I just sat up all night praying that he won’t die.

Danny offers himself as help to Andy on the farm. It’s a new day and DI Keysell is once again keeping an eagle’s eye on Andy and Robert. Alan and Rodney check on Jack via Robert who is clearly exhausted at this point but Rodney manages to lighten the mood at least temporarily. Jack’s doctor easily persuades Keysell to leave the room post haste. Jack begins to stir.

Das riskante Geschäft mit Software-Keys

Neue Spiele für 25 Euro, begehrte Hits gut 50 Prozent günstiger als im Laden: Sogenannte Keyseller versprechen Spielefans unschlagbare Schnäppchen. Doch neben seriösen Anbietern gibt es auch viele Händler, die in einer rechtlichen Grauzone agieren.

München/Pinneberg (dpa/tmn) - KAA3-3EN8-GK9R. MPPHC-6V27E-YK4W6. XP6VF-74VDK-WP2YK-GDDY2-JMP6Z. Es sieht aus, als wäre jemand mit dem Kopf auf die Tastatur gefallen. Doch bei dem Zeichensalat handelt es sich in Wahrheit um Zugangscodes für Spiele, auch Keys genannt.

Wer die Keys auf Plattformen wie Steam, im Playstation Network oder im Xbox Store eingibt, erhält damit digitalen Zugriff auf ein Spiel - der Buchstabensalat ersetzt den Datenträger.

Zum Einsatz kommen die Codes vor allem auf dem PC: Ohne Key lassen sich aktuelle Spiele dort in aller Regel gar nicht starten, selbst wenn der Nutzer eine Disc besitzt. Es gibt sie aber auch auf der Konsole, zum Beispiel für kostenpflichtige Zusatzinhalte (DLC), oder als Schlüssel für ganze Spiele. Und gerade auf dem PC lassen sich die Keys auch direkt kaufen - und das oft deutlich günstiger als beim Direktkauf per Downloadplattform oder im Laden.

Schnäppchenjäger müssen hier aber genau aufpassen. Denn im Netz gibt es zum einen seriöse Anbieter, sogenannte autorisierte Keyseller, wie «PC Games» erklärt - darunter Plattformen wie Gamesrocket, GreenManGaming, Gamersgate und natürlich Alleshändler Amazon. Solche Anbieter beziehen ihre Codes direkt von den Publishern und Entwicklern der Spiele. Der Preisunterschied zum regulären Handel ist hier aber längst nicht so groß wie bei der anderen, nicht ganz so seriösen Sorte Keyseller.

Diese schwarzen oder wenigstens dunkelgrauen Schafe der Branche werden auch Reseller genannt. Anders als bei den autorisierten Keysellern kommen die Codes hier aus anderen Quellen - laut «PC Games» zum Beispiel aus Ländern wie Russland, in denen es Spiele deutlich günstiger gibt. Dazu kommen Software-Pakete mit mehreren Spielen, die Käufer teilweise nutzen und teilweise weiterverscherbeln, oder ungenutzte Spiele-Codes, die zum Beispiel einer Grafikkarte oder einer Konsole beilagen.

Ist es erlaubt, solche Codes weiterzuverkaufen? Diese Frage ist nicht ganz einfach zu beantworten. «Zur Keyselling-Thematik gibt es mittlerweile verschiedene Urteile von den deutschen Landgerichten, dem Bundesgerichtshof und dem Europäischen Gerichtshof, die sich leider teilweise widersprechen», sagt Stephan Mathé, Fachanwalt für gewerblichen Rechtsschutz aus Pinneberg.

So erlaubte der Europäische Gerichtshof in einem Urteil von 2012 zum Beispiel, gebrauchte Software weiterzuverkaufen. 2014 entschied das Landgericht Berlin jedoch, dass diese Entscheidung nur für Software in ihrer ursprünglichen Form gilt, wie das Portal «Spielerecht.de» erklärt. Demnach sei es nicht erlaubt, zum Beispiel ein Paket aus Datenträger und Key voneinander zu trennen und den Code dann alleine weiterzuverkaufen.

Hinzu kommt, dass das oft praktisch gar nicht möglich ist. Denn ein einmal genutzter Code ist danach in der Regel für immer mit einem Account verknüpft - und damit wertlos für alle anderen Nutzer. Und so wird die verworrene Rechtslage rund um Keyseller und Reseller auch für den Kunden zum Problem. Schließlich kann der sich nie sicher sein, dass der gekaufte Code tatsächlich funktioniert.

Grundsätzlich hat der Kunde zwar einen Anspruch darauf, für sein Geld ein funktionierendes Produkt zu bekommen. «Auch beim Softwarekauf gelten zumeist die allgemeinen Verbraucherrechte», sagt Stephan Mathé. «Funktioniert eine Software nicht, habe ich entsprechende Ansprüche auf Nachbesserung oder auch Rückerstattung des Kaufpreises.»

Das hilft allerdings nichts, wenn sich die Ansprüche kaum durchsetzen lassen, weil der Verkäufer zum Beispiel in Hongkong sitzt, so wie viele populäre Reseller. Viele Anbieter berufen sich außerdem darauf, dass sie selbst gar keine Codes verkaufen, sondern nur eine Plattform für den Handel zwischen Nutzern bereitstellen - eine Art Ebay für Keys. Geprellten Kunden hilft es dann auch nichts, sich beim Hersteller des Spiels zu beschweren. «Anspruchsgegner ist immer der, von dem ich den Key gekauft habe», sagt Mathé. «Und nicht der Publisher oder Entwickler.»

Wer einen Key im Netz erwirbt, sollte den Verkäufer daher vorher erst auf Herz und Nieren testen. Ein guter Anhaltspunkt dafür ist die Checkliste der Verbraucherzentrale Niedersachsen für sogenannte Fake-Shops. Demnach sollten sich Onlineshopper nicht von professionell wirkenden Webseiten blenden lassen, sondern vor allem einen Blick ins Impressum werfen: Seriöse Anbieter machen hier ausführliche Angaben zu Kontaktmöglichkeiten und Firmensitz.

Bei Resellern sollten Spieler zudem darauf achten, dass es umfassende Infos zur Herkunft der Codes und zu Gewährleistung oder Garantie gibt. Und wer dann immer noch unsicher ist, kann zum Beispiel in Spieleforen oder sozialen Netzwerken nach Erfahrungen mit bestimmten Shops fragen.

Das ist viel Recherchearbeit, die sich aber lohnt. Denn selbst wenn ein Code funktioniert, können Spieler auch nachträglich noch Ärger damit bekommen - etwa weil sie damit gegen die Nutzungsbedingungen der Spiele-Publisher und -Plattformen verstoßen. Manche verbieten es zum Beispiel, in Deutschland mit Codes aus Russland zu spielen. Andere sperren Codes oder ganze Konten, wenn Keys nachweisbar von bestimmten Resellern und aus illegaler Quelle stammen.

Wehren können sich Nutzer dagegen nur, wenn die Strafe unverhältnismäßig hart ist: «Wird etwa ein kompletter Account mit Dutzenden Spielen sofort gesperrt, nur weil ein Key unzulässig war, dürfte dies unangemessen sein», sagt Mathé. «Wer aber wiederholt trotz Warnung gegen AGB verstößt, muss irgendwann mit entsprechenden Maßnahmen rechnen.»

Wird nicht auf dem umstrittenen Marktplatz von G2A verfügbar sein: Bulletstorm in der Collector's Edition.

Well, that escalated quickly: Es ist erst wenige Tage her, dass Gearbox Software den Verkauf der physischen Collector's Edition von Bulletstorm auf der umstrittenen Plattform G2A angekündigt hat. Und auch der Protest von Youtuber John »Totalbiscuit« Bain ist gerade einmal drei Tage alt.

Nun ist die ganze Sache jedoch wieder beendet. Wie Waypoint / Vice berichtet, hat Gearbox die Partnerschaft mit G2A beendet. Dies geschah, nachdem der Publisher am gestrigen Tag ein umfassendes 24-Stunden-Ultimatum an den Betreiber der Plattform stellte. Eine öffentliche Reaktion blieb aus.

Head of Publishing Steve Gibson sagte dazu:

Da es keine öffentliche Regung von G2As Seite aus zum Thema gab, wird Gearbox Publishing seinen Teil tun und den Marktplatz nicht unterstützen. Sie haben es versäumt, die von uns geforderten, öffentlichen Versprechen zum Schutz der Kunden und Entwickler umzusetzen.

Außerdem bestätigte Gibson, dass man sich nun von der Partnerschaft mit G2A zurückzieht. Der Marktplatzbetreiber sprach wiederum davon, dass sie mit Gearbox reden und eine offizielle Antwort erst nach dem Wochenende veröffentlichen werden.

Bulletstorm-Entwickler soll schuld sein

Wie es überhaupt zur jetzt beendeten Partnerschaft kam, wird anhand einiger Tweets von Gearbox-CEO Randy Pitchford klar. So bedankt er sich bei John Bain für seine Hilfe und gab bekannt, dass er bisher nichts von der Partnerschaft wusste. Ihm zufolge sei der Entwickler des Spiels People Can Fly (PCF) , für die Zusammenarbeit verantwortlich.

Sam continues to help out at the farm apparently. Katie’s clearly is freaking that Jack knows the real story behind his shooting and how it’ll affect all them with the coppers. Crowe and Keysell are determined to see Jack and get his statement. Robert wants Jack to really think it through before he talks to the coopers. Daz worries about himself if Andy gets banged up who has essentially lost all hope having let ‘everyone down’. Jack gets the green light to be released from hospital (that was fast).

Andy is in a state trying to get Jack to forgive him, sorry for what he’s done but Jack is now in a bad position because of it. Crowe and Keysell find it mighty interesting Andy running out of Jack’s room. Katie assures Robert she’s there for him as he hopes to get back on good terms with Jack. Robert can’t see Jack shopping Andy to the cops. Alone with Diane, Jack ponders what to do with Andy. Andy is back at the farm as he’s not wanted at the hospital. Daz is certain Andy won’t go to the nick.

Now… while I’m glad you decided not to insult me by arguing… so… if it wasn’t an accident… I wanna know what the hell’s going on.

Jack just knows the boys told quite a lie to Diane about what happened and he so remembers as ‘he was there.’ Crowe and Keysell show up on cue. The kids have are reunited with the awake Jack. Louise announces to all in the pub that Jack is on the mend. Jack wants a chat with Andy… alone. Boyo, you have some explaining to do.

Robert calls Katie about Andy being at the hospital and now he’s itching to not cover for Andy. DI Keysell continues to be just there, just waiting for the truth to be uncovered. I guess tragedy really does bring people together as Robert takes part of the blame for Jack’s shooting and the brothers end up hugging. Andy’s guilt ridden as nothing about the current situation is worth it and apologizes to Robert.

DI Keysell continues to question Andy who now tells them Katie’s tale with enough plot holes making it not believable to them. Meanwhile, DC Crowe (WHO’S REAL LIFE SURNAME IS HAWLEY!) questions Robert (who has an attorney with him) who begins with the actual facts then ends with using Katie’s version as well. The cops clearly are aware of the dynamics among Robert, Andy and Katie. Andy and Robert stay remanded for the night under they learn if Jack pulls through. If not, Andy is looking at a murder charge!

Your dad is… your dad’s had an accident. He’s very poorly and we need to go to hospital to see him now. (Part 3.2)

So… Katie and Daz are free to go after making their statements to ‘have a think’ then return the next day with the real story of what happened. The two then pop up at Jack’s to tell Siobhan about Jack’s shotgun accident wanting to take Victoria to hospital as she feels he may not make it. Back at the station, DI Keysell takes on Andy and DC Crowe Robert for interrogating them. At the hospital, Dr. Morton informs Katie, Daz and Victoria Jack’s in surgery and in critical condition. Siobhan goes to Louise to get in touch with Diane. Daz puts the blame of the situation on Katie.

These days… the only crime is getting caught.

NO ROBERT. This is essentially an epilogue to the Jack shooting story. Jack feels like he’s let Annie and himself down the way he handled Andy letting him get another free pass. Daz is all about moving on with their lives. DC Crowe and DI Keysell make one last ditch effort with Andy to get him to add to his statement confessing to what he did but it’s all for naught and that as they is that. Keysell tells Andy his license for a shotgun will be revoke ‘to prevent any further ACCIDENTS.’ Andy promises to always be there for Daz. Katie shows up and it’s just empty words for Andy her.

Keysell rubs Charity the wrong way because of her recent experience with him. Crowe and Keysell next move on to the cafe where Viv and Donna give them an earful about prat Robert and Andy’s characters. As Jack and Robert are leaving the hospital, they are ambushed by Daz pleading to essentially give Andy a break as he won’t have a home anymore and well, family is there for each other and don’t run when it gets rough, do they? Donna can’t see Robert (‘too much of a wimp’) shooting Jack or Andy’s targeting having actually been Robert. Keysell and Crowe wait for Jack to arrive at his home.

Crowe and Keysell now keep a VERY close eye on Jack’s place (e.g., Robert). Lisa and Sam offer their help to Andy with the farm. The DI/DS talk to Donna wanting more on Andy and Jack but get nothing. Diane finally returns and is at Jack’s side in no time AND she wants to know how Jack ended up where he is now!

Katie thinks she should be in Jack’s place. Both Robert and Andy are let out while Robert tells Daz to keep Andy away from the hospital. Victoria voices how her not having kept quiet brought bad things happening. Ashley and Emily offer their support and help to Katie where needed. Pearl betting on what really went on regarding Jack’s shooting and that one ‘of the lads’ will be charged. Andy indeed shows up at the hospital and Robert’s far from happy (while DI Keysell keeps very close eye on things) by bringing up Sarah.

Crowe and Keysell finally get in to see Jack who puts them off by saying he doesn’t remember anything after opening the caravan door. Andy’s bad mood translates into him being mardy toward Daz who continues to harp on what would happen to him. Since they got nowhere with Jack, next is asking around in the pub.
