Star Wars Merchandise Collaboration Star Wars Voice Actress
‘Star Wars’ has partnered with ‘Her Universe’, a fashion company and lifestyle brand founded by the actress Ashley Eckstein for an all new apparel collection. Ashley Eckstein is popularly known to everyone as the voice of Ahsoka Tano on Star Wars. The “Star Wars” x Her Universe Apparel collection will include t-shirts, joggers, jackets and will be available at Disney parks and online.

Reliance Inks Franchise Deal with ‘The Entertainer’
The Entertainer, a UK-based toy retailer, has signed a master franchise agreement with Reliance Brands Limited (RBL) to foray into the Indian market. The Entertainer will bring to the country a selection of action toys and figures, soft toys, art and craft sets, games and jigsaws, outdoor toys, collectible toy items and more, including their private label brand Addo. With this agreement, RBL will be opening The Entertainer stores in Mumbai in the first half of 2020.
DOMAIN NAME DISPUTE UPDATES
Naturals Salons Loses Domain Name Dispute to a Korean Company
Naturals, a prominent beauty salon chain in India with over 650 outlets had filed a complaint with the WIPO Arbitration and Mediation Center against a Korean company, Daegu Law Auction owned by Mr. Deock-Ho Kang for using a identically/confusingly similar domain name, www.naturals.com. Naturals alleged that by virtue of the widespread use and reputation of the NATURALS trademark, members of the public and the trade are bound to associate the domain name with Naturals and would have the wrong impression that the Korean company is associated with it. On hearing both the parties and going through the records and submissions, the WIPO Panel finds that there is no evidence that the Korean company was aware of Naturals and its trademark when registering the domain name in 2001 as the domain name was registered well before the NATURALS trademark was applied for registration in India in 2006. Further, there is no evidence that the NATURALS mark was known in the Republic of Korea. The Korean company’s passive holding of the domain name is not evidence of bad faith. Therefore, although the marks were confusingly similar, the Panel denied the complaint due to lack of bad faith.

Osmanabadi goat is the most popular goat breed of the arid and semi-arid regions of Maharashtra. This breed has derived its name from the region Osmanabad, where it is predominantly found. It has many desirable characters such as early maturity, high kidding rate, growth rate and quality of the meat. Osmanabadi goat breed is also noted for its high resistance power against diseases and also for their reproductive capacity. The Application was filed by Osmanabadi Sheli Sanvardhan Shetkari Gat of Osmanabad District, Maharashtra under Class 31 for Live Animals.

Roaring increase of 124% in total number of hearing notices issued, an increase of 1236 in the total number of renewal notices issued and more. These statistics have been compiled from the official journal of the trademark office published weekly on Mondays.
INDIAN TRADEMARK STATISTICS
It can be seen from the statistics in the table below that the Indian Trademark Office has picked up its working pace. The total number of hearing notices issued has increased tremendously by one hundred and twenty four percent (124%). Similarly, there has been an increase of fifty four percent (54%) in the total number of renewal notices issued. However, we also saw a decrease of two percent (2%) in the total trademark applications examined.

HCL launches Microsoft Business Unit to fire production of Intellectual Property
Indian multinational IT services company, HCL Technologies Ltd., has joined hands with Microsoft Corporation to launch a new Business Unit. According to the announcement made by HCL on 21st January 2020, the HCL Microsoft Business Unit is expected to increase the creation of Intellectual Property and also offer support to clients in the field of financial services, healthcare and life sciences, manufacturing, retail, and travel industries. Through the new Business Unit, HCL will have access to Microsoft’s Business Applications, IoT, and AI/Machine Learning, Microsoft Dynamics 365, Microsoft Azure, Microsoft 365 and Windows 10. In addition to this, the collaboration of the two tech giants will bring over 5000 professionals together.
National Startup Advisory Council to be set up by Central Government
The Central Government recently issued a notification indicating the structure of the National Startup Advisory Council that is expected to be set-up in the near future. The Advisory Council will be chaired by the Ministry of Industry and Commerce. According to the press release of the Ministry, the Advisory Council will suggest measures to “promote ease of access to capital for startups, incentivize domestic capital for investments into startups, mobilize global capital for investments in Indian startups, keep control of startups with original promoters and provide access to global markets for Indian startups, keep control of startups with original promoters and provide access to global markets for Indian startups.” The setting up of the Advisory Council is also expected to improve India’s rank in the World Bank’s – Ease of doing Business Index where India secured the 63rd position, in 2019. The Advisory Council will offer guidance to startups in matters of protecting and commercializing Intellectual Property Rights. The members of the Advisory Council will comprise of official as well non-official members. The names of the non-official members will be nominated by the Centre. These nominated members will serve a two-year term.

Xilinx files counter claims in lawsuit instituted by Analog Devices for alleged patent infringement
On 21st January, Xilinx, Inc., the American Semiconductor manufacturer responded to the complaint filed by Analog Devices Inc. in the United States District Court for the District of Delaware. The complaint filed by Analog Devices, in the month of December 2019 alleged Xilinx of infringing eight of its patents. The patents at issue, namely – United States Patent No. 7,719,452; 7,663,518; 6,900,750; 10,250,250; 7,274,321; 7,012,463; 8,487,659 and 7,286,075, primarily relate to technologies involving – serializers/deserializers (SerDes); high-speed analog-to-digital converters (ADCs); digital-to-analog converters (DACs) and mixed-signal devices targeting 5G, without authorization. In addition to the counterclaims, Xilinx has stated nine additional defenses including Non-Infringement, Invalidity, Estoppel and others. EPO’s Academic Research Programme rolls out six Research Reports, for the very first time
The European Patent Office (EPO) published six Research Reports that were developed with funding from its Academic Research Programme. The Academic Research Programme was launched by the EPO in 2017 with the objective of encouraging research in the field of patents and to promote the dissemination of research findings. A total of 300,000 Euros were awarded for the research projects. The final results of the research were presented at a workshop that was recently hosted by the EPO in Munich. During the research period, researchers used patent data to delve deeper into topics such as financing for innovation, knowledge transfer, trade, tracking inventions in the marketplace, and the growth of technologies to tackle climate change. 
The program’s scientific committee selected the six research topics from amongst 66 submissions from 13 different countries after which the call for proposal was held in 2017. The six Research Reports are as follows:

Financing innovation in Europe
CAPPA – Career paths of patent attorneys
Knowledge spillovers from product and process inventions in patents and their impact on firm performance

This week’s Patent & Design data has been compiled from the Official Journal of the Patents and Designs Office published by the patent office on the 24th of January 2020. These statistics are presented to you by the Patent attorneys and experts of BananaIP Counsels, India’s leading Intellectual Property Firm.
INDIAN PATENT STATISTICS
A total of 1148 patent applications have been published in the 4th issue of the Patent Journal, 2020. Out of the 1148 applications published in the journal, 103 applications account for early publications while 1045 applications account for ordinary publications or publications occurring after the 18 – month period. A total of 556 applications have been granted last week as compared to 337 grants in the week preceding the last thereby marking an increase of about 64.98%

Singer Josh Stone Files Infringement Suit Ariana Grande
Adding to the spate of infringement suits filed against popular musicians lately, pop star Ariana Grande has landed in hot water over the chorus of her song ‘7 Rings’. Singer Josh Stone has filed a copyright infringement claim against Grande and Universal Music Corp, alleging that the hook in 7 Rings is substantially similar to his 2017 song ‘You Need It, I Got It’. The lyrics to the hook of 7 Rings are ‘I want it, I got it, I want it, I got it’, while the lyrics to the hook of Stone’s song are ‘You need it, I got it, you need it, I got it’. One of the claims made in the lawsuit, which was filed in New York, alleges that, each of the 39 respective notes of 7 Rings is identical with the 39 notes of ‘I Got It’ from a metrical placement perspective.
Further, Stone revealed that in 2017 he had played his song to an executive named Tommy Brown, who was also a producer and had collaborated with Ariana Grande.
Eden Project Artist Sues Botanic Garden Over Infringing Sculptures
UK-based light installation and sculpture artist Bruce Munro has filed a suit against Fairchild Tropical Botanic Garden, seeking USD 150,000 in statutory damages for allegedly infringing his work, titled ‘Forest of Light’. He has also sought an injunction and destruction of the infringing goods purchased by the Florida-based Botanic Garden. He claimed that the exhibition has bought unauthorised replicas of his light installations from Chinese seller G-lights, who is also impleaded as a defendant in the lawsuit. G-lights reportedly offers infringing copies of Munro’s works rather blatantly on Alibaba’s online retail platform, by advertising them as ‘Bruce Munro Style’.
The complaint claims substantial similarity between the garden installations used by Fairchild and many of his famous works. To demonstrate the renown of his light exhibitions, Munro went so far as to compare the footfall at his Longwood exhibition with the Rolling Stones 2014 concert tour, stating that half as many concert attendees attended his installations, many from more than three hours away.
EWHC Dismisses Infringement Claim against Google
The England and Wales High Court (EWHC) recently dismissed a copyright infringement lawsuit against Google. Christopher Wheat, the operator of the website theirearth.com, appealed against a lower court’s decision to dismiss his suit against Google for copyright infringement of his photograph. Wheat stated that an aggregator had hotlinked his photograph of Lewis Hamilton, which was originally available on his website.  Hotlinking refers to the method of displaying content on the website not by copying it, but by merely providing links to the original host website and displaying the content directly from their servers.
Wheat alleged that, after his photograph was hotlinked, Google either saved a copy of or cached the aggregator’s website and displayed it at the top of the image search results for Lewis Hamilton’s name, thereby infringing upon his copyright in the photograph.
The High Court however, seemed to disagree with Wheat, as it stated that, there is nothing in this situation that came within the ambit of copyright infringement. It noted that Google had not ‘attributed’ the image to itself, and neither did the hotlinking have any effect of depriving Wheat of his rights in any manner. The High Court upheld the lower court’s decision and dismissed the suit.
Spotify and Time Warner End Indian Licensing Dispute
Spotify, the audio streaming platform, and Time Warner, the American Multinational Mass Media Company, have made an announcement ending their year-long licensing dispute in India. Both companies released simultaneous and largely similar statements on 14th January,  announcing that the court dismissed the pending litigation between them on the joint request of both parties. They also announced a new multi-territory licensing agreement, which includes India within its ambit.
Last year’s litigation, which saw both sides trade sharp barbs, was centered around the low subscription rates Spotify charged Indian customers and the resultant valuation of streamed music. While the announcement did not reveal the terms of the deal, Spotify mentioned in its statement that it was happy with the deal’s impact on the Indian customer base and likewise Time Warner mentioned that it was satisfied with the valuation of its music.
Apple TV+ Show ‘Servant’ Faces Copyright Infringement Claims
Francesca Gregorini, the director of the film ‘The Truth About Emmanuel’, has filed a copyright infringement suit against director M. Night Shyamalan and Apple, for allegedly borrowing the plot of her film and adapting it for the Apple TV+ show, ‘Servant’.
The suit alleges similarity not only of the plot, but also of characters, scenes, directorial choices and modes of storytelling. The plot of the film revolves around a woman dealing with the loss of her infant treating a realistic doll as a human baby, and the plot of the show revolves around a wealthy couple that also cares for a lifelike doll in the wake of their infant’s death. Interestingly, a key difference between the two works is that, while her film is told from a female point of view, Shyamalan’s show employs a male narrator. Gregorini claims this is typical of Hollywood’s usurpation of stories from female perspectives and imposition of male voices and male central characters upon those stories. It will be interesting to note how the court will treat the retelling of a substantially similar story from a different point of view, especially when such changes are commonly made even for acknowledged adaptations.
The lawsuit does not specify the amount of damages that Gregorini seeks to claim.
Court Orders Ed Sheeran to Reveal Concert Revenues
The ongoing copyright infringement proceedings in a New York court, instituted against singer Ed Sheeran by the heirs of songwriter Ed Townsend, have taken an adverse turn against the singer. The suit alleged that Sheeran’s 2014 song ‘Thinking Out Loud’ infringed the copyright held by Townsend in the lyrics of Marvin Gaye’s ‘Let’s Get It On’.  The court granted the plaintiffs’ request for financial data about Sheeran’s concerts in which he performed the song, including both  ticket sales and revenue generated through merchandise sales.
The court rejected arguments by Sheeran arguments denying a causal connection between the alleged infringement and revenues from concerts. It also rejected Sheeran’s arguendo that he had a right to perform his song due to blanket performance licenses from the organisation that holds the copyrights to ‘Let’s Get It On’. It called such an argument ‘unfounded’, holding that the said licenses only granted the licensees the rights to perform their songs, rather than conveying any kind of consent of the author, to play infringing music, or remedying the infringement.

Amazon to Launch Fleet of 10,000 ED Vehicles in India by 2025
In a bid to increase energy efficiency and minimise adverse environmental impact, eCommerce giant Amazon has announced its commitment to deploying 10,000 electronic delivery vehicles (EDV) in 20 Indian cities by 2025. The vehicles will be three wheelers as well as four wheelers, and will be manufactured in partnership with Indian vehicle manufacturers. Boosted by the success of its pilot runs using electronic vehicles in the supply chain, this announcement comes as an addition to Amazon’s Climate Pledge initiative to use one lakh electronic delivery vehicles globally by 2030.
Amazon’s statement also mentions the Indian Government’s FAME (Faster Adoption and Manufacturing of Hybrid and Electric Vehicles in India) policy as having encouraged its electronic vehicle plans in the country. This development follows last September’s announcement by the company to eliminate single use plastic packaging waste. Other commitments in its Climate Pledge include becoming a net zero carbon company by 2040, a decade before the 2050 goal in the Paris Accord.
Zomato Acquires Uber Eats India for USD 350 million
In the first major consolidation acquisition in the online food-delivery market, Zomato has completely acquired Uber Eats India for USD 350 million (approximately Rs. 2,485 crores), giving parent company Uber a 10% shareholding in Zomato. Uber Eats will cease to exist as a separate brand and customers will be redirected to Zomato, with 90% customers of Uber Eats expected to switch to Zomato. This acquisition will give the combined entity a 50 to 55% market share in terms of number as well as value of online food orders. The deal was enabled by Zomato’s latest round of funding by Ant Financial, the FinTech company, which is an affiliate of the Chinese eCommerce platform Alibaba. Ant Financial valued the company at USD 3 billion and infused USD 150 million into the Gurgaon-based company.
Uber had been looking to offload its food delivery business due to huge operating losses according to regulatory disclosures, and a reported deal to sell the business to Swiggy had fallen through in February 2018. Its model relied heavily on steep discounts to lure consumers in the highly competitive Indian food-delivery market, since around the same time in 2018, Uber’s Indian competitor, Ola had also reduced focus on its food delivery business, Foodpanda.
TikTok Signs Sub-Licensing Agreement with Tencent
Chinese short-video platform TikTok is aggressively expanding its business both at home and in India. ByteDance, the Chinese parent of TikTok has reached a Sub-Licensing Agreement with Tencent Music. The deal will enable TikTok users to legally perform and share Tencent-owned music on the platform. For Tencent, TikTok will act as an important additional channel for reaching consumers. At the same time, in India, TikTok is looking for ways to monetise the large user base it has quickly acquired in the country.
Executives from ByteDance’s monetisation have been conducting meetings with Indian creators and influencers, assessing their needs and payment mechanisms, maintaining that the monetisation will also help creators make money from the app. Deliberations are said to include introduction of features and tools that will allow brands to collect information and data on the user bases of influencers. This will allow for product placements through pop-up formats, which will help the company to measure sales directed at them from the platform and assess their rate of investment.
Heineken Partners with James Bond
Continuing their long-running partnership, Heineken has launched a new global advertising campaign for its non-alcoholic beer Heineken 0.0 featuring Daniel Craig partly playing the fictional character James Bond. The two-minute ad will also be played in more than 74 countries before the new James Bond series film releases in April. The campaign includes tie-ins in the new movie ‘No Time To Die’ and Heineken will release consumer promotions and limited edition packaging centering around the James Bond franchise.
The ad shows Daniel Craig repeatedly being mistaken for James Bond, the character he is famous for playing, and emphasises his human and relatable aspects such as catching his breath after running, and finally shows him enjoying a bottle of Heineken 0.0. The advertising focus by Heineken on its alcohol-free beers is a part of its effort to reach out to consumers who are looking to drink less or are non-drinkers. This is also a part of the company’s strategy to deal with reduced beer consumption among millennials and the wellness trend’s focus on trying to reduce or eliminate alcohol consumption.
Spotify to Acquire Podcasting Network ‘The Ringer’
In the wake of analysts’ warning that Spotify’s business is underperforming, Spotify has launched efforts and talks to acquire podcasting network The Ringer. This might be due to podcasts being hailed as the next big thing in the audio streaming industry.  The talks are reportedly in early stages, some are predicting that Spotify’s competitors such as Apple Music might launch their own efforts at acquiring podcast entities, driving up investment in the podcast industry. Other major players are also looking to make strategic investments in podcasting, especially as a means to differentiate themselves from one another in the crowded audio streaming market.
Apple Music and the NBA Sign New Deal
Apple music has announced a deal with the US National Basketball Association. As part of this deal, Apple music will generate an exclusive playlist of 40 songs, featuring mostly urban and indie-genre artists with a hip-hop vibe on a weekly basis. The playlist will be compiled in partnership with music services platform UnitedMasters. The songs will be played in NBA’s in-game highlights, social media videos, and on the NBA app and websites. UnitedMasters maintains that it will strive to promote emerging urban artists and smaller music labels.

Pidilite Enforces Adhesive Trademarks  
Pidilite Industries Ltd., the popular Indian adhesive brand, has approached the Bombay High Court to grant an interim injunction against E.C. Industry, a Mumbai based adhesive company, for using deceptively similar trademarks and trade-dress infringement. Pidilite is the registered proprietor of various trademarks including ‘DR.FIXIT’. Pidilite has alleged that E.C. Industry is using its registered trademark and similar packaging to sell its products. The Bombay High Court while acknowledging the prima facie infringement, held that E.C. Industry was marketing adhesives in bottles of similar shape and design, and was using labels of similar colour scheme as that of Pidilite, and thus granted an interim injunction.

Amazon Looking to Expand Pharmaceutical Service Outside the US
Amazon, the American technology major, has recently applied for registration of the mark “Amazon Pharmacy” in Australia and Canada. The mark has been applied under classes primarily covering pharmaceuticals, pill dispensers for domestic use, supplements research and medical services. The company operates a full-service online pharmacy in the US under the brand Pillpack, an independently operated subsidiary of Amazon. With the recent trademark applications filed in Australia and Canada, the company is looking to expand its pharmaceutical online retail and in-store retail services outside of the US.
Mighty Fight Over Tomatoes Across US Canada Border
MightyVine, a US based hydroponic tomato producer, has filed a trademark infringement suit against Mastronardi Produce, a Canadian greenhouse vegetable company, for using the term ‘Mighty’. MightyVine has alleged in the suit that the use of the term Mighty by Mastronardi in its their brand Tiny Mighty Tomatoes will likely cause consumer confusion.  Due to the similarity in the brand names, MightyVine contends that Mastronardi is trading off its goodwill and brand reputation. The US company has prayed for unspecified damages along with an injunction on the use of the mark Mighty by Mastronardi.
BRAND LICENSING UPDATES
NFL Teams Up with H&M for Apparel and Accessories
US’ National Football League (NFL) has collaborated with global fashion retailer H&M to launch NFL-branded apparel and accessories. The deal has been brokered by talent management company IMG. The collection includes men’s jackets, tops and loungewear, which are currently available online and at H&M stores. The collaboration will include women and children’s apparel, and accessories which are likely to be launched in the upcoming season. The products will be available in more than 20 countries outside of the US, including the UK, China, Japan, Colombia, Germany, India, Mexico, South Korea and the Middle East.
Compaq Forays into LED TVs in India
Compaq, a US based computer manufacturing corporation, has entered into a licensing partnership with Ossify Industries, an LED TV and sound system manufacturer, based in Noida India, to launch ‘Compaq Smart LED TVs’ across India in 2020. Compaq Smart TVs are likely to incorporate features and functionalities to enhance the basic television experience.

Burger Singh Plans on Franchise Expansion in Tier-2 and Tier-3 Cities across India
Burger Singh, a popular Indian burger chain from Nagpur, Maharashtra known for its big burgers with an Indian twist, is planning to expand its outreach Pan-India. The burger chain that currently has more than 35 outlets across India plans to launch 66 more outlets in the next two years. Burger Singh is currently offering three franchise models ranging from Dine-in, Express (takeaway/delivery) and Mini (kiosk). Burger Singh is targeting to expand its operations in Tier-2 and Tier-3 cities in India due to high sales recorded in such regions.

BHP Stops a Confusingly Similar Domain
BHP Billiton Innovation Pvt Ltd (BHP Billiton Innovation), an Anglo-Australian multinational mining company headquartered in Melbourne, Australia has filed a complaint with the WIPO Arbitration and Mediation Center against Joe Kreg, for using the domain name “bhpbillitonpetroleum.com”. BHP in its complaint has alleged that the domain used by Joe is confusingly similar to its trademarks. WIPO panellist Miguel B. O’Farrell while holding that Joe Kreg had acted in bad faith, opined that the disputed domain name was confusingly similar to the trademark BHP Billiton.  The mere addition of the word “petroleum” was not sufficient to avoid a finding of confusing similarity and as such the panellist ordered the transfer of the domain name to BHP.

Alibag White Onion is a traditional variety of white onion cultivated in Alibag Tehsil of Raigad District in Maharashtra using only traditional and genuine seeds. Generally, white onions are pungent, but the Alibag White Onion variety is characterized by its sweetness.  The geo-climatic conditions of Alibag is said to make these onions unique in taste, flavour and shape as compared to other varieties of white onions. The application has been filed by the Alibag Pandhara Kanda Shetkari Utpadak Gat under the Agriculture category in January 2020.

Slow week at the trademark office with decrease of 24 percent in total number of renewal notices issued, An increase of 1778 in the total applications published in the trademark journal and more. These statistics have been compiled from the official journal of the trademark office published weekly on Mondays.
INDIAN TRADEMARK STATISTICS
Last week, the Indian Trademark Office had a mixed week in its working capacity as can be seen from the statistics in the table below. The total number of applications published in the trademark journal has increased by twenty nine percent (29%). Similarly, there has been an increase of twenty-one (21%) in the total number of hearing notices issued. However, we also saw a decrease of twenty four percent (24%) in the total renewal notices issued.

This week’s Patent & Design data has been compiled from the Official Journal of Patents and Designs published by the patent office on the 17th of January 2020. These statistics are presented to you by the Patent attorneys and experts of BananaIP Counsels, India’s leading Intellectual Property Firm.
Indian Patent Statistics
A total of 1425 patent applications have been published in the 3rd issue of the Patent Journal, 2020. Out of the 1425 applications published in the journal, 147 applications account for early publications while 1278 applications account for ordinary publications or publications occurring after the 18 – month period. A total of 337 applications have been granted last week as compared to 348 grants in the week preceding the last thereby marking a decrease of about 3.26%
