California Supreme Court denies cannabis for prison inmates 8/18/21

Court denies cannabis for prison inmates (The Center Square) – California’s high court has reversed a lower court’s ruling declaring that inmates in state prisons have the right to possess up to an ounce of marijuana. The California Supreme Court ruled the incarcerated aren’t entitled to carry cannabis on them while in the custody of a state prison. The case comes from five incarcerated individuals, one being Goldy Raybon, who were found to have had cannabis in their cells. They argued to have their convictions dismissed since the 2006 change that allowed people to carry up to an ounce on their person. Possession of cannabis or other drugs in state prisons is not allowed. Court denies cannabis for prison inmates

An appellate court panel ruled in 2019 that incarcerated people may carry up to one ounce, or 28 grams, of cannabis in prison as long as they didn’t consume it. Justice Joshua Groban wrote for the 5-2 majority, saying that allowing inmates to possess up to 28 grams of cannabis in prison likely falls outside what voters approved when they passed Proposition 64. “It seems unlikely that was the voters’ intent,” he said. “We think it clear that laws barring possession of cannabis in prison relate to drug use. The act of possessing cannabis and the act of using cannabis have an obvious relation insofar as ‘a person has to possess cannabis to smoke or ingest it.’ ” Court denies cannabis for prison inmates

The two dissenting justices said the majority overstepped by addressing the question of whether possession in prison was illegal after legalization. “We do not need to answer questions about post-Proposition 64 charging practices to resolve Raybon’s claim concerning his pre-Proposition 64 conviction,” Associate Justice Leondra Kruger wrote. “Raybon’s only argument here is that he is entitled to the retroactive dismissal of his prior conviction under Proposition 64 because he is a person ‘who would not have been guilty of an offense’ had Proposition 64 been in effect at the time.” The 1996 Medical Marijuana Initiative allows for cannabis in prisons as long as a medical cause is established. University of Southern California will partially defund its police after nearly year-long review 8/18/21

(The College Fix) – The University of Southern California has heard the pleas of student and faculty activists and will partially defund its campus police department. The private university unveiled multiple police recommendations on July 28 in a 80-page safety report after the school’s police received heightened scrutiny from the campus. The Community Advisory Board, which began meeting in September 2020, said USC should “reallocate where warranted” in an effort to “re-envision its policing strategy.” The reallocation of funds from policing to other functions is a partial defunding. The partial defunding has won the endorsement of the chief of the Department of Public Safety. “I am very supportive of the Community Advisory Board and its recommendations,” DPS Chief John Thomas told The College Fix via email. “I also support the recommendation of having trained professionals handle requests for assistance that aren’t part of the traditional public safety role,” Thomas said. “That includes having trained mental health professionals and social service experts respond to nonviolent mental health calls or calls involving homeless people.” This recommendation followed a letter submitted by 382 USC faculty members last year that urged the university “to redirect 25 percent of the DPS budget to initiatives that will make underrepresented students and community members feel safer on campus.” University will not share how much they want to cut Members of the advisory team that conducted the review would not provide answers to The Fix about how the policy will be implemented and how much money will be taken away. California’s scorched earth: More than 1 million acres burned

(The Center Square) – More than one million acres have already burned in California as of August 14, Cal Fire reports. California’s scorched earth totals nearly one quarter of all the acres of land that have burned nationally this year, about 3.9 million acres, according to the National Interagency Fire Center. The Dixie Fire, the largest fire this year, has burned 540,581 acres in northern California. As of Saturday, it was only 30% contained. The Dixie Fire is the largest single wildfire in state history and the second-largest wildfire ever in California, Cal Fire reports.

The largest fire occurred last year after a series of fires merged into one fire categorized as a gigafire, one that burns more than one million acres. Called the August Complex, more than one million acres burned in the Mendocino, Six Rivers and Shasta-Trinity national forests. The August Complex, a compilation of more than 30 fires, was reportedly ignited by lightning and to date was the largest wildfire in California history. Last year was a record one for wildfires in California. In 2020 alone, the SCU Lightning Complex in the southeast Bay Area burned 396,624 acres; the Creek Fire in the Freso area burned 379,895 acres; the LNU Lightning Complex in the Napa area burned 363,220 acres; the North Complex in the Oroville area burned 318,935 acres; and the SQF Complex in the Sequoia and Kings Canyon national parks burned 170,384 acres. So far this year, more than 10,300 wildfire personnel are battling wildfires in California, nearly half of those battling all fires nationwide. Read the full article

Rat poison is just one of the potentially dangerous substances likely to be mixed into illicit drugs 8/16/21

Tag# Rat Poison illicit drugs Over 150 people in Illinois started bleeding uncontrollably after using synthetic cannabis-based products – including fake marijuana, Spice and K2 – that contained the rat poison brodifacoum in March and April 2018. By the end of July 2021, these banned products were still being sold in 10 states and the District of Columbia, resulting in hundreds of severe bleeds and several deaths. Illicit drug use was responsible for an estimated 166,613 deaths worldwide in 2017 due to overdose. The increased risk of disease and injury associated with illicit drug use caused an additional estimated 585,348 premature deaths. And it’s impossible to tease out whether people were harmed by the drugs themselves or by the myriad impurities added to them. I am a clinical pharmacologist and guest editor for a special supplement in the Journal of Clinical Pharmacology on commonly abused substances. I also recently surveyed the research on what’s known about illicit drug adulteration. While in the military, Black MP Well continued to work on his songwriting skills and right after leaving the military, he released a few singles including a hit song “Cherie m Pap Fout Kitew” which dominated night clubs and radio stations and made him a household name in the Haitian Music Industry. California voters to be able to download ballots at home for recall election, sparking security concerns

#download ballots (The Center Square) – The California Secretary of State’s Office has made downloading mail ballots from home possible for the recall election of Gov. Gavin Newsom. The state legislature also passed a measure to send out mail ballots to every registered voter regardless if they asked for one or not. The methods being employed by the state add to concerns already raised by a group that brought up potential voter fraud issues during the 2020 general election. Downloading mail ballots from home is made possible through technology used during the 2020 election, the Secretary of State’s Office reports. #download ballots

The system includes two options, one for the entire state and one for Los Angeles County. The statewide system is called, “Remote Accessible Vote-By-Mail (RAVBM),” which enables voters to fill out ballots online, print them out themselves, and either put in the mail or drop off at a polling location. According to the Secretary of State’s office, there were “four certified RAVBM systems” for the November 2020 vote: “Five Cedars Group Alternate Format Ballot v5.2.1, Democracy Live Secure Select 1.2.2, Dominion Voting Systems Dominion ImageCast Remote 5.10A, and Los Angeles County Voting Solution for All People Interactive Sample Ballot 2.5.” Even though RAVBM was created to be used by voters with disabilities, “any voter” could request to use it in 2020. The Los Angeles County option, the Interactive Sample Ballot (ISB), enables voters to fill out a sample ballot online, which generates a “poll pass.” The pass can be printed out or voters can download a QR code and then vote using a “Ballot Marking Device” at a polling location. #download ballots

L.A. County produced instructional videos explaining how to use RAVBM and ISB. It also sent voters a sample ballot stating the ISB system was designed to simplify voting because of the “large number of candidates appearing on the ballot” in the recall election. The Election Integrity Project California (EIPCa), a nonpartisan nonprofit organization advocating for the right of every eligible citizen to vote in California, purchased VoteCal voter registration and voting history files and after auditing them raised concerns about California’s election system. The group published a list of questionable mail ballots sent out during the 2020 general election to deceased Californians and those no longer living in California. It also learned that 13 California counties have more registered voters than eligible citizens. #download ballots

The group sent a letter to the Secretary of State’s Office last year raising concerns about the number of registered voters compared to the number who voted in the 2020 election. It found that California had 1.8 million more registered voters than eligible citizens in the last election, and that nearly 124,000 more votes were counted in California’s 2020 general election than voters recorded as voting in the election. According to EIPCa’s evaluation, Los Angeles County has 206,728 registrants who have not voted or updated their registrations since November 2008 who are listed as “active” voters and could receive mail ballots in the mail. EIPCa says it uses precise methods that err on the side of caution and that its findings likely underestimate the state’s election problem.
