Delhi excise scam case: Court extends BRS leader K Kavitha's judicial custody

A court here on Tuesday extended the judicial custody of BRS leader K Kavitha by two weeks in the Delhi excise policy-related money laundering case.
Special judge for ED and CBI cases Kaveri Baweja extended Kavitha's custody till April 23 after she was produced before the court on expiry of her judicial remand granted earlier.
The judge had on Monday denied interim bail to Kavitha, saying prima facie she not only destroyed evidence but was also instrumental in influencing witnesses and there is "every likelihood" of her continuing to do so in case the relief is granted.
The agency has alleged that Kavitha, an MLC and daughter of former Telangana chief minister K Chandrashekar Rao, is a key member of the "South Group", which has been accused of paying the ruling AAP in Delhi kickbacks of Rs 100 crore in return for a big share of liquor licences in the national capital.
Kavitha, 46, was arrested from her Banjara Hills residence in Hyderabad on March 15.

Delhi Chief Minister Arvind Kejriwal today accused the Bharatiya Janata Party (BJP) of attempting to "buy" seven Aam Aadmi Party (AAP) MLAs with an offer of ₹ 25 crore each in a bid to destabilise his government in the national capital.

Mr Kejriwal claimed that the BJP engaged in talks with the AAP legislators and purportedly threatened imminent arrest for the Delhi Chief Minister in connection with the Delhi liquor policy case. The alleged conversation involved a sinister plan to topple the AAP government in Delhi.
In a long social media post, the Delhi Chief Minister alleged, "Recently, they [BJP] has contacted 7 of our MLAs of Delhi and said - 'We will arrest Kejriwal after a few days. After that, we will break the MLAs. Talks have been held with 21 MLAs. Talking to others also. After that, we will topple the Aam Aadmi Party government in Delhi. You can also come. Will give ₹ 25 crore and contest the elections on BJP ticket.'"
Despite the claim of contacting 21 MLAs, Mr Kejriwal insisted that the information available to the AAP suggests that only seven MLAs have been approached, and all of them have firmly declined the tempting offer.
"This means that I am not being arrested to investigate any liquor scam but they are conspiring to topple the Aam Aadmi Party government in Delhi," Mr Kejriwal stated. "In the last nine years, they hatched many conspiracies to topple our government. But they did not get any success. God and the people always supported us. All our MLAs are also strongly together. This time also these people will fail in their nefarious intentions."
Mr Kejriwal added that the alleged attempts to destabilise his government are driven by the AAP's good work in the national capital. Despite various obstacles, Mr Kejriwal added, the people of Delhi hold immense love for AAP, making it difficult for the BJP to defeat them in elections.

Delhi HC Issues Notice to Enforcement Directorate in AAP MP Sanjay Singh's Bail Plea

Today, the Delhi High Court took action by sending a notice to the Enforcement Directorate following a plea from Aam Aadmi Party (AAP) Rajya Sabha MP Sanjay Singh. Singh sought bail after his arrest in connection to a money laundering case linked to the Delhi excise policy scam.
Justice Swarana Kanta Sharma announced that the next hearing for the case is scheduled for January 29.
Senior Advocate Mohit Mathur represented Singh in court and informed the proceedings that Singh had not been specifically identified in the initial offense. Mathur emphasized that Singh's arrest followed only after the tenth statement made by a witness.
Since October 4, 2023, Singh has been in the custody of the Enforcement Directorate (ED) subsequent to a search conducted at his residence by the agency. He has remained in judicial custody since October 13.
The trial rejected his bail plea on December 22, 2023.
The allegations against Singh revolve around his purported involvement in devising and executing the defunct Delhi excise policy. This policy is accused of being designed to favor specific liquor manufacturers, wholesalers, and retailers, with Singh allegedly playing a significant role in its formulation and implementation.
Sanjay Singh's arrest represents the third significant apprehension of an AAP figure in connection to the excise policy case. Earlier, AAP's communications in-charge Vijay Nair was arrested in September 2022, followed by the arrest of former Deputy Chief Minister of Delhi, Manish Sisodia, in February 2023. As of now, both Nair and Sisodia remain in detention.
Earlier, Singh had filed a plea contesting his arrest, citing it as an abuse of the legal process and a breach of the Supreme Court's judgment in the Pankaj Bansal v. Union of India case, often referred to as the M3M Reality case.
However, the High Court dismissed this plea on October 20, 2023, asserting that the Enforcement Directorate (ED) holds a prominent status as an investigating agency. The court cautioned against attributing political motives to the ED, highlighting potential implications for the country's reputation.
Singh subsequently approaches the Supreme Court regarding this matter, which is currently handling and reviewing the case.
