It is very likely the Assembly will pass it this time upon return to session given the Senate already passed it right before the summer recess. I see no reason why Governor Hochul wouldn’t sign it (she approved expanding the qualifying conditions list and what products could be purchased under the medical cannabis program as it is better than an opioid addiction, and permanently waived the registration fee).
This would be a critical step for helping New Yorkers (especially low income New Yorkers) access medical cannabis. This would just come out of the state’s funding for Medicaid, Child Health Plus, the Essential Plan, EPIC, and Workers Comp. Not sure how coverage for the NY State of Health Plans would go.
I can see New York based Medicare Advantage Plans (Medicare can’t cover it because the feds still think pot is a gateway drug) covering medical cannabis as a way to get people to buy their plans over having just Medicare or a plan based in another state. Advantage plans are technically private and would be permitted to cover it if this bill passes.
New York has always covered things for Medicaid regardless of Federal match. They honestly could use some of the tax money to fund this.
The only other problem is there needs to be more medical dispensaries, especially outside of NYC Metro. 40 medical cannabis dispensaries is not enough. I would at minimum double it. New York is a big state and we can’t expect people who need medical cannabis to drive 2-3 hours one way to get it.
I can see New York pushing this issue and being like “Not only did we legalize it, we’re treating it as the medication it should be and providing coverage for it”. That is a very New York thing.
