El concurso para personero: un efecto dominó?

El lío en el que se encuentra la mesa Directiva del Concejo Municipal por el concurso de méritos paa la elección de Personero es tan grave que varias cabezas estarían rodando y hasta las curules de concejales repitentes.

El oficio enviado al Concejo por el rector de la Universidad del Cesar Rober Romero Ramírez, desautorizando la ejecución del convenio inter administrativo por $30 millones firmado por el ex Vicerector en calidad de ¿Representante Legal? Orlando Seoanes Lerma porque el funcionario que hizo estas veces no tenía la autorización para hacerlo, por lo tanto perdería toda legalidad, es apenas la punta del iceberg que tiene en lios a la mesa directiva, al secretario y logicamente al presidente del Concejo Jhon Blert Corena.

Y es que el 28 de junio del 2023 se firmó el acta de inicio con esa Universidad en la que Orlando Gregorio Seones, hasta ese momento Vicerector Administrativo, fungió como representante legal del alma mater El convenio tuvo un costo de $30 millones y el plazo de ejecución fue de cinco meses. De ese convenio fue delegado como Supervisor el Secretario de la corporación Franklin Andrés Nuñez Cuellar.

El presidente del Concejo Jhon Blert Corena, basado en las certificaciones que acreditaban la experiencia e idoneidad en la ejecución de convenios similares desarrollados por esta universidad en los municipios de Plato, Magdalena, San Juan del Cesar, Aguachica y El Piñón, Magdalena, valida el convenio.

Sin embargo, es claro el rector cuando dice en el oficio enviado al Concejo, el pasado 2 de enero del 2024, que esa entidad a la que representa no tiene la idoneidad para contratar.

Y entonces, cómo contrató con otros municipios como lo acreditan las certificaciones aportadas por los concejos donde supuestamente hizo ese ejercicio?. Sabían las directivas de la Universidad de la ejecución de esos convenios?

Pero lo más grave es que la Oficina Jurídica de la Universidad del Cesar certificó que ahí no reposa ningún soporte o documento que garantice la firma y ejecución del convenio. Y es que, como lo asegura su rector, el manual de procedimiento aprobado por la oficina de Planeación, todo convenio o contrato que suscriba la Universidad debe ser proyectado o tramitado y reposar copias en la Jurídica.

Y aunque el Vicerector aceptó que firmó el acta de inicio del convenio con el Concejo de Barrancabermeja y cuenta con documentación y soportes de este convenio, no hay copia en la Universidad.

Es necesario resaltar que el Vicerector tenía autorizada delegación de funciones para suscribir contratos y convenios, y respaldado por tal delegación actuó. Sin embargo, desde el 2022 a traves de la resolución 1475 del 2022 se dejaba claro que todo convenio suscrito debía pasar por la Unidad de Contratación y no lo hizo así. Eso claramente deja sin piso la ejecución de un convenio como este.

De acuerdo a las clausulas del contrato, el contratista recibió los pagos pues estos estaban supeditados a la entrega de los resultados de la lista sde admitidos y de publicado el resultado definitivo, etapas que sobre el papel se cumplieron y el 20 de noviembre, como así consta, la Universidad aportó los resultados definitivos.

Sin embargo, la Universidad desautorizó ese convenio alegando que no existen contratos ni actuaciones que acrediten la ejecución del convenio. Curiosamente, ese mismo día, en que se entregaron los resultados, la Universidad a través de la resolución rectoral 3751 despojó de la delegación de funciones que hasta ese día tenía el Vicerector. El 1 de diciembre éste presentó renuncia irrevocable del cargo.

Aunque el oficio del rector de la Universidad, en el que evidencia los vicios que dejarían sin piso el convenio, tiene fecha 2 de enero del 2024 sorprende que el 31 de diciembre del 2023 los vicepresidentes de la mesa directiva saliente Edgardo Moscote Pava y Jorge Escalante firmaron una resolución 081 del 31 de diciembre del 2023 dejando sin piso la resolucion 076 que daba continuidad a la programación. Esa resolución que revoca la 076 no tiene la firma del presidente y representante legal hasta ese momento del Concejo, Jhon Blert Corena ni del secretario quien a la vez fue supervisor del contrato.

Si trazamos una línea de tiempo nos damos cuenta que el rector de la Unicesar advertía el presunto entramado de corrupción que se dio con ese contrato.

El 10 de noviembre, 10 días antes de conocerse los resultados definitivos se le informa al Concejo que el Vicerector no estaba autorizado para la suscripción del contrato.

El 13 de diciembre en un nuevo oficio la Oficina Jurídica de la entidad les informa acerca de la denuncia instaurada ante la Fiscalía curiosamente por parte del Vicerector solicitando investigar la ejecución de este contrato, además de la resolución que le terminaba las facultades otorgadas al vicerector para suscribirlos.

El 14 del mismo mes el rector de la Universidad también hace llegar al Concejo la copia de la denuncia instaurada, ésta vez por el Representante legal de la Unicesar.

Sin embargo, el 27 de diciembre los miembros de la mesa directiva y concejales Jorge Escalante y Edgardo Moscote y el secretario del Concejo, y Supervisor del Contrato, decidieron adoptar sin la firma del presidente Jhon Blert Corena, la resolucion 076 considerando que no hubo reclamaciones por parte de los aspirantes y estableciendo el cronograma para la elección del personero que debería darse el 7 de enero del 2024.

Sin embargo, estos dos miembros decidieron adoptar el 31 de diciembre la resolución que revocaba el mismo acto administrativo que ellos el 27 habían establecido. Empero, si bien es cierto, para la mesa no hubo reclamacones, ya conocían de la advertencia que les hizo la Universidad y que está contemplada en la resolución 081 del 31 de diciembre.

Surgen varias preguntas: El Concejo pagó la totalidad del contrato? Qué tipo de correos o mecanismos se utilizaron para la recpeción de información por parte de la Universidad, conociendose que el Vicerector no estaba autorizado para firmar convenios?

Si desde el 10 de noviembre, 10 días antes de conocerse los resultados de las pruebas,por parte de la Universidad, se conocía que el Vicerector no estaba autorizado, por qué decidieron seguir con el cronograma?

Por qué el Presidente no firmó las resoluciones 076 y posteriormente la 081 que la revoca?

Fue viernes, último de mes. La gente pidió por un primer milagro. Santa Quincena y los angelicales cestatickets fueron olvidados –a pesar de la innegable necesidad–. Prioritario fue observar, en vivo y directo, el promocionado acto con las rigurosidades de la bioseguridad en pandemia. Ese camino que permitirá al hijo de Benigno María Hernández y Josefa Antonia Cisneros, transferir sus virtudes humanas a la cima del cielo, jovialidad incluida por su afición a la música en aquella decimonónica Venezuela casi aldeana –tocaba piano y violín y bailaba como el que más–, luce plagado de deseos imposibles que de cumplirse ojalá la cúpula sacerdotal capte tan velozmente como otros que sin previo aviso pasaron el umbral y se instalaron a la diestra de Dios Padre luego de sus legales canonizaciones. Si hay un cybersanto europeo, por qué no puede haber un santo médico y musicólogo, virtud irrefutable del beato criollo que con la ciencia atendía males físicos y con música y baile alegraba su espíritu y el de sus allegados. ¿No cree usted? Aunque como está el país y el mundo, al hijo ilustre de Isnotú le corresponde atender peticiones más de índole moral que científica. ¿Será poner la vara muy alta al doctorcito? Nada debería resultarle imposible. Por eso se oyen y se leen peticiones –de ateos y feligreses– de todo tipo, deseos y anhelos que van de lo individual a lo colectivo… Juzgar y ser juzgado Si la Biblia y las santas escrituras son más extensas, en centímetros por columna, que el Quijote de Cervantes, por qué la beatificación estuvo amenizada con el canto sepulcral que interpretó un desconocido aspirante a prelado sobre el versículo 25:35-46 de Mateo, cuyo contenido pareciera contrario al unionismo y anti intervencionismo demandado en un video horas antes por el argentino, jerarca católico, Francisco. “Todo lo que hicieron a mis hermanos necesitados a mí me lo hicieron. Entonces me volveré a los de la izquierda y les diré: ¡Apártense de mí, malditos, al fuego eterno preparado para el diablo y sus demonios”…Silencio sepulcral. ¿Un desliz de la élite católica criolla en tan especial momento aguardado por más de 70 años? Extraña manera de subsanar la evidente fractura social y política. Un minuto más tarde el jefe del nuncio apostólico, Aldo Giordano –palabras más, palabras menos– editó sin música la misma parábola y con ambidextra tolerancia omitió los sonoros epítetos. ¿Milagro rectificador? Ave María Purísima. El orientador mensaje del jesuita Jorge Mario Bergoglio quedó bloqueado en las redes sociales. Increíble excusa: “Quien subió el mensaje lo borró”. ¿Quién domina la plataforma youtube? Milagro hubiese sido darle like para, como buenos samaritanos, imitar al beato andino. No obstante, lograron bajarlo a otras plataformas y aunque sin llegar a trending lograron difundirlo. Milagros muy esperados El milagro más solicitado fue el fin del coronavirus y todos sus vestigios. Que se cure Ulises --mi hermano-- y todos los afectados. Hay mucha fe en ello, porque si de algo sabía el venerable era de medicina y esas cosas de salud. Para ella vivió, y garantizando la de un paciente murió.

Surgieron otras peticiones. Quizás, unas más lógicas que otras. Milagro justiciero. Que le caiga el peso de la Ley a quien atentó contra la vida de Yaxuri Solórzano. Es dicotómico porque sin ese delito no hubiese existido la víctima que visibilizó la causa. Ese, esos y todos los delincuentes merecen similar destino que el coronavirus: su neutralización. Milagro de cordura y paz. Ninguna fuerza pública puede negociar con hampa común ni permitir la creación de cuerpos paralelos para administrar (in) seguridad ciudadana. ¿Milagro sexual? Tolerancia cero con agresores de menores de edad y personas abusadas sexualmente. Cesen los crímenes de odio y la violencia de género. Milagro de reconocimiento. Profesionales de la medicina, enfermería y todo el personal de salud, así como educadores y otros pilares creadores de vida y crecimiento integral del país deben ser reconocidos, respetados y dignificados. Cero piratas. Milagro presencial. ¿Cuándo aparecerá el profesor Carlos Lanz? Lo esperan vivo y sano. Como él, cuántos más…Ver para creer...No fue así, lamentablemente... Milagro de multiplicación. Jesús multiplicó panes y transformó agua en vino. ¿Quién multiplica los salarios y dignifica el poder adquisitivo? Hay teorías y estrategias al respecto. Buscar menos culpables y trabajar más unidos en la solución podría ser parte del milagro, con un punto de honor: desaparecer “for ever” el bendito dólar y el website que from Colombia mueve la economía de our milmillonario country. Increíble que el recién anunciado aumento no alcance ni para un cartón de huevos… Milagro de humildad: Aplicable a los líderes de todas las tendencias. Y aunque son minoría, en el discurso se rasgan vestiduras por amor al pueblo mientras en la práctica malogran la quimérica justicia social. Milagro de alcurnia: Como dijo un profesor amigo, ¿debe JGHC apelar a su segundo apellido para acceder al olimpo católico? Tantas peticiones que lucen inalcanzables allanan de imposibles el camino a la santidad del humilde médico, quizás por eso las lágrimas derramadas por su imagen en un liceo de Charallave (certificado por su directora, profesora Dilcia Millán)… Creer o no creer. Chimienti said Wendy's also inflated the amount of toppings it uses.In a 19-page decision, Gonzalez said the chains' efforts to made their burgers look appetizing was "no different than other companies' use of visually appealing images to foster positive associations with their products."He said McDonald's and Wendy's were not legally obligated to sell burgers by advertising them, and that their websites provided "prominent, objective information" about the burgers' weight and caloric content.Gonzalez also said it is not misleading to depict fewer toppings than the plaintiff's "personally preferred amount."Lawyers for Chimienti did not immediately respond on Monday to requests for comment. It is funny but in the Perfect 'Verse (and in each and every 'verse I get to think of), the Alcantara siblings (original characters) would call Jo Gar out if he stepped out of the line however mildly he sounded it, but would defend him from anyone who'd try putting him down regardless. And it is not just because he is their late cousin's friend but that they believe that good friends call each other out when needed, and that is a good thing. It is just that they wish that Jo Gar can freely express his own pain and frustration but they won't force him if he doesn't want to.

With Sadi Ratan, meanwhile, it ranges from indifferent to downright hostile. Gregorio would rather be preoccupied with teaching students than have the additional worry about the childish behavior of a grown man. Magdalena does not like him but she keeps everything professional and tries not to take out her scalpel. Edilberto is outright hostile towards the lieutenant because he loathes the way the lieutenant tries go after Jo Gar and doesn't learn his lessons despite being warned of the personal and legal repercussions he may face. Gertrudis thinks he is handsome but his negative attitude puts her off and it is easy to troll him at times. Arnulfo, well, would rather wonder if one of his professors is hungover from his night job as a cabaret musician than think about how the lieutenant could have been that musician's musical muse if he ditches his rudeness.

But then again, the siblings have lives of their own and they would rather not be caught up in their shenanigans.

Article 1407

In a contract where both parties are incapable of giving consent, express or implied ratification by the parent, or guardian, as the case maybe, of one of the contracting parties shall give the contract the same effect as if only one of them were incapacitated.

If ratification is made by the parents or guardians, as the case may be, of both contracting parties, the contract shall be validated from the inception.

Where both parties to a contract are incapable of giving consent, the contract is unenforceable. However, if the parent or guardian, as the case may be, of either party, or if one of the parties after attaining or regaining capacity, ratifies the contract, it becomes voidable.

If the ratification is made by the parents or guardians, as the case may be, of both contracting parties, or by both contracting parties after attaining or regaining capacity, the contract is validated and its validity retroacts to the time it was entered into.

Badillo v Ferrer

Facts:

Macario Badillo died intestate on February 4, 1966. He was survived by his widow, Clarita Ferrer, and five minor children: Alberto, 16, Nenita, 14, Hilly 12, Cristy, 9, and Maria Salome, 5. He left a parcel of registered land of 77 square meters in Lumban, Laguna, with a house erected thereon, valued at P7,500.00. Hence, each of his five minor children had inherited a 1/12 share of the P7,500.00 or P625.00 each.

In 1967, Clarita the surviving widow, in her own behalf and as natural guardian of her minor children, executed a Deed of Extrajudicial Partition and Sale of the land in Lumban in favor of the spouses Gregorio Soromero and Eleuteria Rana. A new transfer certificate of title was thereafter issued to Soromero and Rana.

In 1968, Modesta Badillo (Macario's sister and aunt of the five minor children) was able to obtain guardianship over the persons and properties of the 5 minor children, without personal notice to their mother, who was alleged "could not be located inspite of the efforts exerted."

In 1970, Modesta caused the 5 minor children to file a complaint in court for the annulment of the sale of the Lumban property to Soromero and Rana. The complaint likewise averred that, even if such sale were valid, the five minor children as co-owners were allowed to exercise the right of legal redemption.

Issue:

Whether or not  the Deed of Extrajudicial Partition and Sale is a voidable or an unenforceable contract?

Held:

It is an unenforceable contract. The Deed of Extrajudicial Partition and Sale is not a voidable or an annullable contract under Article 1390 of the New Civil Code. Article 1390 renders a contract voidable if one of the parties is incapable of giving consent to the contract or if the contracting party's consent is vitiated by mistake, violence, intimidation, undue influence or fraud.

In this case, the 5 minors were not even parties to the contract involved. Their names were merely dragged into the contract by their mother who claimed a right to represent them.

Art. 1403(1) of the NCC provides that a contract is unenforceable, unless ratified, if the contract was entered into in the name of another person by one who has been given no authority or legal representation, or who has acted beyond his powers. Art. 1317 NCC further provides that "no one may contract in the name of another without being authorized by the latter, or unless he has by law a right to represent him," and that "a contract entered into in the name of another by one who has no authority or legal representation, or who has acted beyond his powers, shall be unenforceable, unless it is ratified, expressly or impliedly, by the person on whose behalf it has been executed, before it is revoked by the other contracting party."

 In the present case, Clarita did not have authority to convey to Soromero and Rana the undivided share of her minor children. Consequently, the subject deed was unenforceable.

Rosario Mata Castro and Joanne Benedicta Charissima M. Castro, vs. Jose Maria Jed Lemuel Gregorio and Ana Maria Regina Gregorio

Case Digest

Facts: 

Atty. Castro was allegedly married to Rosario Castro (Petitioner). Unfortunately, they separated later on due to their incompatibilities and Jose’s alleged homosexual tendencies. Their marriage bore two daughters: Rose Marie, who succumbed to death after nine days from birth due to congenital heart disease, and Joanne Castro (Petitioner).

On 2000, a petition for adoption of Jose Maria Jed Gregorio (Jed) and Ana Maria Regina Gregorio (Regina) was instituted by Atty. Jose Castro. Atty. Castro alleged that Jed and Regina were his illegitimate children with Lilibeth Gregorio (Rosario’s housekeeper). After a Home Study Report conducted by the Social Welfare Officer of the TC, the petition was granted.

Rosario and Joanne filed a petition for annulment of judgment seeking to annul the decision of the TC approving Jed and Regina’s adoption. Petitioner allege that Rosario’s consent was not obtained and the document purporting as Rosario’s affidavit of consent was fraudulent.

Issue:

Whether consent of the spouse and legitimate children 10 years or over of the adopter is required?

Held:

As a rule, the husband and wife must file a joint petition for adoption. The law, however, provides for several exceptions to the general rule, as in a situation where a spouse seeks to adopt his or her own children born out of wedlock. In this instance, joint adoption is not necessary. But the spouse seeking to adopt must first obtain the consent of his or her spouse.

In the absence of any decree of legal separation or annulment, Jose and Rosario remained legally married despite their de facto separation. For Jose to be eligible to adopt Jed and Regina, Rosario must first signify her consent to the adoption. Since her consent was not obtained, Jose was ineligible to adopt.

The law also requires the written consent of the adopter’s children if they are 10 years old or older (ART. III, Sec. 9, RA 8552).

Since the trial court failed to personally serve notice on Rosario and Joanne of the proceedings, it never validly acquired jurisdiction.

è trascorso poco più di un anno dalla pubblicazione “Delle pene senza delitti - istantanea del Cpr di Milano”, report effettuato al centro di permanenza per il rimpatrio in via Corelli 28 dal senatore Gregorio de Falco e dalla Senatrice Simona Nocerino. La volontà era quella di rendere pubblica la condizione dei “detenuti” all’interno delle strutture anche a tutti coloro che non vi hanno accesso, ai comuni cittadini, e di denunciare lo stato di degrado in cui i soggetti si ritrovano. 

A livello nazionale, ad oggi sono dieci i centri volti a svolgere questa funzione? Ma di cosa si tratta nello specifico?

l’ordinamento disciplina queste strutture nel Testo unico sull’immigrazione, designandolo come un luogo funzionale per ospitare gli stranieri irregolari destinatari di un provvedimento amministrativo di espulsione, cioè nel solo caso in cui l’espulsione non può avvenire in maniera immediata. Il tempo massimo di permanenza (che deve essere convalidato dal giudice di pace entro 48 ore) è ad oggi di 90 giorni, prorogabili di altri trenta nel caso in cui l’Italia abbia concluso un accordo con lo stato da cui il soggetto proviene. Per un soggetto richiedente asilo che viene configurato come “pericoloso per l’ordine pubblico e la sicurezza” i tempi possono dilatarsi fino ad un massimo di 12 mesi. 

Questi centri, 10 in tutto il territorio nazionale, sono stati condannati dalla corte Edu nel 2016 in violazione dell’art 6 CEDU, sostenendo che gli stranieri fossero privati della propria libertà senza alcuna base legale e senza possibilità di fare ricorso all’autorità giudiziaria.
