Subject of the film ‘Bernie’ files to expand suit to cover all inmates without AC

AUSTIN — The subject of the Richard Linklater film Bernie , convicted murderer Bernie Tiede, acted Monday to widen a lawsuit against Texas’ prison department to force the state to provide air conditioning to all state inmates.

Tiede, a 65-year-old inmate of the Estelle Unit in Huntsville, initially sued the Texas Department of Criminal Justice in August, alleging the agency was violating Eighth Amendment protections against cruel and unusual punishment.

Tiede’s attorneys on Monday filed to widen the lawsuit’s scope to all Texas inmates in hopes of bringing air conditioning to the roughly 85,000 inmates — 70% of Texas’ jail population — who lack access to climate-controlled cells.

“We do not want one more person to die or become sick this summer from extreme heat,” said Jodi Cole, one of the attorneys in the case. “It is unconscionable. It should not be happening.”

Temperatures in Texas prisons can reach 110 degrees during the summer.

At one unit, the temperature reached as high as 149 degrees, according to a 2022 Texas A&M study.

The motion added several organizations as plaintiffs to the case while notifying the court that the group would no longer pursue legal action against several defendants, including Attorney General Ken Paxton.

Tiede was convicted of murder in the 1996 shooting death of 81-year-old millionaire Marjorie Nugent.

Tiede admitted to investigators he shot Nugent in the back and hid her body in a freezer in her Carthage home for nine months before family discovered her.

Drawing interest

His crime became the subject of Linklater’s 2011 dark comedy Bernie, which drew interest to Tiede’s case and unearthed previously undisclosed evidence that cast doubt on his presence of mind while committing the crime.

Tiede was released after a judge granted a new sentencing trial, but he was later resentenced to life in prison.

After a health crisis that speakers described as a heat-induced stroke, lawyers filed emergency litigation to move Tiede into an air-conditioned facility.

In a streamed news conference Monday, Linklater, DeSoto Democratic state Rep. Carl Sherman Sr. and several former inmates criticized prison conditions in Texas and discussed failed legislative efforts to get AC to prisoners, resulting in organizations including Texas Prisons Community Advocates and Build Up Inc. joining Tiede’s case to seek systemwide change.

Linklater described summers in Texas prisons as “relentless, torturous conditions.”

The Texas Department of Criminal Justice said no heat-related deaths have been recorded in Texas prisons since 2012.

Lawyers and advocates dispute this, saying the agency has not recorded heat stroke deaths but has seen numerous fatalities due to heart attacks and strokes that can be caused by extreme heat.

A prison department spokeswoman said the agency does not comment on pending litigation.

She pointed to TDCJ’s enhanced heat protocols, which prioritize inmates for air-conditioned prison placement based on a “heat-sensitivity score.”

During the hottest months of the year, prisoners are provided access to air-conditioned areas if needed and have access to cold water and fans.

The department received $85 million to install air conditioning during 2023’s legislative session.

The agency has added 8,433 air-conditioned beds since 2018.

In addition, 2,149 cool beds are under construction and 11,565 are in the design phase, according to a TDCJ website.

Every time I watch The Searchers I find myself asking, is this really a great movie? It ranks No. 15 on the 2022 Sight and Sound critics poll of the greatest movies of all time. For my part, I think Red River (Howard Hawks, 1948) a richer, more satisfying film -- and, incidentally, the one that taught John Ford that John Wayne could act. And among Ford films, I prefer Fort Apache (1948) and even Stagecoach (1939). The Searchers is riddled with too many stereotypes, from John Qualen's "by Yiminy" Swede to the "señorita" who clatters her castanets while Martin Pawley (Jeffrey Hunter) is trying to eat his frijoles, but most egregiously the "squaw" (Beulah Archuletta) whom Martin accidentally buys as a wife. (Notably, the two most prominent Native American roles in the film are played by Archuletta, whose 31 IMDb credits are mostly as "Indian squaw," and Henry Brandon, who was born in Germany, as Scar.) There is too much not very funny horseplay in the film, a lot of it having to do with the humiliation of Martin by Ethan Edwards (Wayne). Martin also takes a drubbing from the woman who loves him, Laurie Jorgenson (Vera Miles). It's almost as if, dare I suggest, the 62-year-old Ford took a sadistic delight in beating up on handsome young men, since he does it again in the film with Patrick Wayne's callow young Lt. Greenhill. (Do I really need to explain the significance of the way Ward Bond's Reverend keeps belittling the lieutenant's sword as a "knife"?) And although Monument Valley, especially as photographed by Winton C. Hoch, is a spectacular setting, by the time of The Searchers Ford had used it so often as a stand-in for the entire American West that he has reduced it to the status of a prop. Yet by the time Ethan Edwards stands framed in the doorway, one of the great concluding images of American films, I'm resigned to the fact of the film's greatness. It consists in what the auteur critics most admired in directors: It is a very personal film, imbued in every frame with Ford's sensibility, rough-edged and wrong-headed as it may be. And Wayne's enigmatic Ethan Edwards is one of the great characters of American movies -- not to mention one of the great performances. We never find out what motivates his obsessive search for Debbie (Natalie Wood), leading some to speculate unnecessarily that she's really his daughter by Martha Edwards (Dorothy Jordan), his brother's wife. And his radical about-face when he finally lifts Debbie, a reprise of what he did with the child Debbie (Lana Wood) at the start of the film, and takes her home, after threatening to kill her throughout the film, is as enigmatic as the rest of his behavior. But it's a human enigma, and that's what matters. Ford's strength as a director always lay in his heart, not his head. In the end, The Searchers really tells us as much about John Ford as it does Ethan Edwards.
