stare decisis: chapter two - amarum
amarum: latin for bitter

rafael barba x original female character
“Carmen, can you get me the witness statements for-” Quinn starts to ask as she rushes into her office with cup of iced coffee in hand.
“The photographer case? What we have of the DD-5s from the detectives are on your desk. Mr. Barba is at the precinct now,” she explains.
“Remind me to thank him for the invite,” she huffs rhetorically as she enters her office. She shuts the door behind her and throws her work bag on the arm chair that sits right inside the door. Two months she’s been in Manhattan and she’s still getting the cold shoulder from the squad and her supposed co-counsel. She dials his cell from her office phone while she glances over the reports from the detectives. He picks up a few rings in.
“Barba.”
“You’re not seriously thinking about filing charges are you?” she asks and can almost hear his eyes rolling through the phone. Her right hand rests on the desk with a pink gel pen in it on a blank legal pad, willing and ready to take notes.
“I thought you would think better of me,” he smirks and mouths her name to Olivia.
“I don’t and that’s how I know you’re still helping the squad cook up some convoluted plan to get this guy,” the smirk is wiped right off his face, it was like she had read his mind.
“They either do it with legal counsel observing or the start violating constitutional rights with reckless disregard,” he lowers his voice as he walks into the breakroom of the precinct.
“Or you’re there and they violate someone’s rights and then you’re also named in the lawsuit. I don’t think the city’s malpractice insurance covers rights violations,” she huffs.
“I appreciate your concern but I’m doing this,” he grunts and hangs up the phone. She sighs angrily. She’s been co-counsel to Barba for three months and they’ve been at each other’s throats constantly. This time she’s actually looking out for him and he’s continuing to brush her off.
She works the rest of the day quietly, Barba is in and out of his office, leaving her out of the game all day.
***
Quinn’s boring and quiet day came to an end later that night while she sat on her couch watching trashy reality television. At a pivotal point in the episode her phone rings next to her, she picks it up with her eyes still glued to the TV.
“Mac, you won’t believe what happened today,” she says without a second thought. As she’s about to continue speaking she’s interrupted by an unexpected voice.
“Miss Brady, it’s Sonny Carisi. Sorry to call you so late,” she sits up straighter from her slouched couch position.
“Oh Carisi, what’s up? Barba off playing poker with the Governor?”
“Actually ma’am, he doesn’t know I’m calling you. But I think you should come down to the precinct. Fin arrested the perp tonight while UC.”
“He did what?” she all but shouts into the phone, she can feel Carisi’s painful cringe through the device. “I’ll be right there,” she seethes as she stands up from her spot on the couch.
The ride to the precinct is short and grueling. Only because Quinn attempts avoids any human interaction as a way to spare them from her anger. Steam is essentially blowing out of her ears as she enters the squad room and sets her sights on her co counsel. Her gaze almost as fiery as the color of her hair. Olivia Benson watches as he almost shrinks into the waist code he’s wearing.
“Are you fucking serious?” she seethes in front of the whole squad, not bothering to excuse herself and Rafael from the group.
“What are you doing here?” he asks, looking her casually clothed self up and down. She’s donned in loose fitting blue jeans and an oversized white button up; like she just walked off the set of a nineties movie.
“I just had a feeling you were going to let them do something unbelievably stupid. And look, I was right,” Sonny takes note of her lack of disclosure as the the actual reason she showed up, he likes to think it was to spare him rather than to make her look good. “I told you to specifically not to do this and here we are.”
“No offense counselor, but you’re not his boss, nor are you ours,” Olivia speaks up removing her reading glasses to make eye contact.
“You’re right, but when we’re all named in the lawsuit for constitutional rights violations; it has consequences, career consequences,” her eyes narrow at every team member. Barba’s smirk is stamped on his face before he even speaks.
“Sounds like you have experience counselor.”
“I was a federal attorney after 9/11, yeah I’ve heard about constitutional rights violations,” she says straight faced. “What do you plan on doing now that you’ve arrested a man with no evidence of wrongdoing?”
“Do what we do best: investigate,” Amaro shrugs his shoulders. She rolls her eyes at him then looks to Barba again.
“We need to talk. Now,” she leads them to the secluded locker room. As soon as the door shuts she’s laying into him again. “How can you not see how bad this is? How did you let them violate him with no evidence? What were you thinking?”
“Okay, I know this is bad, but there’s some compelling information. Fin arrested him in a sterile torture chamber that had been soundproof. The things he said he wanted to do on those message boards are downright awful. And I was thinking that the kids he’ll hurt in the future need to be saved,” he calmly explains while holding her green eyes captive with his. Her breath hitches in her throat before she’s able to blink free.
“While that is noble of you, it is not legal. And we’re supposed to be co counsel and you left me in the dark. Now we’re both in this mess and the DA is going to be pissed. We can’t keep going on like this, you have to loop me in.” She grunts then removes herself from the room with a huff.

stare decisis: chapter one - novus
novus: latin for new
wc: 1,043
rafael barba x original female character
Quinn Brady glances at the name she had scribbled on a bright pink sticky note, Rafael Barba, she confirms that it matches the name on the door before walking up to the desk of his assistant. She's a beautiful woman, Quinn can tell she's tall before she even stands up.
"Hey, good morning. My name is Quinn Brady. Mr. McCoy sent me," the woman nods knowingly.
"I'll let Mr. Barba know you're here," she disappears through the double doors of the office briefly before coming back out. "You can go on in," she smiled. Quinn thanks the woman and then enters the office.
"Mr. Barba, I'm Quinn Brady, the DA just pulled me over from Queens," she holds her hand out for a shake, his large warm hand covers her pale cold one with a firm grasp. He's intimidating, she notices, arrogant too.
She's attractive, he can't deny that. Slender, only a few inches shorter than him, with freckles covering her cheeks and nose, and ginger hair that compliments those freckles so nicely. Shamefully he admits to himself that having a woman sitting with him at counsel table during trial will also help with the jury, probably the DA's exact thought.
"The DA told me you were coming over, what department were you in?"
"Gangs," she smirks as she places a hand on her hip. Her petite stature always allowed her to be underestimated, especially when it came to prosecuting gang-related crimes.
"Well you've certainly made some enemies then," he smirks, he has too.
"Definitely, I'm sure you've done the same. You have quite the reputation," his phone vibrates in his hand and he tears his eyes from hers to glance at it.
"Well, welcome to SVU. The squad just caught a case, so we can go over the precinct and I can introduce you to them," he grabs his coat from the coat hanger by the door. He passes right in front of Quinn, and the warm embrace of his evergreen cologne wafts through her senses.  "I need to warn you about them, they're passionate, and don't understand what we go through as ADAs."
"Oh, have you ever met a cop who does?" She quips, and a light flashes through his eyes. Maybe he's met his match. They share a cab, on the DA's office's dime. It's close quarters for newly acquainted coworkers but they make it work. She’s first to break the silence.
"So where did you go to law school," Quinn looks over, his nonverbal markers tell her everything she needs to know. He's an Ivy League guy.
"Harvard, you?"
"Georgetown."
"Did you stay in D.C. after graduation?” He knows most people do, so in his mind it’s a stupid question.
“For a few years, I bounced around for a while until I ended up in New York,” she watches closely as the yellow cab pulls up to the 16th precinct, the large building home of New York City’s elite squad of detectives.
“Well, let’s go see what they have for us,” they make their way up the exterior stairs and then up the elevator to the squad room.
A short blonde woman is waiting at the elevator doors when they open, she doesn’t give Quinn a second glance, her eyes are only set on Barba.
“We need a warrant.”
“For what? For who? Why? I don’t care what you think you need, I care about what you have,” Rafael grunts and storms past the detective; Quinn follows on his heels. She’s unintentionally led right into the middle of the squad, four other people are gathered around a few desks, talking about the evidence they think they could obtain.
“Barba, great, we need a warrant,” an older brunette woman.
“Yeah, that’s what Rollins said, but why do you think you need a warrant?”
“Josh Casey consulted some telephone attorney based on his cell records. But if it was only a consultation then he’s not a client and attorney-client privilege doesn’t apply. So we need the attorney’s records from their consultation,” a lanky, blond but graying, man says animatedly. Quinn takes in the room, they still haven’t noticed her. Just as Barba opens his mouth to respond Quinn butts in instead.
“Those records are more than likely protected by work product, so you’re not going to get those.”
“Who are you?” a Hispanic man with dark hair asks.
“Quinn Brady, your new ADA,” she studies the looks of shock between her and Barba. Maybe that wasn’t the best way to say that she was joining the team.
“What the hell, you’re leaving?” the brunette woman asks Barba.
“No, he’s not leaving, there’s two of us now. DA’s orders,” Quinn answers for him.
“Brady, this is Sergeant Olivia Benson, Detectives Amanda Rollins, Fin Tutola, Nick Amarao, and Dominic Carisi,” Barba points to everyone as he says their name.
“You can call me Sonny,” Carisi blurts as soon as Barba says his name. Quinn looks at the man’s outstretched hand but ignores it.
“Yeah, right. And even if it is not all protected by work product, whatever attorney Casey winds up with next would probably instruct him to say he thought the phone attorney was his actual attorney. So then it’s protected by attorney-client privilege.”
“AKA, we’re not getting you a warrant. But thanks for the time for introductions. Call us when you actually have something,” Barba smirks while Quinn pulls out a pen and a bright pink sticky notepad from her coat pocket. She jots down her cell and office numbers on it and hands it to Liv.
“My cell is the best way for you to contact me, but I’m also right across from his office,” she motions to Barba as she hands it over. Liv holds up the sticky note and thanks her for it. Barba and Quinn leave the precinct together leaving the squad stunned hi her wake.
“Not only did he just meet his match, but I think we’ve met ours,” Liv says as they walk away.
“Yeah well I think I’m going to marry her,” Sonny smiles.
“And when she finds out you’re in law school and were still pushing for that warrant?” Rollins asks.
“Yeah well I guess that’s not a good look is it?”

stare decisis - a masterlist
rafael barba x original female character
(a/n: timeline is a little wonky, starts at the end of season fifteen but Sonny is already there and Murphy is not CO of SVU, I just love Sonny too much to start the fic a season later)
When Assistant District Attorney Quinn Brady lateral transfers from the Queens Gangs Unit to Manhattan Special Victims on orders of the District Attorney feathers are ruffled. Preexisting ADA Rafael Barba struggles with introduction of co-counsel after flying solo for years and the SVU detectives enjoy answering to two attorneys much less than they enjoyed answering to one.
Follow Manhattan's elite detective squad as this new addition changes things for the better . . . or for the worse.

Rafael Barba Appears at the 16th Precinct Again
Tumblr media
Rafael Barba x gn!reader
warnings: angst, grudge holding.
You all but crash into the conference room at the 16th, anxious to tell the squad that Mickey Davis had gotten some hot shot attorney, that you had heard courthouse gossip about it. The door swings open and you're met by Kat, Fin, Rollins, and Rafael.
His green eyes almost darken at the sight of you. He's not shocked that you're here, it's just the shock of not having seen you in years that strikes him. Taking in the crowd in the room you barely blink before spitting out at Rafael, "oh I'm sorry, I didn't mean to interrupt, you just look like someone I used to know," before spinning on your heel and storming back out into the squad room. You don't even look up at Liv and the deputy chief as they pass you. Amanda follows after you after Rafael is pulled into Liv's office by the Captain and Deputy Chief Garland. You're sat at your desk, head up in a thousand yard stare.
"Well I think you definitely hurt his feelings, if that's what you were going for," you're broken from your gaze by her speech and you look up to her from your seated position.
"After what he put me through I think what I said was fairly tame."
"You might be right about that, but maybe think about what he's been through too. He nearly threw his entire career away and had to leave you in the process," she tries to reason with you but your eyes narrow as she keeps talking.
"He didn't have to leave me and he should have talked to me first. I showed up to work one day and he was gone. The man I loved left me without a single word. It felt like my life fell apart," you seethe. Amanda looks over your shoulder to see Rafael standing behind you.
"That's very mature of you," she says before walking away, he walks up behind you and gently lays a hand on your shoulder. But you hadn't notice him yet so as he makes contact with your body you jump to face him, hand on your holstered weapon.
"Woah," he throws his hands up, "its just me," you scoff but remove your hand from your hip.
"Just you? Just you?" You start to pace back and forth in front of him, searching for the words to tell him off. But deep down you're glad to see him, he looks healthy, the beard he's grown compliments him.
"We should talk."
"Oh you want to talk now? But you didn't want to talk four years ago when you left," you all but shriek, your voice sparking the attention of those in the precinct. "You pulled the plug on someone's baby, were charged with murder, acquitted, and then you left me. And you didn't talk to me about any of it. We were supposed to be together and you left me out of it," your voice continues to raise as you takes steps closer to him, ending up in his face. His eyes search yours trying to find the person who he had once loved, but all he find is someone who has undoubtedly been incredibly hurt by his actions. The tears are threatening to spill from you eyes but you stay strong. Your raised voice causes Liv to step outside of her office.
"Both of you, take it outside. Now," you glance between Rafael and Liv before turning on your heel and storming out with Rafael following close behind. You meet again in the elevator where this time you stay silent.
"I didn't know how to tell you I was leaving, so I just left," he says quietly. "It wasn't the right thing to do, you didn't deserve that, but I needed to leave here. I was suffocating," the both of you stare at the elevator doors, not daring to look at one another. You reach up and hit the elevator switch, stopping the elevator in its descent.
"No, I didn't deserve that," a tear escapes your left eye at last, but you don't wipe it away. "You threw me away like I meant nothing to you. I would have went with you if you had just talked to me."
"You meant everything to me. I just couldn't let you throw your NYPD career away to come with me on the campaign trail. You were just getting to the point of being on the precipice of making sergeant," his eyes are now glued to the side of you head while you keep looking at the doors. You take a second to think about what you're going to say before raising your voice and making direct eye contact.
"Yeah well I failed the sergeant's exam twice since you left so I'll only ever be a detective now," Rafael can feel the holes your eyes are burning in him, his breath kicks up and he's uncharacteristically speechless for a moment. You huff and flip the elevator switch again allowing it to continue its descent. The doors open on the ground level of the 16th and you start to take a step out when he speaks.
"The day I did what I did to Baby Drew I was meant to pick up a ring. An engagement ring," he hangs his head, not looking at you.
"Oh so one day you were thinking about getting married and then next you were throwing everything we had together away? I don't know why you came back, but I don't think there's any fixing this. Not right now anyway," you shake your head as a few more tears fall.
"Liv and Fin called me," he admits.
"Oh even better, you didn't even come back for me. Tell Liv that I'll be back in a little bit," you storm out of the precinct. Rafael runs a hand through his hair as a tear now escapes one of his eyes. He composes himself quickly then presses the floor number of the squad room to go back up.
"I really fucked that up," he says to himself.
