Ahead of Muharram on the Public Interest Litigation filed by Shagufta Sulaiman before Hon’ble Calcutta High Court, the Division bench of Hon’ble Mr. Chief Justice TS Sivagnanam & Hon’ble Mr. Justice Hiranmay Bhattacharyya hereon July 27,2023 directed West Bengal Pollution Control Board to immediately issue a public notice giving wide publicity that the noise level cannot exceed the permissible decibel, and also make it clear that any violation thereof would invite penal action under the provisions of the pollution control laws.
The Bench also directed the State, if feasible, can also identify the groups, which can be permitted to carry on beating of drums within the permissible noise level. The period for beating of drums shall also be regulated as the mourning ritual is to be performed on 29th July, 2023 and within the short time.
There will be a direction to the respondent/police to immediately issue public notice regulating the timing for beating of drums.
Background
The PIL was filed by the petitioner on account of continuous beating of drums by a group of persons, throughout the day and night on the alleged ground that they are performing the mourning ritual on occasion of Muharram. The contention of the petitioner is when there is a ban for Azan by using loud speakers as that lasts 5 minutes only, which is certainly a religious matter but the non - stopping of beating of drums with no restriction of intensity of the sound is illegal. The noise pollution is a serious threat to public health and welfare. There are school going children. Many of them have to take their examination. There are senior citizen people, who are sick and ailing and all of them have been affected.

কলকাতা : ২০১৪-র টেটের প্রশ্নপত্রে ভুল ছিল। এই তথ্য সামনে এসেছ আগেই। সেই ভুল প্রশ্নের নম্বর পাওয়ার জন্য বিভিন্ন সময়ে মামলাকও করেছেন প্রার্থীরা। এবার ২০২২-এর টেট যত এগিয়ে আসছে, ততই সেই প্রশ্ন আরও প্রকট হচ্ছে। ওই মামলার সমাধান সূত্র না বেরনো সত্ত্বেও কীভাবে নতুন করে টেটের বিজ্ঞপ্তি প্রকাশ হল, তা নিয়েও প্রশ্ন উঠেছে। এরই মধ্যে কলকাতা হাইকোর্টের বিচারপতি প্রশ্ন রাখলেন, ভুল প্রশ্নের জন্য প্রত্যেক পরীক্ষার্থীকে নম্বর দিয়ে দেওয়া সম্ভব কি না। অভিযোগ, ২০১৪-র প্রাথমিক টেট পরীক্ষায় মোট ৬টি প্রশ্ন ভুল ছিল। এই নিয়ে একাধিকবার মামলা হয়েছে। যাঁরা ওই প্রশ্নের উত্তর দেওয়ার চেষ্টা করেছিলেন তাঁদের প্রত্যেককে কি বাড়তি নম্বর দেওয়া যায়? সোমবার এই সংক্রান্ত মামলায় বিচারপতি অভিজিৎ গঙ্গোপাধ্যায় উল্লেখ করলেন, এ বিষয়ে সিদ্ধান্ত নিক প্রাথমিক শিক্ষা পর্ষদ। ইতিমধ্যেই প্রায় ২৫ হাজার চাকরি প্রার্থীকে বাড়তি ৬ নম্বর করে দিয়েছে পর্ষদ। বাকিদের ক্ষেত্রে পর্ষদের অবস্থান কি? তা জানতে চায় আদালত। আগামী ৪ নভেম্বর দুপুর ১২ টার মধ্যে জানাতে হবে পর্ষদকে। ওই দিনই হবে পরবর্তী শুনানি। উল্লেখ্য, টেট পরীক্ষার আর খুব বেশি দেরি নেই। শেষবার টেট হয়েছিল ২০১৭-তে। পাঁচ বছর পর আবার টেটের বিজ্ঞপ্তি প্রকাশ হয়েছে। কিন্তু তাতে বিতর্ক কাটছে না। ২০১৪-র প্রার্থীরা আন্দোলন করছেন এই দাবিতে যে, তাঁদের অনেকেরই বয়স পেরিয়ে গিয়েছে, তাই আর পরীক্ষা না নিয়ে সরাসরি নিয়োগ করা হোক। অন্যদিকে, প্রশিক্ষিত হওয়া সত্ত্বেও কেন অগ্রাধিকার দেওয়া হবে না, তা নিয়ে প্রশ্ন তুলেছেন ২০১৭-র প্রার্থীরা। এরই মধ্যে ভুল প্রশ্নের নম্বর নিয়ে বিতর্ক পিছু ছাড়ছে না। প্রার্থীদের দাবি, ভুল প্রশ্নে যাঁরা উত্তর দেওয়ার চেষ্টা করেছিলেন, তাঁদের প্রত্যেককেই বাড়তি নম্বর দিয়ে দিতে হবে।           Source link Read the full article

Disposed of on 27.12.2023 by the Bench of Hon’ble Mr. Justice Jay Sengupta J with the observation that the respondent police authorities shall keep a sharp vigil at the locale, ensure that no breach of peace takes place and no order of a Civil Court is violated.
Surveillance shall include frequent visits to the area by police patrol.
To harass and demotivate the petitioner, the respondents supported by locals resorted to social boycott of the petitioner and his family members.
Facts
This is case where a temple was illegally constructed in front of the property of the petitioner Ranjit Mondal. When petitioner objected to it there was social boycott of the petitioner and his family members by the private respondents and the locals residing there.
Petitioner approached Civil Court, Arambagh, Hooghly seeking order for restraining the defendant nos. 1 to 6 from changing the nature and character and possession of 3 feet wide and 40 feet long common passage existing in between the suit plot by way of encroachment.
Interim Injunction was granted on 22.11.2022.
Petitioner also made a complaint that private respondents are trying to disturb the possession and enjoyment of the property as a result police authorities have also come in action and proceedings under 107* Cr P C was initiated.
107*Cr P C in case of emergency when breach of peace is imminent, Executive Magistrate orders the accused person to agree to a bond which asks him to maintain peace for the prescribed period of time as the Judge thinks would fit.

NALSA’s Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes, 2018
"Acid Attack Survivor"
Present case is filed by the #survivor of #acidattack. Survivor happens to be the minor girl of 17 years and his brother also acid victim survivor of 14 years. The Compensation to acid attack survivor is awarded under the (National Legal Services Authority)#NALSA’sCompensationSchemeforWomenVictims/ #SurvivorsofSexualAssault/ #otherCrimes2018.
Paramita Bera & Anr. V. The Union of India & Ors. WPA 5633/2021, Before Hon'ble Calcutta High Court According to the scheme, a minimum compensation of Rupees 7 to 8 lacs is payable, with an additional 50% of the said amount, on account of the victim being a minor girl child.
Here the boy had been paid a sum of Rs.4,50,000/- as per the existing Rules.
Now the issue before the Hon'ble #CalcuttaHighCourt was addressing the claim of the minor girl. #SupremeCourt as well as the High Courts of the Country acknowledged that the Acid attack victim goes through the physical, economic, social, and psychological ramifications.
Hon'ble Apex Court in Parivartan Kendra Vs. Union of India & ors., reported in (2016) 3 SCC 571 felt the plight of the survivor and had observed that, 1. The likeliness of the victim getting a job which involves physical exertion of energy is very low. The social stigma and the pain that she has to go through for not being accepted by the society cannot be neglected. Furthermore, the general reaction of loathing which she would have to encounter and the humiliation that she would have to face throughout her life cannot be compensated in terms of money. 2. As a result of the physical injury, the victim will #notbeabletoleadanormal life and cannot dream of marriage prospects. 3. Since her skin is fragile due to the acid attack, she would have to take care of it for the rest of her life. Therefore, the aftercare and rehabilitation cost that has to be incurred will have huge financial implications on her and her family. Recently in Nipun Saxena & Anr. Vs. Union of India & ors., reported in (2020) 18 SCC 499, Hon’ble Court applauded the NALSA’s Compensation Scheme for Women Victims and added that,
1. We have gone through the Scheme prepared by NALSA with the assistance of the Amicus Curiae and we are of the view that it contains the best practices of all similar schemes and should be implemented by all the State Governments and Union Territory Administrations. 2. . ……We make it clear that the Scheme postulates only the minimum requirements. This does not preclude the State Governments and Union Territory Administrations from adding to the Scheme. However, nothing should be taken away from the Scheme.
Observation of the Calcutta High Court
1. The Apex Court’s judgement has created an obligation upon the State Governments to have similar provisions in consonance with the Scheme. 2. The NALSA’s Compensation Scheme for Women Victims 2018 provides that acid attack victims with face disfigurement, must get compensation ranging from a minimum of Rupees 7 lacs to a maximum compensation of Rupees 8 lacs. 3. The Scheme also postulates that minor victims are eligible for compensation that is 50% higher than the minimum amount specified in the Scheme. It appears that the State of West Bengal has not complied with the mandate of the Supreme Court in Nipun Saxena & anr. Vs. Union of India & ors (supra) and has failed to amend its own scheme of compensation in tune with NALSA’s Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes, 2018. 4. It is unfortunate that this West Bengal, which was once known for its progressive feminist discourse, with women such as Begum Rokeya Sakhawat Hossain, Sarojini Naidu Chattopadhyay and many others, has forgotten its feminist roots.
Order
Hon’ble Mr. Justice Shekhar B Saraf J vide order dt.08.09.2023, directed the Government of West Bengal to immediately act in accordance with the Supreme Court judgement and frame its scheme as per NALSA’s Compensation Scheme for Women Victims, 2018 within a period of eight weeks from 08.09.2023.
The girl child was a minor and is accordingly eligible for a minimum amount of Rupees 7,00,000/, as compensation as per NALSA’s Compensation Scheme 2018 and an additional 50% of the said minimum amount (i.e., Rupees 3,50,000/-) is payable to the victim on account of her being a minor girl child. Accordingly, the total compensation payable to the victim is Rupees 10,50,000/-. Further, the State of West Bengal was directed to pay the further sum of Rupees 7,50,000/- to the State Legal Services Authority, West Bengal who shall disburse the entire sum to petitioner no.1 within a period of four weeks from date.
