Hey, asking you this as nicely as I can but can you give the immediate victim blaming a break. The absolute lack of respect you have for the people tmc abused is genuinely disheartening. Yes, he’s a shitty person, you’re entitled to hate him but immediately going “well you should’ve seen it coming earlier lol we’ve been saying this” is just ASTONISHINGLY shortsighted and cruel. Have your opinions about him and the situation all you want I would just ask that you please keep it to yourself due to the many many people he’s hurt that are still on here and can see you disparaging them.
ok, that is not what i have been saying. "well you should've known" is not an accurate summary of my feelings on this matter but apologies if thats how it came across. i have been in an abusive relationship where the person did a lot of the same things and i, too, defended that person without considering how it impacted other people. i almost lost my best friend because of how i acted as a result of keeping him in my life while people around me kept telling me to get tf out. i know.
what i am is im frustrated and annoyed by how long people were willing to publicly and passionately defend this guy while apparently fully aware what kind of shit he was doing to other people, many of which is detailed in the callout itself, and how this is now being framed as news. before the document itself was published all me (or anyone) had to go off of was vague posts that amounted to a "callout trailer" and almost all of the information on it was shit that was 100% completely public knowledge. 20+ people being aware of all that goddamn stuff and not one of them publicly stopping associating with him is frustrating. it comes across as spineless and yes, like one anon told GD, gaslighty (although i have my own issues with this being used on a large scale instead of in interpersonal relationships but i understand where they were coming from). his lesbophobia, transphobia (strange that none of the transphobia towards trans men was mentioned?), and panphobia/aphobia/biphobia were widely documented and seeing that on a callout post as if it were news was extremely tiring.
ive since read the callout. the interpersonal actions seem to have been horrible but sadly im not surprised (by which i dont mean "and neither should you" but rather. my spidey senses for this sort of behavior are pretty accurate most of the time and i did see this coming. this isnt me saying im Better than these people or that they shouldve as well but rather that i have learned to identify people of this genre.) by any of them.
also im 75% sure this is tumblr user GD. hello. if not then apologies, its just that the typing here is very similar. if it is, i think you trying to both take accountability for this and process whatever it is youre processing at the same time on tumblr is a bad idea and going to just lead to people feeling hurt and betrayed because while i truly do see where the reaction is coming from (like, truly, i understand, believe me), if you say "i take responsibility for how i acted while being manipulated" but then when people voice their negative feelings you tell them theyre victim blaming you it is going to reflect poorly on you. i dont think you understand how many people were absolutely hurt by the enabling you and your large, massively popular group of friends did for him, including the MASSIVE defense rant you typed up in defense of him when someone sent an ask to the bi jon event about him being panphobic and aphobic. whether its fair for people to expect you to immediately go into depth about it is questionable but dont invite people to do this when you obviously cannot handle it (i dont mean this in a bad way like "oh you should handle it". i mean genuinely this is how you get burnt out and possibly worsen possible future trauma. by trying to immediately placate people without having the mental resources to do so.)
i think the "we dont condone these views and never did!" without ever specifying what they were or doing any other work there is a lazy fucking cop-out. your circle was/is massively popular and a lot of people took all of you as authorities on stuff like headcanons and respectful portrayals of certain characters or identities to the point of accepting your meta as canon (something you havent really dissuaded ever), and associating publicly with someone who would constantly do this kind of shit and then defending him publicly while also positing yourself as an authority isnt something you can just "oops! we never agreed with him!" yourself out of. GD & TF specifically, you are massive blogs. you are babys first TMA blog. people in your askbox hurt and betrayed by this shit are not necessarily there to victim blame you. they are there because they trusted your word when they said "hey seraf reblogged anti pan and anti ace and weird transphobic posts" and you said "seraf is one of my dearest friends and would never do any of those things and im personally offended youd even imply that." i think you dont understand the real life consequences of the massively popular posts and sentiments he made & published and that you helped spread (despite apparently knowing that he was being a massive hypocrite and bigoted towards those groups or identities in his personal life). obviously interpersonal abuse/conflict is going to be "worse" but dear god i hope you collectively understand that "oh btw we never endorsed his views" is a massive copout and a shit apology for the hurt this association and endorsement caused. tmc has been terrorizing this fucking fandom for months with his bullshit and bigotry and you have not been passive bystandars but active enablers.
anyways, hope everyone involved gets to uh, heal i suppose, but i think expecting the people who seraf suicide baited, the groups of trans men he misgendered, the people who he targeted and harassed, the genuine fucking long lasting dysphoria he caused real people to have over his shitty takes re: transness and dysphoria, and the general shit behavior he was allowed to keep up with zero pushback from anyone in his circle of the fandom to drop all the anger or frustration they have for the people who enabled him and defended him aggressively is... unrealistic. and makes you look bad. especially when the doc doesnt even clarify which opinions you still support.

Patrilineal Jewish girl, Sephardic culture

are inconsistent statements. 
The first statement sounds like the only indication Dad has of which Jewish culture they are is a statement he's not even sure about ("thinks"?) and the second statement sounds like Dad considers himself Sephardic and practices Sephardic traditions.
So, to me personally, this would depend on the level of Sephardic cultural practice she grew up with. If she grew up with those traditions and Dad sharing them with her, then yes, that's who she is. If Dad isn't even sure he's Sephardic and what she practiced in her upbringing wasn't distinctively Sephardic in any way, I have a hard time seeing why she should claim the culture if she's not even sure if her ancestors were Sephardic.
Disclaimer that the Reform position is to 'count' patrilineal Jewish people as long as they were raised in the traditions. This is not the Orthodox position but I am Reform.

I'm also a bit confused about this situation. I think it would be helpful if you start by specifying where in Europe the family comes from and what anti-Semitism they were fleeing from. I'm Ashkenazi and not the most knowledgeable about Sephardi history, but as far as I know it wouldn't make sense for a Sephardi family to be seeking asylum from the pogroms in Russia or Poland, for example. I guess it could make sense if they were from Spain, France or Italy, but we would have to know more, and I'm wondering if this isn't a 'trace your logic' situation. Why do you want them to come from Europe? *Quickly cracks open a Claudia Roden book* Sephardi Jews have origins in many North African and Middle Eastern countries, such as Morocco, Algeria, Libya, Syria, Iran and Iraq just to give a few examples. If you want Sephardi characters, why not represent those cultures instead of re-hashing the same Euro-centric Jewish stories?   
In terms of whether she could claim Sephardi heritage of any sort if they don't know, I'm interested in what Sephardi followers think. Religion-wise, I don't think there would be too much of a problem with it. Yes, Sephardim are more lenient on some things and stricter on others, so by picking the wrong one she may be following some of the rules wrong, but that's just a matter of tradition really. If someone was a ba'al teshuva and had no way of finding out which population their family came from, I imagine a rabbi would advise to choose one and stick to it without worrying too much about which one. I don't know 100%, though. 
Culture-wise, I don't know if this is what Shira was getting at but I wonder if it would be cultural appropriation due to Ashkenazi Jews being more likely to be white-passing and getting more media representation. Is Jewish lineage enough to claim Sephardi traditions and culture, or do you need to know for sure that you're Sephardi - that will be for Sephardi followers to decide. 
To build on Shira's disclaimer:
I'm Modern Orthodox and I would describe your character as someone who is not halachically Jewish, i.e. not in Jewish law. In most situations, this would be a technicality for me and I wouldn't hesitate to treat her as Jewish if she identifies as such. In particular, with her family history it makes sense that she considers herself ethnically Jewish and the legacy of discrimination is part of her identity - that's not something we can erase or overlook. It would be different if my kid wanted to marry her, I think (not that I ever plan to be one of those parents who would disown their kid or something for marrying out but I'm not going to pretend I completely wouldn't care, either). Then I might be hopeful that she may formally convert, especially if she had always lived as Jewish anyways.
 Other things she may experience if she hangs out in Orthodox circles: a few people might act like jerks and be iffy around her like she's 'not really Jewish', probably the same people who are pro-Trump and mansplain why women's exclusion from parts of Orthodox worship is actually protecting us. On the subject of women's exclusion, if you have any male characters with a similar parental background, they can't get an aliyah in shul or count towards a minyan - the character you're describing couldn't anyway, though. 
Hopefully if your other Jewish characters are nice people, they take to heart the teaching that you should rather throw yourself into a fire than humiliate someone else in public. When I was a student, there was a patrilineal man in our community who once entered the shul just in time to be the tenth man, making a minyan. A Chasidic man in the congregation quickly stood up and said "Oh no, I left the gas on!" and left. That way no one had to make a whole song and dance about the other guy not being allowed to count. Patrilineal Jewish followers, feel free to add more!

I'm going to add some things here, about the terms Sephardi and Ashkenazi, that I think might be partially tripping the author up.
Sephardi and Ashkenazi are terms used to describe the traditions that a person follows. Those traditions are heavily linked to the land where they rose up, and to parentage, as people are typically encouraged to follow the traditions they grew up with. However! Converts exist, and converts are usually encouraged to join in on the traditions in their community. So, as an example, a person can be from anywhere in the world, of any racial or ethnic background, convert in a Conservative synagogue, and follow Ashkenazi traditions. A person can be from a place that is usually seen as very Ashkenazi-heavy, like Germany, and then end up converting in an esnoga (synagogue) in Spain, and practice Sephardic traditions. Either of those converts might have children, and those children will take on their minhagim (traditions), and will be a part of the culture their parents joined just like their parents were.
It can be confusing for many people because the terms are so often conflated with ethnicity, which is in turn conflated with genetic lineage. The trouble is, the groups they describe are older than the modern, western conception of race, and ethnicity,  and we don't completely fit into these categories. Ashkenazi Jews don't all come from Europe, even their ancestors might not. In the US it's been estimated that at least 12-15% of American Jews are Jews of Color, and those JoC are very, very often Ashkenazi. Some converted, some didn't, but they are still following the traditions, and are still Ashkenazi.
So it's fair to say that the traditions of Sephardim grew in the Iberian peninsula, and North Africa, but they also moved along with those Jewish people as they dispersed, and were expelled. Jews from Portugal fled to the Azores, but also to the Netherlands, where there is a large Sephardic presence, right in the middle of a space that is assumed to be all Ashkenazi! Scores of Jewish people from Morocco moved to France. Then too, people marry folks from other groups. Often they will pick one family's traditions to follow, but sometimes they mix and match, and sometimes they end up moving somewhere else and taking on those traditions.
Because so many people have traditions that match their genetic background we've begun using the term Ashkenazi to mean strictly white, European Jewish people. Sephardi we have taken to mean strictly white, Iberian Jewish people (which doesn't even include the massive number of North African Sephardim). We've forgotten entirely to cover Mizrahim (a tradition associated with the Middle East), or the Romaniote, or Cochin Jews, or any number of other groups. Yes, genetic background accounts for a large portion of those people, but it doesn't map completely, and it's important not to forget that.
This complexity is why the statements Shira drew attention to:

Don't make sense. You would know you are Sephardic, because it's something you do first, and may be, secondarily, directly linked to something in your ancestry.
Finally, since you are showing a patrilineal Jewish person, I really encourage you to show them consistently engaging with their Jewishness, and actively participating in Sephardic culture. I'm the Conservative one here, and my movement, and Sephardi tradition (there are no movements for Sephardim, just varying observance) don't allow patrilineal descent to give a person Jewish status halachically. This is not something I endorse. Patrilineal descendants really struggle outside of Reform communities, to be seen as Jewish, and often to just be treated with respect, so it's important that you give this character every opportunity to participate, and show who they are.

Conversions - Old Apartment Or New Condominium?
Typically the spate of conversion connected with old apartments to condos has finally abated mainly due to the failed economy. For a lot of reasons which we have earlier noted, buyers prefer fresh construction and only buy sales when the housing market is in some sort of selling frenzy. Nevertheless, hundreds were sold and operator claims have arisen starting from minor issues with the unit alone to major waterproofing and also structural failures in the houses which will require very expensive renovation for which no funding has been provided by the converter.
These kinds of claims are often defended by means of developers with the argument in which since what was purchased has not been new, the owners could not expect that the converter must pay the cost of rehabilitation. The conversions are not new design is not usually hidden coming from buyers. Everyone buying dự án chung cư bình dương project performed or should know that the structures were more than just a few years older and that deterioration can be expected.
But some of us wonder what most buyers do not know and may not have to expect is that the upkeep and repair funding program which was coupled with the sale in the unit was inadequate for that eventual repair of the properties. And why is this crucial? Because a condominium conversion is not merely a used apartment. It is a cool product which is assembled from many important pieces.
In order to offer an old apartment as a terme conseillé the converter has to produce a salable product. This includes saving a condominium map which usually changes a single parcel directly into multiple separate parcels. They must draft and record Convention, Conditions, and Restrictions (CCRs) which enable the new keepers to jointly manage the job. They have to comply with various restrictions of the California Department associated with Real Estate which include preparation of any funding plan adequate to fulfill the needs of the new frequent interest development. If some of these parts are missing, often the units cannot be sold.
An automobile can be manufactured of re-cycled steel, but without rims and a motor, it's not a new "car" that can be sold. The identical is true for converted rentals. Without legal status as being a condominium and an adequate buying into plan, it cannot be marketed as a condominium. A ripping tools must create a new product from this old apartment and the additional necessary parts. This "package" carries with it certain diagrams of fitness, not the smallest amount of of which is that the funds required to properly maintain the project as well available when needed.
Adequate funding could possibly be assured by depositing adequate cash into the association's addresses so that it can afford future fixes. It could also occur when you fill out the necessary repairs at the time of the actual conversion so that less cash is necessary in the future. The converter can also fund the association through setting the owner's tests high enough to pay for repairs. Or perhaps, the seller could do some mix of all three. The converter are not able to, however , do " non-e of the above. " Often the buildings can have defects or perhaps un-repaired conditions, but if they certainly, there has to be a budget enough to maintain or repair these properly and if the resources plan fails to accomplish this, the particular converter is liable for the shortcoming for failing to disclose the actual cost of ownership.
A common false impression among conversion developers and in addition many judges is that the customer of a used apartment must be subject to the same rule regarding "caveat emptor" or "buyers beware" as the buyer of an used single family residence. The buyer of a single house is personally responsible for every one of its maintenance once earnest closes, so why shouldn't the customer of a condominium conversion carry similar risks?
A condo is a different animal totally. An individual condo owner are unable to repair his or her portion of point out, the roof, which is shared simply by other owners, not only due to the fact it's physically impossible, but in addition because an individual is minus the legal authority to touch this component. Only the community relationship can legally maintain the "common area" which includes the roof as well as other exterior and certain internal components of the building. And to accomplish that, it must raise the necessary cash through the funding plan given by the original seller.

Defeating fascism beyond the ballot
The world can breathe a sigh of relief that it will not know just how unhinged Donald Trump would have become with the validation of re-election, especially after already surviving literally hundreds of scandals and an official impeachment.
Trump’s defeat – largely to the credit of Black people, especially Black women – is immeasurably consequential for the planet. Even without a majority in the Senate (which Democrats still have a slim shot at winning in Georgia’s upcoming runoff elections), the United States can now work internationally and domestically to undo the damage Trump caused during four years of his presidency.
However, the US faces steep, deep-seated problems that neither began, nor will end, with Donald Trump. As liberals celebrate a “return to normalcy,” the people who delivered this victory will not be satisfied by a return to a profoundly violent status quo.
Trump and his disciples already plot a comeback, but if we study how he was narrowly defeated, we can prevent society from welcoming his brand of politics again.
Denormalisation
If liberals thought of Trump’s constant lying and false promises as “un-American,” they should listen to Native Americans and read about the long history of Indigenous genocide as nonpartisan US government policy.
This is a country built on Black enslavement and Indigenous genocide, constructed by a racist system of law and lifted by imperialism. Now, as the empire crumbles, it is also a country descending into a neo-feudal society only buttressed by a consolidating panopticon of state violence and corporate surveillance.
These are not problems that can be addressed individually and there are no cookie-cutter, one-size-fits-all solutions. Rather, everyone has the power to wield, given their specific positions in society, and everyone must play a role if we want to change institutions and systems. Start exactly where you already are.
Trump has spent years broadcasting that he would try anything to maintain the presidency, including legal and clandestine voter suppression and intimidation. If the election’s integrity can be protected from Trump and his supporters’ ongoing attempt at a coup d’état, we will still emerge into a polarised country where nearly half of the voting population – roughly 70 million overwhelmingly white people – do not consider bigotry a deal breaker.
The ratio of people who approve of political violence is growing substantially across the ideological spectrum. Furthermore, a good portion of the populace has a twisted view of reality, where rumour and conspiracy are more important than critical thought or facts. Research shows that many of them can be converted, but how?
Personal relationships can slowly rebuild shared trust. In practice, this includes the sometimes difficult job of listening patiently and empathetically to friends who have fallen for concerted misinformation campaigns and more diffuse efforts of manipulation. Everyday compassion might be our best way out of the social media bubbles and conspiracy theories that cloud our collective foresight.
Undoing oppression cannot be a burden placed on the oppressed – people living at the intersection of marginalised social categories. People mobilised by this electoral wave must support and invest in communities of colour, but without demanding that marginalised people find “common ground” with fascism. The hard work of confronting and transforming this system must be carried out by those most structurally privileged.
Critique as a gift
One of the most important long-term strategies is scaling up this kind of work into intentional organising and community building everywhere: our work, families, friends, everyday interactions and wherever else possible.
The long-term political battleground is cultural, as Antonio Gramsci wrote from prison almost 100 years ago and US conservatives have understood since at least the 1970s. In the words of Republican media strategist Pat Buchanan, “if you capture the culture of the country, eventually you might prevail.”
The right-wing strategy of recapturing American culture after the anti-war movements of the 1960s and 70s explains why the strongest sources of censorship and “political correctness” in this country are not leftist “online mobs,” but rather conservative entities like the Texas State Board of Education, which has spent decades rewriting history with political intent.
In its narratives of exceptionalism and refusal to teach this country’s violent history, the board denies generations the opportunity to reckon with the structures that shape their present realities. And given Texas’s population size, textbooks produced for that state influence instructional materials in many other states, and the effects of this miseducation grow and become embedded over time.
Evidence of the “culture war” strategy is abundant today, well beyond Fox News. Spend a minimal amount of time on social media and you will come across the disinformation machine fuelled by millions of dollars of Koch money, propaganda videos on YouTube from accounts like PragerU (which is not a university of any kind), and thousands of similar copycat accounts that are likewise monetising narratives of white victimhood and paranoia.
We must learn and teach each other how to better recognise propaganda, appreciate difference and confront injustice. Furthermore, we must commit ourselves to more intentional and democratic relationships, contrary to the dominant paradigms where we are always in competition and our victories must come at someone else’s expense.
Breaking the grip of these ideas will require building an alternative through mindful practice – embracing constructive critique, learning to give and cherish feedback, knowing how to apologise and grow, and preferring strategic bridging over destructive sanctimony. Neither performative cruelty nor tone policing can help us get there. Accountability is not the same as fixating on someone’s small mistakes or clumsy language.
As bell hooks has put it, “Forgiveness and compassion are always linked: How do we hold people accountable for wrongdoing and yet at the same time remain in touch with their humanity enough to believe in their capacity to be transformed?”
Uprooting arrogance at a societal level requires self-examination. We should support each other more and police each other less.
Merging left without compromising values
Lasting change will also require merging around a transformative agenda that speaks to different constituencies without sacrificing progressive values or pandering to colonial tendencies.
Among other things, this vision for systemic change must include Black reparations, radically curtailing or even withdrawing the state’s power to inflict violence on marginalised communities through policing and criminal punishment, honouring the treaties this country made with Native peoples, expanded equal access to rights like education and healthcare, demilitarisation, equal pay, progressive taxation on the ultra-rich, green jobs, decarbonisation and environmental justice.
The policies above are overwhelmingly popular with the electorate but they remain difficult under our current institutional design. Therefore, organisers must work community by community, state by state, and federally towards procedural reforms that can yield structural payoffs.
These include abolishing the electoral college, honouring Puerto Rico’s vote for statehood, instituting ranked-choice voting, protecting voter rights such as universal registration and mail voting, making election day a holiday, mandating voting as a civic duty, reforming campaign financing, instituting an independent commission to reverse partisan districting, democratising the Senate by making it proportionally representative of states’ populations, curtailing executive authority to make war and surveil the world, and more.
In all, our platforms must be driven by intersectional analyses attentive to how each policy will differently impact people depending on their various identities and social positions. We otherwise risk reproducing a long trend within so-called progressive movements led by men and white people, and especially white men, where their concerns become the default. Everyone else is dismissed with demands to “not be divisive” about our very real differences, which are treated as something to reduce or eliminate, rather than appreciate and welcome.
Personnel is policy: taking and making space
In the finer details, social transformation will require shifting the field organising strategy and infrastructure of political parties, especially the Democrats. The 2020 election cycle proved that the old guard’s strategies are ineffective, but also that their antidote is bottom-up energy. In particular, one of the most significant investments donors can make is in year-round community organising and canvassing efforts to build up sustained power.
Trump’s defeat belongs to social movements and activists, especially Black organisers and Black women in particular, who turned out to vote in record numbers.
Credit is also due to Indigenous voters who undeniably helped tip Arizona, Wisconsin, and played an important role in Democratic victories in other states, despite the disrespectful erasure of Indigenous peoples in corporate media coverage of the election. States like Georgia, Nevada, Pennsylvania and Michigan were likewise won by organisations like Mission for Arizona, spearheaded by young Latinas.
These organisations lack the resources of the Democratic establishment but did the hard work that paved the way for Trump’s defeat. Let us save the symbolic gestures of gratitude and actually provide these groups ongoing support and investment.
Incorporating these solutions requires altering not only policy platforms but also the makeup of the party. Democrats are more diverse than the Republicans in membership, but not much more in leadership. White consultants who occupy most positions of power inevitably approach issues with internalised biases, and thereby come to the “impartial” conclusion that “X community does not vote, so more resources must be redirected towards old white voters instead,” which only becomes a self-fulfilling prophecy.
As long as strategic decision-making remains dominated by white strategists, the party will continue redirecting resources away from its most important and yet most disrespected backbone of support – people of colour – thereby feeding apathy and disaffection. Do not expect marginalised communities to continue rescuing a party that refuses to hear or show up for its own base.
A politics of love
“Your Congresswoman-elect loves you,” Cori Bush declared during her acceptance speech. “If I love you, I care that you eat. If I love you, I care that you have shelter and adequate, safe housing. If I love you, I care that you have clean water and clean air, and you have a liveable wage. If I love you, I care that the police don’t murder you.”
Flawed as the electoral process is, it remains crucial to making social change. Elections provide a structure of opportunity, attention and resources to organise and reshape discussions about our material, everyday realities. Activists interested in changing society must therefore continue to engage their momentum and give them direction, all while changing their traditional model – from one where our energy flows upward to support the liberal establishment, towards one where we instead draw resources from electoral cycles to improve and sustain our communities beyond them.
Activists should remain critical of the risk of activist energy being co-opted by a Democratic Party that has presided over a bipartisan dismantling of public services such as housing, bloating and militarisation of a racist policing system, mass incarceration exacerbated by their own crime bills, mass deportation programmes, indiscriminate surveillance, growing inequalities, and a war and carbon-based economy.
At the same time, the work of groups like those mentioned above shows that it is possible to build electoral power without sacrificing organisational autonomy at the grassroots.
The pace of change in political institutions is unbearably slow by design. However, taking state power remains important to altering the daily realities of people’s lives. Around each new win up and down the ticket, no matter how small, we can rally new resources and recruits, feel our power through our results, and grow the fight for radical democracy, both within and well beyond the state.
Love is an everyday, radical mission. Collective liberation requires an ethic of care and a strategy for building political communities rooted in shared respect for all living things. In this, anyone can play a role, everyone is needed and everything must be built with intention – forging welcoming spaces, ceding space, redistributing power, organising solidarity everywhere, winning small battles, persuading the public and scaling upward to generate new possibilities in our unwritten future.
Given the interlinked crises facing humanity, radical change is more urgent now than ever, so let’s pick up a clipboard and do the work, following the leadership of the people of colour, especially Black people, and especially women, who won this election.

Symposium: Religious freedom and the Roberts court’s doctrinal clean-up
This article is part of a SCOTUSblog symposium on the Roberts court and the religion clauses.

Those who think and write about the Supreme Court, including many of the justices themselves, tend to collect and deploy colorful adjectives and epithets to describe the state of its religion clauses doctrine and case law. It is not necessary to go full-thesaurus or to march out the entire parade of pejoratives here. A “hot mess” was the recent pronouncement of one federal court of appeals. And my own favorite is still Justice Antonin Scalia’s 1993 portrayal of the so-called “Lemon test” as a “ghoul in a late-night horror movie that repeatedly sits up in its grave and shuffles abroad after being repeatedly killed and buried.”
An important part of the Roberts court story, though, is that it has both continued and facilitated developments-for-the-better in law-and-religion. Chief Justice John Roberts, following in several ways the example and path of his predecessor, William Rehnquist (for whom he and – full disclosure – I clerked), has directed, not merely endorsed or observed, these changes. The standard, habitual denunciations no longer seem to apply. As Larry David might put it, the law of the religion clauses is actually “pretty, pretty good.”
Many scholars and commentators would disagree, of course. To them, these developments represent the “crumbling,” “demolition” or some other masonry-related downgrading of the “wall of separation between church and state,” or they supply evidence of a judicially ascendant “Christian nationalism” or even “theocracy.” In fact, though, the Roberts court has moved the law of religious freedom and church-state relations toward coherence and clarity, and better aligned it with American history, tradition and practice and with an appropriate understanding of judges’ capacities and the judicial role in a democracy.
A number of recent decisions, including several cases from the 2019-20 term, illustrate this movement. And one that is already scheduled for the fall and another that the justices have been asked to review provide an opportunity to continue it. But before discussing recent rulings and upcoming arguments, it is worth asking how and why things went wrong.
The Supreme Court, during its first century and a half, had almost nothing to say about the judicially enforceable content of the right to religious freedom, about the role of religious believers and arguments in politics and public life, or about the terms of permissible cooperation between “church” and “state.” Questions about these matters were, for the most part, worked out politically and practically, and in ways that (for better or worse) did not often depart from public consensus, habit and expectations. With the gradual “incorporation” of the Bill of Rights, though, and the Supreme Court’s emerging understanding of its counter-majoritarian role, this changed.
As the court took up the task of interpreting and enforcing the religion clauses, at least three things contributed, eventually, to the much-derided state of doctrinal affairs. The first was the constitutionalization — indeed, the fetishization — of a James Madison pamphlet and a phrase in one of Thomas Jefferson’s constituent-service letters. In his 1947 opinion for the court in Everson v. Board of Education, Justice Hugo Black of Alabama presented as canonical a potted and partial history of America’s religious-freedom experience in which a Virginia controversy and Jefferson’s passing reference to a “wall of separation between Church and State” — and not the broad range of views about the meaning of disestablishment — were foundational and controlling. Particularly in school-funding cases, this focus (or myopia) would cause the justices to convert the First Amendment’s no-establishment rule into a command that, somehow, governments avoid “advancing religion.”
A second misstep was the embrace of an understanding of constitutionally required “neutrality” that consisted not in even-handedness or nondiscrimination among America’s increasingly diverse array of religious traditions and communities, but instead in the absence of (something called) “religion” from (something called) the “secular” sphere. That is, “neutrality” was often said to require the forced confinement of religion to the purely private realm, preventing it from playing any role in the routines of public schools and other spaces.
Finally, there was the relatively late-emerging problem of public religious displays, symbols and expression. Although these did not, strictly speaking, impose any obligations, penalties or disadvantages, or confer any privileges, they came to be seen by the court as threatening or contributing to “political divisions along religious lines” or as “endorsing” religion and thereby telling some that they are less than full citizens or “outsiders in the political community.” At the same time, judges and justices were often unwilling to follow through to the extent of outlawing all public displays, symbols and art connected with religious holidays and themes, or undoing the national motto, or cancelling longstanding practices like legislative chaplains. The line between an unlawful endorsement and a permissible acknowledgment of religion seemed to depend on little more than the intuitions, or the aesthetic preferences, of the one drawing it.
For these and other reasons, the evocative denunciations by various justices of, say, the interior-decorating and semiotics aspects of courts’ attempts to apply the “endorsement test” and of the strange contrasts involved in school-funding cases between the religion-advancing effects of books and maps, had force. However, to make a long story short, under the Rehnquist and now the Roberts courts, things have improved.
For starters, in Hosanna-Tabor Evangelical Lutheran Church and School v. EEOC, a unanimous 2012 opinion authored by Roberts, the court reminded us that the point of separating, or differentiating between, “church” and “state” is not to erect a cooperation-killing “wall” but instead to protect religious freedom by preventing governments from interfering in religious matters and from purporting to answer religious questions. In June, the justices re-affirmed this understanding, and the corresponding right of religious communities to select their own teachers and teachings, in Our Lady of Guadalupe School v. Morrissey-Berru.
By 2002, a gradual but unmistakable evolution in the cooperation-with-religion context culminated in the Zelman v. Simmons-Harris decision, in which the court downplayed the “Lemon test’s” quixotic aim of avoiding any “advancing” of “religion” and instead applied a more straightforward and enforceable requirement of formal neutrality. And, this past term, in Espinoza v. Montana Department of Revenue, the court ruled that not only may governments provide funding to persons who choose religious schools, hospitals and social-welfare agencies for the important public goods they provide, they may not discriminate against religion when doing so.
And another example of doctrinal clean-up came in 2019’s decision in American Legion v. American Humanist Association, in which the justices rejected an establishment clause challenge to a large and longstanding war-memorial cross on public property. Instead of hypothesizing about the messages on civic status communicated by the cross to judicially constructed “reasonable observers,” a majority of justices called for respecting, and deferring to, history and tradition when deciding whether a particular symbol amounts to an “establishment of religion.” Noncoercive and time-honored displays and practices should not be uprooted on the complaint of “offended observers” in the name of an abstract understanding of the secular.
The remaining category of American religious-liberty controversies involves exemptions for religious exercise and accommodations for religious people. The Roberts court has several times affirmed, sometimes unanimously, that religious exercise may, and should, be legislatively accommodated and may be treated as “special” by governments in keeping with the particular solicitude shown for it in the First Amendment’s text and throughout American history. The long-running dispute over the Affordable Care Act’s contraception-coverage mandate, which returned to the court last term with Little Sisters of the Poor v. Pennsylvania, provides a contested illustration of the court’s willingness to interpret legislative accommodations of religion broadly, but the controversy surrounding this particular controversy should not obscure the broad, clear consensus that reasonable accommodations of religious dissenters promote both religious freedom and civic peace.
So far, the Roberts court, with its “conservative” majority, has left in place the rule, laid down 30 years ago in Employment Division v. Smith, that, although generous accommodations of religion are permitted, exemptions from generally applicable and nondiscriminatory laws that burden some religious practices are not required by the free exercise clause. The Smith rule has come in for criticism that is every bit as harsh, and at least as widespread, as the critiques of the Lemon and endorsement tests. And the justices have agreed to hear a case this fall that offers an opportunity to reject or revise it.
Fulton v. City of Philadelphia involves the city’s decision to exclude Catholic Social Services from participating in the enterprise of foster-care placements because that agency refuses, for religious reasons, to certify same-sex couples as foster parents. Although the justices could rule for Catholic Social Services on the narrow ground that the city’s policies are not really neutral or generally applicable – an approach similar to the route chosen in the 2018 case Masterpiece Cakeshop v. Colorado Civil Rights Commission – the question “whether Employment Division v. Smith should be revisited” is squarely presented.
The Roberts court’s interpretation and application of the religion clauses have continued an evolution that made First Amendment doctrine more coherent and also more consonant both with historical practice and the judicial role. Exactly how a “revisiting” of Smith would fit in with this evolution remains to be seen. Stay tuned.

Crypto Tax in 2020: A Comprehensive Guide
Paying crypto taxes is becoming increasingly difficult in 2020, as government tax authorities around the world continue to change their minds on how digital assets should be handled. To make things easier, we’ve put together a comprehensive guide to bring you up to speed on the latest changes.
Crypto-assets have entered the mainstream in the past few years, attracting the attention of tax authorities in leading economies. Following a boom in trading and prices, the gains made from crypto-related deals and activities are starting to be counted toward taxable income. Especially in the developed countries, tax authorities have tools to track unreported income.
Cryptocurrency taxation accelerated after 2014, when Bitcoin and a handful of assets arrived on stage. With the arrival of significant gains in 2017, most tax authorities prepared to reinvent their rules and attempt stricter regulations on potentially hidden income. Having a general idea of when taxable events occur make it possible for crypto investors to make informed decisions, and avoid working in breach of local laws. Overall, the past 12 months saw shifts in regulations related to cryptocurrency. Tax regulators started not only passively reminding investors to pay any due taxes, but also issued specific guidelines and warnings on reporting income. It is possible that the IRS can also track transactions for some networks. The latest status of tax requirements and the level of interest that tax authorities pay to crypto assets varies by country and region, with the tax rates ranging from zero to as high as 55%. For now, the IRS 60X rule for futures and options trading refers only to forex options and futures, where 60% of gains or losses are accounted as long-term capital gain, and 40% are treated as short-term capital gains. The Legal Status of Digital Currencies, Tokens, or Coins The general consensus is that digital currencies of any form or based on any technology represent a type of ownership. The nature of the asset is relative as some types of tokens are considered securities. 
Worldwide, regulations differ, but so far, no country has admitted any digital asset as “money”, “currency” or legal tender. Crypto assets are usually categorized as commodities, or a form of property.  So far, merely holding digital assets in a wallet is not a reportable event for most tax jurisdictions. But the most important concept is that of capital gains, or gains and losses realized upon the sale of a digital coin or token. Because cryptocurrency prices are extremely variable, it is highly possible that not all coins are sold for a gain.  Taxing and legalizing BTC and crypto trading is a complex issue, with each nation having its own set of rules. A handy list compiled by Reuters may be the starting point for exploring one’s specific tax situation and events that need to be reported.  Capital Gains from Crypto Sales A capital gain is a rise in the value of any asset held, whether stocks, real estate, or in this case, ownership of digital assets. A capital gain is only realized when the asset is sold.  It’s important to differentiate between a short-term capital gain, where the asset is held for less than a year. Longer-term holding means the sale will be taxed at the usually more favorable rate for long-term capital gains.  Because of the turbulent nature of cryptocurrency trading, short-term capital gains reporting may be more involved, requiring a log of all trading activity, as well as gains or losses realized.  The rule of short-term, or long-term gains may be applied depending on jurisdiction, and some taxation forms do not allow for such a differentiation.  Taxable Events The other important concept on trading crypto assets may be the actualization of a taxable event. For some jurisdictions, this may be as simple as selling the underlying asset.  But for US nationals, a taxable event may arise in other situations. Those may include: 
Using cryptocurrency for buying and selling;  Exchanges between crypto assets;  Coins or tokens allocated in an airdrop; Coins and tokens allocated after a hard fork;  Receiving a payment in the form of crypto assets.
US taxation rules are not entirely clear on taxing hard forks or tokens received for essentially zero-value. There is no consensus on what is the fair value of an airdrop, but it must be kept in mind it is possible some assets may be counted as a taxable event.  In the past few years, the growth of the sheer number of cryptocurrency assets, in the form of new coins and tokens, makes it impossible to track all assets received. However, some exchanges and other cryptocurrency-related operators may have the duty to report cryptocurrency sales and withdrawals.  Case: US-Based Forms US-based exchanges have been asked to produce 1099-K form, which only counts the transaction coming out of the exchange. This means the trader may have sold at a loss, but the end withdrawal may be counted as a gain. 
To avoid the confusion, US citizens may have to fill out form 8849, which allows for more detailed tracking of asset acquisition and disposal.  But this case reveals a more proactive approach, as the IRS started to send out letters reminding traders to pay taxes on their crypto gains. But after more detailed discussions, the IRS has allowed for detailed reporting to describe all exchanges and trades that are relevant to the tax base.  Cryptocurrency Ownership At the moment, most blockchains, starting with Bitcoin, are pseudonymous. In theory, it is possible to track ownership, but only if there is voluntary reporting. For tax purposes, authorities count the receipt of assets as a confirmed transaction, and the moment the assets come under control.  In 2020, total surveillance of digital asset ownership is not feasible, and the IRS is still not tracking all potential owners. However, in the case of some tokens or specific blockchains, the ownership may be tied at least to a personalized account. In rare cases the issuers of tokens even perform KYC, tying ownership to a real-world identity.  But there is no proactive approach to track crypto ownership, and until the assets are sold through an exchange, or in another manner that is traceable, only voluntary reporting remains to inform the taxman.  And while the consensus sees crypto gains as taxable, at this point it is still possible for multiple transactions or trades to remain outside the scope of tax authorities. But those conditions may change in the future, exposing anyone that may have tried to disguise crypto ownership or gains.  Hard Forks and Capital Gains The issue of hard forks has been highly contentious for cryptocurrency owners. Buying Bitcoin was simple enough. But in the past two years alone, Bitcoin forked into several assets, thus potentially giving all owners the claim to the same amount of coins on other networks.  Starting with Bitcoin Cash, there have been more than a dozen forks. And while some of those assets traded at very low prices, the IRS issued requirements in late 2019, which ambiguously claimed a taxable event upon the receipt of a hard fork.  But the IRS has not clarified what it means to receive coins in a hard fork. Taking control of those coins is not automatic, and requires a process known as “coin splitting.” Coin splitting requires that an exchange credits the user accounts with the forked coins. The other approach is to move coins to a new wallet, where the balance may be recovered from the new network. Not all owners of BTC choose to gain access and control to all forked coins.  This has led to a letter requiring the US IRS to specify what it means by receiving coins in a hard fork, and to avoid taxation that may lead to a high tax bill for a now-worthless asset.  Case: Bitcoin Gold Bitcoin Gold was a hard fork from late 2017, which produced an asset initially trading above $500. If the initial IRS guidelines are to be counted, all BTC owners at the time of the hard fork, if they are US citizens, would owe tax on the new asset.  But the price basis for Bitcoin Gold is a price that has nothing to do with current market prices. The time of claiming the coins, if that is counted, may be very different from the price when Bitcoin Gold initially traded. BTG subsequently fell to a price as low as $5, and recovered to around $12 in early 2020.  Establishing the taxable event for this relatively small fork, as well as other similar attempts at re-creating Bitcoin, is still under discussion.  As of December 20, 2019, the IRS is still reviewing a letter from Congress, requiring a revision of the guidelines, and demanding that the latest tax rules are not treated as established law. Instead, the group of Congressmen takes into account the fact that cryptocurrencies are still a new technology, which cannot be captured in the rules of 1099 forms.  It is possible that reporting may vary in its detail and intentions, and the IRS cannot foresee and establish each taxable event arising from various digital coins or tokens. Hence, the best approach may be to look at trading history, but also to keep in mind the final gains, as well as funds that entered bank accounts or were received in another manner.  How the IRS Defines Crypto Value The idea that cryptocurrencies and other virtual assets represent value, and are hence taxable, stems from the way the IRS codifies those assets as representing value in recognized national currencies, including the US dollar.  “Virtual currency that has an equivalent value in real currency, or that acts as a substitute for real currency, is referred to as “convertible” virtual currency. Bitcoin, Ether, Roblox, and V-bucks are a few examples of a convertible virtual currency. Virtual currencies can be digitally traded between users and can be purchased for, or exchanged into, U.S. dollars, Euros, and other real or virtual currencies,” the IRS stipulates. “The sale or other exchange of virtual currencies, or the use of virtual currencies to pay for goods or services, or holding virtual currencies as an investment, generally has tax consequences that could result in tax liability,” warns the IRS. From those propositions stem most cases where each individual owner or trader may have to figure out the exact approach to report income, based on specific gains or losses. The IRS has a set of guidelines, ranging from general to specific, and has asked for reporting since 2014. But the new tax season has more details on reporting, this time expanding the scope of taxable events. The rules of 2019 are what is considered the most recent and relevant basis for reporting for tax season 2020. Letters of Warning In 2019, the IRS signalled its strong stance on crypto trading by sending 10,000 letters of warning. The letters were of two types – a warning and educational letter, and a more serious one demanding a reply and actions to file the correct tax returns. Letters 6174 and 6174-A require no action. But receiving letter 6173 requires an immediate response, and the failure to do so invites a tax audit. The sending of 10,000 letters suggests IRS may be tracking accounts related to exchanges, most probably Coinbase. The accounts mentioned in the letter do not relate to wallets or other forms of ownership, such as having balances on the blockchain.  To file the correct tax return, if required, may be done through form 1040. The warnings and requirements affect persons that have shown activity related to cryptocurrency trading, while failing to mention their ownership and trading operations. Sources of Balance Information Building up the base to calculate taxes may be complicated. Information on balances may be acquired from exchange logs.  For now, the IRS has not issued specific requirements for futures or derivatives trading. Futures trading and margin cryptocurrency 100X leverage are also not unusual, and may generate specific income streams. In 2020, there are no specific guidelines on how to tax 200X leverage, or even higher margin calls. But it is possible to claim a loss on trades.
Reporting on Bitcoin transactions may also happen using various techniques, including FIFO and LIFO. But in the case of Bitcoin, any specific time of purchase may arrive with different price ranges. This means that a detailed list of transactions may specify exactly which coin was sold, and what is the difference between the purchase price and the sale price.  For instance, selling a coin acquired at $8,000 is not the same as one acquired when BTC was $1 or even $30. Hence, there is no requirement to sell earliest coins first, and reporting may focus on an asset purchased at a specific price.  This possibility means selling Bitcoin can form a base that can also lead to temporary capital loss, if the reporting person chooses to minimize taxes for a certain time period. Transaction information from wallets is also not revealing all taxable events. Moving coins between owned wallets or addresses is not considered a taxable event. So far, the IRS has not issued guidelines on reporting transactions or revealing the intention behind transactions, or giving any other evidence of private key ownership. Crypto-to-Crypto Exchanges and Stablecoins Perhaps the most confusing moment of cryptocurrency trading is the need to report a switch between crypto assets, as well as any capital gains stemming from those operations.  The IRS has a concept of Like-Kind exchange, which does not generate a taxable event when moving between some types of assets. However, this does not apply to cryptocurrency exchanges, which are not registered for Like-Kind swaps. For US citizens, as of 2020, those types of exchanges are only limited to real estate.  This also means cryptocurrency exchanges in the US are not registered to support Like-Kind exchanges, and fulfill the requirements to file form 8824. This also means that switching between Bitcoin and altcoins is capable of generating a taxable event.  For instance, buying BTC at $6,000, and exchanging it for Ethereum when BTC has already climbed to $9,000 generates the same capital gain of $3,000.  However, this gain can be offset by a loss as well. In case the altcoin drops in value, the sale itself generates a loss that may offset the capital gains, in the end leading to a lower tax bill. However, both operations need to be accounted for, until the last liquidation into fiat.  Stablecoins and Taxes In 2020, most cryptocurrency trades use one of several coins pegged to the value of the US dollar. Those assets have varied states of legal acceptance, but are widely used worldwide. The most common one, Tether, or USDT, is capable of storing the value of assets sold.  In the above example, BTC appreciated from $6,000 to $9,000. However, the asset was exchanged for USDT, meaning the funds are still not switched to fiat. Still, the capital gains may generate a taxable event, which means stablecoins are not suitable tools to disguise capital gains.  For US citizens, coins like Paxos, TUSD, or USDC also require complete screening with real-world identity evaluation. For now, exchanges do not report trades that transform gains into stablecoins. However, stablecoin issuers are a potential source of disclosure. Having a Coinbase account, as already discussed, means the IRS may be aware of cryptocurrency activity, while discounting the usage of stablecoins.  However, the best approach is to consult an expert on the issue of transactions between cryptocurrencies. The best approach is to have a complete log of activities, to achieve an easier calculation of the tax basis.  Crypto Taxation in Canada The Canada Revenue Agency works with a set of guidelines from 2014, advising on the correct filing. Canada supported highly active cryptocurrency activity, and the tax authorities had the tools to track and require payments, similar to the US system.  Canada treats cryptocurrencies as commodities for the purposes of taxation. Depending on sources, income tax or capital gains tax is applicable. Canada differentiates between sporadic and regular income, and treats regular activities as sources of business income.  As for fair value, the requirement is to estimate and self-report based on general guidelines.  “To figure out the value of a cryptocurrency transaction where a direct value cannot be determined, you must use a reasonable method. Keep records to show how you figured out the value. Generally, the CRA’s position is that the fair market value is the highest price, expressed in dollars that a willing buyer and a willing seller who are both knowledgeable, informed and prudent, and who are acting independently of each other, would agree to in an open and unrestricted market,” the Canadian tax authority explained. Crypto-to-crypto exchanges are also causing a taxable event in Canada, similar to the US-based system. Similarly, reporting for Canadian citizens or businesses requires the preservation of most records, including wallet entries, exchange withdrawals and any other relevant data on transfers and acquired coins and tokens. Tax Situation in the EU The European Union is one of the more relaxed regions for cryptocurrency trading. However, most countries are aware of the gains potentially made in cryptocurrency trading.  The tax rules within the EU are highly varied, as the overall rules allow trading, while leaving it to countries to figure out the tax accounts of citizens or corporations. For that reason, it is difficult to offer general guidelines on EU-based taxation. The exact rules vary based on local tax rates and types of taxes.  There is also a disparity in the way each country views digital coins and tokens. Germany, for instance, sees Bitcoin as money, however, not official money, but a form of “private money”. Switzerland, one of the most lax regulators, accounts for cryptocurrency in the way forex markets are codified when it comes to taxation.  For most EU countries, owning digital assets does not need to be declared. Switzerland is an exception, where the Swiss franc value of those assets must be declared in advance at the start of the tax year.  However, there is a big exception for speculative trading – not all operations need to be taxed as they happen. This is a big advantage and a relief to EU citizens, where only the initial and final value of assets may be reported.  Usually, traders will make a series of deals, and it is rare to see straightforward buying and selling of Bitcoin or other assets. The EU rules may be solved on a case-by-case basis. However, it must be noted EU bank accounts can be traced, and transfers above 5,000 EUR are often scrutinized.  EU-Based Exchanges and Brokerages EU-based exchanges and brokerages are usually completely transparent. They are connected to the EU-wide banking system, and offer relatively high limits for trading and withdrawals.  However, EU-based exchanges are not obliged to report on taxes and tax events, especially given the decentralized nature of the union, with many different jurisdictions. Thus, all EU citizens must report their gains or losses as physical persons, to pay the taxes owed.  The EU taxation rules also apply to Malta, Liechtenstein, Switzerland and other territories that have harmonized their financial legislation. The potentially applicable taxes are, in most cases, physical person income tax; some forms of local taxes; wealth tax when it applies, and possibly corporate tax in case the cryptocurrency activity is related to a business entity.  EU and VAT on Crypto Deals Cryptocurrency trading in the EU is treated in a way similar to forex trades. This means the trades do not incur VAT. Merchant usage of cryptocurrencies is also freely available, and for now may be a tool to circumvent VAT payments.  Taxing Miners in the EU Cryptocurrency mining is differentiated from speculative activities. Namely, the gains from this activity can be counted as the results of business activity. Thus, the sale price of coins can be offset by business expenses, including the hardware and electricity costs incurred in the process. This approach may require the services of an accountant, which may end up in a lower tax bill.  The EU has not issued any specific requirements on income from hard forks or airdrops. For now, capital gains where they apply may be calculated for any coins received and possibly sold for fiat.  UK Crypto Taxation The UK has had most of its financial rules harmonized with the EU. However, with Brexit looming as of January 31, 2020, and with a 10-month process of establishing a new relationship with the EU, the UK may have a different set of taxation rules before long.  The overall stance of the UK is that cryptocurrency is either an asset/property, or private money. Tax reporting also hinges on the principle of capital gains tax. Sales tax, a form of VAT, does not apply to cryptocurrency deals.  Case-By-Case Basis Unlike the US, where the IRS has attempted to create a system of terms, the UK tax service HMRC has taken a case-by-case stance. This means that each transfer or sale may be regarded as a novel situation, looking into where the exchange of value really happened.  The HMRC has admitted that cryptocurrency is a new sector, and with the advent of tokens, it has created multiple tax situations that are too complex for a single framework.  UK Tax Terms
The tax authority has still established some general terms for digital assets. Usually, those  Assets utilize a Distributed Ledger, although a distributed ledger does not necessarily use a token or coin. Those assets can be stored, transferred, or exchanged.  The HMRC recognizes three types of assets: exchange tokens, utility tokens, and security tokens. Bitcoin, for instance, is considered an exchange token.  Taxation happens based on the de facto events regarding value transfers and capital gains, and not on the definition of the token. Thus, selling Bitcoin or a security token incurs the same capital gains tax.  The general stance of UK tax authorities is that in the majority of cases, individuals hold onto the tokens as a form of alternative personal investment.  “In the vast majority of cases, individuals hold cryptoassets as a personal investment, usually for capital appreciation in its value or to make particular purchases. They will be liable to pay Capital Gains Tax when they dispose of their cryptoassets,” the tax guidelines state. But because the tax authority looks at different cases, using cryptocurrency as an alternative form of payments may incur not only capital gains tax, but also personal income tax and insurance.  UK Definition of Crypto Trader UK tax authorities also differentiate between sporadic cryptocurrency deals, and what may be considered “trading” activity. High frequency and volume of activity may constitute financial trading activity, and incur a different type of taxation; once again income tax instead of capital gains tax.  “As with any activity, the question whether cryptoasset activities amount to trading depends on a number of factors and the individual circumstances. Whether an individual is engaged in a financial trade through the activity of buying and selling cryptoassets will ultimately be a question of fact. It’s often the case that individuals and companies entering into transactions consisting of buying and selling cryptoassets will describe them as ‘trades’. However, the use of the term ‘trade’ in this context is not sufficient to be regarded as a financial trade for tax purposes,” the tax authority explains. Thus, in the UK, it is important to differentiate between sporadic activity, and what may be considered business-like activity or regular trading.  In the case of highly active and regular cryptocurrency-related activities, business income reporting may be necessary, falling under a different set of rules. Airdrops Not Considered Until Liquidation The term disposal means the final act of liquidating digital assets. Like all crypto cases, the UK authorities look at the specifics and whether the airdrops have the nature of assets with potential returns. Generic, goodwill airdrops not related to any purchase or investment, incur capital gains only upon their sale.  More specific airdrops which may present dividends or other types of returns present specific challenges, depending on whether the assets were liquidated or if their value presented potential capital gains.  Airdrops were a fad in 2017 and 2018, when projects would award tokens for free, as a tool to expand their communities. Those types of generic airdrops can usually be accounted as a capital loss.  Token Pooling UK tax reporting has specific rules when accounting for multiple token sales with gains or losses. There is a 30-day waiting rule when acquiring new assets, before they can be pooled when accounting for capital gains or losses. Newly acquired assets that are traded within 30 days of acquisition must be counted separately.  Older assets may be used to calculate the cost of sale and the tax basis.  For instance, if Alice bought 10 BTC for $1,000, and then bought 10 BTC for $1000,000, she would have a total allowable pooled cost of $101,000. Selling 5 BTC for $40,000 could be discounted with the cost of 5 BTC from the pooled cost, or $25,250. Alice’s total tax gain would be $14,750, on which tax would be due.  However, if Alice bought one BTC at $7,000 and sold it days later at $8,000, it would be accounted separately and not pooled with previous purchases for a cost basis. This rule makes the timing of purchases and a detailed log extremely important. Claiming a different cost basis may make a big difference in counting gains or losses. With turbulent crypto prices, this may also make the final tax bill look different. In any case, just like US-based traders or owners, UK tax reporting requires keeping score of all transactions, and being ready to make the case for one’s specific intentions and levels of cryptocurrency activity.  Pooling and Hard Forks The HMRC will consider hard forks on a case-by-case basis. This means that if a Bitcoin owner did not decide to split coins, or receive coins from an exchange, tax authorities may be understanding and not require reporting.  For instance, a snapshot of the Bitcoin blockchain, which reportedly allowed access to HEX tokens, need not be reported if a user does not intend to take the HEX tokens, or trade them.  But if a fork-based asset is acquired, its fair value and cost are not pooled with other tokens, and a sale can be calculated just for that asset.
Rekt: Reporting Asset Prices Going to Zero UK-based traders may claim they “disposed” of an asset, where the value has gone to zero. Even without a sale, following general capital gains rules, an asset can be pronounced to have “negligible value”. The zero-based value can then be used in conjunction with the cost basis of pooled assets, to claim capital losses. This rule is especially valuable to altcoins, where indeed losses and crashes to zero have been possible, despite previous spikes to extraordinary valuations.  Lost Private Keys Based on the above rule, loss of private keys may be used on a case-by-case basis to avoid paying capital gains. In case of a loss, the user claims negligible value minus the re-acquisition value of the assets, to crystallize a loss. However, the loss must be accepted by the HMRC, to avoid fraudulent claims. The tax authorities do not track blockchains, and claiming to have owned and lost private keys must be supported by evidence.  However, the HMRC does not have provisions for theft or loss of digital assets, except for the potential to claim negligible value.  As seen above, the UK guidelines are extremely detailed and also flexible, to reflect the shifting nature of the cryptocurrency space. The above cases may be made for other jurisdictions, and reveal examples in which tax authorities do not have a proactive outreach, but may be amenable to reporting or negotiations.  The latest UK regulation on cryptocurrency dates back from 2018, and there may be changes once Brexit becomes a reality.  Southeast Asia, Japan and China: Specifics in Crypto Taxation
Southeast Asia is one of the hottest regions for cryptocurrency activity. For that reason, in the past few years, tax authorities have also reawakened to the reality of relatively high potential gains from trading.  Japan considers Bitcoin as a legal method of payments. Its approach is to levy capital gains tax on sales made for profit or loss. Cryptocurrency payment is highly developed in Japan, but payments are exempt from consumption tax.  Japanese taxation is relatively high, ranging between 15 and 55%, with mandatory reporting required on gains made based on crypto assets. The taxation depends on tax brackets, and is higher in comparison to gains from international stocks. Japan has allowed exchanges to link directly to banks, and trading is not anonymous, hence traceable by the National Tax Authority. China, for now, is still the Wild East when it comes to crypto. All coins and tokens are considered a “virtual commodity”. Ownership, trading, and disposal of cryptocurrencies are still a legal gray area.  As of 2020, China has still not levied tax on digital asset gains, despite the highly active trading activities. Exchanges may report in the form of corporate taxes, but for individuals, there is no tracking or compulsory reporting.  The reason for this may be the fact that China tried hard to separate the world of banking and fiat from trading cryptocurrencies. Back in 2017, most exchanges stopped offering pairs with the Chinese yuan, and switched to trading between coins only, with the aid of stablecoins. Legal observations have not noted any specific rules regarding cryptocurrency reporting, except for monitoring and auditing general wealth.  Since the fall of 2017, it has been near-impossible to trade in fiat. Hence, Chinese traders moved their activity entirely on the blockchain, and into USDT tokens. China is thus unable to track bank accounts, or link exchange accounts to real persons. Its aim to deprive the crypto sector of a fiat gateway is also hampering the potential to collect taxes.  The chief reason for China’s stance is to impress its rules on capital controls. However, the potential to move cryptocurrency internationally has somewhat managed to circumvent those controls, at least partially.  Crypto regulations constantly fluctuate in Southeast Asian countries. It is possible some countries levy taxes where there were none before.  Currently, Singapore levies no tax on crypto transactions. However, the country is very strict about money laundering, and has capital controls to avoid funds flowing out of the country. Selling cryptocurrency in Singapore may in the end require foreign citizens to report the sale to their respective countries’ tax authorities, or face a penalty and even imprisonment.  Thailand’s model is relatively simple, levying a 15% capital gains tax, while allowing a waiver of the 7% VAT in the country. Hong Kong is also offering tax-free Bitcoin sales, and does not require specific reporting on trades. However, income in cryptocurrency for merchants may have to be reported in Hong Kong dollar value.  Foreign nationals, however, are mostly blocked by significant difficulties in liquidating assets in those regions. Attempting to avoid taxes may be a complex affair for foreign nationals, and lead to potential penalties.  Cryptocurrency laws in Asia are also constantly reinvented, mostly focusing on fraud, consumer finance risks, as well as money laundering. For now, the regions have more lenient policies on taxation. Russia: Still Struggling to Tax Crypto Assets Russia is yet another region where cryptocurrency activity is extremely high. Yet the country is still not ready with regulations, and trading is a big gray area. For now, cryptocurrency activity flies under the radar of tax authorities.  But the Russian Duma may be working on new legislation, potentially tracking cryptocurrency activity and finally taxing individuals. For now, Russia still allows low-verification trading on some exchanges, which remain high-risk. Banks have offered to track transactions coming from cryptocurrency sales, but for now, Russian traders and sellers may fly under the tax radar. So, Can Crypto Avoid Some Taxes? In 2020, it looks like most of the Western countries and some markets in Asia are on track with taxing cryptocurrency gains. The IRS has taken the most proactive approach by linking identities to Coinbase accounts. But there are still offshore regions where cryptocurrency sales may be tax-exempt.  There is a caveat though- for most jurisdictions, the location of assets is considered the country of citizenship. This means even if a token is held on an offshore exchange, its location can still be considered the UK or the US for tax purposes.  Still, there are regions where a tax-free sale could be achieved, alongside other techniques for offshore businesses.  Slovenia, part of the EU, has all the benefits of a fully legalized market, plus zero capital gains tax on cryptocurrency sales. However, income in cryptocurrency is taxed with personal income tax. But overall, speculative trading may be possible for local residents without capital gains tax.  Belarus, while not in the EU, is one of the regions where crypto taxation is a gray area. The country, despite political risks, is still a haven of crypto activity, for those willing to get exposure to its regime and economy.  Offshore zones already mentioned include Singapore and Hong Kong, as well as possibly China’s Hainan special economic zone. But similar possibilities exist for Barbados, Malaysia, and Mauritius. Other offshore zones with special cryptocurrency rules include Puerto Rico, the hurricane-stricken country which attracted Bitcoiners.  But perhaps the biggest advantage is that cryptocurrency trades are VAT-exempt, limiting the liability when switching to fiat.  Tools to Calculate Crypto Taxes The tax base could be calculated using logs from wallets or exchanges. But there are tools that make the tracking of transactions easier, as well as the balances required to calculate the tax base.  Tools like Koinly consolidate exchange information, wallet transactions, and include the potential for professional advice to achieve the minimal potential tax payment. Koinly works with multiple major tax authorities, for detailed reports with complete compliance. The eToro brokerage and trading platform also includes tax calculation for UK citizens. It is also possible to use generic free tools for easier calculation. Crypto tax calculators usually support information directly from exchanges to complete the reports.  Taxing Mining Income Mining income is, in most cases, treated as regular business income, with rules applying to the specific jurisdiction. The biggest advantage of miners is they may claim the expenses of hardware and electricity to decrease the tax basis. In the past, mining has been an amateur activity. But since 2016, cryptocurrency mining 50x increases in activity were not unusual, for Bitcoin and other assets.  Depending on the coin mined, the value of this activity may be extremely low, as in the case of amateur mining. But Bitcoin mining may be used as a tool to decrease the tax basis for most miners. With multiple operations situated in China, it is possible some miners fly under the radar.  Best Approach to Crypto Taxation The best approach to cryptocurrency taxation is to err on the side of reporting. Regulations shift all the time, and depending on the potential for surveillance on bank accounts, tax authorities may be more aggressive in seeking out earnings originating from cryptocurrency exchanges. Simply having a big unexplained balance may alert tax authorities.  The rules of residence may vary, as some regions may have more lenient taxation. The other requirement is to keep detailed records of all activities, either using specialized tools or tracking and copying each transaction or operation to calculate the most favorable tax base based on regional rules.  For now, there is no need to report or reveal addresses or wallets, or declare a connection between a name and an address. But in the future, blockchain tracking may become a big part of taxation rules. Currently, only a few startups are working on tracking the blockchain, identifying “whales” and significant moves. But in the future, assets themselves may not be fungible and anonymous, leading to a stricter potential for taxation.  With season 2020 in full swing for reporting, the world of cryptocurrency also faced stricter regulations in the EU, as well as the USA, coming into force in the new year. Increased surveillance also looks like a positive fact, in that cryptocurrency has been accepted among investment methods, and taxing is a way to legitimize that activity. There are companies out there who teach you how to use shady PBNs and other link schemes to “trick” Google. It might get short-term results, but in the long term, you’ll land in hot water. You can’t take shortcuts with SEO. Just like in business, you have to put in the work and the time if you want to see the results.
Some tips for doing this the right way? Don’t spam keywords. Hands down. This is one of the biggest mistakes most people make. Create your content for humans while also paying homage to search engines. But more importantly, ensure that whatever it is that you’re conveying is insightful, engaging, unique and adds a tremendous amount of value.

The best way to do this is if you can identify the right pain points and present a solution in your lead magnet, then you’re well on your way.
What problem are consumers facing in your niche? What made you get into business in the first place? Ask yourself these questions before building out your lead magnet. The better you identify the problem or pain points at the outset, the better you’ll be at actually addressing that with a solution in your lead magnet.
What type of lead magnet should you build? That could either be an ebook, a cheat sheet, a checklist, a video, and others. Of course, it’s not just about the lead magnet. You have to have a squeeze page with sizzling sales copy to get people to drop into your funnel. But it all starts with a great lead magnet. The better it is, the more effective you’ll be at reaching your audience.
7. Use Facebook ads with re-targeting.
One of the most powerful methods you can use to market just about anything these days are Facebook ads. With Facebook, you can reach a very specific audience and you can do it very easily. You can target by interest, age, relationships status, geographic location, and so much much more.
But the trick here to getting great results isn’t just about click-traffic. You have to focus on conversions and re-targeting through pixels. Part of any good sales funnel is going to be an email marketing sequence. These are the automated messages that go out to users once they subscribe to your list. Use your email sequence to build a relationship with the subscriber. Be authentic and transparent. And convey your journey.

Historic Restoration Condo & SARA National Award
A façade preservation and restoration project at 54 Bond Street in Manhattan received the Society of American Registered Architects’ National Award of Excellence. The international project team for this highly complex exterior restoration included architect CTA Architects P.C.; owner’s representative D+DS Architecture Office; general contractor Traditional Waterproofing and Restoration; Gent, Belgium-based cast-iron fabricator Van Cronenburg Architectural Hardware; and structural engineer GACE Consulting Engineers. Andrews Building Corporation manages the building. The project was also recently recognized with the Lucy G. Moses Award, the New York Landmarks Conservancy’s highest honors for preservation excellence.
54 Bond Street is a circa-1874, corner cast-iron building in the French Second Empire style. The Lucy G. Moses Awards are the New York Landmarks Conservancy’s highest honors for preservation excellence. The award was bestowed upon the project team on the evening of May 8, 2018 at the 28th Moses Awards, held at the historic St. Bartholomew’s Church, on 325 Park Avenue in Manhattan.
“The $4.5 million project was phased, with the first phase being the façade restoration, and the second, final phase being the reconstruction of the sidewalk,” said Christa E. Waring, AIA, LEED AP, CTA’s Principal in Charge. “It was an extremely involved, painstaking process involving extensive restoration as well as the replication of over 1,000 incredibly intricate cast-iron units, including formed metal cornices and pediments. In addition to the extensive cast iron, there is sheet metal ornamentation on the façade, on elements such as the cornices. All renovation work was performed from pipe scaffolding,” she added.
The highly ornate, six-story, 15,000-square foot 54 Bond Street building in the Bowery section of the NoHo Historic District, was designed by Henry Engelbert and constructed between 1873 and 1874 – at a time when the Bowery was a residential and cultural center. Columns surround the windows and a stately cornice was specified for above the sixth floor. A shallow pediment is on the Bond Street side of the building, while Englebert placed a cornice around the building between each floor, to unify both sides of the façade.
The structure served as the Bond Street Savings Bank for five years. As the Bowery declined, the structure became home to the German Exchange Bank, then a loft and storage space, and, after that, the Bouwerie Lane Theater in 1963. The New York City Landmarks Preservation Commission (LPC) designated the building an individual landmark in 1967, and it was placed on the National Register of Historic Places in 1980.
In the mid-2000s, the Bowery began to improve. It was in 2007 that 54 Bond was purchased and converted into a condominium property with three large high-end residential lofts and two commercial spaces on the first two floors. A few years later, in mid-August, 2011, the owner, 54 Bond Street Condominium, contracted CTA to repair the façade, as it had become somewhat dilapidated. Cast-iron units along the façade were heavily rusted and/or deteriorated, for instance, while there were a number of points of local leakage. CTA, which has extensive experience with both historic restorations and residential buildings, not only restored the façade to its original condition and addressed the leakage, it restored the brick masonry parapets on the northwest side of the structure.
CTA designed the facade repair, bid out the project, and performed construction administration services, developing the budget and the trade packages. Before any renovation work was undertaken, however, CTA’s project manager, Matthew Jenkins, AIA, performed an intensive and detailed three-month-long documentation of the façade for two primary purposes: 1) to assess and document the façade’s condition; and 2) to ascertain which cast-iron units would need to be replaced. “It was amazing to see just how detailed each unit was. The intricacy and the decorative and interlocking nature of each unit made it a challenging undertaking,” Jenkins said. He also uncovered some hidden conditions, and stated, “When the units were removed, we found that the cast-iron braces that held them in place had deteriorated, along with the brick-and-masonry backup.” Since these items had to be addressed, they were added to the scope of the project.
Full Scope of Work Most cast-iron buildings are narrow, so their facades are limited. However, 54 Bond is unusual in that it is on a corner. Hence, the amount of cast iron is much more extensive on it than on most cast-iron buildings. In fact, the Bond Street side alone is over 100 feet long.
Due to the façade’s beauty and uniqueness – as well as its landmarked status – CTA was careful to avoid using alternate materials that differed from those originally used. In fact, the only modern material the team used was concealed sheet flashing to protect the building’s interior from water penetration.
All of the cast-iron units to be replaced were numbered, shipped to the fabricator’s facility in Belgium, and reviewed in detail, allowing the fabricator to create shop drawings, molds, and then create the replicas. The cast-iron pieces were also zinc-metalized to provide additional rust protection and then painted with three coats of epoxy paint. Pieces that were in good condition, on the other hand, were stripped of paint and rust and were then recoated in a phased process.
Due to the architectural significance of the building, the team worked with the coating manufacturer, Tnemec Company, Inc., to develop a system for testing the paint, to make sure it adhered appropriately to each element.
CTA’s Bradley Heraux, technical manager on the project, noted that the team’s biggest challenge was coordination. “The cast-iron units were molded and replicated in Belgium, while the sheet metal elements were remade locally, in Long Island City, by Gotham Sheet Metal. There were so many different elements in different geographical locations, we really had to coordinate it all very carefully,” he said. “The team collaboration was superb despite the geographical distance,” Heraux continued. In fact, the Belgians traveled to Manhattan for an extensive site review and to create additional documentation of the façade elements.
Overall, in order to make the restoration easier and to avoid dust, the contractors removed old paint using a stripper tape impregnated with solvent, rather than by sandblasting. Further, as the windows were somewhat recently replaced, the façade renovation team simply repainted them to match the color of the renovated façade.
After the façade work was completed, the second phase began with the replication of the three original cast-iron entrance stairways leading to the ground floor, which is elevated above the street level. One entrance goes to the residential portion of the building, while the other two belong to the retail portion. At some point over time, the stairways had been replaced. CTA designed new stairs to match the originals the team had found in old photographs and from remnants on site. In addition, CTA added new perimeter areaway fencing, ensuring it was both visually attractive and meeting the current codes. The final steps are to replace the sidewalk and renovate underground vault, as well as to restore the historic areaway. The team is currently waterproofing and protecting the underground vault.
Of course, CTA worked with LPC throughout the process. All processes, materials, and equipment had to be approved by the agency, even the security cameras installed on the building. CTA specified cameras that were installed using a low profile, so as not to detract from the aesthetics.

It’s now time to build your Facebook ad.
“We’ve run successful static ads,” says Colling. “But if you can, you’ll see much higher returns from creating a video ad—for example, a short 15-second video that pitches why people should read or click through to your content.”
At Hootsuite, we’ve seen video ads consistently outperform static ads. Not everyone can afford a video team, but there are different tools such as Animoto that you can use to create inexpensive videos on any budget.
If a video is out of reach, make sure you do some A/B testing for your static ad. Facebook shows you which images are resonating. If you have the Facebook Pixel installed, you’ll also be able to see which images lead to conversions on your website.
Step 4: Set your budget
When it comes to your Facebook ad budget, there are two ways to define cost—overall amount spent and the cost per result. If you have a budget of $500 per month, this is your overall amount spent. If you divide this amount by the number of clicks (or other measurement), you get your cost per result.
At Hootsuite, the key areas we measure are cost-per-click, cost-per-result, and cost-per-engagement.
“We set targets for each of these so we can easily tell if something is underperforming—or draining our budget,” Colling explains. “We’ve done this at Hootsuite for years, so our targeting is very precise and our costs are low. Any brand that sticks to it and slowly refines their ad process will see their targeting improve and costs go down.”
While results can be achieved with any budget, you need to set realistic goals depending on your budget.
“Smaller budgets need smaller locations,” Colling explains. “You can’t spend $50 and target all of New York. Target a smaller area and for shorter time frame, such as a week. Make sure you’re targeting the right areas. Don’t target fancy Manhattanites with your time tracking software for plumbers—target New Jersey.”

At Hootsuite, the key areas we measure are cost-per-click, cost-per-result, and cost-per-engagement.
“We set targets for each of these so we can easily tell if something is underperforming—or draining our budget,” Colling explains. “We’ve done this at Hootsuite for years, so our targeting is very precise and our costs are low. Any brand that sticks to it and slowly refines their ad process will see their targeting improve and costs go down.”
While results can be achieved with any budget, you need to set realistic goals depending on your budget.
“Smaller budgets need smaller locations,” Colling explains. “You can’t spend $50 and target all of New York. Target a smaller area and for shorter time frame, such as a week. Make sure you’re targeting the right areas. Don’t target fancy Manhattanites with your time tracking software for plumbers—target New Jersey.”
In order to simplify the budgeting process, we recommend setting a daily budget. Divide your overall amount spent per month by days in the month to get this number. Then, set a reminder in your calendar to check on your budget and costs every day.
Pay attention to the more successful days (i.e., those with lower CPCs.) What did you do differently on those days? What steps can be replicated? Consider the variables that could have affected your results, and use this information to optimize your future campaign budget.
Step 5: Measure performance
One of the most significant errors social ad managers can make is forgetting to track how their ads are performing. If you forget—or don’t know how—to measure your ads properly, you can end up costing your business a lot of time and money.
Measuring your Facebook ads means paying attention to what’s working—and what isn’t.
“In the start, it’s important to check a lot. I recommend checking on your campaigns every 24 hours and 48 hours to make any tweaks. Once an ad is performing well, we’ll let it sit till the end of the campaign,” Colling explains.
When you closely monitor your ads, you’re able to quickly make decisions such as pausing or stopping ads that aren’t performing well. This lets you pour that budget back into top-performing ads. Monitoring your ads gives you the opportunity to make adjustments that will ultimately drive better results.
What to track
Before you begin any campaign, you need to establish performance metrics relevant to your objectives. According to Altimeter, only 34 percent of organizations feel that their social strategy is connected to business outcomes.
If your objective is business conversions, for example, you might want to look at the number of leads driven by your Facebook ads.
“We track cost-per-conversion when our goal and main objective is conversions, Colling says. If someone signs up for a webinar or downloads a piece of content, we’re able to track the business impact of this.”

June 6, 2008 Patrick Pichette Re: Offer of Employment with Google Inc. Dear Patrick: On behalf of Google Inc., I am pleased to offer you the exempt position of Senior Vice President and Chief Financial Officer, reporting to the Chief Executive Officer, subject to the terms and contingencies set forth below. The position is located in Mountain View, California. Your start date shall be August 1, 2008 and you will assume the position of CFO effective August 12, 2008. You will receive an annual salary of $450,000, which will be paid biweekly and subject to a periodic review. You are eligible to participate in the Company Bonus Program; your annual bonus target will be 150% of base salary. Bonuses under the Company Bonus Plan are discretionary. The actual bonus amount could be larger or smaller than this amount, based on your performance and the performance of the Company. Whether a bonus will be awarded in a particular bonus period, and in what amount, is within Google’s sole discretion. Both your base salary and the components of your bonus are subject to periodic review. Additionally, upon your start date, Google will pay you a one-time Sign-On Bonus of $500,000. This will be taxed as supplemental income. At the completion of six months of full-time employment with us, Google will pay you an additional $500,000 Cash Bonus. This will also be taxed as supplemental income. In the event your employment is terminated within the first six months of your employment, the Cash Bonus payout will be accelerated and paid on the termination date or as soon thereafter as Company business practices allow, but in any case within thirty (30) days of your termination. If you terminate your employment at Google before the one year anniversary of your start date, other than as a result of a breach by Google of this Agreement, you will be required to repay the Sign-On Bonus and Cash Bonus. Any required repayment will be prorated based on the number of remaining calendar days until the one year anniversary of your start date. Google will pay relocation costs and provide reimbursement for specified moving expenses as outlined in Google’s North American Officer Relocation Policy. In order to receive these benefits, you will be required to work with a third party vendor provider designated by Google to assist in employee moves. As a regular full-time employee you will be eligible for various benefits offered to similarly-situated Google employees in accordance with the terms of Google’s policies and benefit plans. Among other things, these benefits currently include medical and dental insurance, life insurance, and a 401(k) retirement plan. You will automatically be enrolled in the 401(k) plan at 4% into the Wellesley Fund, which is a balanced fund of stocks and bonds. Vesting in both of these stock option and GSU awards is contingent on continued employment on the applicable vesting dates. The third award will be a grant of 910 GSUs.
