Following is an excerpt from the FDA's response to the Right to be Smoke-Free and Nicopure lawsuit. "Plaintiffs acknowledge none of these risks. Their briefs give no inkling that nicotine is highly addictive, that e-liquids often contain toxic chemicals, or that e-cigarettes can explode. Instead, Plaintiffs contend that e-cigarettes should not be regulated at all, because they are generally “safer” than conventional cigarettes—one of the deadliest products ever brought to market. But that is rather like saying that cars should not be regulated because they are safer than motorcycles. News Alert via SFATA: "We were just made aware of a U.S. Consumer Product Safety Commission letter dated TODAY (July 22, 2016) with revised industry guidance on The Child Nicotine Poisoning Prevention Act of 2015 (CNPPA). Today’s letter states, “Upon further legal analysis, CPSC staff has determined that the CNPPA applies to existing inventory on its effective date. Thus, beginning on July 26, 2016, the sale of liquid nicotine in non-compliant containers is prohibited. Chris Hughes is a very good friend of ours and it breaks out heart to bring this to you. The following is a quote from Chris Hughes, the owner of Fat Cat Vapor in PA, he is also very involved in advocacy. "PLEASE SHARE THIS WIDELY: So as most of you are aware, the Pennsylvania legislature that is led by so called "conservative" Republicans, passed an abusive 40% tax on vapor products, that will absolutely wreck this young and extremely beneficial industry. This law imposes a 40% wholesale tax on hundreds of small mom and pop businesses in PA. The law also requires them to take an inventory on Oct 1st, and write a check to the state for 40% of the wholesale value of their entire inventory at that time. Most shops, mine included, could never hope to do that, so I will be closing in mid September. Bizarrely this law that also taxes smokeless tobacco, leaves cigars alone. I urge everyone to keep an eye on my posts in coming weeks, as I will be speaking extensively about why cigars were excluded, as well as releasing names of legislators that voted to devastate this industry. I will be starting with Republicans, because I'm under the presumption that they were elected by promising to reduce taxes, or at a minimum not raise them, but there's lots of blame to go around. I advise all business owners to make signs like the ones below, and display them in your windows. I also recommend urgent voter registration drives in PA, because ultimately, we may need to settle this at the polls.
