The Lawlessness is the Point, Part II
The panel of Fifth Circuit judges who will hear the appeal of the bonkers Texas decision that purported to outlaw mifepristone has been announced. Judges Jennifer Walker Elrod, James Ho, and Cory Wilson will hear the case. (In case you're a bit confused: the Supreme Court put the district court decision on hold while the appeals process played out, but did not issue a final ruling; hence why we're still getting a stage before the Fifth Circuit).
From the vantage point of reproductive rights defenders, it's tough to imagine a worse panel draw than this -- and that's saying something, given that there aren't a lot of good panels to be drawn on the Fifth Circuit. But Judges Elrod, Ho, and Wilson are all right-wing reactionaries and anti-abortion extremists who made no pretenses at respecting rule of law in this subject even when Roe still was the law of the land. And without even the presence of a more moderate voice on the panel who could act as a break, we're likely to see a runaway train of ideological one-ups-manship where all three judges push each other to be as aggressive and extreme as possible.
So what will happen here? One possibility is that the panel will accept the signal offered by the Supreme Court in its stay, and reverse the decision (that is, preserve mifepristone's legality). This strikes me as highly unlikely. One enduring quality of the Fifth Circuit in general and these judges in particular is that they do not hesitate to shoot their shot. Their philosophy has consistently been to throw up the most radical, results-oriented conservative fantasy decisions they possibly can, and then dare the Supreme Court to reverse them. Given the composition of the Supreme Court, after all, it's hardly a bad bet. And hey -- you miss 100% of the shots you don't take!
Okay, so "dutifully obeying the law" is probably out. What else? Basically, I think there are two realistic options for what we might see. Possibility one is that the judges try to "write the brief" to the Supreme Court to convince (at least five of) them to ban mifepristone. This could include filing off some of the rougher edges of Judge Kacsmaryk's original opinion, maybe soft-playing some of the more radical insinuations (like with the Comstock Act), purport to address the lower court ruling's disdain for administrative law or standing principles while functionally just replanting it, and basically try to create a fig leaf that, with time and distance, five members of the right-wing supermajority on the Court think will be large enough to shield the obvious fact that they're imposing their policy preferences and calling it law.
Possibility two is that the judges will not even try to reframe the issues in a way that looks more palatable or reasonable. Forget the fig leaf; they're let it all hang out in naked splendor -- a "eugenics" references here, a twee comparison of President Biden and/or the FDA to King George III there -- and just completely bulldoze any semblance of adherence to the governing legal rules and precedents that govern this case. Wild theories of standing or administrative law review will be asserted with not a care in the world for how they interact with past precedents or the judges' own putatively-held legal principles. The opinion will be a flat "because we can" declaration of unfettered judicial might.
One might think the former choice is more likely. There's a real opportunity here for conservative judges to further shear off the rights of women over their own bodies -- a huge priority for them -- that's more likely to meet with success if they don't let their eyes get bigger than their stomachs. Don't oversell, trim the sails back a bit, and take what would still be a huge W for them (and a huge L for women).
But I think the latter is more probable, and it goes back to the theme I've been hitting on in prior posts: the lawlessness is the point. Critical to the practice of conservative judges in this era is openly asserting and living out the proposition that they are unbound by law. That a given judicial opinion reads as lawless is not a problem, it is a feature; it is a means of demonstrating this freedom from constraint. It is precisely because Judge Kacsmaryk's decision was so universally panned by legal experts that it needs to be affirmed and, if anything, expanded upon -- judges (or at least these judges) assert their power and legitimacy as far as they demonstrate they are not bound by the strictures of professional norms or public commentary. The more one deviates from the professional consensus, the more one demonstrates judicial supremacy. And bizarrely, I don't think being reversed by the Supreme Court really upsets them. What matters, oddly enough, isn't the tangible outcome of the case. What matters is showing that they, personally, have flamboyantly demonstrated how they soar above the mewlings of their lessers.
Judges Elrod, Ho, and Wilson are among the prime instigators of this style of judging on the Fifth Circuit -- jurists completely drunk on their own power, who revel in demonstrating that what was thought to be law will in no way binds them from imposing their will. I predict that their decision in the mifepristone case will be another venue for them to make this point. Yes, it will be lawless. And yes, that's the point.

Get ready for Dobbs 2.0, a decision that will far exceed the damage done by the Supreme Court in Dobbs v. Jackson’s Women’s Health.
In Dobbs v. Jackson’s Women’s Health, the radical majority on the Supreme Court ruled that there is no constitutional right to privacy that protects reproductive liberty. As a result, the debate over regulation of abortion was returned to the states. Or so we thought.
It is likely that a single federal judge in Texas will issue a nationwide ban on Mifepristone, a drug approved by the FDA for more than two decades to induce therapeutic abortions. The ruling, if made, will effectively outlaw or deny access to abortions across vast swaths of the nation—even in states where legislation or the state constitution protects the right of reproductive liberty.
We have reached this sorry state of affairs because ultra-conservative federal judges in Texas have rigged the system to ensure that all challenges to reproductive liberty and LGBTQ rights are funneled to a single judge with extreme religious views. The situation is explained by Dennis Aftergut and Laurence Tribe in Slate, The Texas-Sized Loophole That Brought the Abortion Pill to the Brink of Doom.
Aftergut and Tribe write,
The problem here goes beyond a single hearing, or even this single case. The real issue is systemic. Far-right groups have created a judicial pipeline to predictable triumph in one culture war battle after another: from Kacsmaryk in the plains of the Texas panhandle, to the hyperconservative U.S. Court of Appeals for the 5th Circuit, to the radically stacked majority on the Trump-packed U.S. Supreme Court. One Amarillo-based judge with carte blanche, virtually certain his extreme views will prevail on appeal, is apparently planning to curtail abortion access across the country.
[Here, there is] a coordinated national strategy, enabled by a district court federal bench, to bring right-wing legal causes into a single courtroom where a favorable result is a sure thing and where fair-minded appellate review has also been hijacked.
There is a simple—albeit difficult to achieve—solution. We need only elect a Congress and president willing to enact legislation to reform the federal judiciary. That will require (in my view) a carve-out of the filibuster, an expansion of the Supreme Court, curbs on the ability of a single federal judge to issue nationwide injunctions, restrictions on the ability of the Supreme Court to issue merits-based decisions on its “shadow docket,” and enactment of an enforceable code of ethics on the Supreme Court (among many other reforms).
At some point, the imposition of an extreme religious ideology on all Americans by a new class of judicial aristocrats—or “juristocrats” as described by Aftergut and Tribe—should cause Americans to reclaim their constitutional birthright. We have been too complacent in the face of a concerted assault over the last decade. Perhaps Dobbs 2.0 will be the decision that finally causes Americans to understand that the reactionary judges aren’t going stop until they have effectively codified their religious beliefs in federal law. The coming decision will hurt. Let’s turn our outrage into action.
North Carolina Supreme Court to reconsider case underlying Moore v. Harper.
On Tuesday, March 14, the North Carolina Supreme Court will hold a hearing to reconsider its ruling in the case underlying Moore v. Harper, currently on appeal before the US Supreme Court. You may recall that Moore v. Harper raises the question of whether the Independent State Legislature theory insulates the NC state legislature from judicial oversight.
Last year, the North Carolina Supreme Court overturned congressional district boundaries drawn by the state legislature. When the partisan composition of the NC Supreme Court flipped from Democratic to Republican, the new Republican majority on the court agreed to reconsider its ruling—for no good reason other than that it could.
Chances are good that the NC Supreme Court will reverse its prior ruling, thereby mooting the appeal to the US Supreme Court. Like the rogue federal judges in the Fifth Circuit, the Republican judges on the NC Supreme Court are making nakedly partisan rulings because they can. Like the solution for the federal judiciary, the solution in North Carolina is through the ballot box.

no conspiracy or whatever, but i think charles is being treated the worst amongst "young" drivers who are supposed to be their team focus/future/hope. and he is the one, outside max, that has proven the most for his team. this doesn't make any sense
It's not even a conspiracy, it's just the truth 😭 The sad part is absolutely no one saw this coming. Not now, not in a season where Ferrari has the car and has the driver and, well, at least initially had the ambition. Of course I knew how most people end their term at Ferrari, but I think I (and a lot of of other people) stupidly assumed 1. it wouldn't be so bad since he's one of their own, a product of the FDA, and surely that has to mean something, how ugly could things get?, 2. it would happen much, much later down the line. Like, years. I thought it would be... I don't know, Ferrari consistently giving him under-performing cars or something that would cause a rift. But whatever is happening now, the way he's being sidelined for no good reason that isn't motivated by internal politics and big sponsor money...it's shocking and frustrating because it just doesn't make logical sense.
I've thought about this in regards to this question that's been coming up lately of what are Charles's options if not Ferrari? We're in this relatively new situation where a lot of academy drivers have graduated to the 'big' teams - Max at RB was first, then Charles at Ferrari, Lando at McLaren and finally George at Mercedes completing the big four. Hell, even Alpine (who were genuinely regarded as having one of the worst academies in terms of young driver to seat ratio) are looking to put Oscar into a seat, even if it means loaning him out for now. And I think for the most part they're all doing right by them. Max is obviously in the best situation at the moment, with the team fully supporting him and being sort of built around him. And it paid off, he got that first title, and at the rate he's going, he's going to be picking up a second come November.
Anyway, safe to say this current situation is the last thing I expected: didn't have Ferrari giving up on Charles on my 2022 bingo card yet here we are. And the thing is everyone else can see his talent - hell, rival TPs are praising him; he's been getting more compassion and understanding from his rivals than those within his own team, including his teammate. It's not like he's had a performance drop-off or is being genuinely outscored and outperformed by his teammate which makes Ferrari reconsider their priorities. He's been giving them his 120% since the moment they signed him and especially this year, and it was so heart-wrenching to watch him keep repeating that he still believes in the championship as much as he did at the start of the season when it seemed like he's the only one out of the team that does.
I can't think of another team, certainly not any of the top teams, that would do what Ferrari did in Silverstone. It defies all logic to not prioritise your championship contender when his main rival is having a bad day at the office. A vulnerable Max is a gift that very rarely comes around and they just threw it away and they're claiming it was the right decision. And now they've caused an even bigger mess with the ambiguity of having their drivers so close to each other in the standings. They've been reluctant to put their faith and trust in Charles and failed to have the basic respect and decency to make him the number one driver, the one who will bring them that title if they only let him, when it never should have even been a question.

What the country wants of our government...
As we listen to the Democrats and the Republican Legislators, we hear promises made. However, empty promises is what we get. We the People want more done, as they our constitutionally bound to do.
Here is a partial list of things we wish to see accomplished in the next few years.
1.) The Democratic Party and it's legislators held accountable for their voting, passing, and decisions to undermine this great nation. They from the Congress members to the Senate members, and to the White House. Have been systematically been destroying the lively hoods of millions upon millions of Americans with their legislations made into law.
The over reach of the FBI, CIA, NSA, IRS, EPA, FDA, CDC the Branches of our Armed Forces at the Pentagon along with the DOJ are out of control. The America First Policies must be reinstated to do what is best, and right for Americans who's needs must come first.
2.) Stop sending billions upon billions of Tax Payers dollars to other countries. Those dollars need to stay here to rebuild our infostructure, our schools, hospitals, and social NPO's. So that our children and the American people have a chance at a better life.
3.) Increase penalties for local, county, and states that under mine the prosperity of all ethnic groups within our boarders. Also finish the wall on our Southern Boarder and take a long hard look at the growing problem of those crossing our Northern Boarders more closely. As we have been seeing an up tick of illegal crossings there as well.
4.) Reinstate funding, equipment, and training for ALL police agencies in our Government Agencies as well as our States, and Local Municipalities for a safer America. For they are on the front lines. Also, to the Governors, reign in those prosecutors within your states that are not prosecuting the criminals. Also, liberal judiciary's should be closely monitored in their judgements on a case by case scenarios. The victims of crime should have the ultimate right to see justice done on their behalf.
5.) The Teachers Union must be over hauled, dismantled and reorganized along with other major Unions, and Corporations that are pushing CRT and the Woke Agenda. This undermines the well being of our peoples and our nation. Progressive and Social awareness are needed but not at the force and misleading's of the few and the Main Stream Media. Journalistic standards along with Social Media Companies need to be held accountable for their lack of fair and balanced policies that effect every American and even the World.
6.) Bring inflation down quickly, and impose a greater emphasis on the fiscal responsibilities at the Local, State and Federal levels of Government. What is fair for the average family and persons paying the taxes deserve better from all the agencies.
7.) Start up drilling and replenishing our National Reserve of Oil, and Gas for the betterment and national security of our great nation. This will bring fuel prices down across the board so that Americans can afford to go to and from work as well as take better care of their families and personal needs. On the matter of Infrastructure make better our mass transit systems. From Buses, Bus lines, Airports, Airlines, and Rail. Mergers need to be more closely scrutinized through the proposal and acquisition process.
8.) Finally, I bring up the first and second amendments which are every Americans Constitutional Right. Free speech, and the right to bear arms are undeniable. Which is good for all legal citizens 18yrs, and older Americans. I'll leave it up to the readers of this blog to make statements and suggestions that will add to the betterment of an America First agenda.

Seeing number of twitter accounts saying Mick is not renewing his contract with the FDA and is going to leave at he end of the year for AMR..
Don't know how to feel about it. Like, yes haas is not great and Gunther treats him poorly but Aston's is not great either and Lawrence Stroll's son will obviously get the preferential treatment.. it's like picking between a rock and a hard place
I honestly have my doubts on whether the rumors have substance or they are just assumptions based on Seb saying he would like to see Mick take the AM seat….
However, if there’s any truth in that, I will say that it would be a very bad decision.
Günther can be somewhat toxic (for example the comments he made about Mick a few months ago), but I actually like Haas as a team right now. They’ve always been the underdogs, the ones with the least money and not much but willing to keep improving. Also I think that Kevin as a teammate has been an enormous asset to Mick’s career. They are a bit awkward, but I also think they push each other to be better. And Mick is finally comfortable with the team (2nd half of the 2nd season and all that)
Now if he moves to Aston Martin, he will have to be teammates with Stroll, which uh… not only is an issue because he’s the boss’ son etc, but also I don’t think there’s much to gain from him. Like if he wants to improve in this sport, if he wants a shot at a big team then he has to know that staying with experienced drivers is the right move. Also I just… don’t like Aston Martin as a team. Their philosophy has always been “lets just throw money at the problem, lets copy parts and we’ll see”. To me, that’s a sinking team and really not where you want to be in such an early stage of your career. And most importantly, we saw how tiresome Aston was for Seb (an experienced 4x wc) so why would he want Mick to experience the same thing?
As the FDA thing, ofc I’m biased and I can’t say much, but also I don’t think it’s a good move because, at the end of the day, Mick is the obvious next in line for the Ferrari seat if something happens to Sainz (changes team, doesn’t perform, etc). If he is not backed by Ferrari then the chances of him landing a big seat reduces substantially, so yeah… not a smart move in my opinion. Of course he’s a big boy and he has a team who will help with this decision, so I’m sure he will make the one that feels right for him.
Besides, if we think about this clearly, Seb announced his retirement like 3 days ago, and there’s just no way in hell the contract talks move this fast. So don’t worry, everything so far is just speculation, no need to start panicking yet :)

Five Things You Should Know Before Trusting That Supplement
Collagen. Probiotics. Every Letter of Vitamin Under the Sun. Your Local Drugstore is Full of Them—But How Much Do They Actually Do For You?

What if you could take one pill and suddenly have more energy, better skin, and a healthier heart? That’s the promise that beckons every time I walk by the supplements aisle at my local drugstore—filled with fish oil capules, jugs of collagen powder, magnesium chews, and every letter of vitamin under the sun.
It’s tempting. So it’s no wonder that supplements are projected to balloon to a $200-Billion Global Industry By 2025.
But I've always had a healthy dose of skepticism about how much any of these supplements can really do and whether they’re worth the cost. These are some of the insights from our previous reporting on supplements—with the very important caveat that you should always consult your doctor first about health decisions.
1) Supplements Aren’t Strictly Regulated.
Nearly every story we’ve published about supplements hits on one key point: The U.S. Food and Drug Administration doesn’t regulate dietary supplements in the same way as it does food and drugs—meaning companies don’t need to submit products to the FDA for approval before putting them on the market.
This can lead to some misleading labels. Jen Messer, a registered dietitian and president elect of the New Hampshire Academy of Nutrition and Dietetics, pointed our reporter Daryl Austin to an analysis of 57 dietary supplements. It found that 84 percent didn’t contain the amount of ingredients claimed, 40 percent didn’t have any of the ingredients claimed—and 12 percent “contained undeclared ingredients, which is prohibited by the FDA," she said in our November 2023 article.
It also means that companies don’t need to provide the FDA with evidence that their products actually do what their labels purport to do. “It's the Wild West right now,” David Hibbett, a professor of biology at Clark University, told us in our January 2024 story about the booming market of mushroom supplements like chaga and lion’s mane. “The evidence is still very, very limited and, certainly in my mind, does not warrant the very strong marketing of these products as nutritional supplements.”
2) Not Everyone Should Take Them—Even Multivitamins.
I grew up thinking that taking a multivitamin a day was the epitome of health, but this isn’t true for everyone, we reported in June 2023—and you should consult a doctor before you start a daily multivitamin regimen.
There are a few reasons why. For one, multivitamins can interfere with certain drugs like antibiotics or blood thinners. Additionally, people with liver or kidney disease might not be able to efficiently clear the high levels of nutrients contained in a multivitamin. Finally, it’s possible for anyone to get too much of a good thing. (More on this in a bit.)
Ultimately, as with everything, it comes down to your individual needs.
3) The Body Doesn’t Break All Vitamins Down the Same Way.
But it’s not just your own personal health factors to keep in mind. Some vitamins are also absorbed differently in the body—which can make a big difference in deciding whether to take them.
Experts warned in a story we published in November 2023 to be particularly careful with vitamins A and E because they are fat-soluble. This means that the body stores these nutrients in your liver and fatty tissues for future use rather than quickly breaking them down and metabolizing them as it does for other types of vitamins. Large doses of either one could actually harm you.
4) It’s Possible to Overdo It.
As I’ve been alluding to here, there is such a thing as vitamin toxicity—or consuming so much of these nutrients that they actually begin to harm rather than help you.
Take, vitamin A, for example: Exceeding the daily upper intake limit of 3,000 micrograms can ultimately cause issues like joint pain, liver damage, and birth defects. High doses of vitamin E can interfere with blood clotting, causing hemorrhages, among other issues. And an excess of vitamin D can cause nausea, muscle weakness, confusion, vomiting, and dehydration.
5) Food is the Best Way to Get Nutrients.
Many nutrients like collagen and vitamin C are already abundant in the foods that make up a typical diet—and eating whole, unprocessed foods, such as fiber-rich vegetables and fruit, is often a more efficient way to get the vitamins, minerals, and probiotics your body needs, Cleveland Clinic nutritionist Gail Cresci told us in March 2023. “Taking a probiotic or a probiotic supplement," she said, "isn’t going to fix a bad diet."

2ND BLOG- INTEGRATION FROM EMPATHY MAP
There was a quote that says that, there will be a time to pursue and a time to raise the white flag. And it was a paradox how everything goes beyond the integration of a work in progress.
After the business model proposal, we were recommended to either be specific on our topic and change our business model name or completely change the idea and start over again. We have stuck between the two choices after that week and we've been discussing on and off for the betterment of the business group. February 24, 2023, we set a meeting to finalize the idea and we initially thought of changing the business model. One of our business partners has suggested that we will focus on our proposed business model, pursuing it as it was our first decision. The other suggested that we will completely change our canvas and recommend a certain product. It was then that the group became overwhelmed by the idea of inventing or innovating a new product.
On the onset of brainstorming the idea, we have been thinking about the disruptors and its significance for our given target market and have concluded to make a new brand of instant coffee. This instant coffee is a mixture of an energy drink with caffeine as it became a fusion of energy drink and ice coffee. We came up with this idea as first, our target market which is the cmu students who has less energy to sustain itself all throughout the day. Second, students, based on experience itself, wanted to have a constant supply of instant coffee that will help them stay awake for a longer time. And lastly, bringing these two altogether would be a good thing in terms of convenience and availability.
As we start working with its validation, most of us have realized that the idea isn't realistic as it wasnt simple in the name that we are still students. There were many factors to consider that we became aware of. To mention; is the formulation of the product that needed to pass with the FDA and the knowledge we have on food processing and inventing, making a new beverage would be a risk as the capital or start up cost would be high and the chances of succeeding is low, and conclusion of making a fixed price that is cheaper compared to some existing brand of instant coffee cannot be assure. We validated this idea to most of our classmates based on what is their perspective or comments in regards to our proposed business model and they have good reason to reject the said product.
After the validation, March 1, 2023, we are behind our target schedule and we set a formal meeting again to discuss our unfixed business model and it yielded to a conclusion of pursuing the idea of TRES however, deriving its content to a more specific area which is to offer service to students in terms of notes, assignments, projects, and school activities, dissolving the concept of logistics and pad/boarding house finder. We have named this as NOTEd and to validate the idea for the nth time, we have sent a google survey form to our target market which is the 1st year students wherein 41 students suggested to pursue this idea out of 58 respondents.
We were tasked to make an empathy map to fully understand and empathize the point of view of our target market which is the 1st year students of Central Mindanao University.
