Victime d’un accident de la circulation dont le responsable s’est enfui ou n’est pas assuré, vous pouvez saisir le fonds de garantie des assurances obligatoires qui se chargera de vous indemniser.

La règle de droit en matière de saisie du fonds de garantie des assurances obligatoires

Le fonds de garantie est chargé d’indemniser les victimes d’un accident de la route survenu en France dans les cas suivants :

Le responsable des dommages n’est pas assuré (ou son assureur lui refuse sa garantie),

Il est inconnu (il s’est échappé après l’accident),

Son assureur est totalement ou partiellement insolvable.

Mais, ce fonds ne peut intervenir que si vous ne pouvez être indemnisé à aucun autre titre. Vous devez d’abord faire jouer toutes les assurances souscrites (par exemple, votre garantie dommages pour les dégâts matériels).

Les démarches à accomplir

Si le responsable est connu, mais pas assuré, vous devez soit conclure une transaction avec lui, soit engager une action en justice contre lui dans un délai maximal de 5 ans à compter de l’accident et avertir le fonds de votre action devant le tribunal.

À compter de la transaction ou de la décision de justice, vous avez un an pour demander au fonds de vous indemniser. Toutefois, pour l’indemnisation de vos dégâts matériels, vous devez saisir le fonds dans les 6 mois à compter du jour où vous avez appris l’absence ou l’insuffisance d’assurance, et au plus tard 12 mois après l’accident.
