Most popular city: New York, with 13 pieces, followed by Paris with 8, and Chicago is third with 7! Washington DC has 6, Florence, Madrid, and London all have 5, Philadelphia has 4, Dublin, Edinburgh, Mexico City each have three, and all the following cities have two: Boston, Cairo, Calgary, Cordoba, Helsinki, Houston, Jerusalem, Los Angeles, Munich, Ottawa, Prague, Vienna, Warsaw
Most popular museum: somehow the Art Institute of Chicago has the most with 6 pieces! Followed by the Museum of Modern Art with 5 pieces! The Museo del Prado has 4, the Philadelphia Museum of Art has 3, and the Ateneum, Louvre, Metropolitan Museum of Art, Museo Dolores Olmedo, National Gallery of Canada, Solomon R. Guggenheim Museum, Tate Britain, Tretyakov Gallery, and the Uffizi Gallery each have 2! In addition, the single works are spread out amongst 16 city level galleries (ie the Phoenix Art Museum), 5 state/provincial (ie Queensland Art Gallery), 25 national (ie National Gallery Prague), 8 museums named after benefactors (ie the Hirshhorn Museum), 7 museums dedicated to a specific artist (ie the Van Gogh Museum) and numerous other institutions! Churches, palaces, increasingly specific museums, museums that are named after their location rather than their governmental level... and of course a whole lot of private collections and pieces we were unable to find the location of!
Countries! 50 pieces are in the US! 13 in France! 12 in Spain! 7 in England, 6 in Canada and Italy, 5 in Russia, 4 in Ireland, Mexico, and Australia, 3 each in Germany, Austria, and Scotland, and 2 each in China, the Netherlands, Israel, Finland, Wales, Poland, Japan, Egypt, and India, and 1 each in Portugal, Ecuador, Thailand, Singapore, Belgium, Argentina, Sweden, the Czech Republic, Norway, Bangladesh, Saudi Arabia, and the Vatican!
Demographics! I revoked John Singer Sargents American status for these because he was born in Europe, and spent most of his life travelling around Europe. I tried my best to track down the correct numbers but honestly some of these are likely to be slightly off. I went with easily publicly available information like Wikipedia and where that failed the author's website. I also tracked people's birth countries in addition to where they lived / worked for most of their lives. Anyway! We have 74 pieces by American artists! 27 French, 22 English, 14 Russian, 13 Spanish, 11 Canadian, 9 Italian, 8 Chinese, 8 German, 6 Irish, 6 Polish, 6 Mexican, 5 Greek (four of those are Ancient Greece), 5 Ukrainian, 5 Japanese, 4 Australian, 4 Belgian, 4 Indian, 3 Serbian, 3 Armenian, 3 Dutch, 3 Austria, 3 Latvian, 3 Swedish, 2 each from Finland, Scotland, Malaysia, Cuba, the Czech Republic, and Norway, and one each from Israel (specifically), Portugal, Ecuador, Thailand, Switzerland, Denmark, Iran, Colombia, Chile, Estonia, and Egypt (albeit Ancient Egypt)
Including the one Israeli artist, we have 7 Jewish artists represented, as well as 4 Black, 6 Indigenous (one is half Kichwa, one is Sami, one is Haida, one is Ojibwe, and two are Australian Aboriginals. One of those is Kokatha and Nukunu, and the other one was a group project with eight artists who did the majority of the work, and 6 of those are from Erub Island but the articles did not specify further except that at least one of the eight is non-Indigenous), 1 Chicana, and 1 Asian-American (which I am specifying because I felt very stupid adding tallies to an Asian column when I already said there are 8 Chinese artists and 5 Japanese and 2 Malaysians and....). We also do have 16 artists that publicly identify as queer in some fashion! I have listed 9 works by gay men, 2 works by lesbians, and 5 that have chosen to use "queer" instead of other labels.
And on that note.... we have 155 works by men, 51 by women, and 2 by nonbinary artists!
Most represented artists! Frida Kahlo and René Magritte tied with four works each! Félix González-Torres, Francisco Goya, John Singer Sargent each have three! And the artists that have 2 artworks each are... Claude Monet, Dragan Bibin, Edmund Blair Leighton, Francisco de Zurbarán, Gustav Klimt, Holly Warburton, Hugo Simberg, Ilya Repin, Ivan Aivazovsky, Jacques-Louis David, Jenny Holzer, Louis Wain, Pablo Picasso, Sun Yuan & Peng Yu, Victo Ngai, Vincent van Gogh, Pierre-Auguste Renoir, and Leonardo da Vinci (although the second is debated attribution)! That means that 205 of the works are not by any of the above! Some have unknown artists (we've got THREE CAVE ARTS) but most are just... really varied!
And lastly, years painted (as sorted by year finished and not year started). Who else loves when something is listed as "13th century"?? Not me, that's who. This is going to be a lot of numbers, and there's no real way to make it more readable. so..... feel free to skip!
The oldest two submissions are from circa 40,000 years before present, and 30 to 32 thousand years before present! Six more artworks came to exist before 0 (CE or AD depending on who you're talking to), and 7 before 1000! 2 from the 1200s, 6 from the 1400s, 8 from the 1500s, 3 from the 1600s, and 5 from the 1700s! Several of those already listed were started in a previous ....age category (for instance, one has no specified date other than 7300 BC to 700 AD) but once we hit 1600, everything is usually finished in a relatively short timespan. 6 are from 1800-1850, 9 from 1850-1880, and the 1880s are extremely busy. 1 from 1881, 3 from 1882, 1 from 1883-1885, 5 from 1886, and two each from the next four years (1887-1890)! 6 from 1891-1895, and 5 from 1896-1900!
We've got 3 from 1901 or 1902, 4 from 1903, two each from 1906 and 1907, and one each from 1908 and 1909! 3 from 1910-1915, 3 from 1917, 2 from 1918 and one from 1919! 6 are from the Roaring Twenties, three of them specifically from 1928! 4 from 1931-1935, and only 3 from the latter half of the 30s! There's 3 from WWII, and 4 from 1946-1949, 5 from 1951-1954 but only 3 from '55-'59. 5 from the sixties, 7 spread out through the 70s, and 10 from the 80s, two each from 81, 82 and 84. The 90s have a lot of duplicate and triplicate years, totaling 20 overall! 11 are from 90-95, the other 9 are 96-99. 7 from 2001-2005, and 8 from 2006-2009. 9 from 2010-2014, 3 from 2015, 6 from 2016, 5 from 2017, 1 from 2018, 3 from 2019, 5 from 2020, 1 from 2021, 4 from 2022, 11 from 2023, and 3 ongoing projects! Whew! If anyone wants it listed By Year instead of in groups like this, that'll be most readable in like... list form and that's way too long for a stats post.

Holy shit that internet archive post just made me have a revelation.
When you buy a physical book you can lend it to whoever you want. Physically. You can read it aloud to 50 people or ship it to your friend in another country. You can do that with DVDs too. Have a sleepover, a watch party, send it abroad. As long as it’s not on a large enough scale for the companies to find out. Showing Hamilton on a sheet as a block party with ~ 20 people who knew vs showing it at the local movie theater.
But when it comes to digital versions, do you even own your book? Your movie? If they can revoke access, or sue for sharing or uploading… What makes an email with a zip file different than me lending a book? I guess the fact that there is now another copy out there that wasn’t paid for.
But if digital lending works like rental instead of a copy…
So the lawsuit started with the National Emergency Library, which from what I understand removed the limit to the number of people that could borrow any one book at once to help combat the loss of resources for thousands of students. Four publishing houses took issue with this and opened a lawsuit, maintaining it even after the NEL was closed just a few months later in June of 2020. They want every single book taken down, and a chunk of change each. They don’t like that IA is scanning physical books then putting the whole thing on a public website, while simultaneously in the document saying they have no problem with libraries who follow similar procedures. And the licensing of ebooks essentially makes them function like Netflix. Spotify. Microsoft office. Heated seats. On a pay as you want it basis instead of owning what you buy. Someone from IA made the point that if the lawsuit succeeds it undermines the ability of libraries everywhere to preserve their collections.

Angery bite bite rage
Not that I really bought ebooks at all recently except as textbook rentals, but I’m going to be avoiding “buying” digital copies of anything from now on. Heads up y’all, CDs are sometimes cheaper than mp3 albums. There are second hand book shops on ebay that do sales often. I live in a small town rn without a bookstore, and I cannot tell you how many books I’ve gotten for less than $5 a piece. If anybody has alternative let me know but Amazon often sells box sets of movies on the cheap. I got all three Kung fu panda movies for maybe $15 bucks, they have the httyd series for 12.
It’s slow going on the movie and music front for me, the amount I want to buy vastly outprices my monthly netflix, hulu, and spotify payments. But I’m more determined than ever to chip away at it.
Libraries should be more heavily protected and supported and internet archive is a library. Thanks for coming to my TED talk.

A BAD DAY FOR DEMOCRACY


WF THOUGHTS (4/25/24).
It was a depressing day. Every day, the prospects for maintaining our democracy seem to get dimmer. Today, during oral arguments in the case about presidential immunity for Donald Trump, the Supreme Court injected a new dose of darkness.
Before today, I fully understood the fact that the Supreme Court is corrupt. I fully understood that in many cases, particularly the most important cases, the Justices are nothing more than political actors. Despite my dim view of the Court, I really thought that it would do the right thing today. The idea that American presidents and ex-presidents enjoy “Crown Immunity” under the guise of “Presidential Immunity” is preposterous, outrageous, and undemocratic. Because the idea is so bizarre, I figured that even corrupt Justices would put their partisan motivations aside and stand up for democracy and the rule of law. Sadly, I was wrong.
I shouldn’t have been so surprised. After all, this is the same Court that has been steadily attacking freedom and democracy. It has recently issued decisions that restrict voting rights. Ignoring 50 years of precedent, it recently revoked protections for women’s reproductive rights. I should have seen the writing on the wall and guessed that some of the conservative Justices would be open to the concept of supporting autocracy by putting an ex-president above laws that apply to all other citizens. I need to change my mindset and start operating under the assumption that, particularly in cases involving freedom and democracy, this Court will do the wrong thing. That’s depressing. There was a time when I admired the Supreme Court. Those days are gone.
Here’s the short opinion that should be issued by the Court:
“Except for actions taken to exercise specific powers granted under Article II of the Constitution, American presidents and ex-presidents are not entitled to immunity from criminal prosecution. Like all other citizens, presidents and ex-presidents must follow the law and they are subject to criminal prosecution if they violate the law. In this case, the actions allegedly taken by Defendant Trump do not arise from the exercise of any presidential power granted under Article II. Therefore, Defendant Trump is not entitled to any immunity with respect to the pending criminal charges and the trial court is instructed to bring the matter to trial with all deliberate speed.”
Normally, the Supreme Court prefers to focus on the narrow issues presented in the matter. It won’t address issues that don’t need to be addressed to decide the specific case before the Court. That norm was thrown out the window during the arguments today. A bunch of the conservative Justices kept throwing spaghetti at the wall to see what would stick. Three of them openly pursued outrageous lines of argument. This group clearly believes that Trump did nothing wrong and that he’s being pursued by overzealous prosecutors. Two other conservatives were more subtle with their attempts to complicate this simple case. All sorts of extraneous issues were discussed by the conservatives. The motive of these Justices- -particularly the three most vocal conservatives- -was obvious. They want to stall this case as long as possible. They want to throw shovels full of sand into the gears. To shelter Trump from bad publicity, and assist his campaign, they want to block all of the federal Trump trials until after the election. Their hope is that Trump will win the 2024 election and order the Department of Justice to withdraw all federal litigation against him. As president, Trump would have that power. Isn’t it disgusting that Justices of the Supreme Court are actively engaged in such political games? That’s not how our top court is suppose to behave. The Supreme Court is supposed to be an independent branch of government, not an arm of a candidate’s campaign team.
How can the Supreme Court delay the proceedings against Trump? That’s easy. It has the power, using various procedural gimmicks, to send the case back to the lower courts for further hearings regarding the immunity issue. Until those hearings are concluded, and the case works its way back to the Supreme Court for another immunity argument, the federal cases against Trump will remain stalled. Use of these stall tactics will guarantee that no federal Trump case will go to trial before the election.
Let me close by telling you the most frustrating part of the story. At the end of the day, all of the Justices know that Trump does not have immunity from the pending charges. They know that they’ll eventually vote against any immunity for Trump in the pending cases. If Trump is not reelected and therefore unable to force the withdrawal of the charges, they know that Trump will face criminal trials on these charges. Nonetheless, they’re willing to use their judicial power to keep these cases out of the news and thereby enhance Trump’s chances of reelection. If Trump wins, he’ll kill all of the federal cases against him and the immunity issues will be irrelevant. If Trump loses, it will be obvious that the MAGA days are over and the Justices won’t care if Trump faces prosecution. Don’t we deserve better from Justices of the Supreme Court? Isn’t this a very sad state of affairs? The cases against Trump should be decided by a jury of American citizens, not by a court of political hacks.
Thankfully, there is an active criminal case against Trump in the New York State court located in Manhattan. The Supreme Court can’t stop that case, and it will be decided before the election. Trump is presumed innocent, and he’s entitled to the same due process rights that are available to all criminal defendants. Is Trump innocent, or is he a felon? A jury in Manhattan will answer that question for American voters. It’s a shame that we won’t know the outcome of all of the trials before Election Day. The Supreme Court should be ashamed of itself. It should be a beacon of democracy, not the tool of a political candidate who promotes autocracy.
I suppose that during the deliberation process it’s possible that one or two of the Justices will realize that they’ve disgraced themselves and the Court, that they’ve violated their oaths, and that they can partially redeem themselves by doing the right thing by pushing the Trump cases towards a prompt trial. Of course, I’m probably dreaming. I’ve got to stop doing that. We all need to accept the fact that the Supreme Court has become a nightmare.

Article 86 of the FAMILY CODE
Article 86. A donation by reason of marriage may be revoked by the donor in the following cases:
If the marriage is not celebrated or judicially declared void ab initio except donations made in the marriage settlements, which shall be governed by Article 81;
When the marriage takes place without the consent of the parents or guardian, as required by law;
When the marriage is annulled, and the donee acted in bad faith;
Upon legal separation, the donee being the guilty spouse;
If it is with a resolutory condition and the condition is complied with;
When the donee has committed an act of ingratitude as specified by the provisions of the Civil Code on donations in general. (132a)
EXPLANATIONS:
1. The celebration of marriage is necessary in the validity of donations propter nuptias when a donation was given by a party before marriage and it was not celebrates it may be revoked;
2.When the marriage takes place without the consent of parents or guardian who is required to have this consent and it was not or given for example ,Jose married Maria was 20 yrs old before their marriage and Maria was not given consent by her parents or guardian and Maria donated a property to Jose.The donation maybe revoked at the instance of Maria ;
3.When the marriage was annulled ,and the donee acted in bad faith the donation is revoked by the operation of law under Article 43(3), 44 and 50;
4.Upon legal separation and the donee being the guilty spouse ,one of the effectd of legal separation is the dissolution of their absolute community of property or congugal partner
5.if it is with a resolutory condition and the condition is complied with ,example X married Y and Y was studying ,X donated a property to Y in a condition that Y shall return the property after Y graduated .
6.When the donee committed and act of ingratitude to the donor,when the donee committed and offence to the honor ,or a criminal offense to the donor or when the donee refuse to give support to the donor then the donation maybe revoked .

Delaware Franchise Tax – A Guide and Common FAQs

Heard about a fee paid for being able to do business in a state? Maybe, yes. But ever heard about a fee paid for incorporating in a state regardless of doing business? In Delaware, people have heard about that too.
And do not get confused about the word, “Franchise”. It doesn’t refer to the franchise businesses but all the businesses incorporated in Delaware state are liable to file an Annual Report as well as pay the Franchise tax.
In this article, we will be answering common questions about this tax along with providing details about it.
What is the Delaware Franchise Tax?
Delaware Franchise tax is a fee for being able to own a Delaware company and it is imposed by the State Government. Every business has to pay it regardless of their business income, model, or company structure. It can be considered as a goodwill fee submitted to the state.
When is the due date for filing the tax?
Depending on the company type, the deadline of submitting the annual report and filing this tax can differ.
For corporations, the last date of filing the tax is March 01, every year, failing to which there is a penalty. Corporations need to pay US $200 as the penalty with a monthly interest rate of 1.5% on it.
For LLCs and LPs, the deadline is June 01, every year. The penalty of filing the tax late is the same as for corporations.
Remember that the tax needs to be paid even if there has been no business or loss in the calendar year. So, if the corporation has been shut down, it is important to revoke the Delaware business.
What information is required on the annual report?
You annual report of Delaware corporation requires the following information:
Legal name of entity
Total no. of authorized shares
Class and par value of those shares
Franchise tax and fees due breakdown
Principal business address
Business contact number
Names and addresses of all the directors
Name and address of at least one officer
Not just this, but it must be signed by an authorized signer. It could be the president of the corporation or any of the directors. It could also be the secretary or other duly authorized officers.
If it is one of the initial reports, then the incorporator can also become the authorized signer even if the board of directors is still under the election process. However, it is not allowed for subsequent annual reports.
How is it calculated?
The Delaware state uses two methods: Authorized Shares Method and Assumed Par Value Capital Method. A corporation has to pay less of the two methods.
Authorized Shares Method
It is used to calculate your taxes by considering the authorized shares. The taxes are as follows:
For less than or equals to 5,000 shares, it is US $175
From 5,001 to 10,000 shares, it is US $250
For every 10,000 shares and a portion thereof, US $85 keeps getting added in US $250
The maximum limit in this method is US $200,000.
Assumed Par Value Capital Method
It is a complex method to calculate tax as it includes total gross assets listed on your Schedule L. However, the minimum tax in this method is US $400. The maximum remains the same as the Authorized Shares Method.
Remember, in any case, you must add US $50 as the annual report fee along with the calculated tax.
The tax can be paid with the help of your service provider or can directly do it to the Delaware state.
Also, the non-stock or non-profit corporations are exempt and do not pay the standard Delaware Franchise Tax but they still need to submit the report and file taxes with the annual report fee of US $25.
For all the non-exempt, non-stock corporations, the tax is US $175 with no alternative method.
For large corporate filers, the maximum limit of Delaware Franchise tax is US $250,000.
What qualifies me as a “large corporate filer”?
Under Title 8 Section 503, the Delaware state has put the code for the large corporate filers. Corporations having consolidated gross income or consolidated gross assets of US $750 million or more come under the large corporate filers.

Apple's bid to overturn a decision by the European Union was dismissed by the court of justice of the European Union. The "Think Different" trademark remains revoked as the court rejected the appeal made by Apple over Swatch's "Tick Different" slogan stating that the objections are based on "misreading" of the ruling." The General Court dismisses the actions brought by Apple against the decisions of EUIPO revoking the word, sign THINK DIFFERENT," said the court. Swatch and Apple always accused each other of infringing Trademark consultancy. They have gone through multiple court cases relating to the infringement of the trademark. Swatch was sued by Apple in April 2017 for the similarity between Swatch's "Tick Different" line and Apple's "Think Different'' trademark. Switzerland's Federal court ruled that the slogan "Think Different" is not well known in the region. Apple stated that the original ruling was flawed. The European Union dismissed Apple's claims after Apple failed to prove that at least 50% of the Swiss people could associate the slogan "Think Different" with Apple.  Swatch won a similar case over the phrase "one more thing" in 2015. The phrase was already known to be associated with steve jobs. Apple got trademark registration under the EU for the word sign "Think Different" in 1997, 1998, and 2005. Since Apple was not using the trademark "Think Different" uninterruptedly for five years, Swatch took advantage of it and filed three applications for the revocation of the contested mark in 2016. Apple also complained that the Board of Appeal failed to recognize the sales figures of iMac computers in the European Union which were submitted in the witness statement of match 23rd 2017. But the sales figures only show the net worldwide sales for the year 2009,2010,2013 and 2015 and does not provide any details for the sales figures of the Imac in the European Union. The court stated that the evidence of genuine use submitted by Apple with EUIPO has many press articles showing the success of the Trademark consultancy  with the title “Think Different” in 1997 which is the time of its launch. But that evidence predates the relevant period by over 10 years.

Monsoon session: Suspended MPs won't apologise, continue protest

Jul 28, 2022 10:51 IST New Delhi , July 28 (Always First): Opposition MPs, who were suspended from the Rajya Sabha for disrupting proceedings, continued their protest near the Gandhi statue inside the Parliament complex on Thursday and asserted that there was no question of them apologising for their behaviour. "There is no question of apologising. We want to have discussions on price rise in Parliament but we were suspended. Our 50-hour-long protest will continue outside," said TMC MP Mausam Noor. Her comment came after Union Minister Pralhad Joshi's statement that suspension can be revoked if Opposition MPs apologise. Taking to a micro-blogging site, Joshi said," We are always ready for a positive discussion in the parliament, but the Congress party keeps disturbing the house. We are even ready to call back the suspended members, but the opposition should ensure that they do not disturb the house again." Another TMC MP Shanta Chhetri also hit out at the government saying they were only raising issues of the common people. "We are not going to apologise as we haven't done anything wrong. We've raised the issues of common people. The country is suffering from price rise and raising the issue is not wrong," said TMC MP Shanta Chhetri. Trinamool Congress (TMC) lawmakers on Wednesday staged a sit-in protest at the Gandhi statue outside Parliament on Wednesday over their suspension from Rajya Sabha. MPs who were suspended on Tuesday over 'unruly behaviour and disrupting proceedings' include Sushmita Dev, Santanu Sen, Dola Sen, Mausam Noor, Shanta Chhetri, Abhi Ranjan Biswar and Mohd Nadidul Haque. On July 27, Aam Aadmi Party (AAP) MP Sanjay Singh was suspended from the Rajya Sabha for the remainder of this week for "throwing paper on the Chair" during the proceedings. Singh was the 20th MP from the Upper House who was suspended for disrupting proceedings in this session. This is the highest number of single-batch suspensions in the Upper House. Meanwhile, a meeting of Opposition parties was held to discuss the issue of suspension of MPs. However, Aam Aadmi Party (AAP) and Trinamool Congress (TMC) skipped the meeting. Leader of Opposition in Rajya Sabha Mallikarjun Kharge said that the Opposition will submit a request to the Speaker of Lok Sabha and Chairman of the Rajya Sabha to rescind the suspension of the members who raised their voices against the price rise. Speaking to ANI, Kharge said, "The issues that we have been raising since the last 7 days regarding inflation and imposition of GST on essential commodities, today on the eighth day also we will raise our voice regarding the same. Common people are worried about this. We are also raising our voices continuously, but the government is not ready for discussion. I personally met the chairman and said that you allow the discussion and tell the date and time, we will be ready for discussion, but the government is not ready to accept it. We will submit a request to the Speaker and the Chairman to rescind the suspension of the members who raised their voices against the price rise." He further said that the suspension of MPs which has been done at the behest of the government and should be withdrawn with immediate effect. On July 25, four Congress MPs including Manickam Tagore, Ramya Haridas, Jothimani and TN Prathapan were suspended from the Lok Sabha for the entire Monsoon session for their 'unruly behaviour and disrupting proceedings.' In 2016 when people voted for Brexit, there was no clear definition of what Brexit would mean for the country, and all the campaigns made completely false promises.
Now, so close to the departure date, it is much clearer that Brexit will spell disaster for the UK. Here are just some of the things it will affect:
We’re extremely likely to see food and medicine shortages
A minimum of 5,000 jobs could be lost in London alone
EU grants for environmental protection, scientific research and development, and energy will be lost.
We’re already losing medical professionals: 10,000 quit in the year following the referendum, and the number of nurses from Europe registering to work in the UK has fallen by 90%.
The Troubles could be reignited due to the Irish border disagreements (already this year there have been bomb threats in London from people calling themselves the IRA).
Tariffs will increase prices of thousands of products some by more than 50%. Tariffs will also cause inflation to increase and therefore lower our standard of living.
Brexit will not be good for the UK in any way, shape, or form, so let’s do all we can to prevent it happening.
